Consumer Complaint: So they sent me this, " Your account has incurred a late fee of {$15.00}. To avoid impacts to your credit, please make a payment by XX/XX/2017.If you ca n't make a payment today, please complete a Promise to Pay form. This will reduce the frequency of the contacts you receive. And you can always call us at XXXX if you need help staying current on your loan. '' The problem was that about one month ago I was told by Nationstar that I was a complete payment ahead of schedule so I had them apply the outstanding money to the loan. Nationstar Mortgage said they would honor the payment terms from XXXX XXXX XXXX ( previous mortgage servicer ). I was using equity accelerator at XXXX and making half payments every two weeks, Nationstar said they would keep this the same. So my guess here is that when they lied to me about being one month ahead ( I think I was actually 1/2 a payment ahead ), so when they applied the complete payment it put me 1/2 month behind, thus the fee they are charging me. This company has the worst customer service I have ever endured, the representative lies to me every time I call and can not pull up my account to even see what is going on. I have to be transferred to someone else every time to actually get any help.

Consumer Complaint: On XXXX XXXX, XXXX we filed for chapter XXXX bankruptcy which included a large number of mortgage payments. In XXXX XXXX, I received a copy of a motion for relief from the automatic stay in the mail. Nationstar mortgage was asserting we were 3 months delinquent. This came as quite a surprise to me as our first post petition payment was due XXXX XXXX and we had made a payment in XXXX and XXXX. There was one payment not made because Nationstar insisted we had a different post petition start date than I thought and that we were ahead by one payment. I contacted Nationstar almost daily from the date in XXXX I received the motion until the first hearing in XXXX on the motion. Each time I talked to them they told me the payments were there in the unapplied funds account and that they were n't being posted because my post petition payment was less than my pre-petition payment and the system was n't recognizing it as a full payment. Each time they said they were forwarding a request to research asking them to apply the payments. I continued making payments and made a payment in XXXX, XXXX ( which cleared first week in XXXX because of the holiday ) and XXXX. The first hearing was continued because Nationstar 's attorney 's had been unable to reach them to discuss the proof of payment I had sent in. A follow up hearing was scheduled with the same result. The hearing was then continued to XXXX XXXX XXXX. At that hearing the attorney for Nationstar stated that they had accounted for all payments but one - which would be the one Nationstar 's reps insisted I did not owe due to my first post-petition payment due date. The hearing was continued yet again for another two weeks. My attorney had stated that if I did n't have evidence of the one remaining payment that we would be able to do an agreed order and make that payment up over 6 months. The next thing I knew, I got a copy of an order in the mail from the Trustee stating my attorney had erroneously withdrawn our objection to the motion to dismiss and the motion had been granted. When I asked my attorney how they planned to correct this error they indicated they would reach out to Nationstar 's attorney and try to get them to work with me. Now, the attorney is coming back stating I owe payments for XXXX XXXX through XXXX XXXX. The payments they had previously acknowledged as received, they are now stating are delinquent again. Nationstar is clearly not applying payments correctly, timely or appropriately. They erroneously filed for the motion for relief when I was never 3 months delinquent and I am now fighting against foreclosure. To add insult to injury, they want me to cure all post petition payments ( which I have already made and provided evidence of, exlusive of one payment ) but also to pay their attorney fees when they never should have filed the motion to begin with and they still seem to be incapable of posting my payments. I am at risk of losing my house when I have made the post petition payments as agreed. I also fail to see how they can require me to pay attorney fees that should have never been incurred in the first place.

Consumer Complaint: NATIONSTAR is manipulating the numbers ( costs ) shows on my ESCROW ANALYSIS. I received my escrow analysis on XXXX/XXXX/17 and it was incorrect because it showed PMI. I requested an updated escrow analysis be performed on XXXX/XXXX/17. With the new analysis, to my surprise, the result is the same : " There is a shortage of $ XXXX '' ; however, the new anticipated annual disbursement without PMI is nearly {$1000.00} less. So I need NATIONSTAR to explain to me what calculation do they do to estimate the lowest projected balance and the minimum required balance. I have both escrow analysis for review upon request.

Consumer Complaint: Please refer back to Case number : XXXX as a precursor to this. I mentioned that I could not respond until a knew the outcome of my loan modification re-submission. Please note the Auto-Response date of XXXX/XXXX/XXXX. Now, on XXXX/XXXX/XXXX, I had my first Mortgage Foreclosure court date. After judicial review of the case, it was one of the rulings of the court that I submit new loan modification request documents to my lender, starting anew, with the package being prepared by a HUD accredited third party. When I mentioned to the court that I had a loan modification currently in review with my lender, the response was that I should start anew. This was agreed to by the Attorney representing the plaintiff XXXX, along with other other court stipulations. Prior to this date, my lender has sent me an " in-house '' loan modification and had called several times to " find out what I wanted to do ''. They continued to call urging me against the XXXX/XXXX/XXXX offer withdrawal deadline. I asked why, knowing that I had a HAMP loan modification package in process, they could n't wait for the outcome of that and were willing to make me an offer after 1 year of dragging and {$50000.00} tacked on to my initial mortgage balance. I receied no response from the lender on this inquiry/question. Again, please noting the Auto-Response date of XXXX/XXXX/XXXX, I logged on to my on-line mortgage account with NationStar for loan modification status updates. True to form, one month and one day after, on XXXX/XXXX/XXXX, I saw the posting that my loan modification request had been denied on the grounds that my income did not meet eligibility standards. I received a written follow up in the first week of XXXX XXXX and a follow up phone call later in the month, about a month after the XXXX/XXXX/XXXX posting. At this point, I asked the NationStar representative why it took one month to call me to " discuss '' the denial. Again no answer to the question. I mentioned to her that I had since retained legal representation to handle this increasingly twisted case and that my lawyer may be able to better respond to them, through their lawyer. One of the other baffling things from my lender has been the Monthly mortgage documents from NationStar that show monthly payment demands that fluctuate/see-saw between {$2300.00} before the loan modification offer of XXXX XXXX to {$3500.00} after the loan modification offer ( between the XXXX/XXXX/XXXX expiration of the offer and the XXXX/XXXX/XXXX denial of the HAMP loan modification application ) and then back to {$2700.00} in XXXX/XXXX XXXX. I also noticed my bank statements through XXXX billing and prior to XXXX XXXX billing that show XXXX XXXX debiting my account for insurance that included my combined House ( in foreclosure ) & Car payments, through XXXX XXXX. I noticed that starting in XXXX XXXX, that XXXX XXXX XXXX debits now excluded the House ( in foreclosure ) insurance amounts. This change, without my request/intervention.Was this at the request or directive of NationStar Mortgage/XXXX ? What was their motivation, after taking this amount from me through XXXX ' XXXX while also assessing the same monthly amounts towards my outstanding mortgage debt? Taking it from {$15000.00} to over {$54000.00}. Why the change? I am thankful in obtaining legal representation to better represent my interests before this Big Bank and hope that it is clear that there are many questions that I hope they can honestly address.

Consumer Complaint: I filed a Bankruptcy on XX/XX/XXXX because I Lost my job, divorced, and going thru a XXXX due to a very XXXX. In the bankruptcy I redeem the house to the bank XXXX, I was waiting from XXXX to do the process to take the house back from me because I 'm unable to afford it because of my income now. I never received any letter from XXXX indicating that they sold the Loan to NationStar Mortgage. ON XX/XX/XXXX I received a loan modification papers from NationStar Mortgage offering me a loan modification in which a never agreed, signed or made any payment to accept that offer. On XX/XX/XXXX I check my credit report and I discovered that NatiionStar Mortgage reported in my credit report that I was in a partial or modified payment agreement, 180 day past due, and 360 month mortgage in which in the modification paper said XXXX ( XXXX Years ). It is to many discrepancies on the information reported to my credit report, which I need to know what they doing. I have papers that proof everything this letter said, I do n't know what to do, I did a bankruptcy believing that it was going to be a new start and now the past is coming back to me. Consumer Complaint: My mortgage company was XXXX and I was approved for a trial modification in XXXX XXXX. According to the letter and coupons received, I made my payments of {$310.00} to them for the months of XXXX and XXXX XXXX to XXXX. I called into the company, gave them the information and permission to draft my bank account for the amount indicated. In late XXXX XXXX I was notified by NationStar Mortgage that as of XXXX XXXX, XXXX NationStar Mortgage would be my new servicer and collect my mortgage payments. I then made payments to NationStar Mortgage in the following manner ; XXXX XXXX payment was made by phone ; XXXX and XXXX XXXX was made by check which was mailed in. I sent XXXX XXXX payment but it was returned and I also received a letter notifying me of being behind in my payments. I do n't understand if I was in a trial modification how this is possible.

Consumer Complaint: QUESTION # 1 ~When did it become legal to leave lender required items off a HUD ( Truth in Lending Statement ) to deceive a borrower into thinking their payment went down to mislead them into signing a loan. Nationstar has confirmed borrower was misled and provided with a Fraudulent HUD statement already ... and the elderly consumer confirmed they never would have refinanced if the HUD statement was accurate so I will again ask ... QUESTION # 2 ~ When did failure to properly disclose fees, payments and escrow on a loan become legal? QUESTION # 3 ~ Nationstar already confirmed embezzlement of escrow funds with a simultaneous illegal attempt at foreclosure. Nationstar also confirmed that if the consumer would not have done the research and found the embezzlement, the home would have been illegally seized and illegally stolen, even though the elderly owner was paying as agreed. When did it become legal to misuse or divert a person 's escrow account without their knowledge? QUESTION # 4 ~ When did it become legal to take funds from an escrow account without proper IMMEDIATE written notification? QUESTION # 5 ~ When did it become legal to hokld these illegal funds for a period of 7 months without telling the rightful owner where the money was? QUESTION # 6 ~ Nationstar has failed to mail monthly statements for most of XXXX. Nationstar also failed to properly credit oral agreements on the phone during this failure, deceiving the elderly homeowner. When did it become legal to stop mailing monthly statements? QUESTION # 7 ~ When did it become legal to mail false and misleading statements and other attempts to scare homeowners out of their homes? QUESTION # 8 ~ When the fraud was identified XXXX started an investigation and we had verbally agreed that loan cancellation was on the way. XXXX also stated on writing and copied to the CFPB email, that no foreclosure was happening. When did it become legal to deceive a homeowner, telling them you were not foreclosing, while simultaneously foreclosing behind the rightful owners back? QUESTION # 9 ~ Nationstar added thousands of dollars in illegal fees and collected principal without credit on this elderly homeowner. When did it become legal to collect more than the Federally allowed amount for a monthly late fee? QUESTION # 10 ~ XXXX is a {$300000.00} to {$400000.00} house that Nationstar stole and resold while defrauding the Federal Government. It was put under contract twice but unable to close because it was never properly foreclosed. This property was eventually sold bu another realtor that did n't care about laws or compliance. When did it become legal to sell a home you did not own? QUESTION # 11 ~ When did it become legal to deceive the U.S. Government by hiding material facts like fraud and failure to legally own an asset you are selling, while defrauding the FHA, HUD, US Government and various insurance programs like Fannie Mae. QUESTION # 12 ~ Fannie Mae does not own this loan nor do they own any loans yet every Nationstar drone says " Fannie Mae owns the loan '' when questioned. When did it become legal to represent yourself as the U.S. Federal Government in order to deceive consumers about things like legal rights, liabilities and proper ownership? QUESTION # 13 ~ Nationstar purchased this loan in XXXX. Can you confirm that when a loan or asset portfolio is purchased, that Nationstar is responsible for liabilities in addition to the assets it gains from the portfolio? QUESTION # 14 ~ Nationstar and XXXX has engaged in Securities and Exchange Fraud by its incorporation of criminal acts and its absolute, 100 % refusal to comply with the law when caught.
