Consumer Complaint: On XXXX/XXXX/XXXX I received an XXXX dispute update indicating Foreclosure proceedings started on XXXX XXXX. Nationstar has started foreclosure proceedings without any noticeto me. Nationstar 's predecessor, XXXX XXXX XXXX transferred loan number XXXX that had a XXXX balance. Nationstar 's predecessor 's agent sold the property associated with the loan number XXXX in a foreclosure sale on XXXX XXXX, XXXX. I have been in litigation with XXXX XXXX XXXX, Nationstar 's predecessor since XXXX XXXX, XXXX. This lawsuit is currently pending in the XXXX XXXX XXXX XXXX XXXX, XXXX. XXXX v. Bank XXXX New York XXXX and others. Nationstar was transferred a zero balance loan and now they are claiming I am {$110000.00} past due according to the XXXX XXXX, XXXX credit report date. I have never executed any loan agreements after the foreclosure sale to reinstate the loan XXXX. Notwithstanding, reinstatement or any other loan agreement would fall under the Texas Statute of Frauds. The Statute of Frauds bars any collection of debt by Nationstar if it 's not in writing. Nationstar claims I am $ XXXX delinquent, which is equivalent to about 61 months. The foreclosure sale took place on XXXX XXXX, XXXX, 47 months ago. Ironically, this is the number of months Nationstar showed the account delinquent when is was transferred on XXXX XXXX, XXXX. Nationstar ca n't provide any explanation for the 47 month delinquency when they were transferred the loan from their predecessor. Their predecessor, XXXX, never sought to collect any payments after the foreclosure sale on XXXX XXXX, XXXX. In other words, between XXXX XXXX, XXXX and XXXX XXXX, XXXX XXXX XXXX XXXX never sought to collect any payments on loan XXXX. My credit report showed the last account activity from XXXX XXXX XXXX referencing loan number XXXX was in XXXX XXXX. Nationstar was transferred this loan on XXXX/XXXX/XXXX, almost eighteen months ago. I need them to validate the debt. 1. What loan agreement or legal document ( s ) was executed to reinstate the loan XXXX after the foreclosure sale? 2. What date was the loan XXXX reinstated after the foreclosure sale? 3. Who are the parties that reinstated the loan XXXX? 4. What actions reinstated the loan XXXX? 5. Was Nationstar a party to any reinstatement or loan agreement after XXXX XXXX, XXXX? .

They have XXXX billing collection issues and XXXX problems with service according to the XXXX which grades them with a " XXXX '' rating. I have not received any responses from this company with regards to their adhering to the Frank-Dodd requirement and the discovery/disclosure of their identities as Parties in Real Interest. I have proven them not be Parties of Real Interest in a law suit in the Circuit Court of XXXX County XXXX under case number XXXX and I have motioned to remove the case to United States District Court under Title 42 code 1442-1446 under case number XXXX. I recently received via XXXX next day, a letter from XXXX XXXX Nationstar Corp, XXXX XXXX XXXX XXXX XXXX, XXXX dated XXXX XXXX, 2016 stating that they were returning my check, made out to XXXX because, they were unable to process the payment because of " wrong payee. '' I called Nationstar XXXX and spoke with XXXX who initially indicated that I have to update my information for the 10th time. I reiterated that the letter was addressed to me in my lawful name and I received the letter at my domicile in XXXX, XXXX therefor my identification ca n't be an issue. I also have numerous documents on file in XXXX different courts notarized and confirming my identification. XXXX asked me to email XXXXXXXXXXXX. So I did : please find attached a letter form Nationstar Mortgage addressed to XXXX @ XXXX, XXXX describing a returned check indicating, " wrong payee. '' My information is updated and the " payee '' name and address should be updated to reflect this. Please contact me via email if you have any question or responses. Via email XXXX XXXX responded : " The image you have sent is blurry and not all the way legible. In addition, this letter is not from the Customer Relations Department. If you can advise of the department you intend to get this correspondence to, then I may be able to help assist with a better copy of this document. '' I responded : " I was told by XXXX to email the letter to you for explanation and correction even though the letter is on Nationstar letterhead and should be in a file accessible to Nationstar staff. My initial contact was with the customer relations department. If you are not the individual that I should be in contact with, please confirm and state the correct individual to get the status corrected. '' That conversation took place 21 hours ago and I have not received any further responses from XXXX XXXX of Nationstar. This company along with XXXX XXXX XXXX, XXXX are using extortionate and fraudulent litigation techniques. The are using XXXX mail fraud because I made complaints about them using the United States Postal Service for delivery of fraudulent correspondence. They are using racketeering to engage in a pattern of illegal activities though which they repeatedly commit predicate offenses. I want something done about this company. How many other Americans have to suffer because federal bureaus like yours refuse to do your real job and take action against this type of fraud?

As you can see or should be able to see, this is only a copy of the XXXX Trail Period '' XXXX had put us on and then extended it for approximately a year or better. So the papers you sent me are not what I asked for or have been asking for. I am looking for the completed modification with all the documentation on how we went from a fixed 30 year interest of XXXX and why it increased to XXXX last XXXX, XXXX, and is going up to XXXX this XXXX XXXX. I know that this is still a relatively low interest rate, but going up 2 % is a hardship on us when my mom is on a fixed income of Social Security and my take home pay is less than when I started my job six years ago because of the increase in cost of my share of my portion of my health insurance. I know this is not your problem and that you really do n't care. My point is that by law I have a right to see these documents and I ca n't tell you the number of times I have called and requested them and you keep sending me a copy of the trial period and not the finalized modification. I want to see in writing please how it was decided that my interest rate would go up, the number of points that were added, how much was charged for doing the modification and if the balance of the difference between our regular mortgage payment and the trial modification was added back into the loan. We never received a copy of this and like any other financial institution if you are refinancing, having a closing or taking out a loan, all parties should see the documents and agree to the terms and conditions. Until I receive a copy of the documents, I can not agree to the increase to 4.75 %. I feel I have been very patient in this matter, but I am very frustrated. I have spoken to so many of your customer service representatives, the one I 'll never forget is the XXXX XXXX said it was none of my business on how the figures were arrived at. And the other XXXX was a written correspondence from Nationstar saying an audit was done on my file and everything checked out fine, but then why ca n't I get a copy of what I 'm looking for? I 'm wondering if anyone else has these issues or am I just the lucky XXXX. I hope the next correspondence I receive from you is what I am requesting. I have been trying to get a straight answer from you for years and since you have yet to supply me with the documents I am requesting, I feel you are hiding something like it 's a predatory loan. This Company took over the said load and demand me to pay over {$1200.00} they said it was for the demand of the flood insurance I never was required to maintain before. Nothing Changed. I demanded an legal Opinion from their Attorney 's to no avail over a year asking for the same request. They always send a break down of Forced Charges. This same company is involved with several other Banks and Mortgage and loan companies.. for taking kick back from Insurance companies to include the one they are forcing me to obtain insurance with on their behalf. My name is also included in this suit/ The mortgage company knows this and I feel they are refusing to follow their own rules with my previous Mortgage Company XXXX. Again the XXXX previous under the same contract never required or forced me to obtain Federal Flood insurance. Documents have been sent asking them to prove I needed extra Flood Insurance. XXXX and XXXX XXXX has indicated my property location is not or has no Flood Base Line documents or will not have until the State of Florida until l late 2017 They were advise of same. I feel we are being Discriminated against us because of the Current Law Suit among other things. We are XXXX XXXX and asked about Mortgage re financing to no avail we ever received and assistance. When I told the female on the phone she said she did not know how they could add the forced applied insurance to the back of the loan because they would always have to re calculate the figures. Seriously I said The computer always does that. She said She would have to check, so after a few days I call back and she said she had no clue what I was talking about but did remember my name. Closing I asked them to keep my mortgage showing in the credit history as the {$420.00} and not the XXXX because it raise my monthly causing issues when I have tried to get some loans. Normally only the Mortgage is showing because the insurance they are forcing me to purchase they made me have the Insurance company bill them so I had to call the Insurance company. They did obtain Flood Insurance from a company because no one would give me Flood Insurance at the government rates. So even thou they did help me get Flood Insurance against my will, Should have been billed separate as the regular insurance to keep my Credit History, No of the Insurance report the or my Credit status to any of the Credit Bureaus to the best of my knowledge. Also I ask to no avail why are they adding all these extra fees like Property Inspections {$30.00} when My Property Has never been inspected by any company. They have several thing they are charging us, like something called XXXX. On their invoice they have a area showing Optional Insurance they could show on their invoice for these forced insurance that I have several times tell them I disagree but paying under protest so they cant take our home for us. This all has caused a great deal of XXXX causing me to continue to have medical issues because this wrong, illegal, I have never been late to the best of my knowledge and asked why to they keep saying they are the collection agency. I do have copies of what I faxed them, They said the best way to contact them is to fax them and after I fax them the send me notice that I have a new Contact person, Go Figure No we are scared they may continue to Harassment us because of my complaint. I feel that they are doing all this in spite because of the Current Law Suit Closing even though they got me flood insurance that I asked to no avail to prove and yet to do so. I accidentally overpaid in XXXX, I realized immediately what I had done, contacted them, and they proceeded to drag their feet, then promise a refund, drag their feet some more, then say they did n't owe me a refund, charged a bunch of fees with no explanation as to what they were for, charged late fees even though they know they had an extra month 's payment, finally admitted yes they did owe me a refund, gave it to me in XXXX, but are still insisting on collecting fees that I do n't owe them.

Consumer Complaint: To whom this may concern, my name is XXXX XXXX, my wife and I are terrified that our mortgage servicer, Nationstar is forcing our mortgage and our home into foreclosure for their own monetary gain without offering us an alternative to foreclosure. We now have a Sale Date of Tuesday, XXXX. We desperately need someone to step in and intervene or we are afraid that we will lose our home that we have been trying to get back on track with Nationstar for so many months, that has now turned into years. My wife and I suffered financial hardships some time ago and notified Nationstar when that happened. We began the process of attempting to get the loan modified. I have never seen a big company run with such disorganization and the continuous mishandling of protocol and documentation. Violation of The Real Estate Settlement Procedures Act ( Regulation X ) XXXX Loss mitigation procedures. The Consumer Financial Protection Bureau established rules to " protect mortgage borrowers from costly surprises and runarounds by their servicers. '' My understanding is Nationstar received over XXXX dollars in the T.A.R.P. bailout in XXXX. They agreed to help struggling homeowners that had genuine financial hardships ; homeowners like us. How is it that after months & months of submitting numerous financial packages & documentation to them that they continuously lose & mishandle documents over & over? XXXX XXXX Receipt of Loss Mitigation application - " A servicer shall exercise reasonable diligence in obtaining documents and information to complete a loss mitigation application. '' Along with submitting numerous financial packages ( RMA Packages ), we have had anywhere from XXXX to XXXX different account managers. XXXX Continuity of contact - " Servicers are required to maintain reasonable policies and procedures with respect to providing delinquent borrowers with access to personnel to assist them with loss mitigation options ''. Why were n't we assigned a single point of contact to assist us in saving our home? This whole ordeal with Nationstar has been a complete debacle ; it has looked to us that they have deliberately mishandled and mislead us time after time, jumping through never ending hoops only to end up in foreclosure, now with an auction date on our home. How are we in foreclosure when we have been trying to get a modification and have done seemingly everything they have asked us to do? XXXX XXXX Dual Tracking is prohibited. " Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure. XXXX Early intervention requirements for certain borrowers - I do n't feel that Nationstar has ever provided us with a " Fair Review Process '' for a modification, as required under the XXXX & Consumer Protection Act. " CFPB 's mortgage servicing rules ensure that borrowers in trouble get a fair process to avoid foreclosure '', " borrowers should n't be surprised by the start of a foreclosure proceeding until they have had time to explore all available options ''. We can afford our payments and have been able to for some time. We need this loan modified and put back on track so we can remain in our home that we love and want nothing more than to begin making payments again. We are pleading for someone to step up and do the right thing by us. Consumer Complaint: my mother and i owned a home between us, while i was not on the deed, she took out a reverse mortgage in XX/XX/XXXX, she passed away in XX/XX/XXXX. A month later I received a bank letter of default, she never informed me of doing this so it was a shock. I have been living this never ending nightmare since than. On the advise of a attorney to protect my interest in the home and property as i had help purchase the home originally with inheritance money, I filed a Chapter XXXX. The bank had several opportunities to contest, they did not, than a year into the bankruptcy and a confirmed plan, the servicer for the bank filed a motion to lift the stay. I have found papers and mailings to my mother which obviously had her fooled to thinking this was a wise decision. My mother left everything in a trust for my children and we also had a notorized agreement that the home was 1/2 mine. There is a stack of mortgage papers atleast XXXX inches think, there is no way all that was explained to her, just initial here areas and no indication of having any legal advise. What appears to be the first mailing to her the pamplet is briefly written and sounds wonderful to our elderly family members, I see how easily they can get fooled. I have been in bankruptcy just about every few weeks lately, with this horrendous fight. Another issue I have had is people really understanding the reverse mortgage differences vs traditional.At first the judge saw the 'human side ' to my story, and saw 'red flags ' when the term 'reverse mortgage ' came up. I thought i had a fighting chance. However, with many loopholes and people really being misinformed, the judge decided to grant their motion to proceed with the foreclosure.just today. I am devastated. I am a firm believer these need to stop, the loopholes and strings they use is incredible and like sugar coated crimes against the elderly and their heirs, This company has made no attempt to work with me even when the matter was brought to court on accepting payments from me, they refused, saying they have no obligation to do so and that was just during the bankruptcy plan till a refi could be obtained.i believe this was a misleading and deceptive transaction and want some resolution to keep my home from these vultures on our loved ones

Consumer Complaint: My mortgage loan servicer, NationStar Mortgage, blindsided me by applying principal payments to my mortgage without any notice. This came on the heels of an interest rate increase, and the two combined make my payment 150 % of what it was previously, which is a significant increase and causes a financial hardship for me. Apparently, my note was interest-only for 10 years or XXXX payments, so they are within their rights. However, I would expect a reputable loan servicer to make sure their customer was aware of this type of increase well in advance. To expect a consumer to remember a change 10 years after signing the note is not reasonable. Furthermore, at NationStar 's behest, I have been paperless for a while. Each month, I receive email notifications of payment due and paid ; these have been the same for so long, there 's no reason to look at statements without being alerted of a change. I have my notifications set to alert me via email of changes in escrow, interest, etc. In the past, I have been notified of interest rate adjustments via letter and/or email so I know to expect them. In this case, I did NOT get any type of alert about the interest rate increase, and I also did not receive an alert about the application of principal payment. When I started investigating, I found a XXXX interest rate change announcement buried in my online Billing Statements ; apparently a notice in Billing Statements does NOT generate an alert to the consumer. In XXXX, they confirmed the interest rate increase and also inserted the principal payment. Again, there was no alert, and therefore no reason to review the online Billing Statement which has been consistently the same for so long. This practice seems incompetent at best and underhanded at worst. To add insult to injury, they consistently and annoyingly solicit me to refinance my loan ... and this is after I have already spoken to one of their loan officers who admitted they are unable to help me because they do not have access to accurate info on my property. They claim this is a " problem '' in Texas, so my question is, why do they keep bothering Texans with advertising and solicitation?

Consumer Complaint: My husband died and I payed the principal of the mortgage off in XXXX to NationStarBank. In XXXX I received a call XXXXNationsStar Mortgage company stating I owed a payment and that the amount of {$710.00} plus a payment was past due for XXXX. I went on line and paid off the {$710.00} and made the payment of XXXX also. I then got a call the next day that there was a past due balance of {$45.00} XXXX that I did n't pay. I never missed a payment on my loan and I was told that it was an amount paid for my husband and my bankruptcy. The court claims no monies other than what we paid were made and the bankruptcy was dismissed before this loan modification. I called back the mortgage company and was told that it was paid to the attorney. The attorney said it was not and the Trustee also did n't receive the money. I contacted the mortgage company again and was told that the last payment was in XXXX. I gave them the receipt of the XXXX XXXX payment and was told that it was applied but I still owe them XXXX XXXX dollars. I then went to my bank to get financing for this and was turned down due to the bankruptcy. I was told that bills included in the bankruptcy were still showing due. I then contacted XXXX XXXX they agreed to lend me the money to pay this " balloon payment ''. The pay off showed a balance of {$160.00} principal plus the XXXX XXXX. I contacted Nations Star Bank the mortgage company as to where did the {$160.00} come from if I paid off the {$710.00} total principal. They did n't show that payment in XXXX. A manager said it was put into miscalanious funds and not applied to my account. I asked for them to show me where the {$45000.00} was paid to us or our creditors. They said it was a past due balance on our mortgage. I know this is not true because my husbands XXXX XXXX retirement benefits paid the mortgage every month before the bankruptcy and the trustee did n't miss any payments nor did I since it had been refinanced. They could not show me or tell me who received the money. Today I received another letter from the mortgage company which said you are past due on your payment. I am so frustrated. I have already paid for an apraisal on my house to receive a new mortgage to pay this off. I do n't believe I owe this money and think Nation Star bank has added someone elses loan to mine. I am a widow and I do not make enough money to pay NationStars high payment. That is why I am trying to get a loan. Nation Star keeps changing the payoff amounts. I do n't know what else to do.
