Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: In XX/XX/XXXX, I leased a rental unit from XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX. They imposed a MANDATORY rental ( insurance ) bond that had to be paid by me ( tenant ) in addition to a full {$1200.00} security deposit ( one month 's rent ). The rental bond was purchased through XXXX for {$350.00} and it's purpose ( as told to tenants ) is to protect us and so XXXX XXXX can be reimbursed through the bond in the event that I did not fulfill my lease or damaged property. I was told if a claim is filed and paid XXXX would seek reimbursement from me prior to forwarding to a collection agency. My lease ran from XX/XX/XXXX - XX/XX/XXXX. I moved out XX/XX/XXXX XXXX XXXX XXXX after providing a 30 day notice. Due to XXXX - family members lost housing and landed on my doorstep. Management confirmed it would be a violation of my lease for them to stay at my apartment so I had no choice but to lease a bigger rental space. I moved on a weekend. There was only an assistant in the office who stated I would receive my ending balance or refund due in the mail. I was expecting a refund since the apartment was left in mint condition ( I have video ) and I would only owe pro-rated rent for my XXXX days in XXXX. In XX/XX/XXXX, I discovered a collection for {$3400.00} on my credit report. My complaint today is for the following reasons : 1. Property failed to contact me or mail/send a Notice of outstanding balance due. They were provided with my forwarding address. 2. The required claim was never submitted to XXXX to recover outstanding balance. The property was legally obligated to file a claim for any balances owed otherwise why mandate tenants buy the bond. 3. The outstanding balance was sent to a collection agency/reported to all credit bureaus without allowing me the opportunity to be made aware of, pay or dispute the alleged balance. 4. XXXX XXXX charged an unfair and excessive " Late Notice Fee '' of {$2400.00} as a fraudulent attempt to keep security deposit ( lease requires 60 day notice ). Pro-rated rent and utility totaled approx. {$1000.00}. XXXX did not apply any of the {$1200.00} deposit paid towards the balance. My unit was immediately rented after my move-out so the late notice fee charged is not justifiable. 5. XXXX XXXX mandate tenants purchase these rental bonds for their protection in case of lease breach or default but do not file claims because it results in a kickbacks/profits for the property if minimum claims are filed.

Consumer Complaint: I applied for an apartment at XXXX XXXX on XXXX there was an app fee of XXXX dollars for me and an app fee for XXXX dollars for XXXX XXXX XXXX this was paid with a check for XXXX dollars. see attached. XXXX XXXX asked for a check for a deposit of XXXX dollars that would only be cashed if I was approved for the apartment. Per there application they had 10 days to deny or approve the apartment. They denied, then on XX/XX/2020 XXXX XXXX days after I applied they attempted to cash this check. It is clear this was set aside for deposit and instead of mailing the check back or destroying it they had misplaced it, found it, did not know what it was for and just cashed it. but this check was declined at this point. Please keep in mind the cashed and cleared the XXXX dollar check for the two app fees on XX/XX/2020. I have tried to call them and ask them for an itemized bill numerous times. i have attempted to email them as well. If I am missing something and I owe them XXXX dollars I would like to know why and what for. the refuse to provide that for me. to make matters more difficult the collection agency or there company has been sending the bill to the wrong name. the have been trying to bill my XXXX year old daughter and there fore i was just recently made aware that this is on my credit report. ive asked them to provide a itemized bill and they have not done so. ive asked them to take it off my credit report because i do not owe that money and never have. i have also never received a bill from this. I have done everything possible to resolve this situation and would have no problem paying XXXX dollars if I owe XXXX dollars. but as of yet i fail to see where they could believe i owe them money. if so all I am asking for is documentation and I will pay it. but given that they have refused to provide that and that they have been attempting to bill my daughter I have asked this be removed from my credit report. I would suspect XXXX XXXX has a tendency to operate like this and most people give in and just pay because it is such a small amount of money.

Consumer Complaint: I moved out of XXXX apartment on XX/XX/XXXX and paid all my utilities and closed my utilities account. When I saw there is a debt collection on my credit report, I reached out to National credit systems ( NCS ). NCS said that I did not pay utility bills and the documentation they provided says that payment activity and move-out date was XX/XX/XXXX. I asked them to provide any proof to prove that I stayed at XXXX apartments during XX/XX/XXXX but they did not provide any details and also they did not give me any contact details to reach out to Utility services. Even though I gave a call to first billing services where I used to pay my utility bill during my stay in XXXX Apartments and representative said that all payments are done and account is closed long ago. NCS is fraud and very rude on phone calls and not even trying to resolve the issue that they fraudulently reported on my account.
