Consumer Complaint: Yesterday ( XX/XX/18 ), my son and I both received phone calls from National Credit Systems , Inc saying that we needed to call immediately regarding an account for my son. He and I called together right away and my son gave them permission to speak to me since he is XXXX years old. We were told that they had just taken over an account for an outstanding balance from when my son moved out of his apartment in XXXX, Florida in XX/XX/2018. We were told that the full amount of {$2500.00} had to be paid that day and that if it wasnt my sons credit would be negatively affected. After some conversation with the rep ( XXXX ) from National Credit Systems, my son and I both thought we heard her say that the account could be settled for {$1300.00} if I paid right then, so I gave her my credit card information. When she came back on the line to confirm, she told me that she had charged my card for {$1900.00}. However the miscommunication happened, that was not the amount I thought I was agreeing to so I told her to please void the transaction. First she told me they were not able to do that. When I insisted, she transferred me to her supervisor ( XXXX ) who said that he could void the transaction, but if the account was not paid in full that day that my sons credit would be negatively impacted. When I asked about payment arrangements, he said that he would not authorize any payments on this account since I was making him void the credit card charge and that my sons credit was going to be negatively impacted by this. My son called back today ( XX/XX/18 ) to try to work out a payment plan and was again told that payment in full was required and that he was going to ruin his credit if he didnt pay right then. He asked for something in writing showing the exact amount and stating that payment in full was required and was told that they dont do anything by mail or email and that they will only handle accounts over the phone. I dont know how any of this is legal, but even if it is, this certainly isnt fair business practices.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I have been receiving many harassing phone calls from spoofed numbers, from someone identifying themselves as XXXX XXXX from National Credit Systems. They have stated that they are attempting to collect a debt. They have also called some of my family members from spoofed phone numbers. The number that they leave to return calls is XXXX. I received a letter in the mail yesterday that they are trying to collect a debt from an apartment complex, XXXX XXXX XXXX XXXX, I lived in for 6 months in 2017, in XXXX XXXX, TX. The alleged amount owed is {$1000.00}. They have threatened to report to the credit bureaus. Additionally, they sent a separate letter to my husband for the same amount. On the NCS website, they have documentation showing that XXXX XXXX XXXX XXXX owed us the amount they were trying to collect. This debt is not real, as I have proof of a good standing with the apartment complex upon move out and proof that my security deposit was returned. I have been unable to reach the apartment complex yet, but used their website 's " Contact '' function to send an email demanding answers. They call many, many times a day, spoofing their number to be similar to mine. I have resorted to blocking each number, and have never answered the phone. I will take whatever legal action is necessary, as this is unacceptable.

Consumer Complaint: I was contacted on XX/XX/XXXX on the phone by National Credit Systems , Inc. telling me that I have a debt that they are trying to collect. During subsequent calls I repeatedly asked the representative from the company to mail me information and a return envelope so I could send a check to them but she never sent me anything and told me the only way to pay would be by giving her my credit card information over the phone or my bank information. This is after repeatedly verifying my identity over the phone by giving the caller my address which she confirmed she had. XX/XX/XXXX I received a letter, again with no information about how to mail payment, saying the debt would be reported to the credit bureaus. I was never informed I could dispute the debt and the untimely communication with National Credit Systems inc. gave me no choice but to give my credit card information over the phone because of threats from the representative who again refused to mail me anything about this debt. I was never trying to get out of paying the debt but I never had any physical proof that the debt was truly owed or that the people contacting me were not scammers.

Consumer Complaint: Attn : XXXX XXXX, XXXX XXXX and XXXX Please see attached supporting documents. National credit systems INC has falsely accused me of debt that does not belong to me. An application of a lease does not legally bind one responsible for debt unless a legal lease was issued and signed between lesser and lessee. XXXX properties can not produce an official copy alleged lease because XXXX properties never legally issued a lease agreement in my name. Falsely stating there is a judgment against me is a complete lie. If the judgment was issued for my alleged lease the Lessor would have contacted me year and a half ago. It will also be reported to the credit bureaus. This company purchased my old records to use Poor unregulated tactics to have me given in to their fraudulent debt. This company has over XXXX complaints on Better Business Bureau with additional XXXX complaints within the last 12 months, and terrible reviews on XXXX. The only person I will allow legal communication with is XXXX XXXX, XXXX XXXX the department managers and XXXX the department supervisor to notify me via phone or by mail to let me know the collection account has been removed from both credit bureaus. This error has affected my financial health tremendously. I have an active investigating with the credit bureaus and also with my local police department. XXXX XXXX from XXXX XXXX XXXX does not have the legal right to contact me via phone, email or by mail after receiving this notice. If National credit systems INC does not remove their collection error off Equifax within 30 days from receiving this letter. My attorney will then being the legal process to rightful sue this company for fraud, defamation, legal fees and emotional stress. Thank you, R L

Consumer Complaint: On XX/XX/XXXX, I applied for an apartment and got denied due to charges from a previous apartment that I was co-applicant on back in XXXX being on my credit. I never received any notice from the apartment complex, not the collection agency in regards to thee charges. Needless to say, these charges have now accumulated almost {$2000.00} in fees with this collection agency. I contacted the collection agency ( the apartment that ran my credit gave me ) to find out from their representative that they show in my file that I was never contacted and they never tried to contact me. My phone number has not changed. The address they have on file is my mother 's address, which I have been home to see on numerous occasions and had no mail from neither the apartment complex, nor collection agency. So, the collection sends me a break down of the charges. The dates and fees do not make any sense. If I gave notice on XX/XX/XXXX, and my move out date was XX/XX/XXXX, why are there legal fees charged to the account on XX/XX/XXXX. There are charges of written fee and certified letter ( that was never sent cause collections already confirmed that no one tried to contact me ). Also, there are charges for water for XX/XX/XXXX, rent ( vacant rent charge ), washer/dryer, and trash removal for XX/XX/XXXX. How are these charges legal charges when notice was given on XX/XX/XXXX for move out on XX/XX/XXXX. Now they are stating that if I pay half of these charges, they will give me a letter stating that I am paying so I can give to the apartment complex I am trying to get into now, but these charges are not truthful.

Consumer Complaint: Re : XXXX at XXXX and National Credit Systems , Inc. Complaint Dear Consumer Finance : I am writing to make a complaint against XXXX at XXXX XXXX for failure to rectify and create habitation to unit. For the past few months, I have filed several complaints regarding the conditions in which I was forced to endure inhabitable unit. The landlord had refused to make repairs and rectify nuisance. The law states, Texas tenants can terminate lease or deduct and repair for necessary repairs. The tenant has a reasonable right to enjoy a place. The landlord is obligated to maintain property in suitable condition for the purpose for while it was leased. Most importantly, After filing 11 complaints from XX/XX/XXXX to XX/XX/2015, in regards to ceiling leaking water overhead in shower while in use, tub does not drain out during shower, shelving is loose/detached, toilet leaks, multiple indoor pest such as centipedes, ants, spiders, roaches, flies and termites, kitchen stove burner sparks and backfires during use, glass sliding living room door blinds chain/ cord/ wand broken when I moved into unit, tiles and paint peeling off shower wall and tub, nonstop leaks, electrical and lighting outlets did not work, refrigerator parts/ access missing/ broken, excessive noise levels originating from unit ( heard overhead in master bedroom ) due to neighbor in upstairs unit arguing and fighting constantly. Ive called police numerous times to report XXXX XXXX and notified the rental management of this issue. As per the rental agreement and the landlord failed to remedy these issues after receiving notification. I had no choice but to submit notice and vacate unit. Due to the ongoing stress and being unable to get proper rest it worsened my history of atrial fibrillation and caused me to make costly emergency room visits. Furthermore, I dispute the validation of the debt {$2600.00} and firmly believe I do not owe XXXX at XXXX XXXX anything. Due to several violations stipulations of the rental agreement and my right to terminate the lease due to inhabitable conditions and my right to reasonable enjoyable place to live. Thank you for your prompt action in addressing these concerns. Sincerely, XXXX XXXX

Consumer Complaint: I was checking my credit and noticed that there was a debt collector agency on it by the name of National Credit Systems Inc. dated XX/XX/2018. I immediately called the landlord XXXX XXXX in XXXX XXXX, Texas that the debt came from to see what it was for and wanted to know why I did not receive a notification letter because I never received one from the collections agency or a call before the debt was placed on my credit. I could not reach them so I called management company XXXX XXXX and spoke with someone in the billing department and she claimed the assistant manager XXXX at XXXX XXXX claimed a letter was sent but returned per email dated XX/XX/2018. This is not true and I do not believe it. I gave them all of my forwarding information and I never received anything. Not sending a notification to tenant regarding debt is a violation of Texas tenant law because the notice should come within 30 days after departure which was XX/XX/2018. Texas law sec 92.109. XXXX sent me straight to this collections agency. The collections agency sent me a letter on XX/XX/2018 4 months after it was placed on my credit and 7 months after my departure from XXXX. XXXX XXXX from National Credit called me in XX/XX/2018 on a recorded call and said that she will send me another letter with verification to assist me in disputing the debt. I never received the verification letter from National Credit Systems , Inc. She immediately sent me to a third party. I called National Credit Systems and asked where was the letter and they said I had to talk to the third party company. This was another violation Texas law sec 92.110. This was wrong and should have followed proper protocol. The debt collection company violated me here and I never got to dispute with them if I needed to. They also placed on my credit that I did dispute the matter which is false and manipulative. The collector made an improper move here that was not right. I never ever received anything after the first letter. I think it's unfair to pay for something without verification as to what it is and with so many scams out there when this happened I didn't trust the situation and wanted to call the authorities because I feel that National Credit Systems , Inc. and XXXX XXXX have violated the Texas state tenant law here with how this was all handled to get money and that the debt was bogus. I also feel that this situation was manipulated on purpose due to personal issues with the assistant manager XXXX. I feel that she was manipulative and made promises that she did not keep. This was a new management company that came in under this lease and I assure you that the old management company would have never done this. This is improper treatment and I feel totally violated.
