Consumer Complaint: While refinancing and paying off a mortgage from Nationstar Mortgage, they assessed late charges from a prior mortgage servicer XXXX. As they are not debt collectors only loan/mortgage servicers, they are out of their reach of collecting debts for a prior mortgage lender. The assessed late fees had no supporting documentation other than they came from XXXX, which whom they purchased the loan from. They required me to pay off the unsupported late fees before I could refinance, holding me XXXX, with the fear of rising interest rates had I not paid it off prior to my loan lock deadline.

Consumer Complaint: I have a complaint against the current mortgage company who has my loan Nationstar Mortgage. Despite my pleas for help they have not opened up a review of my financial information nor assigned a single point of contact. Instead they have scheduled a sale date of my home for XX/XX/XXXX. Nationstar is the XXXX different bank to hold my loan. I have been trying for a long time to fix this problem of my delinquent payments but every time I seem to be getting some traction the loan gets transferred. I am employed and have owned my house for 11 years and want to save it. This is a conventional loan that I believe is backed by XXXX. I just heard that there were some new programs to help homeowners with conventional XXXX loans and I think I could qualify. My interest rate is 7 % and I have suffered a real hardship the last few years. I have worked in construction for over 30 years and had steady employment and money in the bank when I bought my home. Like millions of Americans, I was blindsided by the recession and found myself in and out of work for the next couple of years. I was still making my mortgage payment each month, but the writing was on the wall that it would be difficult to maintain. I reached out to my servicer at the time to apply for help. ( I believe it was XXXX XXXX or XXXX at that time ). They told me that even though I had an obvious financial crisis going on, they would not consider my application unless I was behind on my mortgage loan. So I took their advice and stopped making my payment in order to be considered for mortgage assistance. I started the modification process but within a matter of a few months I was being threatened with foreclosure by the agents at the bank. So I had to scramble and borrow money and do whatever I could to get caught up on the loan. But the problem had not been solved, I was still barely staying afloat. I hung on as long as I could but eventually due to the high payment vs. my income and sporadic unemployment I fell behind. I tried to work with all of the companies who held the loan -- XXXX, XXXX, XXXX and every time that it seemed I was making progress the loan would get transferred. I have never been assigned a designated point of contact by Nationstar and have never had a review completed. I deserve to be considered for these new XXXX backed programs, as well as all other government and in house programs that Nationstar has available.

Issue: Loan servicing, payments, escrow account

Subissue:

Consumer Complaint: Nationstar Mortgage purchased my loan from my original mortgage company. I was sent information stating none of the terms of my loan could be changed. Nationstar refused to make payments from a volunteer escrow account that I had with my previous loan company. My homeowners insurance was canceled and I had to pay a portion of it to get it reinstated. I asked in XXXX of XXXX that my escrow account be removed from my mortgage statement. I paid my second qtr. taxes in XXXX XXXX and recently paid my 3rd qtr. taxes XXXX/XXXX/XXXX. Nationstar has been applying the principal and interest payments I have been sending to everything except my principal and interest. I was told in XXXX by a representative of Nationstar that my bill would be corrected and it would be reflected in my XXXX bill. Although my taxes are paid and all my principal and interest payments have been made to Nationstar, I received a threatening letter from Nationstar. And, now that they have sent a threatening letter, it is nearly impossible to get a representative on the phone. After a barrage of calls from Nationstar, and my attempt to contact them, I get a voicemail answering service for the first time ever. It appears Nationstar is attempting to ruin my credit in the process of trying to force me to send my taxes and insurance to them. They have added fees and requirements that were not part of my original loan terms. Once they were notified I was going to refinance my loan I received mailings and calls in an effort to get me to refinance with Nationstar. I have refused based on loan rates and since then Nationstar has attempted to bully me through coercive actions..

Consumer Complaint: Nationstar Mortgage approved me for a standard modification in XXXX XXXX, with payments ( {$1600.00} ) in my Trial Period Plan due in XXXX, XXXX, XXXX, and XXXX XXXX. I paid {$1600.00} on XXXX XXXX, XXXX XXXX, and XXXX XXXX. Nationstar 's web site showed my XXXX and XXXX payments had been received. When I logged in last night to make sure XXXX 's payment had been received and correctly applied, I was shocked to see that my modification had been terminated. The explanation given was that I had not made my first payment in the Trial Period Plan or that I had requested the modification be terminated -- neither of which is true. The web page showing I had made XXXX 's and XXXX 's payments is now gone. Instead, I have a payment history showing payments I never paid, a payment reversal ( which never happened ), and a payment for more than the {$1600.00} I actually paid. Neither representative I spoke to today was helpful. I 'm faxing a letter and documents to Nationstar 's Research Department, but I 've dealt with the same Research Department in the past for a Qualified Written Request, which they did not fully respond to and also took far longer to respond than RESPA allows. I really need this modification and am concerned they will get around to my fax eventually but not in time to reverse the termination. I have only XXXX left in my Trial Period Plan.

Consumer Complaint: My escrow account monthly payment has increased over {$120.00} in a 2 year span. I 'm in the mortgage industry so I 'm not confused, however Nationstar Mortgage is. They are an extremely poor servicer. They 're excellent at obnoxios/unnessary harassment of very good accounts but other than that they are pariahs. Long story short they have butchered my annual escrow analysis ( again ) and now are mandating that I pay an additional {$70.00} a month this year in addition to the {$50.00} increase last year. Yes my taxes have increased moderately but my payment now should be worst case {$900.00} a month and it is now, due to their incompetence, {$980.00} a month starting next month. Contacting them is a total waste of time so I 've resorted to complaining to the CFPB. Again they are excellent at actually reminding you of payment due 10 days in the future but other than that they are a liability as a mortgage servicer to the industry ... .and they do n't give a XXXX. I would like to force them to make an appropriate escrow analysis and correct their foul up.. Ultimately I 'd love to see them barred as a servicing candidate.

Subissue: Indicated shouldn't respond to lawsuit

Consumer Complaint: I have a mortgage that is being serviced by Nationstar Mortgage. I tendered my deed in lieu of foreclosure back in XX/XX/XXXX and was told to move out of my house by XX/XX/XXXX. Shortly before the XX/XX/XXXX date I was informed by my contact person there that there was a problem with a " power of attorney '' that was delaying the closing of the transfer. After more inquiry I learned that Nationstar alleged that they did not have all the documents necessary to have an interest in the property since XXXX, the former servicer of the debt, had not sent in all the proper paperwork in XX/XX/XXXX or so. This " delay '' has continued since. I was informed via letter received XXXX ( although dated XX/XX/XXXX ) that matters would proceed to a closing in early XX/XX/XXXX. I again hustled to move the remainder of my items out of my old house to meet the deadline when I was informed by another letter that things had been pushed back to XX/XX/XXXX, then subsequent identical letters to XX/XX/XXXX and then XX/XX/XXXX. I made contact with XXXX in the Fall of XX/XX/XXXX and they informed me that they had completed all the paperwork and there was no problem from their end. I examined the chain of title to my property, and I found that Nationstar did not have a recorded interest in the property from XXXX to them. They did have a recorded transfer from Nationstar to XXXX in the Fall of XX/XX/XXXX. Coincidentally, XXXX filed their transfer from a prior servicer, XXXX, in the XXXX of XX/XX/XXXX, but the actual transfer took place in XX/XX/XXXX. I am upset that I have been paying Nationstar since XX/XX/XXXX and they do not have any proveable interest in my mortgage, and still do not have XXXX to this day. They apparently transferred whatever interest away in XX/XX/XXXX, but have failed to disclose that to me. Consequently due to the delay I have incurred multiple moving bills, had to maintain utilities on XXXX locations, and lost my original house that I was moving to to an arson fire because I could not move in to secure it. My phone contact person at Nationstar told me that the original letters indicating the need to vacate by XXXX and then XXXX were not sent from her office, but by another Department at Nationstar. Incidentally, I was on the verge of filing to participate in the national settlement that XXXX had entered into about these mortgage loans when they abruptly informed me that they transferred my servicing to Nationstar.
