Consumer Complaint: M & T Bank and its affiliates sold my family 's home under letters of false documentation. As the owner of the property I need your assistance in the return of our family home. The did not have the authority to sell our home under an ASSUMED only contract or XXXX contract they claimed to have on your home. They never provided any contract to our family and our family never signed any contract. They sold our home under a deceased person 's name only under ASSUMPTION it was theirs ' to sell. Please contact this company for our family and attempt to obtain the relevant documents necessary for a company to use a non judicial process of collection of a debt. We did attempt to pay this outstanding amount but never authorizing our home to be used as collateral for that outstanding debt. This company should be held accountable and restitution is due for their deceptive false acts and misuse of the nonjudicial system set in place for valid financial institutions and be held accountable in their creation and misrepresentation of actually possessing a valid XXXX on our land as claimed when non of the sort is seen of record and for their creation and use of non legal binding documents signed by their own affiliates to do it. This was done in a discriminatory manor to a service member serving in the XXXX XXXX and XXXX overseas, violating the XXXX members relief act, this was done because she was unable to defend herself and her rights during that time away from the property only in an effort to possess and control our property for their own use. They have violated the entire family 's U.S Constitutional rights to life liberty and freedom during a pandemic. Violated the Fair Housing Act, FHA rules an regulations of any FHA valid lien by not property entering their interest in the home.. the Consumer Protection Act of valid contracts and our Texas Constitutional Rights given to us with respect to debts as seen in Article 16 sec. 50, & the XXXX. My family has previously filed a complaint which the information was not received by us regarding their response until XX/XX/2021 we were to have 60 days to reply to their response and 60 days has not lapsed as of today we still did not receive any reply by the CFPB and the case was closed prior to the 60 day response time as seen on the website. The documents provided need to be read for what they are and that is for their protection of what previously happened, which was not allowed by use before it happened and that being the sale of our property. Any money received was not received only in duress after we were sitting on the curb and received because they felt guilty at that point a year and a half after they sold our property to give it to the rightful heir owner. We would like to provide additional information on our behalf as to the true ownership in our family 's name of the land and property directly to you for review which relevant Information regarding this claim information directly pertaining the FHA vendors XXXX they claimed to have retained a secured interest in and which they did not as seen in correspondence by the department of HUD, the XXXX XXXX XXXX, the XXXX XXXX Department. M & T Bank provided nothing in their reply and documents which were relevant as to a valid contractual XXXX in their name or a valid assignment in their name creating any valid continued secured interest in our land. The trustee and company referred to in their false documents never possessed secured rights to transfer any secured right. A valid signed contract is missing. The documents provided only expose their deceptive actions. Current valid documents would be necessary in our name and along with a valid chain of title and the recorded evidence somehow showing their name as well. The did not provide any valid assignment as would be needed on a currently needed FHA form. No certificate of Mortgage, no certificate of title, nothing presented to you for review is substantive of them having any right to sell our land. I believe they are misusing any authority provided to them as a bank. The abuse is seen of record through deceptively created documents created by their own affiliates, servicers and attorneys to take property which is not legally theirs to take. I, the consumer, demanded that all forms of communication ( calls, emails, letters, communication to third parties such as consumer reporting agencies ) cease through any and all mediums. M & T BANK has not ceased communication. M & T BANK has sent another attempt to collect a debt on XX/XX/2021. M & T BANK sent communication through the mails stating they will continue to send correspondence by mail. M & T BANK stated they will continue to furnish this alleged debt to third party consumer reporting agencies. This is a direct violation of 15 USC 1692c ( b ) and 15 USC 1692c ( C ). I the consumer refused to pay this alleged debt and demanded M & T BANK XXXX out the balance on this account ; return all payments that have been made on this alleged debt, which was a consumer credit transaction and it is a positive balance, back to me the consumer by check pursuant to 15 UC 1692h ; Delete this inaccurate account information being reported to all my consumer reports. M & T BANK had no permissible purpose pursuant to 15 USC 1681b ( a ) ( 2 ) nor did I give M & T BANK consent to have my nonpublic information which is identity theft pursuant to 15 USC 1681a ( q ) ( 3 ). I demanded an audit trail ( the original or any copy of any book, document, record, report, memorandum, paper, communication, tabulation, chart, logs, electronic files, or other data or data compilations stored in any medium ) for this account. These are my specified remedies pursuant to 15 USC 1692c ( C ) ( 2 ).

Consumer Complaint: I have had this mortgage since about XXXX and therefore have made over 120 mortgage payments on this account to M+T Bank and its predecessor. I have never been thirty days past due on this or any other mortgage, ever. In XXXX of XXXX I had approximately {$200000.00} in my checking account and so there is no financial hardship. I have complete ability to pay a {$2800.00} mortgage. On or about XX/XX/XXXX, I attempted a payment by phone of the mortgage payment at the phone number identified on the XXXX mortgage statement. I have done this routinely over the years without an issue. The payment was noted to be completed and I was then instructed to hang up by the voice system. And so I did, I never received any call, letter or email from M+T Bank that my XXXX payment was missing or that it did not process correctly. I received an alert in early XXXX from XXXX on a weekend that my M+T account had gone 30 days past due. I was shocked, and I immediately called M+T when business reopened the next Monday. They advised that they had no record of my XXXX payment. They also said they tried to contact me at XXXX which is an old employer phone number. I found that surprising since they had my cell number at XXXX.. M+T was completely unhelpful to me as a customer and failed to take responsibility for the failure of their phone system, despite my exemplary record of payment. I immediately paid the so called missing payment and the account was brought current no later than XX/XX/XXXX, the first business day after I learned of the problem with the phone system.. M+T is responsible for this payment issue, not me. My past record of payments with them and my checking account funds support the notion that there was no reason for me not to make the payment and it was due to their error that it did not complete.

Consumer Complaint: I do my mortgage payments through my personal checking account through XXXX XXXX XXXX bill payment. I have recurring payments set up with XXXX XXXX XXXX and somehow 2 payments were sent to M & T Bank ( mortgage service company ) on XX/XX/XXXX one for {$990.00} and 2nd for {$990.00} I immediately called both XXXX XXXX XXXX and M & T since the duplicate payment had overdrawn my account for over {$700.00}, XXXX XXXX XXXX said they could not recall the payment even if it was done electronically, they stated I needed to call M & T Bank and ask them to return one of the payments, I also told the XXXX XXXX XXXX teller I did not set up 2 payments as it was a recurring payment the only thing I did was to edit the recurring payment to the correct amount of XXXX agent asked and said the app should have given an error message stating that there were two payments scheduled for same merchant on the same date, I told him that the app did not give any error or anything else. I did not added an additional payment, XXXX XXXX XXXX agent still said I needed to call the mortgage servicing bank and have them return the funds. I then called M & T Bank on Friday XX/XX/XXXX and agent said they did not see the payment applied to the account and asked to call back Monday XX/XX/XXXX and I call that date, agent stated she could see the double payment but in order for them to return the funds within 24 to 48 hrs they needed to see proof that both payments came out of my account, agent proceeded to give me an email address, I sent the email to XXXX with attention to Mortgage customer support as directed by the agent I spoke to over the phone and included the screen shot. Agent reassured me once the email is received the funds will be electronically returned to my XXXX XXXX XXXX account within 24 to 48 hours. I waited till Thursday XX/XX/XXXX and still the funds had not posted to my XXXX XXXX XXXX account. I called back M & T Bank and spoke to a representative agent then stated that it will take 10 business days for payment to be returned to my XXXX XXXX XXXX account. I told agent that I was told on Monday XXXX that as soon as I send the proof of payments debited from my account. I told agent that was unacceptable and this mistake from XXXX XXXX XXXX had put me in a lot of trouble and M & T not returning the funds as they had reassured. Call got disconnected. I called again today Monday XX/XX/XXXX and once again told the agent XXXX, I still had not received the funds on my account and agent said that the payment is being processed but it will take another 10 business days and then it would be sent via mail in the form of a check. This is unacceptable is taking them over 20 days for them to return the funds, neither XXXX XXXX XXXX is not taking responsibility and M & T is just simply holding on to the funds and putting me in a more difficult financial strain. I have complied with all they have requested, my account has never been delinquent, this is just a horrible service from both XXXX XXXX XXXX and M & T Bank.

Consumer Complaint: Hello, On Wednesday, XX/XX/2021 I walked into the M & T bank branch on XXXX XXXX in XXXX, NY to deposit a personal check that was given to me from my mother. I went into the branch, rather than simply doing an ATM deposit or a mobile deposit because the check was rather large and I wanted to do it in-person to be sure there would be no problems. I also wanted to visit the branch to maintain/build my relationship with the employees at this location, since this is not the location where I opened the checking account. I handed the personal check my mother gave me to the teller and I immediately felt uncomfortable due to her judgmental energy and the questions she started to ask. I proceeded to answer the extensive security check with ease and began to explain that I have been banking with M & T for years, and that I personally felt more combatable handing this deposit in-person, rather than the ATM. After she walked to every employee in the branch to discuss the check, she went to the bank where she told me she was going to make a copy of the check. When she returned, she informed me that she would not be able to deposit the check because she believed it was altered due to the fact that some of the writing on the check appeared darker than other areas on the check. I listened to the denial of the transaction as she handed the check back to me and I was able to see exactly what she was explaining. I then placed my ID and the denied check back into my wallet and said it was not a problem as I understood. I was traveling to XXXX, OH that evening, so I could just have my mother write me another check. However, when I left the branch that day, I felt completely embarrassed because another M & T bank associate, from across the lobby, started telling me about the penalties of fraudulent checks. I listened out of politeness and conversation, but was confused because everything he said did not concern me. I then repeated myself and explained how it was not a problem, and I would get another check from my mother and bring it in at a later date. When I left, every team member 's eyes followed me out the door and around the corner until I was completely out of site. Nevertheless, I left the branch thinking my account was still active, just could not complete the deposit. The following day, XX/XX/2021, now in XXXX, Ohio, I went shopping for my mother at XXXX when I attempted to use my M & T debit card. The card was denied twice to my surprise, so I called the XXXX M & T bank number. After I waited on hold for 30mins, the back office told me they do not see anything wrong with my card and it may have been the merchant 's ( XXXX ) issue, not my card. When I got off the phone, I went to a nearby grocery store and the same issue occurred. At this point I was completely frustrated as I am now out of town and my M & T debit card is not allowing me to access my money. The next morning, I called the XXXX M & T bank number again. This time I was on hold for an hour. When I finally spoke to someone, she told me there was a hold on my account and she could not tell me why ; she only told me to call the XXXX branch location as their number was listed in the notes on my account. I then proceed to explain to her the situation I was in regarding the check, and she told me that even with all of that information, it still does not explain as to why there would be a hold on the account ; because, one - the check was being deposited, not cashed, two - if they suspected fraud, they should not have given the check back to me, but held on to it for security purposes and I should have been told my account was going to be on hold. No one in the branch explained anything to me. I left the branch believing everything regarding my account was fine. The back office associated understood my confusion and frustration and wrote an email to the branch explaining her thoughts and confusion of the transaction as well. However, since the day is now Saturday, I would have to wait until Monday morning to speak to anyone regarding my account. First thing Monday morning, I called the branch and explained the entire above situation. The XXXX XXXX XXXX M & T bank associate then told me, that they receive a lot of fraud at the bank and they were not sure. I felt that was completely uncalled for because the check my mother gave me was not fraud! I felt that it was completely unprofessional and laziness done on their part because if they would have just investigated the check ( called the bank from the check to verify, or at least called the number on the check to speak with my mother ) they would have learned that check was indeed not a fraudulent check. On Wednesday, XX/XX/XXXX, now a week later, with my account and my money still unavailable, I walked back into the XXXX branch location to gain a better understanding as to why my account was on hold. Once they pulled up my information, the teller told me they were going to close my account. Now I am even more confused and upset because I have no idea what is going on. I then went into a cubical to speak to the teller that denied my transaction in the first place. The entire time I am there, she is trying to absolve herself from the situation by explaining that it is was security 's decision, not hers, and she had nothing to do with it. Once we finally got security on the phone, the security associate was extremely nasty and rude ; and when I am the one that did nothing wrong and is simply trying to gain an understanding of the situation. Once he relaxed, he told me that because I still have my XXXX I.DXXXX, but trying to deposit a check in XXXX, what I am doing is against the law. However, I was even more confused as to why that has anything to do with the situation, but I explained that I still have the property that is on my license in XXXX and visit frequently. I also explained that I opened this checking account when I was living in XXXX full-time and was receiving direct deposits from my then employer. He then became flustered and hung up the phone on me. At this point, I still do not have a reason as to why my account was on hold for more than a week now and I have been in the branch for over an hour. Since I did this on my lunch break, I had to leave and visit the following Friday when I would be back in XXXX. Now back in XXXX, they gave me a letter stating they were going to close out my account ( no reason given ) and gave me a check for what was in the account. I am reporting this situation because I completely feel discriminated against and believe that this branch should receive repercussion for how I was treated. This branch had absolutely no reason to freeze my account, especially without informing me. This entire situation caused me humiliation for how they treated me, and stress as I was without my funds for over a week with no explanation as to why. M & T bank discriminated and acted completely unprofessional. Everyone should learn from by experience before banking with M & T Bank.

I've called my local branch, as well as corporate and they will not give me a reason as to why it is being closed. It is my right to know what, and why this is happening and they refuse. I feel like I am being neglected by this company and as if they do not care about what I have to say. I would like to legal action action against M & T bank if possible.

Consumer Complaint: On XX/XX/2021 I was asked to send money back to someone after they issued me a bad check. The check had already cleared my savings account, and I had no way of knowing that the check was going to be dishonored by the bank, it was a cashier 's check and I have a copy of it. Not only was it a bad check, it was counterfeit and the person who sent it was not the same person demanding it back and making death threats to me and my family. I was pressured into forcing money out of my bank account with the belief that if I didn't do something fast they might hurt me or my children. Then, when I tried to cancel the transaction I couldn't cancel it, and the bank manager couldn't reverse the transaction either. I lost {$1200.00} because of the abuse. Before the transaction took place, there was also a home break in where things were taken from the home, and my email was compromised, so was my home computer. I was told that the bank actually does have the ability to reverse the transaction, however they did not act. The online transfer was done using XXXX, and they were in the amounts of {$500.00} and {$700.00} on XX/XX/2021.
