Consumer Complaint: On XX/XX/XXXX I received a letter from m & t. Bank which is the holder of my mortgage stating that I am behind a payment from XXXX of XXXX . Apparently the mortgage company infinite mortgage services requested a payment back in XXXX of XXXX from my bank stating it was owed from over a year ago. Back in XXXX XXXX of XXXX " it is even noted on my account '' I had called the mortgage company and also my bank to pay my first payment. They told me I did n't owe anything until XXXX of XXXX . So I started making my payments XXXX of XXXX . Now m & t is starting the foreclosure process with threatening letters phone calls and visits to my home on an error that was in no way my fault. I had contacted the bank for the past 3 months trying to fix this error and requesting letters to help my fix the issue. I had never heard back from them except the threatening letters when they were supposed to investigate the issue. Also they are reporting the missed payment every month to my credit bureau and ruining my chances of ever having a good credit score . I have had issues with this bank from the start and I feel that in the errors I should not have to make this additional payment because I have kept my payments on time every month since obtaining this house. I should not be held responsible for the banks error of over 1 year ago. This company is ruining my life and my credit and I need answers or some kind of assistance. I have XXXX children and live paycheck to paycheck there is no way no will be able to afford to pa y 2 mortgage payments back to back because of there error also there is no possible way I can afford there insane repayment plan of an extra XXXX $ on top of my mortgage every month. This bank is a joke and horrible at what they do please help my situation. Thank you

Consumer Complaint: I prepared a letter to XXXX XXXX XXXX dated XXXX XXXX , 2017 to complain about the horrible treatment regarding a mortgage refinance. As of today I have not received a letter regarding my concern. Out refinance loan was denied. However, we did not receive a letter indicating the reason for their decision. I am very disappointed in M & T Bank because they have not responded to my concern in my letter. We have a mortgage with M & T and we completed an application for a lower interest rate, thus a lower monthly payment. I am sadden by their treatment to me and my husband. I requested a letter from their mortgage section a letter of denial. As of today 's date we have not heard anymore from M & T B ank.

Consumer Complaint: We are trying to work through the process of trying to close on my Aunt 's co -op, located in the neighborhood of XXXX . For several weeks our attorney has tried to get the official pay off documents so that the closing can move forward. It 's not a complex process because our buyer is offering cash for the deal. The bank has stalled and delayed and stalled to the point that we are going to lose this buyer and have to begin the whole process over again. Considering how hard it is to find a buyer who is approved by the Co-op board, we would like to avoid thi s. M & T Bank ha s been of little help. We get excuses. We get promises and still we wait. The bank simply says, " well, we 're waiting on the paperwork from this person or we 're not sure where the document is. '' Meanwhile we are getting a financial hit because we have to continue to maintain the property, maintain the utilities and pay co-op fees. We, including our attorney, are frustrated. HELP!

Consumer Complaint: My husband made a cash deposit of {$1800.00} on XXXX XXXX , XXXX . CASH, handed to a teller, counted and confirmed. That evening I transferred the money to my checking account so that I could pay my mortga ge ( our accts are linked but separate ). The bank put a hold on the deposit stating some rule that if a deposit was made after a certain time then it would n't post until the next day, however, had he deposited thru the ATM the money would have been immediately available. That is the complete opposite of previous banking rules! It was cash, handed to a live human being! At any rate, me transferring the money that the bank says was n't there resulted in 5 overdraft fees. The bank has refunded 3 out of the 5, however, that is not acceptable. I believe the bank is participating in predatory practices to steal my hard earned m oney.

Consumer Complaint: I closed my checking account with this bank last year and made sure the account was closed with a {$0.00} balance. I 'm now seeing that they are reporting a charge off amount for the account! Nothing was owed to them and they would n't even let me close the account with funds still in the account which had to be withdrawn or spent, so how is it possible to charge off an account that wa s MY money??? Not only that, but since the account has been " charged off '' the balance is continuing to increase. Also, this same bank pulled my credit as a hard inquiry in XXXX of XXXX , even though I do n't have any accounts with them or ever gave them permission to run my credit.I live in a state that this bank is n't even in and have no need for their services so I would n't have been looking to take a loan out with them.

The options which they gave me only would cost me more money. In XXXX I applied for refinancing with another company. Every thing went well. On XXXX XXXX , M & T Bank advised new lender that payoff for mortgage was {$70000.00}. This payment was for money due M & T Bank from XXXX through XXXX . On X/XX/17 a payment of {$1200.00} was cashed by M & T Bank. This payment was my late payment for month of XXXX XXXX . M & T Bank received two payments for the month of XXXX XXXX Both new lender and M & T told me that Payment of {$70000.00} was received by M & T Bank on XXXX XXXX On XXXX I was informed by XXXX XXXX of M & T Bank that M & T Bank had received payment of {$70000.00}. I asked about the payment of {$1200.00}. She said that money had been sent to us. I was not satisfied with previous information and I called again M & T Bank. The last call l made I spoke to XXXX . I asked him how to make a complaint. He took internal M & T Bank complaint. I called earlier this week and again was given the runaround.

I am also unable to close the account due to the fact M & T Bank overdrew the account. They are charging monthly maintenance fees which is f urther overdrawing my account. Please see below I have called and sat on hold for over 30 m inutes on 3 sep arate occasions. I am a XXXX year old woman with XXXX XXXX XXXX with my most recent stay in the hospital for a over a month XX/XX/XXXX through XX/XX/XXXX . I can not handle the stress. I have moved from the hospital to XXXX XXXX . I faxed and mailed the dispute forms necessary to reopen my fraud case. My card # was stolen and used without my authorization. I have never done business with any of those merchants. You have removed my provisional credit and have overdrawn my account. I want all fees reversed. Consumer Complaint: On XXXX XXXX , XXXX I sent a certified letter to M & T bank loan modification dept ( CERT MAIL # XXXX ) That letter was in response t o a trail m ortgage period in which the loan was NOT modified from its current status. Namely, the bank wanted {$1200.00} per month and the original loan was about the same payment. I received NO consideration for my changed employment status. Specifically, the bank did not change in the interest rate, change in the principal amount of the loan, change the length of the loan nor the total amount of the payment each month. The banks letter specifically stated that if I was unable to ma ke the trail payments that I should contact the bank for additional options. I never heard back from them. My attorney filed an appeal to the NYS appellate court to challenge mistakes in the county court and in response to this appeal which was to be heard on XXXX XXXX , XXXX the bank forced a foreclosure sale on XXXX XXXX , XXXX in attempt to obtain the property before the legal questions were answered. These questions included : 1. Did the plaintiff comply with the strict requirements of XXXX XXXX and XXXX ? 2. Has the plaintiff proven standing to commence a foreclosure action? 3. Was it error to grant summary judgment when the defendant had served discovery demands and the plaintiff never responded?

Consumer Complaint: On XXXX XXXX XXXX I telephoned M & T B ank and requested that an ACH stop payment order be placed on any transactions from XXXX ( XXXX ). A week later I received a letter from M & T Bank notifying me that on XXXX XXXX XXXX , a stop payment order was issued by M & T B ank for and ACH from XXXX ( XXXX ) On XXXX XXXX XXXX , I checked my online web banking bank account register and noticed an ACH debit from XXXX for the amount of {$1100.00}. I immediately telephoned XXXX XXXX XXXX XXXX customer service and informed the person who answered my telephone call that Crossroads Financial had debited {$110000.00} from my checking account on XXXX XXXX XXXX and that I had an ACH stop payment order in effect since XXXX XXXX XXXX for XXXX ACH. The customer service person whom I was speaking to then asked me to hold a few minutes while she could investigate my problem. A few minutes later, the M & T Bank customer service person came back on line and informed me that : '' a stop ACH o rder goes into affec t 24 hours afte r the amount is debited from my bank account. '' Really?? That is a bunch of garbage, I have a stop ACH order against a company called XXXX and since that order went into affect on X/X/2017 , no money from XXXX has ever been debited from my checking account. This is just another example of the utterly inconceivable computer programming mess existing at M & T Bank. The M & T Bank co mputer banking software is hopeless stuck in the 1980s instead of being written for the 21st century. It is also a perfect example of M & T Bank customer service representatives not knowing what they are talking about.
