Consumer Complaint: NATIONSTAR HAS PREDATORY PROTOCOL IN PLACE TO SUBJUGATE & FORCE HARDSHIP LENDEES TO FORECLOSE on their home. NATIONSTAR actually makes HARDSHIP CASES MORE EXTREME. Under extreme hardship, I applied for a HARP/HAMP modification in XXXX XXXX and qualified beginning payments in XXXX XXXX. From XXXX XXXX until present, I pay insurances on my property while receiving annual disclosures from NATIONSTAR that they have paid my insurances ( Contact XXXX XXXX at XXXX XXXX XXXX. ) I When I received the documents, I immediately notified Nationstar of WRONG ADDRESS, WRONG DEED, WRONG INSURANCE, WRONG CALCULATIONS, et al. For sixteen months, I paid my INCORRECT mortgage while receiving phone call reminders from the XXXX every XXXX of the month. When I received the phone calls : I asked to speak to an American ( denied ) ; I was redirected to XXXX or into a phone loop. XX/XX/XXXX, Nationstar paid only XXXX of my Earthquake insurances and I was dropped from the Earthquake insurance causing a substantial increase to premiums. EVERY MONTH, I INFORMED NATIONSTAR. In an effort for a NATIONSTAR REPRESENTATIVE to contact me, I stopped paying my mortgage for 9 months. XX/XX/XXXX ( after sixteen months of bringing the INCORRECT INFORMATION TO THE ATTENTION OF NATIONSTAR ), I received a DELINQUENT XXXX XXXX COUNTY TAX NOTICE OF over {$14000.00}. At this time, NATIONSTAR refused to address my Federal XXXX and provide a XXXX person to assist me with the CORRECTION of the LOAN. I spoke for 2 and a half hours with XXXX XXXX who assured me that 1 ) PROPERTY TAX WOULD BE PAID IMMEDIATELY ( It has not ) 2 ) MY INSURANCE WOULD BE CORRECTED ( It has not ) 3 ) THE {$11000.00} would be applied to my arrears ( It has not ). I later attempted to call XXXX XXXX only to find that he was on " extended leave. '' XXXX assured me everything will be fine. Everything was " paid on his end. '' On XXXX XXXX, XXXX, XXXX XXXX County Tax Collector 's Office remains in DELINQUENT STATUS. At the end of nine months, I paid {$11000.00} in Cashier 's Check to the Nationstar Payment Center in the City of Industry with USPS Delivery Receipt. On the same day, resubmitted a HARDSHIP APPLICATION, sent documents via USPS, FAX withe receipt confirmation. That 's when XXXX XXXX finally called me. XXXX XXXX instructed me to send the " missing documents '' to XXXXXXXXXXXX. NATIONSTAR REFUSED TO ACKNOWLEDGE SPECIFIC MEMO ON CASHIER 'S CHECKS regarding each check as a PRINCIPAL PAYMENT ONLY and did not apply the money to my balance. NATIONSTAR refused & returned XXXX CASHIER 'S CHECKS specifically indicating ten months of interest payments at the compounded interest at 2 % for 26 months as calculated using a certified actuary. The amount was {$3900.00}. NATIONSTAR refused & returned XXXX XXXX and XXXX XXXX principal payments each in the amount of {$1100.00}. Simultaneously asking for arrears, refusing them. THE PROPERTY TAX IS STILL DELINQUENT. THE INSURANCE IS STILL INCORRECT. THE ACTUATION STILL BENEFITS NATIONSTAR and not the HAMP/HARP Participant. NATIONSTAR designed it 's modifications to prey on people who do n't understand real estate, property tax, insurance and interest. Please call me XXXX. I spoke for 2 and a half hours with XXXX XXXX who assured me that 1 ) PROPERTY TAX WOULD BE PAID IMMEDIATELY ( It has not ) 2 ) MY INSURANCE WOULD BE CORRECTED ( It has not ) 3 ) THE {$11000.00} would be applied to my arrears ( It has not ). Consumer Complaint: I have been trying to Refinance with HARP since XX/XX/XXXX. Nationstar mortgage Loan Specialists said I was one payment late in XXXX XXXX. On XXXX XXXX, XXXX, made XXXX payment and on XXXX XXXX, XXXX made the XXXX payment. The late payment in XXXX made me not be eligible at that time, since It has not been within a year. She advised me to call again and to try again in XXXX or XXXX when the 1 year is up and eligible with XXXX late payment guidelines from HARP. On XXXX XXXX, XXXX, I called Nationstar to refinance with HARP, now their saying I 'm not eligible because I did not caught up on my late payment till XXXX XXXX, XXXX I made XXXX payments. That I have to try again in XXXX. Also, I received a letter saying that I have late fees on my account for {$580.00}. I have been paying my mortgage on time or at times with late charges of {$9.00} Nationstar late fee charges, after 7 days if payments are not made on the XXXX of the month. I do n't see an explanation on my transactions not even in my monthly billing statements in regards to {$580.00} late fees.

Consumer Complaint: XXXX XXXX is in a financial Hardship. She applied for a short sale which Nationstar was aware of and they went as far as to approve her. Then the short sale was declined due to the sale date being " too close. '' The short sale was in ESCROW. Nationstar removed the file and now the homeowner 's sale date is on XXXX with no options but to be foreclosed on. Although there are numerous reasons why Nationstar 's behavior is unacceptable, the issues that XXXX XXXX would like to bring to your attention are the following : While we understand a short sale takes time, it is inexcusable that Nationstar deny the shortsale ; will not let it be completed. It appears that Nationstar has committed negligence, if not reckless disregards for her short sale request. Nationstar approved a short sale, only to the homeowner that she was denied. This should not be tolerated. Nationstar denied her short sale based on inaccurate information and refused to take remedial steps to provide a qualified homeowner with a solution. By refusing to disclose details about the process, Naionstar is able to deny request at will without any accountability. The events described above are just a sample of the practices that are taking place at Nationstar. Nationstar appears to be more interested in foreclosing on home and fire selling them at auction to make a profit. It appears that Nationstar 's lack of participation in a meaningful review of Homeowner 's file indicates a preference to profit directly from Homeowner 's hardships. XXXX XXXX fully believes that she has been discriminated against based on her age, race, ethnicity, sex, marital status, and national origin. At this time, we are demanding that the sale date set for XXXX be postponed or she will assert her legal right naming Nationstar as a defendant in district court.

Consumer Complaint: I applied for a loan modification with Nationstar, based upon the qualifying hardship of a legal separation which will result in a reduction of household income and a significant increase in my expenses, because I will need to pay spousal support once my former wife moves out. I filed an appeal which was also denied because they do not consider legal separation the same as divorce, even though the hardship affidavit list them together, another reason given is that the loan is in just my name, which is not a valid reason because I will be retaining ownership of the property, and my former wife, even if she were on the loan, would need to be removed.

Consumer Complaint: NationStar Mortgage is the only lender out of the XXXX other lenders that I have that give me issues. For about a year they kept calling me and harassing me about payments being late on the XXXX of each month, when in fact I had till the XXXX to make the payment. After a year of calling an yelling at them over the phone they stopped. Thank XXXX some law firm filed a class action against them which I was more than happy to sign up. 2- They changed my bill to paperless. I have called multiple times about them changing it back to bill. 3- My Adjustable rate expired and they never notified me that my payments had gone up. They assumed I would log in online and see it. I did not receive anything in mail 4- Every year, the harass me about my home insurance policy, they want to force their own policy on to me and they can not figure out my name after 7 years still.

Consumer Complaint: My mortgage contract permits me to pay in advance without penalty. The contract does not limit how far in advance I may pay. I stay paid in advance ( presently six months in advance ) and most often also include extra principal payment each month. Nationstar Mortgage has been informing me that I may pay no more than six months in advance. I have repeatedly asked them where in my contract it limits me to paying no more than six months in advance and they refuse to tell me. They always respond that they are sending my request to a research team as my inquiry is complex and I will hear in 7 to 10 days .... yet I never get a response. This month I notified Nationstar that as they can not point out where in my contract it states I may pay no more than six months in advance, and as my contract allows me to pay in advance, that I would be submitting an additional payment to pay seven months in advance and that it should be applied as such. On XXXX XXXX, XXXX I paid my mortgage for XXXX XXXX, XXXX and included an additional {$150.00} towards the principal. My next payment should therefore be due in XXXX XXXX. XXXX. However, Nationstar failed to apply the payment toward my due date of XXXX XXXX, XXXX ... and instead on applying the payment properly, left my next due date as XXXX XXXX, XXXX and applied the entire payment merely towards principal with no credit as an advanced monthly payment. I contacted Nationstar and asked that this be corrected and that my next due date be listed as XXXX XXXX. XXXX. Nationstar refuses by stating that allowing me to pay more than XXXX months in advance XXXX cause my account to fall into default. This is an asinine and nonsensical reply. My contract plainly states that I may make advance payments without penalty. I have repeatedly asked Nationstar where in my contract it limits these advance payments to no more than XXXX months and they have never been able to respond. I ask that my XXXX XXXX, XXXX payment be applied towards the XXXX XXXX, XXXX payment due date plus the extra {$150.00} towards principal and that my next mortgage due date be corrected to read XXXX XXXX, XXXX. I also ask that all future advance payments be applied correctly as I intend to have my mortgage paid at least one year in advance, and more if I am able.

Consumer Complaint: I have a mortgage that is serviced by Nationstar Mortgage. I requested a payoff quote from the company through XXXX/XXXX/2016, but they quoted me a payoff through XXXX/XXXX/2016. When I asked why they were charging me an extra 24 days worth of interest, they informed me that this was their standard practice, and that any overages would be sent back to me within 20 business days. My per diem interest rate is {$22.00} per day, which will result in an overage of {$530.00} ( {$22.00} x 24 days ). The sale of the property that collateralizes the loan will be finalized as of XXXX today ( XXXX/XXXX/2016 ), so the payoff request through XXXX/XXXX/16 is conservative, and already includes a cushion for any timing delays. When I provided this information to the representative that I spoke with ( XXXX ), he claimed that the practice of charging overages and refunding within 20 days is allowable under RESPA. I am filing this complaint because it does not seem right to me that the Lender is charging me for funds that the know full well will have to be refunded to me anyway.

Consumer Complaint: I filed for Chapter XXXX Bankruptcy in XX/XX/XXXX. At that time my Mortgage company ( Nationstar ) was considered a secured loan, which included escrow payments in my monthly fee. Those fees were {$1100.00}. I was in default of {$9800.00}, payments were included in the Trustee payment.I was informed in XX/XX/XXXX by my mortgage company that I needed to pay additional mortgage because the escrow increased. I later fell behind in my monthly mortgage payments and by XX/XX/XXXX i was in arrears of approx. {$15000.00}. Under a government program, Illinois Hardest Hit, in XXXX XXXX they paid my mortgage carrier {$18000.00}, my contribution to their forgivable loan was {$390.00} until XXXX XXXX. I then was responsible for the increased monthly mortgage of {$1400.00}. Last month I received a letter from Nationstar informing me that they failed to provide me with a yearly escrow analysis, since XX/XX/XXXX, because I am under bankruptcy, but because I requested an analysis, they completed one and there is a great shortage. I called them and told them I never requested an Escrow analysis but I thought I should have been informed yearly anyway. The mortgage payment then increased to {$1800.00}. I did not see any reflection of the paid defaulted mortgage.There is a carry over of an amount due of {$1600.00} on XX/XX/XXXX. How I do n't understand because Illinois Hardest Hit paid them a lump sum of my arrears. On the Escrow Analysis I received in XXXX XXXX, it does not list my current mortgage balance, yet it readily list projected charges XX/XX/XXXX as part of the reasons for such a huge increase. Nationstar never reported the mortgage default payment to my Bankruptcy Attorney or to my Chapter XXXX Trustee. When I brought this matter to the attention to my Bankruptcy Attorney, I was told they would look into the matter. I forwarded proof of mortgage default payments to my Bankruptcy Attorney, to no avail. I have had different attorneys because I was told some of them are no longer employed there. Nation star mortgage transfers me to one department after another without any resolution. They will not answer my question to date why they have n't noticed my bankruptcy Trustee about my mortgage being current. My bankruptcy is soon to be discharged in several months. I believe Nationstar Mortgage has intentionally mismanaged my escrow account. There was no reason for them not to provide me with an anual escrow disclosure, which would have notified me of any shortages in the escrow account.I have been very ill and now disabled.But I am now able to carefully read documents and follow-up on my account with mortgage provider.
