Consumer Complaint: Good morning, A law firm was hired for {$5000.00} to handle a foreclosure matter from Hudson City Savings Bank against XXXX. Hudson City looked to do a modification, every requirement they asked for I submitted to them. Every appearance for court the law firm and myself showed up. ( Their theory for denying the loan modification was that they were too small of a bank which was indicated to me ). As the case move forward the law firm asked for another {$1500.00} and I submitted it to them. At a point, when I was n't hearing from the law firm, I emailed them to see what was going on with the case with no response back. I went to another law firm to see about them handling this matter. Numerous time reaching out to the original law firm for my files, they said the file was too big to make copies of and release. So, I could not get another law firm to review the case, because I could not get the files out. As time went on, I received solicitation mail ( not from the bank 's law firm or court ) saying that a judgment was entered on the house. The court has down that I am listed as pro se. So, I have never received any paperwork from the original law firm that was on the case. Also, I never received any paperwork notifying me of any court dates or that I needed to engage another lawyer. After finding out about the judgment, I received mail from M & T Bank ( who bought out Hudson ) in XX/XX/XXXX about applying for a loan modification. I submitted all papers to them numerous times. I was tracking the case as best as I could on ecourts, the last date showing up on file is XX/XX/XXXX. The case says inactive pending future filing. I immediately went down to the court to find out what was going on and it was told to me that the referee who was on the case had a conflict of interest with the bank. Then in a letter dated XX/XX/XXXX M & T suggested about applying for a modification again. I then submitted all requited documents. In a letter dated XX/XX/XXXX M & T said they received the package. Next a letter dated XX/XX/XXXX from M & T was sent requesting more documents, which were all submitted to them. Then, on XX/XX/XXXX I received solicitation mail that there was sale date for XX/XX/XXXX. On XX/XX/XXXX I received a letter from the law firm that represents M & T/Hudson that there was a sale date. Prior to this, I have never received any mail from the courts or this law firm. Right down, from the original summons and complaint was supposedly served to a business of my brother 's in XXXX/XXXX. The only mail coming in from the bank was monthly bank statements that included Hudson and including every month from that point on from M & T and loan modification correspondence. I believe this falls under dual tracking, as the bank and I were working on a loan modification and I even just signed a new three year lease with a tenant to have additional income coming in to make sure there is enough money for modification requirements, and NOW THERE IS A SALE DATE ON MY HOME. Consumer Complaint: Traditional IRA account opened with predecessor bank, XXXX, for a 60 month CD that matured XX/XX/XXXX. Upon maturity of the CD I requested that the proceeds be transferred to a new IRA Custodian. M & T Bank applied a {$75.00} " XXXX '' and deducted this amount from the transfer ( took the money out of my IRA account ). I was never told of this fee, I was never asked if I wanted to pay the fee separately rather than have it deducted from savings, and the original IRA agreement with XXXX made no mention of this egregious fee.

Consumer Complaint: Good afternoon, a few months ago my mother received a letter from her bank, M and T, notifying her of the need to confirm contact information for her two checking accounts. Her name is XXXX XXXX. As her Power of Attorney, my name, XXXX XXXX, is also listed on the account. Immediately, my mother contacted the number provided on that letter to confirm all contact information. She asked if i needed to call to verify anything else. She was told that everything should be completed with the contact information verification. But, no confirmation number was ever given to her to show that she had even contacted the bank. Yesterday, XXXX XXXX, my mother receives a notice dated XXXX XXXX that her two checking accounts had been closed on XXXX XXXX. Included in the envelope were two checks for the proceeds in each of the accounts. No communication prior to XXXX XXXX was received specifying that her accounts would be closed on XXXX XXXX. She immediately called the local XXXX, NY branch. She was told that she would receive a call back once they looked into her accounts. After about an hour, she went in to the same branch and spoke to XXXX XXXX, Assistant Branch Manager. XXXX explained that the accounts had been closed because contact information had not been updated, as mandated by the government. My mother explained that she had followed the directions on the letter and verified all of the information provided. XXXX shared that this apparently was not successfully accepted on the side of M and T Bank. Although XXXX was nice, her hands were tied. She explained that all of the checks that were floating to vendors would bounce if we did not contact the vendors in time. She also explained that the Social Security deposit which my mother uses to pay her bills would be rejected as well. The most upsetting check that was written was to our local church, XXXX XXXX XXXX, for the annual memorial mass my mother holds for my deceased father. All of this is very embarrassing for anyone at any age, especially for a senior citizen. My mother contacted me, in tears, at my place of business. I met her at the branch to help her sort everything out. We were required to open two new checking accounts and deposit the two checks that had been sent in the mail. We were told that although the funds were drawn on the same bank, the funds would not be available until the following day, XXXX XXXX. Ultimately, my complaint is based on the following : 1. A confirmation process should have been in place to show that the action requested by the bank had been successfully received. A confirmation number should have been provided. 2. Prior to closing the accounts a notification letter should have been sent prior to the closing of the account, not after the account is already closed. 3. Once the accountholder realized the accounts had been closed in error and notified the bank in person, there should have been some sort of protocol for the local branch employees to follow in order to remedy the situation. 4. Funds should immediately be available if a proceed check is drawn on the same bank for immediate access to funds. In my opinion, I believe that this is a systemic problem within M and T Bank. The implementation of this government mandated compliance was not well planned. After taking to social media to share this experience, it became apparent that this has happened to many other accountholders at M and T Bank. My goal is to help other accountholders avoid this experience and create a remedy for those experiencing the same problem. Thank you for your attention to this matter. XXXX XXXX

I am concerned about my credit because I was recently denied a loan and my existing credit accounts have increased my interest rates. This negative rating has caused me serious financial distress and will continue to cause me financial and emotional distress until this issue is resolved. In researching my legal rights, I have found several items that I understand I am entitled to. Consumer Complaint: My name is XXXX XXXX and I work with XXXX XXXX XXXX. XXXX XXXX and her daughter, XXXX XXXX, have hired our firm to work on their behalf to recover stolen funds at M & T bank. I am acting as power of attorney. XXXX and XXXX have signed all necessary documents to assign power of attorney to our firm but M & T will not honor the power of attorney documents and so far has refused to speak with our firm about the issue. Someone stole checks from XXXX, forged them, and then cashed them. XXXX mail was diverted by the thief and the fraudulent checks continued to be cashed. The total is in the XXXX dollars. M & T refuses to reimburse the funds under the Electronic Funds Transfer Act and has only offered XXXX a very small amount of reimbursement. So far M & T has refused to put their denial of reimbursement in writing. The fraud was reported to M & T on XXXX/XXXX/2016. M & T made no effort to contact XXXX, or compare the signatures on the checks with XXXX true signature. The signatures differ substantially. The checks were also outside of her normal spending habits but M & T still continued to do nothing to protect the funds or verify the legitimacy of the checks. XXXX has not given M & T any permission or authorization to honor these fraudulent checks. M & T has stated to the victims that they would speak with our firm regarding this issue but has so far refused to return calls or letters. XXXX is XXXX years of age and her nest egg to live on has been cleaned out. We urge M & T to reimburse the full amount of the fraud and go after the perpetrator for restitution. The perpetrator has been arrested and is awaiting court proceedings at this time.

Consumer Complaint: This complaint is against M & T Bank. Our basement flooding XX/XX/2016. All the usual standard protocol was done with our insurance company. The check was made out to us and M & T Bank. We had to mail the check, as there is not an M & T Bank in the tri-state area. We had to rent, out of our own pocket, a dumpster and mildew/mold solution to spray on a very, very small area, per insurance inspector. M & T refused to forward said check back to us until they had an inspector come out and document that we had done 50 % or more so far of the project. We did. The inspector was under the impression that once he sent in his documentation, the check would be mailed to us. Nope! M & T does not like the fact that we are capable of finishing the work ourselves. We had done all the water extractions, removal of flooring, etc. ALL before their inspector came. M & T requested a " letter of intent to repair ''. We faxed said letter and followed up with phone calls. M & T then would requested a " cost list '', which was submitted originally by insurance appraiser. We submitted a " cost list '' and in this letter did a breakdown based on our ins. co. appraiser 's list of the work we have already completed ( prior to M & T Bank 's inspector ) as well as the type of flooring we were planning on purchasing from XXXX. Then M & T Bank requested a " We have the ability and experience to complete all repairs '' letter. We faxed said letter. In between all these requested letters, we have spoken to " Loss Draft Department '' employees of M & T Bank. We 've been told that " normally '' contractors do the work. One " Loss Draft '' employee said that since there was no structural damage and that in our state the only required contracting for this type of claim would be a plumber. That 's not needed as our bathroom was n't touched by the flood or the cause of the flood. I was told by the same M & T employee that her Team Leader had the power to release the check. She called back and said that we had to send in the " We have the ability... " letter and they would send it all out to corporate. A phone called was made yesterday and the same employee that we had dealt with more than anyone else was unavailable and so a new employee was thrown in the mix. She asked what it would take for us to purchase the flooring. I proceeded to tell her about the break-down list that was faxed and that we had done all the work minus purchasing the flooring and pain for baseboards, so those funds are the minimum that is due to us. It was n't a pleasant conversation. She said that " XXXX '' would be calling us back. She did n't. I called this morning and was that she would have to call us back. Several hours later she calls and said that " they need our receipts '' to give to corporate. I lost my mind. She said she was just telling us what her Team Lead told her. We have over and over and over and over, etc. told M & T Bank that we are doing the work ourselves. There was no structural damage, only cosmetic. I asked for the Team Lead 's name and she said she would call us back. We are completely right back to square one. What I do think is the Team Lead is going to ask me the same freaking question the lady asked me yesterday and that would be how much for the flooring. They sent us a check for XXXX?? for the dumpster because we had the receipt and faxed it. After reading all the complaints on the FDIC site about M & T, I will warn any and all to never get a mortgage with them. XXXX, for that matter a checking account.

I have received over XXXX dollars in fees since I have been with them and I have called to request a few fees back and nobody will help. I have always received assistance with other banks. They wont help at all. In addition there fee 's are XXXX each. I just asked for half of my fee 's back. I dont know why they dont try and accommodate there members
