Consumer Complaint: Fell under financial hardship and needing a loan modification for our primary residence. Nationstar reps are giving different answers, solutions and timelines with every call making it difficult to make an educated decision on our primary residence. We are not receiving the documents Nationstar said they have sent and have to call and request them. Some of Nationstar requests have deadlines. Not having all the information to make a decision is difficult. We fear that because of the equity we have in our property, that Nationstar is not willing to work with us and taking advantage so they may profit. With the Nationstar modification we were approved for, they are moving our delinquent payments to the end of the loan but we do n't know if we pay interest again on those payments and Nationstar will not tell us what happens after the trial payment period of their modification. We have a detailed summary that is too large for this form.

Consumer Complaint: This is a complaint against Nationstar Mortgage for failing to comply with the Deed of Trust, not releasing phone transcripts as requested, and poor business practices by failing to contact me about my concerns as promised within the time allotted by them. I called Nationstar Mortgage on XXXX/XXXX/17 at XXXX Pacific time, to confirm that the money above my previous monthly bills have gone toward my principal pay down. The rep stated that they had NOT been, but instead, I was on a " PLAN '' that held them toward future months payments. I had asked why I was on the plan or who put me on the plan. He could not answer that. As of that date he then changed my " PLAN '' toward paying down the principal. I requested a manager call me back with an answer. He said it would take 5 business days. As of now XXXX/XXXX/17 XXXX Pacific, I have not heard back either by phone or email. I also requested a transcript of out phone conversation. The rep said there is NO WAY of doing that. After probing, I insisted that IT IS possible through the consumer relations dept. He then gave me an email to contact them, which I requested the transcript, and still have not heard back yet about a description, answer, or resolution. In my Deed of Trust attached below on page XXXX section XXXX it states the order priority of payments. ( a ) Interest due under the note ( b ) Principal due under the note ( c ) amounts due under section XXXX ie. Funds for Escrow Items. Such payments shall be applied to each Periodic Payment in the order which it became due. ANY REMAINING AMOUNTS SHALL BE FIRST APPLIED FIRST TO LATE CHARGES, ( there are none ), SECOND TO ANY OTHER AMOUNTS DUE UNDER THIS SECURITY INSTRUMENT, AND THEN TO REDUCE THE PRINCIPAL BALANCE OF THE NOTE. To my knowledge, Nowhere in that section does it say there are separate " PLANS '' of payment, or who chooses those " PLANS ''. I am very frustrated with Nationstar Mortgage breaking the law, and ask that you investigate on my behalf since they are failing to answer and comply with simple requests. Thank You

Consumer Complaint: Nationstar filed a 30 day late notice to all three credit bureaus after I was late in XXXX 2016. I paid XXXX 2016 and informed them that I would have to make a double payment in XXXX 2016 for both XXXX and XXXX. I followed through with my XXXX and XXXX payments on XX/XX/2016 and have been current ever since. Nationstar filed a 30 day late notice with the bureaus which has negatively impacted my credit score. Additionally, they called on me to refinance our mortgage since we have equity but declined due to my credit score which was adversely impacted by their reporting.

All persons who notarized the assignment has lack of capacity, authority and personal knowledge of the facts regarding the transferring of the note to the current Servicer, Nationstar Mortgage LLC/ The Assignments recorded also shows lack authenticity. Under the Consent Order with the CFPB, Nationstar Mortgage has the due diligence to make sure the consumer protection laws were adhered to. Consumer Complaint: Short Story : They impound our taxes each month, which totals over {$11000.00} per year. Unfortunately, although they deducted the money from our escrow account, they never paid the second installment of our taxes. We had started the process of refinancing and our new mortgage company XXXX had to pay the taxes on our behalf. Now we owe XXXX {$6600.00} for taxes that were already escrowed by Nationstar. Nationstar is not returning the money. Details : XX/XX/XXXX : They record a deduction from our Escrow Account of {$6000.00} XX/XX/XXXX : Taxes are due to the County of XXXX XX/XX/XXXX : Nationstar Mortgage provides a payoff statement to XXXX showing that the taxes were already paid XX/XX/XXXX ( not exactly sure of the date ) : We settled a refinance with Nationstar XX/XX/XXXX : XXXX sends us a letter that our taxes were delinquent and that they paid them, including the penalty fee of {$600.00}. XXXX tells us that we now have to pay them back the {$6600.00} over the next twelve months. XX/XX/XXXX : Spoke with XXXX at Nationstar and opened a case, which she said would resolve in 5 days. XX/XX/XXXX : Followed up with XXXX at Nationstar. He has no news. XX/XX/XXXX : Spoke with XXXX who is able to see a tracking number for the loan payment, however that tracking number shows as 'Tracking ' XX/XX/XXXX : Spoke with XXXX at Nationstar . She was able to explain that the tracking number I was given was not a wire number, as I was originally told, but was a XXXX number. I am able to search the number and see that a label was created on XX/XX/XXXX, but nothing was shipped. However, that same tracking number is also used for a separate package that was XXXX from XXXX, TX to XXXX. It shipped on XX/XX/XXXX and arrived on XX/XX/XXXX. I was transferred to XXXX at Nationstar who promised to look into it. XX/XX/XXXX : Left a message for XXXX. Never got a call back from XXXX. XX/XX/XXXX : Spoke with XXXX at Nationstar. Finally got transferred to XXXX who was helpful. He investigated and said that the check was sent to the County of XXXX. The County of XXXX was returning it to Nationstar and they will issue us a refund. He said it would take a couple of days. He said it might take 5 days to process. XX/XX/XXXX : XXXX called me to let me know that a check was coming and gave me a XXXX tracking number. He said the check should arrive by Tuesday XX/XX/XXXX. XX/XX/XXXX : According to the XXXX Tracking number nothing was ever shipped. A label was created, but that is it. Left a voicemail for XXXX XX/XX/XXXX : XXXX never called back so I called him again and left a message.

We appeal to the authority of your Offices for consumer protection and investigation of Nationstar Mortgage LLC. NO LENDER NAMED on the purported Notice of Default, nor in the XXXX ( expired ) /XXXX NOTICE of TRUSTEE SALE..for an alleged account that DOES NOT belong to Consumer. No records of alleged debt. No " competent and verifiable material evidence '' to prove its claims and its BONA FIDES. Alleged DEBT remains to be in DISPUTE -the issues on its " intentional misrepresentations '' of the nature, character and amount of debt REMAIN to be OPEN. Nationstar could not even agree with its conniving agent Quality Loan as to the amount of alleged debt purportedly owing - with an exceptional $ XXXX variance in its Statement of XXXX/XXXX/XXXX -- - 3 days from Quality 's Notice of Trustee Sale issued XXXX/XXXX/XXXX. ALL Nationstar has are documents that anyone could obtain from public records, then stakes a claim against our home by recording its XXXX assignment instrument, purportedly from XXXX in XXXX XXXX, and notarized all the way in XXXX, XXXX! [ Perhaps, XXXX XXXX ran out of notaries ...? ] This instrument of course violates Federal and State Laws - CA Penal Code 115 for robosigning, XXXX HOBR 2924.17 for lack of competent and verifiable evidence to support the same, and then XXXX Civil Code 2936 that provides " assignment of a debt secured by mortgage carries with it the security " Nationstar 's XXXX assignment is of course not supported in any way in its alleged copy of Note in XXXX ( in Court records ) - that is left devoid of any " Nationstar '' marks ... ALL THESE and more " intentional misrepresentations of material facts '' and dual meanings per FDCPA ... .as basis for its UNLAWFUL foreclosure auction tomorrow ... for its undue enrichment. THANK YOU CFPB for your remarkable efforts in cracking down unlawful and deceitful practices in the finance industry to protect U.S. Consumers from predators who violate laws for their undue enrichment. Consumer Complaint: Nine months ago my loan was modified. I have made monthly payments since then, which all are reflected in statements. However, despite my numerous requests, the servicer which handled the modification has yet to send me a copy of the modification document with the proper signatures for the lender on it ( I have a copy with only my signature ), nor has it recorded this loan at the Register of Deeds for my county and, importantly, it has not yet recorded the satisfaction of the loan which this one replaced. The servicer is Nationstar. I first asked for a modification, in writing, in early XX/XX/XXXX. I was current on payments and my credit score was excellent. I was then asked to submit repeated applications for HAMP, the process for each application being extended by their requests for an additional piece of information every week or two - until two to three months elapsed - and then being told that the initial application was " out-of-date '' and I would have to submit a new one. This occurred about 12 times over a 30 month period. Eventually, I sent a XXXX letter to the CEO and several months later recieved the offer of a modification - with mathematical and other errors in it. After I did the math for them, they sent new paperwork, I signed and returned it XX/XX/XXXX, and was notified of the new state of my account and began to make payments. I believe it is my legal right to have a copy of the loan with this modification, to have the modified loan recorded legally, and to have the document with the previous loan terms be recorded as satisfied or whatever would communicate publicly that it is no longer valid, and to have these matters accomplished in a timely manner without further harming my credit rating. Almost 10 months have passed with none of those being done, even though I have asked repeatedly for them to do so. Nationstar has also blocked me from using my online account for payments because I am pursuing a remedy in the courts for the violations of my rights and damages done to my credit rating. I believe that blocking is a violation of my rights as well. Note : the question below - which part of the mortgage process is my issue related to? - does not have an option that exactly fits my situation. I chose " signing the agreement '' because I have not received a copy with their signatures on it, even though I have been making payments and have statements reflecting the modified amounts.

Consumer Complaint: Nationstar has illegally attempted to collect on a time barred debt. This has included multiple illegal actions in an attempt to enforce a time barred debt and the lien is expired by Operation of Law however Nationstar refuses to follow any and all applicable laws. The original " Note '' was a promissory note that originated with XXXX in XXXX XXXX '. The Note was called XXXX by XXXX in XXXX ' causing the maturity date to be shortened to XXXX XXXX XXXX '. XXXX XXXX together with XXXX XXXX ; the promissory note expired under XXXX & XXXX - ( Four Years Promissory Note Time Barred ) then after 8 years Nationstar instructed a 3rd party firm named, XXXX XXXX XXXX publish this debt as owed and has caused multiple defamatory publishings that are 'untrue '' and unlawful. This was caused by an untimely Notice of Default claiming that a " DEBT '' was owed. This was not true as this was time barred and the lien was also and is still also time barred and unenforceable. Under Ca marketable records laws ; See attached documents : from CA Legislative web site : pertaining to being time barred unenforceable lien due to the underlying debt is time barred. This is clearly written - XXXX : Expiration of the lien of a mortgage, deed of trust, or other security interest pursuant to this chapter or any other statute renders the lien unenforceable by any means commenced or asserted thereafter and is equivalent for all purposes to a certificate of satisfaction, reconveyance, release, or other discharge of the security interest, and execution and recording of a certificate of satisfaction, reconveyance, or release other discharge is not necessary to terminate evidence the termination of the security interest. Nothing in this section precludes execution and recording any time of a certificate of satisfaction, reconvenyance, release or other discharge. Thereby -- NATIONSTAR HAS FAILED TO RELEASE PER THE APPLICABLE LAWS. AND INSTEAD HAS RAMPED UP COLLECTION ACTS THAT ARE ILLEGAL. These have included criminal trespassing into property and causing a malicious damage with intent to discourage and harass the homeowner, cause fear and intimidation and has not ceased. This has caused over XXXX hospitalizations for " acute '' care to family member undergoing severe stress and multiple police reports for illegal acts in collecting this time barred debt. The actions have been non stop abuses and caused a later forcing into a bankruptcy in XXXX XXXX ' AFTER BEING TIME BARRED however Nationstar refuses to follow any laws and has caused horrendously abusive illegal acts including verbal threats and physical threats and continues to invade on homeowner and intrude and threats to intrude into her home " whenever '' deem I am not " in '' the home and have sent men to peak into my windows with telephoto lens and continue to harass and cause XXXX more hospitalizations just knowing they continue to send letters claiming they have rights to break into my home.

Consumer Complaint: I am writing regarding my home that is currently scheduled for XXXX on XX/XX/XXXX in XXXX Florida. I 'm the heir of my parent 's property with XXXX. I have tried to workout taking possession of the home but with little assistance from Champion Mortgage Company. The court gave me XXXX days to leave the home ; however, I 'm interested in keeping the home since me and my children resides in the home. The process has not been explained to me to take advantage of modification procedures to remain in the home. Yet XXXX is not using the law to assist citizen being discriminated against with regards to the banking processes, especially XXXX homeowners. It seems the courts have been given greater latitude to assist citizens being discriminated against but little has been done to assist me ; I learned over the years the fraudulent tactics used by the banking industry to remove minorities from their homes with the assistance of the legal system. My parents have worked hard for many years and I am heir to the property. I currently work with XXXX with XXXX years of service. I have tried to fight for my home with limited knowledge to avoid foreclosure. My mother and father took a reverse mortgage due to XXXX and the need for income to support medical bills. However, I would like to purchase the home but have not been given the opportunity to understand what I need to do to assume the note to continue living in the home. I also hired a XXXX XXXX, XXXX, FL XXXX and he has not served me well, each court hearing I did all the talking and he was paid to assist me in the process for assuming the home after the XXXX of my father -- XXXX. My father XXXX XX/XX/XXXX and I have not been given the appropriate procedures that due me by law to assume the property. I also have a living trust and the server Champion Mortgage after sending the trust document several times, I 'm was finally told that they they have received the document after I received a summary judgement and a writ to leave the property. The Attorney for Purchaser, XXXX XXXX, XXXX , FL XXXX. Telephone XXXX. On XX/XX/XXXX my home was sold ; I had an XXXX and a XXXX. The first filing I answer the foreclosure I paid XXXX to assist with my parents reverse mortgage to keep the home. The first payment plan arrangement was {$500.00} ; I made the payments as I was instructed to do. I forwarded information that was requested by the courts and bank such as cashier checks, pay stubs utilities bills etc. to assist with XXXX and the hardest hit program, and paid {$1800.00} to a debit program which I was fraudulently assisted. Nothing was done with the DEBT SOLVE program that was recommended by XXXX. The fax number is XXXX and number to office XXXX. The representative is XXXX. Another plan was made by this XXXX and my Dad to file bankruptcy but he XXXX before the hearing. Each time I would meet with the secretary or clerical staff for payment ; yet I was told by the bank that the property is sold. According to the XXXX I was not eligible for the hardest hit program. My parent 's property was upside down in XX/XX/XXXX after the XXXX of my mother. I feel this behavior by XXXX and the law XXXX is criminal thus allowing banks to do this to customers is also unfair ; I filed a complaint because there should be some protection for citizens. I paid a total of {$1700.00} XXXX dollars but my money have been used in a fraudulently manner I have been taken advantage of by the banks and the legal process and in need of immediate assistance.
