Consumer Complaint: I have a loan with Nationstar Mortgage I had a trial payment of XXXX with an income of XXXX. I had to request 5 times that they take the money out of my account. I was XXXX short I informed them that I would the XXXX dollars would be taken from a XXXX XXXX account. The employee at Nationstar said he could not process a payment under XXXX so he refused to process the XXXX dollars then report me to the Dept of Treasury so I can no longer be eligible for the Hamp program that was done on purpose. I should still be eligible for Hamp that was a false forced information. Since when do you have to beg a lender to take funds. At this time I am stuck with their program of their choice. Consumer Complaint: I believed that the Consumer Financial Protection Bureau was instituted to be an arbitration between a consumer and a business. I have directed several complaints about the mortgage business and their practices. Over the years I have studied it by taking classes to increase my knowledge and understanding. My increase in knowledge has turned into the biggest disappointment in my life. Yes businesses can set up adhesion contracts, one-sided by luring a potential customer into it with lies and misrepresentations galore. The customer starts asking questions and basically with lies is told to pay, even when XXXX makes XXXX. You have no business asking those questions, you have no rights. One than finds out, may be there is an agency or law that will protect one. Again, the law is nothing but circular rhetoric which aids and actually seems to promote fraud. Laws are not followed, they favor those too big to fail and too big too jail. Our case, we do not need legal assistance ... .We understand that there is no law that will protect us from fraud from those who knowingly defraud us. Instead of creating a great society, there is a force that knowingly destroys society. Our case : Predatory loan ... .yes we could afford the loan, but were not informed, we trusted the loan officers, like we trusted school teachers and doctors. The broker made {$20000.00} We could have had a fixed loan. We never were informed about securitization. The loan was made XXXX XXXX ... ..XXXX it was securitized with the closing of the XXXX in and about XXXX XXXX, XXXX. The note and the Deed of Trust were separated. The DOT was recorded with MERS as the nominee for Nationstar and as Beneficiary. Never Mind no True sale was recorded to XXXX. Nationstar is the Lender on the DOT. To become part of the XXXX, the XXXX was not followed ( their own rules with the Security Exchange Commission ) and there is no clean chain of title. As a matter of fact, not even the Deed of Trust was assigned ( Not only once, but twice ) to XXXX Bank as Trustee 8 and 10 years later in the county Recorder 's Office. Again an assignment is the culmination of a TRUE SALE. ( 8 and 10 years later and twice ) When I found out the fraud, we were subject to harassment of the new Servicer with add on fees, corporate fees, escrow fees ( we had paid them and it was not in our contract. They were up to date ) monthly calls ... .Yes at times I made double payments ... Basically I finally said, if you do not give me the information about who I have to pay and what contract we follow, I am opting out of this one sided contract. Yes, because of harassment and easily spotted illegalities, we decided to stop paying. Neg. amount due, Interest payment only and interest and principle were all the same ... .a mathematical impossibility. The interest deductible also did not add up. Five months later, the " debt buyer '' Nationstar ( XXXX ) came in, taunting they were the servicer, welcome. We know that insurance was paid after 90 days. We disputed the debt and nationstar proceeded to try to collect under the guise of being the servicer for XXXX Bank. XXXX XXXX we received a letter that XXXX Bank is the owner of the Note ( It is a security, and the note and security can not exist together ) and less than two weeks later we received a letter that Nationstar is the owner of the Note ... ..fast forward ... ..Yes Nationstar showed the CFPB an assignment, copy and not registered that they indeed were the owner of the note. This assignment again should be the culmination of a True Sale. In one of their letters of half validation ... .it indeed indicated a new loan, no cash. XXXX XXXX, Nationstar without sending the required notification filed a substitution of trustee in the County Records making XXXX the Trustee. The NOD was filed on the XXXX XXXX website, but not the the Substitution of Trustee. Our house will

Consumer Complaint: I have been trying to negotiate a loan modification with my mortgage lender for 7 years! It will be 7 years in XX/XX/XXXX. When I began this process my mortgage was held by XXXX XXXX XXXX. Since then, my mortgage has changed hands 3 times! Each time, I had to start the process over. The current lender is Nationstar and based on on-line research, I am concerned that my experience with them is mirroring that of thousands of other consumers. They do not negotiate in good faith. For example, they constantly low-ball the value of our property. With each negotiation, we have to appeal the denial of our modification request and key to those appeals are independent assessments that show our property as valued at more {$100000.00} than what Nationstar quotes. Last year, we finally had an agreement but Nationstar asked for a " deposit '' in order to execute the agreement - I now know that the request for a " deposit '' is illegal/inappropriate. Also, the agreement referenced a 2-year " interest-only '' payment period at an amount that was quite manageable. Nationstar refused to apply those payments to our mortgage indicating that the " interest-only '' payment period terms were " vague. '' The alleged " vague '' terms were created by Nationstar and signed off on by their Assistant Secretary XXXX XXXX. Nationstar continued to refuse to apply the " interest-only '' payments to the mortgage based on this vagueness argument and as a result we are now trying to negotiate yet another modification. Once again, they denied our request ( even though we were approved for a modification last year, albeit " vague '' ). The denial was based, predictably, on a low-ball valuation of our property. Yet again, independent evaluation showed a value of $ XXXX+ higher than what Nationstar showed. We are appealing the modification denial. After 7 years, how much longer do we have to keep playing this game with them before they will negotiate in good faith and put some reasonable and not " vague '' terms on the table?!

Consumer Complaint: We ( XXXX XXXX, XXXX XXXX - note holder/on title ) initially contacted Nationstar on XXXX regarding loan modification due to the rate increase resulting in a {$700.00} mortgage increase per month and our inability to make the payment with the new rate hike. XXXX XXXX emailed paperwork over to get the process started on XXXX/XXXX/XXXX. On XXXX XXXX I emailed XXXX the filled out paperwork. On XXXX an account was created in the NationStar system and messages started processing via the system. Log of Messages for XXXX XXXX : XXXX/XXXX/XXXX acknowledgment from message center they received my email regarding the need for a modification. XXXX/XXXX/XXXX received reply XXXX/XXXX/XXXX - XXXX Sent paperwork XXXX/XXXX/XXXX - We sent filled out paperwork back. On XXXX/XXXX/XXXX - I received a call from Nationstar representative, we spoke at length about what paperwork was still needed and he advised we submitted it after the holiday weekend. XXXX/XXXX/XXXX new correspondence received from message center confirming conversation re representative. XXXX/XXXX/XXXX - an account created that the modification is in process, missing documents sent. On XXXX/XXXX/XXXX XXXX XXXX sent message with a example Profit/Loss for us to follow. We were assigned to XXXX XXXX who is in the Bankruptcy department because XXXX XXXX had filed bankruptcy in XXXX, which was discharged in XXXX XXXX. Our mortgage has never been involved w/bankruptcy now when we call Nationstar automated system says " this is an attempt to collect a debt. ) Due to this history Nationstar sent our case to the bankruptcy department/modification. This is when our case started to be mishandled. We have never spoken with XXXX XXXX despite placing over 10 phone calls to her office. LOG DATES : XXXX, XXXX, XXXX, XXXX, XXXX/XXXX/XXXX All dates of calls to either XXXX XXXX with Nationstar or to Nationstar customer service to be transferred to XXXX XXXX who returned my call once to XXXX on XXXX/XXXX/XXXX at which time could n't answer the phone and called her back the next day. Left multiple messages. On XXXX/XXXX/XXXX - Sent new documents ( XXXX documents in total ) and they responded saying they needed a supported PDF format. XXXX all the documents on XXXX/XXXX/XXXX Sent email on XXXX/XXXX/XXXX to modification department and cc XXXX XXXX and XXXX requesting response re documents sent to XXXX XXXX and rectified any and all requests made regarding document changes. LOG FOR XXXX : XXXX/XXXX/XXXX - another phone message left for XXXX XXXX XXXX/XXXX/XXXX - Phone inquiry made to customer service regarding the lack of response from XXXX XXXX XXXX/XXXX/XXXX - We received a message back stating that XXXX had called us and did n't reach us ( on XXXX/XXXX/XXXX only and we responded to that call multiple times ). We let customer service know this was the case. They did not reply to that issue. XXXX/XXXX/XXXX - New documents sent that the message center had as redlined items - including new profit and loss. XXXX/XXXX/XXXX - An email was sent to XXXX with another message stating we were unable to get a hold of XXXX XXXX and were looking for a status on our loan modification and that the documents had been sent but some were still redlined - XXXX XXXX XXXX, social security benefits letter ( We 've uploaded XXXX of them ), and a message stating we needed to call them regarding the income verification/30 day consecutive pay stub. But when we call them we are transferred to XXXX XXXX who never answers and never returns our calls. No response to this email was given. XXXX/XXXX/XXXX - We called Nationstar again - left on hold for nine minutes and then the call was disconnected. Unable to reach anyone. XXXX/XXXX/XXXX - We called XXXX XXXX again and left another message. We have also during this time uploaded new P & L 's, new Social Benefits letter ( we 've uploaded XXXX of them and it is never updated. Our calls are never returned.

XXXX XXXX at Nationstar, Emailing her since XXXX XXXX to present minimal response back and directing me to the customer service for information, the customer service had advise us that we quality for second modification to please fill out the application and send in with all necessary document which it was done and it was denied, In contacting XXXX XXXX she stated that we had modification twice already, Which that is wrong, That Nationstar mortgage stalled the modification which cause us to do the paperwork XXXX times is another thing. We were modify once in XXXX XXXX. I call the Making home affordable.gov for information which they provided with which is doing a tier XXXX under the original modification which a tier XXXX, for situation like ours I e-mail XXXX XXXX the information and she directed me to customer service dept, The dept was unaware of the information I provide them. I e-mailed XXXX XXXX 3 times and with other issue as fee being added, Like inspection fee and misc fee. This was XX/XX/XXXX, More than plenty time for us to do something We fail in our trailer due to unforeseen situation like I was unemployed and my husband was XXXX and our tenant did n't pay us the rent for 5 mos we had to evict them and take to court, My mother was diagnosed with XXXX. now we receive foreclosure document for XXXX XXXX the investor that does allow a homeowner to do a modification only every two year. I Also in XXXX I call requesting to make some type of payment and we were told that we could n't the period has passed that I need to do a modification or pay the entire amount we were behind. Consumer Complaint: I filed for a loan mod in XXXX XXXX. XXXX XXXX XXXX I was informed they did n't have enough time to get the documents into underwriting. XXXX XXXX XXXX was the scheduled auction date on my home, so I filed BK chapter XXXX to save my home. If XXXX XXXX I did a chapter XXXX conversion to chapter XXXX. The bank went back to the court to have the stay lifted, on the grounds that I was 15 payments behind. That was not true, but I did n't have the necessary evidence with me to prove that. I have a payment history report from Nationstar Mortgage XXXX TX showing the payments and the date they were received. They charged me an enormous amount in interest when my note says not to exceed 4 %. They proceeded with foreclosure because the courts lifted the stay.

Consumer Complaint: In XXXX, I declared bankruptcy and surrendered XXXX rental properties ( XXXX in XXXX and XXXX in XXXX. I was, and am, an XXXX military XXXX. These rental properties were meant to be a large part of my retirement income. At the time of the bankruptcy, I had great credit and no debt beyond the mortgages, but was forced to declare bankruptcy due to the housing crash and a real estate scam. While I was XXXX in XXXX and XXXX from XX/XX/XXXX to XX/XX/XXXX, I kept getting notices from my property manager in XXXX to send money to repair things. Once I returned to the states, I flew to XXXX and found out that I had been part of a real estate scam. My properties had been gutted bringing their value down to {$10000.00} and the real estate ring was charged with mortgage fraud. This left me with no alternative but to file bankruptcy to surrender the properties. I filed XX/XX/XXXX before XXXX in XXXX and my bankruptcy was discharged in XXXX XXXX, XXXX. The XXXX properties, at this time, were in good shape and rented for more than the cost of the mortgage and other related fees. Although the mortgages on these properties were less than the sales value, they were profitable. I surrendered the profitable XXXX properties as part of my estate and had the renters move out. The XXXX XXXX properties have since foreclosed, but the XXXX XXXX properties have yet to foreclose after XXXX years and I have just been served with {$17000.00} in fines by the HOAs. I was served with these papers while currently XXXX in XXXX, and have had extreme difficulty in reaching the banks to try to resolve this issue. My wife, who is in the states and has my power of attorney, has also been unable to reach the banks to resolve this issue. These properties have not foreclosed even after papers being filed with the courts in XX/XX/XXXX and XX/XX/XXXX. If I had known that the banks would not foreclose for over five years, I could have kept my renters in the properties and paid all fees associated with the houses over all of these years. Instead, in good faith, I surrendered the properties and did not feel I had the right to rent them out. These properties have now sat empty for five years rendering them less likely to rent or sell and have been accumulating HOA fees and fines.

Consumer Complaint: XXXX/XXXX/XXXX Colorado Flood Natural Disaster left my grandmother and myself displaced immediately after the flood as my grandmother 's house was severely damaged by the flood. My grandmother passed away 3 months after the flood and I have been displaced still as a result of the flood 3 years. When my grandmother passed away Nationstar put the loan information to reflect XXXX XXXX in the estate of XXXX XXXX. There was flood insurance on the property which has a case for bad faith, and allot of dispute of damages that took place regarding the flood where the insurance company took over 14 months to correct their damage estimate to reflect another XXXX in damages. Regarding repairs Nationstar was clearly aware of the bad position which can be explained later due to maximum character in this complaint. The homeowner has paid mortgage for over 2 years on a house that the homeowner could n't live in due to the damages. the homeowner reached out to the mortgage company requesting due to the natural disaster and other flood victims in similar situation that the mortgage company and or banks worked with them such as placing them in a forbearance. Homeowner asked if the mortgage company could help him and or to speak with the President due to Nationstar not wanting to help the homeowner and only demanded monthly payments which was paid going on over 2 years after the flood. Nationstar sent homeowner a letter attached denying homeowner to speak with the President and also stated the house would be at 2 % interest rate which was never implemented. Homeowner continued to pay more payments from date of the letter XX/XX/XXXX to about XX/XX/XXXX where homeowner fell behind. Homeowner reached out to the mortgage company resulting in the foreclosure date being moved until XXXX XXXX, XXXX. Homeowner spoke with Nationstar personal XXXX XXXX XXXX/XXXX/XXXX at XXXX explaining concerns and the only option for the homeowner was to try and get approved for a reinstatement which is pending, but homeowner faxed detailed letter XXXX/XXXX/XXXX of requests for resolution and its not fair to go further in debt due to nationstar involvement. Homeowner ca n't even get an update from XXXX XXXX as he has requested numerous times in email and voice mail but only receives email that XXXX XXXX ca n't get in touch with homeowner. The mortgage is aware the house is severely damaged, not livable with starting bid $ XXXX house. XXXX county has house value XXXX. Other concerns of the loan is that back in XXXX I believe the house faced foreclosure issues and was successfully stopped, but the balance of the loan back in XXXX of about {$100000.00} and now the balance of the loan in XXXX was about {$100000.00} and now due to foreclosure the loan balance is about {$120000.00}. The principle balance of the loan has not changed from about XXXX to XXXX. The homeowner remembers signing some type of paperwork regarding helping XXXX XXXX get refinanced on the loan back in the early XXXX 's due to an unethical interest rate XXXX XXXX was in. Shortly after the XX/XX/XXXX flood XXXX XXXX XXXX passed away and the mortgage company updated the information on the loan to reflect XXXX XXXX/In the estate of XXXX XXXX. The balance of loan is the same as it was in XX/XX/XXXX. nationstar is aware the house is severely damaged and not livable but yet lists selling in foreclosure which is pendeing at starting bid of $ XXXX and on XXXX for $ XXXX which is not fair to anyone whom buys the house as it requires possible demolition. Please help me save my land and not go to foreclosure and if go to foreclosure sale I get a A deed in Lieu of Foreclosure, again I want to restructure the loan at what is fair to keep the land due to the hardship my mortgage put me in as they could have put me in a forbearance XX/XX/XXXX and I would n't be in this position with balance XXXX

They took two months to correct the XXXX. problem of the incorrect property tax payment, and after 6 weeks of numerous calls, e-mails, faxes, and letters they are still increasing my Escrow Acct. The person that I talked to acknowledged the mistake but had to send it to a committee and would call me back in 7 days. She never called back. Nationstar never calls back when promised. Consumer Complaint: I filed a lawsuit against Nationstar Mortgage for mortgage fraud that was settled out of court. During the course of actions that I sued them over they took a complete payoff of my mortgage debt, not a short-sale or other negotiation, they accepted in full the amount to satisfy the debt to their satisfaction from another company that I had never been in contact with. The problem is that they still show on my credit, two years later and after we have settled out of court on this matter and several others where they admitted guilt, that they foreclosed on our property and that we owe the total balance, neither of which is true. This is barring me from purchasing another home. This false information has been requested to be removed on multiple occasions. I can show legal court papers showing their payoff was complete two years ago. I believe that this should be enough to get them to remove the negative reporting from my credit, as I was not even delinquent to them at the time of this issue arising.
