Consumer Complaint: This complaint is in regards to the unethical business practices in which XXXX XXXX NMLS # XXXX with M & T Bank endured on me. I am a XXXX-year-old citizen and was trying to buy my first home with a FHA 3.5 % loan. After listening and trusting in the loan originator mentioned above, I felt I can trust her and the bank at hand. After 2 months of phone and emails, we finally decided to move forward with the loan process. She mentioned to me that to move forward, I need to have the appraisal done first to START the application. I asked her why would I pay for something upfront if I do not know if I am going to get accepted for the loan first ...? I then asked if I get charged for the appraisal and get denied, will I get my money returned, and she said yes. I read the fine print as well, and it did mention I can get a refund if denied the loan during process. So, trusting her since this is my first time, I said okay, let 's go forward. NOW, I am stuck with a {$930.00} appraisal fee ( with no appraisal document ) with a loan that I was denied. I was baffled on how fast she turned over the tables and said that I need 25 % down for the loan to proceed or I will get denied. I said WHAT! I was under the influence of her telling me that everything is good, then went from {$3500.00} down payment to {$25000.00}. All my paper work went through for a FHA loan, not a conventional, and then I received a letter on XXXX XXXX, 2017 stating that I was denied but with no reason for why I was denied the loan. And I am also stuck with the {$930.00} appraisal fee which they refuse to credit back, again, with no valid reason which was done on the XXXX. The appraisal was done on XXXX XXXX, 2017 and the way that I found out was through my broker who called me the same to tell me the appraiser finished. I said oh wow, because I had no knowledge of when he was going to meet with my broker, which all happened in one day, in which THEY contacted my broker without my knowledge. So, the appraisal was done on the XXXX, I was denied on the XXXX and asked to put {$25000.00} instead or we can not go through with the loan. I still have not received a valid reason for being denied and still have a charge of {$930.00} on my credit card. This was a clear indication that the loan originator was all along trying to get the most money out of me by deceiving me from the beginning. Then I reached out to several numbers to get some help and all the calls with M & T Bank employees were just brushing me off. I also spoke with XXXX XXXX, VP of Administration for M & T Bank, her boss, and it has been over 3 weeks and several voice messages and no results. I feel I have been robbed of the opportunity to buy my first home and of {$930.00} for a service I can not use with M & T Bank unethical business practices. Currently, I am still waiting for a call or feedback and no luck. Why would they do this to a XXXX-year-old for?!? I wish I had help ... ...

Consumer Complaint: I, XXXX XXXX believe that all my mortgage payments made to M & T Bank on a mortgage I had with my brother since XX/XX/XXXX was paid perfectly by direct withdrawal from my checking account. In XX/XX/XXXX, we sold the property and a copy of the HUD-1 is attached. However, M7T Bank shows a 30-day late payment for XX/XX/XXXX, that should be corrected. I believe that the credit reporting system works, but sometimes mistakes are made. I have disputed this late payment and M & T Bank has not responded to my satisfaction. Accordingly, I respectfully request a review through the Consumer Financial Protection Bureau to rectify this matter. The 30-day late payment should be removed with every credit reporting agency.

Consumer Complaint: In XXXX of 2016 my vehicle was total lost in a not a fault accident. Shortly thereafter my primary insurance carrier settled the claim. I made the last up to date payment on or about XX/XX/2016. On XX/XX/2016 I made a new car purchase from the same dealership that I have been dealing with for the past 7 years starting at a zero balance. I had additional Gap insurance to cover residual debt in the event of a total lost situation. to my surprise I discovered that the unregulated out of state insurance company out of Florida breached the standing contract with me! this caused the lender to charge off the debt to my credit report which I disputed, and I provided all the necessary documentation to this affect. The lender write off the debt, but reported that I was suppose to continue to make the monthly payment to them on the loan. All XXXX bureaus were contact both before the charge off, and after the charge off in writing in a escalated dispute. however XXXX XXXX has refused to adhere by removing inaccurate information regarding my dispute with them.

Consumer Complaint: I opened an account and everything was fine besides a discrepancy about fees that were assessed. that was corrected and now here we are yet again. Only this time, I deposited a check in light of it clearing there was fraud on that account and I had to close. As a result I went to a ATM and deposited more then enough to cover as a supplement so to speak, since when I called customer service they advised me there was nothing that they could do since it was done via mobile. Now here we are and they are keeping the money that I had in the account and charging fees that I would not have if I were to have the debit card to make transactions. This is very draining having being a new member and being as up front as possible. They locked all access and told me that the debit card is no good. All of this was done with no written communication. If I did not visit and ATM for it not to take my money. I would never know the problem when actually I still do not know the issue since I tried to clarify fix the problem. I could not help my stuff stolen and the only option was to close the account. In addition is was a first time offense.

Consumer Complaint: After reviewing a copy of my annual credit report, I have noticed that I have XXXX closed mortgage accounts placed in my file which is causing my credit to be less than mediocre. Because I was not equipped with my rights as a credit consumer at that time, I had no idea that there was anything I could do to fight this. Neither of these debts have been verified or validated for me and if this is correct, I have absolutely no knowledge of the amount owed, if I wanted to remedy the problem. It is known that both M & T Bank and XXXX have predatory lending tactics aimed at minorities, therefore, I hope hope that they ae not attempting to take advantage of me as a single XXXX mother of XXXX children ( ages XXXX and under ).

Consumer Complaint: My wife and I have a mortgage with M & T Bank. We are repeatedly being told we must go to our local branch to verify our personal information. We went over there in XX/XX/2016 and now we are being told we have to do it again. In close to 10 years with Hudson City Savings Bank, which they recently purchased, we have never missed a payment or been late. Our credit rating is exceptional and we have considerable amounts in our savings accounts. I believe that this is a thinly veiled attempt to get us into the branch to sell us additional products, which we are not interested in.

Consumer Complaint: M & T Bank and XXXX Bank NA did a fraudulent foreclosure on my homestead home. I 'm the person who is name is on the note & mortgage that these XXXX Banks presented to the court. My original complaint was to XXXX, case # XXXX, but XXXX 's response is that they had transfer the loan to M & T bank, but the only name on the plaintiff is XXXX. These XXXX banks have put a cloud over my deed and foreclose on my with out bringing me in the case, this is fraud. Because a bad loan modification that XXXX did & denied in court that it happened.

Consumer Complaint: In XX/XX/XXXX, I was contacted by XXXX saying my M & T mortgage was 3 months late and was up for foreclosure. I should have checked, I was actually only 2 months behind, almost. They instructed me to do a modification mortgage. They said, " Do not make your XX/XX/XXXX payment and the modification can start and lower your monthly payment drastically ''. I did as instructed like an XXXX. XXXX was to b my first payment. They set up a time and date for me to call in my payment. XX/XX/XXXX and XX/XX/XXXX was the same appointments. I was only allowed to talk to XXXX. No one else could take my payment. At the end of XX/XX/XXXX, they told me to wait on a letter and mail my payments with the slips to M & T. XX/XX/XXXX I finally get the letter. They said my payment would not be counted late since they did not have the paper work ready. But even though I mailed in my payments when they said for XX/XX/XXXX, XX/XX/XXXX and XXXX, they counted them late. I paid my payments to who they said and did what they said when they said and they reported me as 120 days late on my credit reports. Then, they tell me to give it time and my credit report would straighten itself out. No, it still has not. And my payment went down only XXXX bucks and they added XXXX grand to my mortgage. I have petitioned the credit bureaus twice about this unfair reporting and M & T 4 times and XXXX refuses to talk to me. I just want the six months of on time payments to show as on time.

Consumer Complaint: According to Colorado Revised Statute XXXX ( XXXX ), in the case of a foreclosure sale by the Public Trustee, a sale date can be no less than XXXX calendar days nor more than XXXX calendar days after the date of recording of the notice of election and demand, which is this case was recorded on XX/XX/XXXX. Also, according to Colorado Revised Statute XXXX ( XXXX ) Dual Tracking Prohibited Defendant received confirmation from servicer, M & T Bank XXXX during the first week of XX/XX/XXXX ( letter dated XX/XX/XXXX ) that a loss mitigation application had been received and that it was complete. In addition, during the same time period, M & T Bank stated in multiple phone conversations that foreclosure proceedings were suspended pending the " process of being reviewed to determine if you ( I ) qualify for assistance ''. The Public Trustee was NOT notified of such status so the foreclosure process was continuing in the " eyes '' of the Public Trustee, therefore Dual Tracking. Some time during the second week of XX/XX/XXXX the defendant was notified by M & T Bank that the application as submitted by defendant was not accepted, and that a new application could be submitted, which is currently in progress. The XX/XX/XXXX notification set in motion the foreclosure proceeding that was recorded on XX/XX/XXXX, setting at sale date of XX/XX/XXXX, which is only 57 days from the recording date of XX/XX/XXXX.

Consumer Complaint: I am filing this complain against M & T Bank which has filed a late payment with XXXX credit card bureaus. In 2013, My employee stole my credit card and used it. I was not aware of theft until I received a past due bill from M & T Bank for {$410.00}. I paid this bill as soon I realized that my credit card used by him. Despite many pleas to the bank to remove late payment from my credit, they have refused to do. It has been four years since this late occurrence, my credit has been damaged by one single late payment. Bank was sending minimum balance, however, I paid the entire balance. I will ask you to have bank remove this late payment. Because of late payment on my credit, i can not refinance my house or buy a car.
