Consumer Complaint: The borrower is an XXXX with XXXX. He had arranged a modification of a mortgage which was excessive in valuation, and the prior bank, XXXX XXXX XXXX, refused to honor the modification agreement. Then, the current servicer, XXXX XXXX XXXX XXXX XXXX, as trustee, foreclosed on the premises and sold it to itself. On XXXX XXXX, 2016, the mortgage servicing agent Northstar ( I recall ), sent a letter that the balance of the mortgage including legal fees that was due and owing was around {$180000.00} ( it might have been $ XXXX ) as of XXXX XXXX, 2016. The Bank foreclosed on the property around XXXX in 2016 and the referee 's report relied on XXXX XXXX XXXX XXXX. 's representation that the indebtedness was around {$420000.00}. The referee reports selling it to XXXX XXXX XXXX XXXX. for around {$380000.00} for XXXX dollars and other consideration. After researching the land records in XXXX County, New York, I can come to no other conclusion than fraud in regard to this discrepancy. I sent a notice letter to the Bank 's current attorneys and received no response thereto. My client remains in the premises with his wife ; the Bank has filed an L & T petition to evict him in the XXXX Justice Court ( with there being improper service of the notice of petition and petition ), which date is XXXX XXXX. It 's likely that I will need to file a chapter XXXX bankruptcy with an automatic stay to preserve my client 's rights in his equity and possession of his and his wife 's residential premises. I am not certain the extent and nature of the probable fraud and of its civil nor criminal implications in its entirety, but it appears to me to be sufficient for a criminal RICO indictment. The borrower now has a social security card and green card ( although he was eligible for TARP modification without it ).

Consumer Complaint: I have a home loan with Nationstar Mortgage and they are not honoring an agreement I entered into with them on XX/XX/XXXX, which I have maintained, and they are threatening me with foreclosure. Per them, my mortgage had not been paid since XX/XX/XXXX to XX/XX/XXXX, which is not true and I have sent them copies of all of my cancelled checks, which they they processed. Each time I have contacted them via phone, I have been given the run around. First they claimed they never received the payments and then they sent me statement showing the checks. I have until XX/XX/XXXX to pay them the outstanding balance of {$8200.00}, otherwise, per the letter they sent me, they will foreclose on my home. True I was behind in XX/XX/XXXX, approx, {$28000.00}, however, prior to my bankrupcty being approved, they agreed to allow me 60 months to repay my arrears over a 60 month period at no interest and penalties in the amount of {$540.00}. per month in addition to my mortgage. a few months after I entered into this agreement, I found out from the county that my property taxes were not being paid from my impound account so I called them and they informed me that they were not paying them because I was behind in my mortgage. Subsequently, I wrote them and informed them that I had an agreement with them, and was paying my arrears over time and my mortgage payments included the impound fees, but they claimed no agreement existed and never responded to my written correspondence, but did pay the property taxes. Now they are trying to say I did not pay my mortgage since XX/XX/XXXX-XX/XX/XXXX, when they know that I in fact did, and sent them evidence supporting disputing their claim, all I get from them is untruths and the run around.

Consumer Complaint: We received a loan modification back in XX/XX/2011, we had a 90 day trial and it was official. If we paid our mortgage on time we would receive {$1000.00} off our principal mortgage every year for 5 years and at the end would get {$5000.00} off the principal mortgage. We had this agreement with XXXX who sold our mortgage to Nationstar Mortgage Company 3 or so years into it. Nationstar and XXXX both assured us that we would not have a change of any kind. We continued to receive the {$1000.00} credit every year. We continued to pay on time. Yesterday I was informed that we were not getting our {$5000.00} credit because Nationstar claims they did n't receive my " Real Estate Fraud Certification ''. We not only sent this form 3 times by regular mail, we finally were granted permission to email this form. Prior to the due date ( which in not on the form they mailed to us ) we were told we could only send it regular mail. Every year when we received this incentive, we did n't need to fill out Fraud Certificaton paperwork. However, we did fill it out several times and yesterday I was told that the research Dept decided we could n't get the credit to our mortgage. I asked the representative to please allow me to speak to a representative in that Dept. and I was told they are in a back room and I ca n't speak to anyone from that Dept. They do n't have phones, instead I must email them. I then spoke to ( Supervisor XXXX ID # XXXX ) who assured me she would fix this problem, yesterday she called to say we would not receive the credit. We have worked very hard to maintain our end by paying on time consistently and feel we are entitled to this incentive.

Consumer Complaint: Between XXXX and XX/XX/XXXX, and after I filed a CFPB complaint against Nationstar Mortgage, they allow me to submit a Second Loan Modification based on my hardship financial situation. I have submitted all the documents that they requested uploading them through its website. I contacted several times Nationstar Mortgage to get a resolution. On XX/XX/XXXX I spoke with a representative and he told me that the modification was denied without any explanation and I request a denial letter that they said they will email me and send on regular mail. Shortly after I received a letter dated XX/XX/XXXX ( attached ) stated that they are waiting for third party to complete the evaluation. I called again on XX/XX/XXXX and XXXX told me that they denied the loan modification and has sent the letter that I request again to have sent by email, XXXX told me that she was sending as an attachment on email. I have never received the denial letter. Instead I have received a letter notice that per agreement modification they will increase the interest rate per the schedule. Please see the attached letter. First at all Nationstar does not care about customer service, their phone system does not allow to speak with loan modification department. Nationstar does not care about clients that want to keep their home. They only care about increase interest rate and consequently their profits. I really doubt that they have a Loan Modification Department and or Underwriters that analyze documentation for loan modification applications.

Consumer Complaint: I have been with this company XXXX after I was bought out from XXXX. I have called them and also had to tape record them through out the years because of the issues witch I had with Nation star. It always seem to happen around the year of reanalyzing my escrow. I always found out they were over charging me I continually keep watch on my mortgage. On XX/XX/2017 I called I received a letter that my mortgage had went up because my taxes and insurance had went up, I then called the XXXX and my insurance and got it lowered down and I called them they told me my shortage was {$350.00} I then had a three way conference call with the insurance agency she assured them my mortgage insurance went down from {$740.00} to {$560.00} they said they would reanalyze the escrow and it would be lowered before XX/XX/2017 On XX/XX/2017 at XXXX I called a spoke with some lady name XXXX she replied that she was the escrow I asked her to connect me with the escrow department she replied she was the escrow department I told her she was with consumer services what is the problem she ca n't connect me she said she put in to have it checked with the escrow department I then explained to her I had already spoken with someone from the department she told me to hold and kept me on hold for two hours until the phone hung up. I have some recording of some of the communication from the other dates involving the conference calls. I also made them aware I was recording our conversation because of the misunderstanding past the years I 've been through. I 'm just asking that my information be corrected. Before XX/XX/2017 If not I should be refunded back not adjusted this could be avoided if Nation star does what they should.

Do you have this set up on Bill pay using the grace period? To cut down on my courtesy call volume, please tell me if you are going to continue to pay using the grace period. Consumer Complaint: I had to have an insurance check endorsed by Nationstar. I talked with a number of people, was put on hold, hung up on, finally talked to XXXX, who said to make up for poor service, would expedite handling and overnight to endorsed check to me so I would receive it XX/XX/2017. The post office said it was delivered Tuesday, XX/XX/2017. I called XX/XX/2017 as I had not received the check ; XXXX of the Loss/Draft/Correspondence department told me it had just been entered into their system on XX/XX/2017. XXXX called me at the end of her shift to let me know it had been overnighted on XX/XX/2017 ; I would receive it Friday, XX/XX/2017. When I 'd not received it, I called again, eventually speaking with " XXXX '' while discussing the issues I 'd been having with " XXXX '' on XXXX. XXXX finally admitted he had NO control over any of the processes, but he would call me with the resolution. He had " XXXX '' call me at approximately XXXX EST XX/XX/2017 to tell me the endorsed check was at XXXX and overnighted for delivery on XX/XX/2017. I asked specifically if the check would be delivered on Saturday, and was told yes. After repeatedly being lied to about the status of this, I checked XXXX. The check was NOT at XXXX, it was pending pick-up. It was not sent Saturday delivery, estimated delivery is Monday, XX/XX/2017. I messenged XXXX, who states she 'll get back to me Saturday after she reviews the issue - again. I called XXXX - the office is closed until Monday. I am sick to death of the constant lies, disrespect, waste of my time, etc. I have spent over 6.5 hours this week trying to get an honest answer about this, and I still do n't have any idea of what is going on.
