Consumer Complaint: My family has owned our home in XXXX, Arizona for over 30 years. I have had some major health issues the last few years and due to a XXXX and XXXX XXXX was forced to retire. I had a lapse in income after retiring while waiting for my XXXX checks to begin and as a result fell behind on my mortgage with Nationstar. Now that I am receiving a regular check from XXXX and with my wife 's income we can resume making our mortgage payments. The problem is that Nationstar will not accept our payment. They will not communicate with us or assign a point of contact. We have asked to be reviewed for modification programs through the federal or state government but they have not even opened a review. As a result we now have a foreclosure sale date set for XXXX XXXX, XXXX. This should not be happening because we can afford a fair payment if Nationstar just gave us a chance at a modification. My wife and I refinanced our home in XXXX. When I began having XXXX XXXX in XXXX and was unable to work we were allowed to apply for a loan modification and were approved. We made these payments without any problems until I XXXX in XXXX which left me unable to work. At this time the loan had been transferred to Nationstar. I do n't know why Nationstar is not even considering our current financial situation and working with us towards a restructured loan. I think it would be better for everyone and more money for Nationstar if they worked with us and allowed us to stay in the house instead of foreclosing on us. We are not that far behind on the loan and our balance is low as well. I definitely believe if Nationstar took the time to review our information we would qualify for help.

Consumer Complaint: My mortgage payment went up {$88.00} last year. This year it has gone up an additional {$430.00}. I ca n't understand how I 'm expected to pay {$1400.00} a month, when we bought our home knowing our payment was {$910.00} a month. I have read the explanation on nationstars ' website about the escrow amount going up. Still I can not fathom paying an additional {$430.00} a month. With the company making this change, our best bet to survive as a family will probably have to be to sell our home as we will not be able to make the payment of a nearly 50 % increase on our mortgage.

Consumer Complaint: I applied for modification due to my interest-only loan becoming fully amortizing and interest rate increasing which resulted in an unaffordable payment. This complaint is due to Nationstar 's determined income being significantly beyond our available income and ability to repay. It appears their model for determining income does not support QM or ATR requirements. Nationstar uses a gross income average from XXXX paystubs and annualizes this income as stable qualifying income. This is without regard to the source of income. In our circumstance, their method of determination significantly overstated both my spouse 's and my incomes. Their approach negligently disregards the continuance of all income sources and is not in agreement with both QM and ATR requirements. For example, my income determination used overtime that was not supported with YTD earnings. It was not considered if this income was supported or expected to continue. My modification application intentionally excluded overtime as monthly income since this was not stable or expected to continue. Per the documentation provided, my most recent paystubs have bi-weekly overtime of {$1200.00} and {$1300.00}. Nationstar calculated total gross income as an average of {$4300.00}, annualized to $ XXXX = or {$9500.00} mo. Considering base income per paystub of $ XXXX {$6600.00}, Nationstar considered {$2800.00} as stable overtime income for qualification. Check ending date of XXXX/XXXX/XXXX and pay ending date of XXXX/XXXX/XXXX does not support this as stable income. YTD overtime average per last paystub is {$1300.00} monthly ( {$11000.00} XXXX ). This evidences that this is potentially not a stable income source and would require additional analysis for consideration. In reality, this overtime is not stable and resulted from significant mortgage volume resulting from the lowest interest rates in history ( XXXX XXXX ). Any significant overtime is not currently or expected to be available. Overtime at this amount was not supported by the XXXX XXXX or YTD income. This is why this income was not included on the modification application. In summary total income was determined at {$120000.00} ( Annual bonus plus Nationstar determined income ) rather than base salary of {$79000.00} plus bonus of {$9300.00}, or {$89000.00}. Based on the documentation and the above analysis, this is a {$34000.00} overstatement of annual income. It should be noted, my modification request did indicate my base income at {$84000.00} due to an expected increase which is supported on my supplemental paystubs with base of {$83000.00}. Effectively this would reduce this overstatement to {$30000.00}. For my spouse 's income, she is a XXXX and her salary is listed on the paystub. The base salary was not considered and Nationstar used the gross income which included a {$170.00} one-time income earnings adjustment to take advantage of a paid pre-planning event. Since this is not a stable income source it should not be considered as part of stable qualifying income. Again, stability of income was disregarded by Nationstar and they determined her income to be {$43000.00} rather than her actual income of {$41000.00} as indicated on her paystub. Ultimately, I appealed their income determination and this was rejected. Their rejection is on the basis that the supplemental documentation provided is considered new information. None of the supplement documentation was new information. The original income documentation provided did not support the income Nationstar used to qualify and the continuance of all income sources was not addressed by Nationstar. Based upon the response by Nationstar, this appears to be a systemically negligent policy and has likely negatively impacted many people requesting modification.

I 've requested a number of updates to XXXX County Judicial Court from the Federal government including my last request for legal assistance to remove a Judicial Court Judgement. I submitted under the following CFPB complaint # XXXX from the VA location at XXXX XXXX XXXX, XXXX, MN XXXX. However, after further review, allegedly CFPB assigned a file # of XXXX. I know my XXXX. Please check both CFPB files. I was XXXX at XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, MN XXXX address of my Federal/District Court Briefcase dated XX/XX/XXXX which included my CFPB user ID & password. Can you contact my email on file or telephone XXXX with password? CFPB staff wo n't allow me to access a critical Judicial Court file without an accurate User ID & & & password. Please email reply with a password change " authorization code ''??? These District Court Judgements which amounted to $ 20,000+ which prevented my ability to sell my home at XXXX XXXX XXXX XXXX, XXXX , MN XXXX for a reasonable equity profit. I must ask CFPB legal to intervene, & contact XXXX County District Court Administration to remove XXXX and XXXX from my credit bureau record and XXXX County District Court records. Consumer Complaint: My husband and I are the only borrowers on the mortgage loan associated with XXXX XXXX XXXX XXXX, XXXX, PA. We received several notifications today, XX/XX/XXXX that a new item has been reported on our credit. When he went into XXXX XXXX to find out what the new item was he found out the Nationstar Mortgage had tagged our home loan with a XX/XX/XXXX Bankruptcy filing from his parents who do not own, have never owned or been associated with the mortgage on the above property. Our credit scores immediately plunged about XXXX plus points with the derogatory remark as it is called. When he called the mortgage company they were told by Nationstar that the bankruptcy was for XXXX and XXXX. They live with us because they are XXXX however, they are not on the mortgage and have never been associated with the mortgage of this property. Based on that one negligent move by Nationstar we have had to do everything to notify the various credit agencies and CFPB because in one unjustified key stroke they devastated our credit that we have worked extremely hard to get back. This is the second time that Nationstar has done this to us and they do not have any repercussions we the borrowers end up enduring all the burden in making sure that everything is corrected and our credit restored to the way it was previous to this negligent act. Nationstar mortgage needs to have better practices and people in place to perform their duties. I want them to be held accountable for everything that they did and to make sure that everything and every credit bureau is notified of the wrong doing and that this needs to be removed and everything restored to the way it was prior to their negligent act. I am also going to notify each of the credit agencies however, I would like something in writing from Nationstar accepting responsibility for this wrong doing and requesting that all credit reporting agencies remove that derrogatory remark that was added on XXXX and restore our credit to the way it was before the remark was added. Consumer Complaint: Dear government agency, My loan account XXXX I have been being victim from Nationstar Mortgage for cheating as servicer. They have told me to help me to cooperative with them to avoid foreclosure. I have been cooperated with them and they lied and foreclosed my house today XXXX XXXX, 2017. They do n't even tell us that they will foreclose today. I just noticed today. I was so sad to me since they promised me to coop with them. I have been listed the house and did as they directed. They told me that they will have my house approved for short sale auction with XXXX and as long as I signed agreement with them. On the agreement they did say that if I agreed to let them auction my house at XXXX, they will suspend the sale date and help me walk through the process. However, the auction end yesterday with no bidder, they foreclosed my house today. I do n't think they do something fair to give me a chance to avoid foreclosure. I do n't even notice that the foreclosure sale is today too. I relied on what they said and promised.
