Consumer Complaint: . I was going over my consumer report. I saw that I had a collection by National Credit Systems, so I sent a debt validation according to 15 USC 1692 ( g ) ( b ) to verify the debt obligation. Also, included in the letter was a cease and desist all reporting notice. They responded with a letter saying that they adjusted the debt due to their investigation which brought the alleged debt from {$4500.00} to {$2000.00}. Which mean they were furnishing misleading information according to the FDCPA in the beginning. Furthermore, attached to the letter was a summarized resident ledger from the alleged original creditor XXXX XXXX XXXX showing that account was paid off on XX/XX/19. In North Carolina, the statute of limitations for automobile loans, installment loans, credit cards and promissory notes is three years. The account # XXXX is still showing on my consumer report. It is a fact, National Credit Systems has been reporting false, inaccurate information on to my consumer report which has caused me and my family severe harm and damage my reputation due to negligence.

Consumer Complaint: My name is XXXX XXXX XXXX XXXX. I am filing this complaint against your company for the fraud you have committed against me. I did not give NATIONAL CREDIT SYSTEMS any permission to use any of my identifying information to commit mail fraud by contacting me about an alleged debt they claim I owe. NATIONAL CREDIT SYSTENS has also committed aggravated identity theft by sharing my social security number with the credit reporting agencies without my permission. No one can use my social security number but me. It was given to me by the government and no one else can use it without my knowledge or written consent. I am demanding a cease and desist of all illegal activity, any communication of this and any alleged debts until NATIONAL CREDIT SYSTEMS can provide me with sufficient documentary evidence that I gave them written permission ( a signature on a contract is not written permission ) to share my personal information such as my social security number and to report any transactions on my consumer report. If this documentary evidence can not be produced and NATIONAL CREDIT SYSTEMS continues to report transactions between my self, the consumer, and the person making the report, I will file for litigation for actual damages caused and NATIONAL CREDIT SYSTEMS will be held criminally liable for aggravated identity theft pursuant to 18 USC 1028A, extortion, theft by deception, securities fraud, and mail fraud. Upon receipt of the documents herein and of this notice, you are herby notified Pursuant UCC 1-202f. Your prompt attention and response are both requested and required. I have filed an identity theft report with the FTC. Per 15 U.S. Code 1681c2 - Block of information resulting from identity theft : ( a ) Block Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of Furnishing this alleged debt to my consumer report as a means of coercing me to pay is EXTORTION. Consumer Complaint: I completed my obligations and arrangements made with an apartment community ( Side Note : this community was poorly managed, run down on the inside with mold, roaches, water leaks, along with several other safety concerns and issues. They would say they came in and fixed issues while I was working during the day but the leaks, mold, and several other issues were still there when I would return. This was not a livable habitat nor legal, but I still stayed and paid my rent for fear of retaliation. I was in constant contact with the office, as well as having to physically go into the office to pay rent every month. They did not accept credit card payments in office, online payments of any kind, have a drop box, etc. The office was open at random times, never during their posted hours, and they would constantly charge me additional 'late fees ' due to no one being in the office to accept my rent on the first of the month ). They knew the day I was moving, we discussed it, and it was about 1-2 weeks earlier than the lease officially ended. They we're fine with it and changed my listed move out date with no problems. This was NOT a lease termination or eviction, and I was told there would be no 'termination fees ' associated with moving out. Months later, I check my credit and see a collection account that was sold to an attorney/collection company. This collection included trumped up, fake charges like 'lease termination ', 'damages ', and other unethical charges. They had ALSO kept my move-in deposit without communicating with me after the move, nor at the time we discussed it. This deposit was 1 full months rent plus the utilities they include in rent ( {$930.00} ). I NEVER received any notice of collections until I noticed it, and disputed this fraudulent debt. After I disputed, an attorney/collector sent me some papers from them and the former apartment community. These papers are just copies that have these fraudulent charges added to them. That is the only response I get, are these copies that were randomly created after I moved out. Although anyone can create paper work, edit a pdf by adding extra content to the paragraph body, or signature, which is extremely troubling ; I contacted the collection agency, I wrote them a letter, and I left them a message. I stated how ridiculous and troubling this collection was to me, and that I was even willing to pay the remainder of the month I moved out ( I offered {$400.00} for about 15 days ) to make this go away. I have not heard back via email, letter or message, and now I just need this removed and fixed please. This has to be taken care of ASAP, because I have to find a place to live for me and my children. My current lease is expiring next month and the home is being sold. XXXX and XXXX have since removed the debt from my report I believe, but XXXX ( there document upload service NEVER works on the APP, and they will not let me dispute again ) has not, and refuses to actually listen to what's happening and remove this. It is hindering me from being able to shelter my children, and rent a home or apartment for us to live in. I have no one else to help me, and this feels like a gross injustice. Please assist.

The XXXX Judicial Court, in XXXX XXXX, MO, was not finished with the case when XXXX XXXX XXXX transferred my account to a collection agency. Consumer Complaint: Debt Collector National Credit Systems ( NCS ) claimed that I owed an Apartment Complex in XXXX TN rent without providing any supporting documents. XXXX also reported to the XXXX Credit Agencies about this faulty debt collection account, which caused major damage to my credit score. I called XXXX and told them that I never lived in that apartment because I have been living in CA. I sent out a debt validation letter to XXXX on XX/XX/2022 asking for supporting docs and how the debt is tied to me. XX/XX/2022 I received response via mail from XXXX. The supporting docs they have is a copy of lease agreement. I read through the lease agreement and did not find any ID or SSN that was pointed to me. The tenant used my name and initials. The signature was e-signature instead of handwriting signature. This is not sufficient to claim that I owe the debt. XXXX should have done a thorough investigation before they claim debt and report to my credit account to ruin my credit score. To summarize, without sufficient evidence, this company tries to collect debt and ruin people 's credit. Based on some e-signature, they turn me an innocent people into a victim and a debt owner. This is ridiculous. Anyone could use someone else 's name and forge the e-signature to get a lease. Is it enough to collect debt from people who use the same name? No. I have reported ID theft to the police office ( case card attached ).

There is no question that you willfully violated my rights and that I could bring charges against you immediately. However, I am assuming this has been a terrible mistake on your part and that you will take appropriate steps to enlighten yourself and your staff of such dangerous actions. I checked my credit report and you have willfully reported an unverified and disputable debt to the credit bureaus. which is a violation of the Fair Credit Reporting Act. I will state again in this certified complaint that you have failed to verify the debt, you have provided no proof of this alleged debt This is in response to the CFPB your company or CFPB department provided to me and the lack of validation pursuant 15 USC 1692g. Florida Office of Financial Regulations states that Per Federal law, every debt collector must send you a written validation notice telling you how much money you owe within five days after they first contact you. This notice must also include the name of the creditor to whom you owe the money, and how to proceed if you dont think you owe the money. ( ITS BEEN MORE THAN 6 Months AND I HAVE NOT RECEIVE ANYTHING FROM THIS DEBT COLLECTOR ) To whom may concern I contacted the Attorney General of Florida, I reported the fraud from your company with the FTC. If you default again I will contact the Office of Financial Regulations, file a police report due to Identity theft by your company and File a complaint with the XXXX XXXX XXXX Please be apprised that you are in direct violation of the Fair Debt Collections Practices Act. In my opinion you have violated at least three sections of this act by : a ) Failing to validate a debt as allowed to the debtor under 15 USC 1692 ( g ) Section 809 ( b ) Communicating with a debtor after receiving a cease and desist certified CFPB complaint under 15 USC 1692 ( g ) Section 805 ( c ) Harassment of alleged debtor under the " abuse & harassment '' subsection of the statute, 15 USC 1692 ( g ) Section 806 ( 5 ) ) You proceeded to say you validated the debt which is NOT considered a " validation of debt '' by any means.
