Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: On XX/XX/XXXX, I checked my Credit Bureau Scores and discovered that an alleged debt was " Parked '' on my credit reports without any notification beforehand. I do not recognize this debt or debtor. I have contacted XXXX and will be contacting the other credit reporting agencies to asked them to remove this from my consumer account as it has damaged me already by lowering my credit score XXXX points across all three reporting agencies. I have sent certified mail demanding verification of this debt as I am exercising my rights as a consumer to have a 100 % accurate credit report. 15 U.S.C 1692 ( g ) prohibits parking debt on my consumer report without first providing validation and/or verification of this alleged debt owed.

Issue: Problem with a purchase shown on your statement

Subissue: Card was charged for something you did not purchase with the card

Consumer Complaint: On XX/XX/2023, it has come to my attention that NATIONAL CREDIT SYSTEMS has included an unfavorable remark on my credit report, as indicated by XXXX XXXX. I want to assert that this account is fraudulent and was never associated with me. Upon conducting a thorough investigation, it has become evident that this account has been transferred or sold, and I bear no responsibility for this fraudulent activity. Additionally, the credit agency responsible for this collection has failed to verify its legitimacy, and no written communication, contact, or signature pertaining to this alleged debt has been provided. It is essential to recognize that a bill lacking a signature does not validate the debt, as anyone can send an invoice and falsely claim it as mine. In light of these circumstances, I must highlight that NATIONAL CREDIT SYSTEMS has violated my rights as a consumer under the Fair Credit Reporting Act ( FCRA ). Consequently, I am requesting immediate legal action to rectify this matter by removing the account without delay.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I received an email from my credit monitoring service that informed me that my credit profile was adversely impacted. I found that NATIONAL CREDIT SYSTEM had illegally posted an alleged collection account to my credit report. I have never heard of nor had an account with this company. My report shows that NATIONAL CREDIT SYSTEM open account was opened on XX/XX/2022 with a balance of {$15000.00}. I have no knowledge of this company, nor this alleged debt. I have never had any dealings with this company. By federal law, a debt collector is supposed to make contact with an alleged debtor and give them 30 days to validate or dispute before they move forward with collection attempts. I never receive a letter in the mail that gave me 30 days to validate or dispute this account. I never received a letter stating that I have an alleged debt with this company and owe a balance on that account. Again, I have absolutely no knowledge of this account with them. I, a consumer defined under 15 USC 1692a ( 3 ), understand that, under the FDCPA guidelines for collection agencies, they have to provide ( 1 ) legitimate proof that they are the original holder of this debt and can legally hold me responsible for paying this debt and ( 2 ) contractual proof of obligation or an assignment SIGNED from an officer from the original creditors corporation that I am supposed to pay them. 15 USC 1692g Sec. 809 ( b ) of the Fair Debt Collection Practices Act ( FDCPA ) grants me the right as a consumer to request validation of this alleged debt they say I owe. I never received a notice of right to dispute nor did I receive any information to verify that the alleged debt with this company belonged to me. If I would have gotten anything in the mail or phone call from this company before they illegally reported to my credit report, I would have respectfully requested evidence that I am the person they are asking to pay this debt and a contractual obligation that legally binds me to pay them this debt. Upon them receiving my validation letter by certified mail with return receipt, they would have to legally cease from collection calls, letters, and efforts and delete the account from my credit reports until they can validate this debt. But again, I never received such a letter about this account or phone call ever in the mail because it was never sent. In order for them to prove that I received it properly, the proper letter should have been mailed certified mail with return receipt or by some form of proof of postage that would require my signature. And if the company did mail anything to me, where is the legal proof of my signature stating that I received it? Where is the return receipt or postage signature showing that I received it and signed for it? But again, I never received any sort of mail or package. They have illegally posted and reported to my credit file without adhering to the FDCPA laws. Im not sure if this company is a scam, but I know that this company has broken FCRA and FDCPA laws by reporting an alleged account to my credit report without informing me through mail or phone and I did not receive notice of right to dispute nor did I receive any information to verify that the alleged debt belonged to me. My credit has dropped tremendously in the middle of making a major purchase. Please help me get this account removed immediately. As a consumer, Im publicly publishing this descriptive complaint on consumerfinance.gov so that others can learn from my experience and so that this government agency can use this information to help work with other violations and complaints from consumers regarding this company. As a consumer defined under 15 USC1692a ( 3 ), I'm also preparing to sue under the FCRA and FDCPA because of the numerous consumer law violations committed by this company, damages to my credit and opportunity costs with making a major purchase, and business ventures that must be delayed until this illegal account is removed. It should not be my responsibility to submit proof that this debt does not belong to me. It is the responsibility of the debt collector to submit proof that they can legally collect on the alleged debt and legally report to the credit agencies. As of this date, they have failed to do so. Issue: Written notification about debt

Subissue: Didn't receive notice of right to dispute

Consumer Complaint: National Credit systems nor the original creditor XXXX XXXX XXXX ever sent me anything in the mail in regards to this debt. I never knew about these alleged charges until they appeared on my credit report. National Credit systems won't investigate this debt thoroughly. The supposed Itemized list sent to the collection agency was never given to me nor was I ever aware or notified of a balance owed. I did not get the opportunity to speak with the original creditor about this alleged debt or why I was being charged anything. I never got the chance to dispute this with the original creditor or even try to go to court for this alleged debt. I never received any pictures documents etc before it just appeared on my credit report. Had I have not tried to dispute this information I would have never knew it was allegedly owed. The original creditor XXXX XXXX XXXX had my forwarding address email as well as my phone number. And they never tried to get in contact with me for this alleged debt so that I can try to pay it off or dispute it directly with them. Before we'll rain from this unit. I was required to fill out a notice with my forwarding address as well as email and phone number. So they do have those documents on file. National credit systems just keep sending an itemized list provided by the original creditor however, as I stated before, I was never given that information. It has also been passed the time frame in which this debt can be collected via the Colorado security deposit law. Overall had I have known about this debt before hand I could've had a better opportunity to get a handle on it.

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: XXXX XXXX ( appartment building ) was uninhabitable due to a cockroach infestation. Efforts were made over months to correct the problem to no avail. I terminated my lease legally according to AZ XXXX for uninhabitable conditions. XXXX issued a fraudulent move out statement with over {$4000.00} of early termination fee and insufficient notice fee and other fees. Ironically their own statment proves they knew about the cockroach problem ( pest control charges ), and adequate notice was given ( notice date ). They even kept rent paid after the move out date ( that should have been returned ) to offset against these fraudulent charges. Then they submitted the charges to a collection agency that reported them to the big three credit agencies just weeks after move out. If you search XXXX reviews for XXXX XXXX apartments in AZ, you will find many more reports of cockroaches and illegal tactics.
