Consumer Complaint: The borrower, Ms. XXXX received a notice on XXXX of a Trustee Sale scheduled on XXXX. Mr. XXXX contacted the lender on XXXX to request Mortgage Assistance. She was informed by a representative that the lender, Nationstar Mortgage LLC would not allow her to pursue a short sale because they needed 37 days prior to the Sale date to consider any mortgage assistance options. Consequently, the borrower asked the representative why she was n't provided with the notice at least 37 days prior to the Sale date so that she would have had enough time to request mortgage assistance. The representative stated that such notice was something that they were not required to do and that the Sale date will go through as scheduled. However, pursuant to XXXX XXXX of the California XXXX XXXX, " The sale date shown on this notice of sale XXXX be postponed XXXX or more times by the mortgagee, beneficiary, trustee, or a court. '' Furthermore, pursuant to XXXX " At least 20 days before the date of sale, deposit or cause to be deposited in the United States mail an envelope, sent by registered or certified mail with postage prepaid, containing a copy of the notice of the time and place of sale, addressed to each person whose name and address are set forth in a duly recorded request therefor, directed to the address designated in the request and to each trustor or mortgagor at his or her last known address if different than the address specified in the deed of trust or mortgage with power of sale. '' Ms. XXXX did not receive such notice via Registered or Certified Mail and thus the Lender did not provide proper notice.

I have had the same house and have always made payments. I believe this occurred when I refinanced to another company. They even filed the lien with XXXX county in which I live. I have tried numerous times to talk to them and they just redirect me to another company. I don't know what else to do?

The most frustrating part of it all is the fact that Nationstar received {$25.00} XXXX dollars in incentive payments for loan modifications from the Department of Treasury, as part of programs such as Making Homes Affordable.

Consumer Complaint: I have my home in 2003 and I 'm still paying for PMI on my mortgage. I thought that this insurance will drop after 10 years I was told. My loan has been sold couple of times. My Also I 'm experiencing problems with my escrow balance. I need assistance with this Mortgage Company. They ca n't explain to me when I ask then where did my money go if I send a check for my shortage on escrow. I paid in advance and they still inform me I 'm short but I paid the balance in full. Consumer Complaint: First I must say that there isnt a correct selection for a credit collector who is reporting a debt far outside the Statute of Limitations. NationStar has been reporting my Mortgage as late when they should not be reporting the account at all as it is well beyond the 7 1/2 year Statute of Limitations allowed by the FCRA. Section 605 ( c ) ( 1 ) which states the reporting period begins 180 days after the event that caused the account to become delinquent. Then the Statute of Limitations runs 7 years. This date does not change unless payment has been made by consumer which resets the clock. In a letter dated XX/XX/XXXX NationStar states without question, and I agree, that the Date of First Delinquency was XX/XX/XXXX. I have disputed this on 3 occasions with XXXX, XXXX and XXXX in the past 2 years and included copies of the NationStar letter showing the XX/XX/XXXX date. Each time Nationstar violated the FCDPA and FCRA by voluntarily and with malice reporting an invalid debt. In many discussions the folks in collections say they can not make changes to my Credit Reporting Agency files and only they can do that, and NationStar just keeps reporting a debt whose last payment was made 9 years ago!!!

Consumer Complaint: Nationstar mortgage has disrupted my credit because they state that in XX/XX/2015 I missed a payment. I never missed a payment. Between XX/XX/2015 and XX/XX/2015, my payment changed because Nationstar states that my loan went from an interest only loan to a principle and interest loan. I made my usual payment of {$3200.00} in XX/XX/2015. What I did not know is that Nationstar put that money into suspense and did not apply it to the loan because they do not accept partial payments. When I received my statement in XX/XX/2015, I noted the increase in required payment adjusted my payment accordingly. At the time, I was remodeling the home and I assumed that the increase in payment was to cover additional escrow because the taxes and insurance went up. I never thought any more of it and continued to make the new payment ; actually paying more than the required payment. ( This is a practice that I have always done with all of my loans ) Nationstar never notified me in writing, email, or by phone prior to XX/XX/2015 that my payment would be changing in XX/XX/2015. They state that they tried to contact me in the month of XXXX, but that my phone was disconnected. That would not seem plausible since, as a surgeon, I would never not have a working number. Even if they had tried to contact me, it would have made no difference because I already had corrected the payment. At the time, there was more than sufficient funds in escrow to cover the {$600.00} difference that they said that I owed, but they did not apply those funds. Instead they put the {$3200.00} into suspense and did not apply it to the loan. I never discovered any of this until I started the process of refinancing my home. Now, Nationstar says that they can not amend the report. This is disrupting my credit and making it difficult for me to refinance the home. At XXXX years old, I have never declared banckrupcy, short sold a home, or missed a payment in my life!! This is a mistake on Nationstar 's part that is affecting me. I find it hard to believe that they can not amend their report based upon all the evidence available. I think that this is fraudulent and shameful. Moreover, I believe that legally, Nationstar should have notified of the payment change. Had they done so, I would have adjusted my payment accordingly and this never would have happened.

Consumer Complaint: I fell behind on my mortgage and hired an attorney to help me apply for a loan modification with my lender Nationstar Mortgage in XX/XX/XXXX. I had submitted an application on my own back in XX/XX/XXXX and I was told by Nationstar verbally that I was going to be denied. My attorney helped me put together an updated complete new application, which also added a contributor income to solve my budget issue. This NEW application was forwarded to Nationstar on XX/XX/XXXX. I received a letter confirming my application was received on XX/XX/XXXX ( Attached ). My attorney has called Nationstar every week since then and was told the NEW application was under review and nothing was needed. By the time we hit XX/XX/XXXX my attorney advised me there was something wrong. Nationstar per RESPA Regulation X only has 30 days to make a decision and it had already been over 60 days. My attorney on XX/XX/XXXX ( Notes attached ) finally was able to determine that Nationstar did n't even have my NEW application in their system. They were still working on my old application from XX/XX/XXXX which did not have my additional income ( contributor ) of {$4000.00} per month. Nationstar point of contact asked my attorney to send the application again because it was lost, so my attorney forwarded it by email on that day. Now Nationstar is telling my attorney that they merged my old budget and application with my NEW application and they are denying me for a negative budget. Not only is Nationstar in violation of RESPA Regulation X for not completing the review and issuing me a denial or approval letter from my XX/XX/XXXX application, but they are also PURPOSELY using my old budget in order to purposely get me denied. I do not want my old budget used in my NEW application review. I provided an updated budget on XX/XX/XXXX ( Attached ). I never asked them to merge my old budget with my NEW budget. I submitted my NEW budget because my attorney counseled me on my budget and we made changes so I could balance my budget. Nationstar is purposely merging my old budget with my current budget solely to get me denied. My attorney states I qualify for Making Home Affordable ( Positive NPV attached ). Nationstar is either incompetent in processing my loan modification application or they are purposely evading review and using information that was already updated to purposely get me denied. In addition, the HAMP program is now expired and I DID apply before the cutoff. Nationstar never gave me my NPV chart from my applications in XX/XX/XXXX or XX/XX/XXXX. We are now going into XX/XX/XXXX!!!! and I am now being " DUAL TRACKED '' for foreclosure. My attorney states Nationstar is NOT supposed to merge my prior applications with my current updated, revised application. That in their opinion they are purposely evading review and using old, OUTDATED, information that I have already revised ( my budget ) so I can be able to afford my mortgage in order to purposely get me deneid.

In XXXX XXXX XXXX XXXX confirmed with Nationstar that a full and complete modification packet had been submitted. On XXXX XXXX and XXXX XXXX, XXXX XXXX contacted Nationstar to re-affirm that the loss loss mitigation was complete and under review.Meanwhile, the foreclosure sale had been reset seven ( 7 ) times in anticipation of Nationstar making a decision on the loss mitigation application However, before Nationstar informed Homeowner whether he was approved for a loan modification to reinstate the loan, Nationstar informed Homeowner that the loan was transferred to Sharepoint on XXXX XXXX, XXXX. Homeowner has since been advied that the will need resubmit his application for a loan modification to Sharepoint. Because of Nationstar 's blatant disregard for the servicing loss mitigation rules, Homeowner is at risk of losing his home. Furthermore, Nationstar failed to advise client or his XXXX Counselor as to whether Homeowner was approved or denied for a loan modification.
