Consumer Complaint: During the time that my mother was transferring the property to me, Nation Star broke into the house. At that time, the house was filled with personal belongings, specifically a lot of collectors items. After this break in, a lot of things were missing from the house. Nation Star ripped out wood floors, busted the ceiling open to get a safe that was hiding in the ceiling, and left the safe completely empty. After this happened, I called the XXXX XXXX Police Department and filed a report. When I went to the XXXX XXXX XXXX and Deed 's Office, the lady I spoke with said nothing was filed on this house that would give anyone the right to break in. She said that I needed to get an attorney. I called Nation Star and explained the situation. Nation Star did n't even know who owned the house and requested that I email them paperwork showing the house was in my name. After sending them the paperwork they requested, they gave me the lockbox code, were very apologetic, said they would write up a report of the break-in, and send me documentation showing that the lien was valid. Nation Star failed to provide me with the documentation I requested. They sent me a payoff quote and several emails with corrupt files that could n't be opened. They also never sent me the report of the break in. Nation Star went silent and I did n't hear back from them. I assumed this was because they realized they had broken the law by breaking into this house without following proper procedures. I decided to move forward with my plans to remodel the house and found a partner for the project. Then I quit claimed the house over to XXXX XXXX XXXX, a company I own, and XXXX XXXX. When my partner contacted a real estate agent, she informed us that the house was already foreclosed on and sold in a sheriff 's sale. I received no notice, no email, phone call, or letter in the mail. I checked the mail at this house at least twice a week and had a construction crew working on the house during this time.

Consumer Complaint: In XXXX XXXX our fresh start loan was sold to. Nationstar mortgage Plc. We tried to make a payment each month but they did not have all the paperwork from XXXX. After a few months of this excuse my husband actually called XXXX they stated to him all paperwork had been forwarded. Finally my husband thought he was being scammed they stated they could not accept any phone credit card check by mail only XXXX XXXX. Even though they kept sending monthly statements to us. They decided to foreclose on our home, I requested a modification through MHA they sent out the paperwork I got it back to them. They used my overtime to calculate my acceptance so instead of us having a smaller monthly payment now it 's way more and they wanted escrow for taxes and insurance. Our first payment did include a down payment first month payment and escrow. Two days ago I received notice my homeowners insurance is being cancelled for non payment. I also included this with my contract a copy of the invoice. Tried to call my contact person to find out why? I was. It going to leave one more message. Pressed zero got on the phone with XXXX told her what was happening she agreed to get a team lead on with us he said it will be a couple more days until they have it figured out Really!! I do n't have that my house insurance will expire on XXXX/XXXX/XXXX. I was on hold for over twenty minutes I had to go lunch was over. The foreclosure is not closed yet as of XXXX/XXXX/XXXX. " They are not done processing my loan ''! I have heard a couple days for everything now they said my foreclosure was moved to XXXX XXXX XXXX. I have an attorney and I am willing to go to any length to make sure this does not continue for us or anyone else. Also when we first got approved it was 8 % then the contract comes they know they have me by the nose it 's adjustable every two years until it 's 10 %. Is n't there a truth in lending? Or am I just stressed out enough over all this! You bet I 'm stressed I have been dealing with this for two years now! Can or will someone help me? Consumer Complaint: We are waiting on a modification so that my mother and I can assume the loan. We completed the package and we did not get an answer from the company. XXXX. I have had some mail returned by the post office, like for court dates or for the Human Services Department for Medicaid or XXXX. The post office at my home is staffed by people who change every couple of months and the issue restarts, misdirected mail. I recently came back to my home and I was alerted that the mortgage is not going to honor their modification/assumption workout and instead has filed a notice of completion of briefings and demands foreclosure by summary judgement. We did all the company wanted, we can afford the house, we receive income, and we just made the payment, I am including the statement of the Escrow company who is taking the payments for over two years, which is really, credit worthiness to so good on the loan, however, the interest rate and the legal fees and interest that the company alleges is due make the loan so inflated! The rate is XXXX points higher than ( high cost ) the prevalent rates and my mother XXXX XXXX is dropping all her social security ( SSA ) income to make the payments at the demise of all her other bills. I was helping until I got physically incapacitated to work ( letter from doctor ) and I am better, I will be able to reintegrate to the workforc soon, XXXX. I am asking for XXXX accomodations on the issue or response, I was XXXX. Instead of reaching out to us, via mail, phone or else, the bank filed a completion of briefings and demands the court to foreclose. We are occupying the property, keeping the lights and heat and water and repairing it and maintining it and we want to keep our house, please do not let this house go to the XXXX investors, this is an owner occupied home, please help us to decrease the blight eyesores in the neighborhood that depressed values and that contributed to our inability to refinance in XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX since the property was and still is underwater. we just made the payment and will include proof of that. We put the property in my name as per request of the bank so that they will grant the modification, we did all they wanted. I will include the XXXX payments I will soon receive through the division of vocational rehabilitation which I qualified for and the social security of my mother, our tANF assistance for my minor child, SNAP and all again, if they wish, current statements but keep us communicated, now word from the bank about a modification and they filed in court a completion of briefings, what is that??? Let us keep my mother and I ( XXXX and XXXX XXXX XXXX XXXX ) the home that we are living in and raising a family with minor and XXXX kids

Consumer Complaint: National Star returned XXXX of my payments. The payments are for the correct amount. However, they want me to continue to pay for their insurance policy. The funds that are sent to cover my current, active, insurance policy are n't being applied. Instead they are being utilized to cover the insurance preferred by National Star. Further, National Star Bank continuously, refused to honor my request to cancel their insurance. They are trying to force me to pay for both. I indicated, several times, that I did not want to utilize their insurance company. National Star stated that I have to pay on their insurance and my insurance company payments will be an additional payment and held in escrow. I did not agree to pay for both, especially their 's, policies. Also, they keep reporting me late to the credit bureau and I am suffering from their poor decision making and torpid policies. They should not retrurn my payments.

Consumer Complaint: In XXXX we filed a chapter XXXX in XXXX ind, case XXXX, XXXX XXXX was Tha morgage holder, we paid payments every week on time for 6 years and 7 months, we completed our bankruptcy, it was discharged, XXXX and XXXX services were afilliated also, since then a few banks have filed foreclosure on us, but never got past the bankruptcy, since then, XXXX n XXXX and now nationstar claims we owe XXXX the loan was onlyXXXX, now they have harrasement us by mail n phone, they obtained a forclose without us being notified by the XXXX county court in XXXX ind, the only papers we recieved was from a lawfirm of XXXX XXXX XXXX, none of the papers were court filed or stamped, now they have our house up for sale in XX/XX/XXXX, nationstar the man 's name is XXXX XXXX , we only recieved a court paper stating nation star was substitute for us bank, it 's a federal crime that they somehow for closed on my morgage, without a court hearing, ,cause number XXXX, from what I could tell XXXX XXXX copied papers from a XXXX for closure that XXXX XXXX tried but was thrown out by XXXX XXXX, ,I 've obtained my documents from the federal court, and I will be taking them to judge XXXX office and the county clerk, nationstar is commiting a federal crime, please help us, sincerely XXXX XXXX

Consumer Complaint: Dear CFPB- I am writing because I received a property insurance cancellation notice ( attached ) from XXXX XXXX due to non-payment of premium of {$6700.00} by my Mortgage servicer ( Nationstar ) unless paid by XXXX XXXX 2016. As per my last mortgage Statement, Nationstar is holding in escrow a balance of {$11000.00} There are XXXX active disturbances in the XXXX that could negatively affect my home and Nationstar Mortgage is risking my insurance coverage either through neglect of with the intent putting me in peril by maximizing leverage of my escrow funds to for their own benefit. I have faxed copies of this letter to Nationstar and sent a letter to their listed office of insurance renewals at XXXX and tax notices/bills at XXXX with no reply. My mortgage has been re-sold twice in three years and this is the second time in that period that this has happened. I expect that since Nationstar has proven themselves to not be reliable custodians of an escrow account and my equity in my home is significantly above XXXX % that I will attempt to take responsibility of payment of property insurance and property taxes. Consumer Complaint: I have been trying to modify the loan on this property since XXXX. I was at first given a forbearance, made my three payments, then it was dropped in a confused and confusing manner and I turned to applying for a modification. The process was awful, I spent enormous amounts of time faxing documents that were lost, etc. and put on a dual track so that the trustee sale date eventually came before any modification was granted. Then when the bank foreclosed on the property, it wrongfully foreclosed on the adjoining lot which does not belong to the bank. I called both XXXX and XXXX, they paid no attention. I started a lawsuit, and after many months, the bank settled for attorney fees and recognized they were in error. I started applying for a modification again, but again things were delayed, I was told I had not submitted documents on time when I had and was able to prove it, etc. Again the trustee sale date came before a modification on XXXX XXXX. And again the bank wrongfully foreclosed on the adjoining log, using the exact same documents as before, disregarding the few guidelines agreed upon in the settlement. So, being an optimist, I tried for a modification again. I had a very difficult time with the agent who was assigned to me, who never responded, and dismissed me without really digging into my file whenever she was available. To make a long story short, I was slated for a trustee sale five times in five years, and each time the foreclosure included the nearby lot which was separate from the property. XXXX even rescinded the settlement agreed upon at the end of the lawsuit, without ever consulting with me. On XXXX XXXX, XXXX, XXXX transferred my loan to a new servicer, NationStar Mortgage, without ever addressing the wrongful foreclosures described above. Oblivious to this ancient history ( for them ), the new company is simply starting the modification process all over again, despite my complaint that due to the enormous delays caused by XXXX from XXXX on, the escrow on the loan has become so large that numbers no longer add up. This process must be stopped until the illegal actions of XXXX have been addressed.

Consumer Complaint: Nationstar is our mortgage servicer. We had a mortgage from XXXX XXXX XXXX and we were n't informed until after 60 days from the transfer. We had been current with XXXX and had never had any delinquent months since ou purchase. We immediately noticed that our amount owed monthly was different. Nationstar failed to provide any documentation of breakdown in details of " fees ''. The current problem is that following my extensive and repeatedly hospitalizations, we became behind XX/XX/XXXX. It was our first time being behind 30 days. Our XXXX/XXXX/16 payment was late 60 days. We were able to catch up a bit and bring it back to 30 days late for the XX/XX/XXXX and XX/XX/XXXX payments. Due to additional hospiatlizations our XX/XX/XXXX payement was 60 days late ( paid on XX/XX/XXXX ). On XX/XX/XXXX we made the XX/XX/XXXX bill. The account showed as pending until after XX/XX/XXXX. XX/XX/XXXX suddenly the payment showed as REVERSED. I called Nationstar to find out why. Their response was there must have been an error on my part with the number. I asked to speak with a supervisor who confirmed that the number had been used before. She asked that I go to bank and 3-way call with them to confirm that the number was our account and they would be able to credit the amount as paid and take the money again. When at the bank, the manager confimed with nationstar rep that account was valid and money was still there.XXXX manager also explained that Nationstar did not attempt to take the money. Nationstar explained that it was nw XX/XX/XXXX and by not having XX/XX/XXXX payment in account it was now 90 days delinquent. XXXX again confirmed funds were in bank and the funds for XXXX I attempted to pay. They told bank manager that funds would not be allowed to be paid to Nationstar. The problem resolution request was sent by rep but would not lkely be addressed until XX/XX/XXXX. In the meantime they refuse any payment. This would make it 120 days late. So by reversing payment in XX/XX/XXXX, they have caused t to be 90 days late. And then again refusing XX/XX/XXXX would make it 120 days late. And acknowlegeing it would take until XX/XX/XXXX cause it to be 150 days late. How can they fraudulently cause a delinquency?? Also all the funds I pay each month over what is owed to be applied to principal and " fees '' has never been applied. They even reversed escow funds out of that I have paid. They now say that because the XX/XX/XXXX payment was n't credited they have moved case to foreclosure!!! They will not speak with XXXX or myself further.

Your mortgage servicer handles the day-to-day tasks of managing your loan. Your loan servicer typically processes your loan payments, responds to borrower inquiries, keeps track of principal and interest paid, manages your escrow account, and may initiate foreclosure if you miss too many loan payments. Your servicer may or may not be the same company that gave you your loan. '' Specifically, we are disputing a ) the identity of a true secured lender. Because of extensive criminal activity and fraud in this arena, we require proof of the chain of secured ownership from the original alleged lender to the alleged current lender. Further, we require proof that you are the entity that has been contracted to work on behalf of the alleged lender. I would also like to state that there is a difference between a LENDER, a SERVICER and an INVESTOR. We are specifically asking WHO THE LENDER is and this is the question that needs to be answered.
