I have asked the orginal creditor multiple times for someone to please provide an explanation of these charges and have yet to get an answer. i have reached out to the orginal creditor on several occassions verbally and via email.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: XXXX XXXX XXXX XXXX threatened to damage my credit by putting a charge on my credit reports. They wanted {$540.00} for falsely accusing me of having a pet while living there. Just after moving in I sent several emails to the office stating that they needed to change the carpet due to pet odor and hair. My daughter is highly XXXX! My daughter was not able to stay with me very often because of this issue. When I finally was able to move out since they never corrected the situation, I was charged with {$540.00} for pet stains. I refused to pay so they sent the bill to collections at National Credit Systems. XXXX XXXX XXXX changed management companies several times. Many other clients have the same complaint against them, unlawful charges upon moving out. I have contacted both XXXX XXXX XXXX and National Credit Systems asking for a copy of the lease where I PAID A PET DEPOSIT or any form of verification ( picture etc ) of a pet!! I will not pay for something I did not have. They were given the time to comply with my request and have not. Therefore the collection should have been removed from my XXXX and XXXX credit report. I have hired a lawyer and will sue since they have not followed the law. XXXX XXXX

Subissue: Attempted to collect wrong amount

Consumer Complaint: Original Creditor : XXXX DBA XXXX XXXX XXXX DBA XXXX XXXX XXXX XXXX XXXX XXXX : National Credit Systems XXXX XXXX XXXX, XXXX, GA XXXX Agency Phone Number : XXXX Information about rental dwelling : Address in question : XXXX XXXX XXXX XXXX XXXX Apt # XXXX, XXXX, KS, XXXX Move In Date : XX/XX/XXXX Monthly Rent : {$570.00} Lease Terms : 13 Months Satisfied Months : 9 Remaining Lease : 4 Months Remaining Contract Amount : {$2300.00} First reported amount to collections : {$3600.00} Important information related to living conditions provided during move in : This unit was leased as a Joint Account and at the time we took possession of the dwelling we were handed an article by the office staff titled " Mold- How to Make Your Home Mold-Free and Keep It That Way '' and told that there had been limited cases of non-threatening mold in some of the units. We were not presented this information until after we had signed the lease agreement. Information related to violations of Kansas Statute Chapter 58 Article 25 : During the course of occupation of the dwelling on 5 separate occasions the management office of XXXX XXXX apartments attempted to fraudulently collect fees and additional payments by leaving notices on our door that rent had been paid past due, not at all, or with insufficient funds. I had to personally dispute these allegations and all were overturned based on physical evidence I was able to produce at the time via bank statements and check images. We were regularly harassed about our rent payments and our maintenance requests were intentionally ignored by the property management team until we " smartened up and did what was good for us '' or " learned the management was n't to be XXXX with. '' This is a major ethical violation pertaining to Kansas Statute Chapter 58 Article 25 and many subsequent Kansas Laws for the Fraudulent and Unethical charging and collection of debts. Major event leading to termination of lease : During the course of occupation of the dwelling we discovered a significant black mold infestation and had become dangerously ill and when we informed the property management team we were told " tough XXXX we told you when you moved in how to take care of it yourself ''. Pursuant to KS 58-2559 " Material noncompliance by landlord ... '' We submitted in writing, on XX/XX/XXXX, that we would be vacating the unsafe conditions of the dwelling within 30 days if the property management team continued to refuse to bring the dwelling within health and safety compliance to which we received our noticed crumpled and stapled to our door. We vacated the dwelling and left it in the same condition in which it was presented to us ( which I still to this day have photograph evidence of ) and left a forwarding address for a final bill. Failure to comply with FDCPA guidelines on reasonable collection practices : XXXX XXXX XXXX ( Landlord ) failed to make the following actions applicable to Kansas Law. 1. Mitigate loss with reasonable attempt at re-renting. 2. Produce documentation that clearly conveys all activities related to re-renting. 3. Offer the dwelling at a fair market value and within health and safety code. 4. Participated in an " illegal eviction '' to try to monetarily gain. 5. Collected double rent. Additional areas of concern. The landlord failed to produce a final statement. The landlord refused to produce an itemized statement of charges after the lease was terminated. The landlord failed to make a " reasonable attempt '' to collect or communicate the debt before reporting it to credit reporting agencies. The landlord failed to provide documentation related to the agency that would be contacting me about the debt. The landlord made false claims, misrepresentations of legal action, and XXXX XXXX intentionally made false and deceptive claims that he would exonerate my liability to this property on multiple occasions. The collection agency involved, National Credit Systems ( Agency ) also violated FDCPA during the course of the last 5 or more years by doing the following. The agency declared it was a legal firm or attorney. The agency refuses to produce documentation or a statement of charges. The agency has contacted me on a employers phone line, after being informed it was my employers phone number. The agency has threatened to publicize my debt. The agency has threatened to publicly embarrass me and defame my character and credit profile. The agency has called me in the middle of the night. The agency has threatened to tell other creditors not to lend to me. The agency has tried to belittle, degrade, embarrass, berate, and intimidate me into paying a debt that I have disputed. The agency has refused to respond to disputes requested by legal representation. The agency has intentionally and knowingly destroyed documentation or evidence of my interactions with their agents. Inability to seek legal resolve or representation : Once I had begun to understand the damaging nature of this claim I sought legal assistance to help me contest and refute these claims in a court of law. I called over 100 licensed attorneys and every single one of them told me that they either could not represent my case because of a conflict of interest with XXXX XXXX XXXX XXXX, XXXX, or that they would not represent my case because of the blatant and unconscionable corruption of the XXXX XXXX and their dealings with the legal system in the State of Kansas. This debt, which I believe is unsubstantiated, invalid, and illegitimate based in law, has defamed my credit character and caused me significant pain, suffering, and financial hardship. I believe that both the Landlord and the Agency should be held accountable for their actions and forced to remedy these horrible acts.

Consumer Complaint: The reason for this email is in regards to a dispute that I have with XXXX XXXX XXXX XXXX in XXXX, XXXX. I moved in on XXXX XXXX of 2016 and occupied XXXX. I had the best signing experience I think any renter could possibly have and even though I do have a rather unsatisfatory pending issue, I can say that XXXX in the Leasing Office was beyond amazing. I believe in giving credit where it is due. I enjoyed 7 months in my apartment and had minimal issues while residing there. Unfortunately, my employer decided to relocate me to XXXX, XXXX and i have been here since. I submitted the requested paperwork to prove I was being relocated because my job was being moved ( eliminated if I stayed in XXXX ), and I was in correspondence with the property manager the entire time, making sure to update them on dates, issues, or even payment options for the month of XX/XX/XXXX. I moved out on XX/XX/XXXX, and turned in my key that day. I checked in with the property manager to see if there were any loose ends to be tied up before my drive to XXXX. She told me she would submit the required paperwork ( The letter from my Human Resources Department reflecting my relocation date and initiated job relocation ) to corporate and I was fine. She even told me not to pay for the month of XX/XX/XXXXonline ( like all my previous payments ) as she did not want me to overpay because I was moving out before the month began. Since then I had not heard from the property manager or XXXX. Nearly 8 months after my departure and closure with XXXX I get blindsided with a bill from a credit collection. I asked the rep what the bill was for and she stated a fee because I left without notice. I was completely blindsided and a little set back. I had requested all information regarding the order be sent to my forwarding address had given XXXX and have yet to receive said bill, however the collection account has shown on my credit report. Im completely dissatisfied with the way this whole matter has been dealt with. The property manager, assistant property manager and XXXX all had access to my email/phone number and forwarding address. Im not sure how or why no bill was sent to me before handing this matter to another 3rd party. I would like some type of answer or resolution to the matter as if I was given notice beforehand I would have made accommodations to reflect the balance. I even emailed the property manager the day before my departure and day after to ask if there were anything I needed to resolve before I left and both times I received not word.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: The beginning of last year I received notification from this agency. I immediately called and spoke to a representative and stated I am disputing the collection. I asked for proof of validation. 2 Weeks later I received the same demand for payment letter with no validation. I then requested validation again in writing. I no longer received any form of communication from this agency. Instead they put the collection on my credit with a memo saying I dispute the collection. The address provided on my credit for the business is XXXX XXXX XXXX XXXX, XXXX, GA On X/XX/2017 I requested verification through the Credit Bureaus. I received no response so I requested again on X/XX/2017. This time the collection was removed from XXXX because the company has yet to validate this debt of {$3200.00}. On X/XX/2017 I filed a complaint with the BBB. Complaint # XXXX. This company failed to respond to the complaint. It has been well over 30 days since my last request but over a year and a half from my initial request. They have no proof of this debt. I have no contract with this company.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: I have disputed this particular debt with National Credit Systems twice in XXXX and XXXX. They continue to send the same letters ( word by word ) and fail not to respond to any of the questions I included in my dispute and is stating this account is paid in full but is negatively impacting my credit report. First and foremost, I do not recognize this debt AT ALL and not aware as to why they are collecting. In both of my dispute letters, I have asked for the following : *The original application or contraction *Any and all statements allegedly related to this debt They have FAILED to provide any of the documentations in both dispute letters. This collection is inaccurate and is a MAJOR VIOLATION of the FCRS and FDCPA. I have asked for this debt to be deleted due to non-sufficient proof, but it is still negatively impacting my credit score and not able to provide a better life for my family. Please investigate this and I demand for this information to be deleted as quickly as possible.
