Consumer Complaint: Thank you for the opportunity for XXXX to bear witness to your failure to respond to the issues I presented in my complaint # XXXX through the CFPB. The issues which you avoided went right to my fundamental right to be free from inaccurate reporting as well as fraud and identity theft. One can only assume that the avoidance of those issues is an indication that you have more to hide. Your company failed to provide a responsive answer which would satisfy my right to information requested. I wish to make public notice of the following : 1. Notwithstanding the production of any substantively admissible facts to the contrary, the following shall stand as facts not reasonably in dispute in any adversarial proceeding : a. Your company furnished negative information to one or more consumer reporting agencies as evidenced in the above referenced complaint. ( See exhibits in the above referenced complaint ID # ) b. I filed a complaint with the cfpb. The complaint challenged the legal sufficiency of your actions. c. Your companys response appears intended to misrepresent and mislead me into believing that your company is in possession of sufficient substantively admissible facts to establish your right to report or collect on an alleged debt without having produced said facts. d. Your company has failed to provide me with substantively admissible facts sufficient to show that you have or had my express written authorization to use my personal identifying information in connection with the collection of the alleged debt in question. e. Consumer Complaint: I called MandT Bank ( MTB ), XX/XX/XXXX at XXXX and spoke with a rep about the calculation of the mortgage escrow which I believe to be wrong. We are in agreement that the monthly mortgage escrow before shortage should be {$1200.00} per month required annual mortgage escrow is 14 months at {$1200.00} or XXXX. Beginning escrow balance is {$7300.00} a/o XX/XX/XXXX. escrow payments from XX/XX/XXXX to XX/XX/XXXX total XXXX this would bring the total escrow to XXXX well above the required escrow of 14 months of {$17000.00}. The woman who answered the phone started the conversation by telling me she does not have the ability to calculate whether the escrow is right and it is done by computer. she kept saying the bank 's calculation is right with no explanation. I asked her how she can be so sure the Bank 's calculation is right when she told me she didn't know how to calculate an escrow earlier in the conversation. she hung up without saying anything. I did not raise my voice, but obviously, MTB 's training leaves a lot to be desired.

Consumer Complaint: In XXXX my spouse was forced to resign from a job he has had for over XXXX yrs and we proactively reached out to XXXX for a solution to assist in catching up on the missed payment that we missed for XXXX or XXXX of that year. Over the years my husband and I have acquired at least 4 mortgages between the both of us and we had never missed a payment until this point. Prior to M & T obtaining the loan around XXXX or XXXX, we were in the process of a repayment plan with XXXX to catch up on a missed payment of the mortgage on our house. During this process we were verbally told by XXXX that our loan would remain in good standing as long as the catch-up payments that were kept current which they were. We missed 1 payment during the entire year of XXXX but it shows on our credit report as it was consistently late for more than 5 months. We contacted M & T and they assured us that everything was fine and we were in good standing. In late XXXX of XXXX, our home in XXXX XXXX suffered a tremendous loss due to extreme water damage from the pipes bursting and completely flooding all 3 levels of our home. Our home had over {$200000.00} dollars of repairs done that took several months longer than projected due to M & T withholding the funds and paying the contracting company in a timely manner which was agreed upon between the 2 companies. Needless to say the process was very stressful. We still continued to keep the mortgage payments in good standing. Since all of this has transpired, the mortgage loan was paid off early and in full in XXXX of XXXX due to the sale of the home this loan was associated with. With this repayment plan our initial payment was {$4400.00} and the following payments were in the amount of {$3300.00} for 6 months or more in order to get this the missed payment caught up and we were told that our credit report was going to show we were in good standing, but to our dismay we discovered just recently that this was not the case.

Consumer Complaint: I open a checking account of this M & T Bank at XXXX XXXX XXXX of XXXX but now it been closed. So, i visit other branch in Downtown in XXXX XXXX. Aside from checking, i open a savings account and they also give me a credit card too. Because, i have no time to go to other bank near to me i decided to open a CD year XXXX. When i open my account on this bank they tell you a good product and services they offered like you are Protected for OVERDraft fees if you open other account servjces you have. As we all know we have no time to read the detail terms and condition you signed. IN SHORT the people in the bank will NOT give you the Pros and Cons if your savings become lower to the minimum balance or if you used your checking account without funds evendo you have money in your other account like savings and a credit line they offered to us to save my overdraft, now the {$12.00} overdradft fee became a transaction fee this is what the Agent told me name XXXX I call today XX/XX/XXXX at XXXX XXXX to dispute this {$12.00}. I issued a check the amount of {$98.00} XX/XX/XXXX but my remaining funds that time is around {$53.00} plus then the M & T bank automatic they charge on my M & Tbank that connected to my all accounts ( checking, savings ) i check my accounts last night and i found out the transfer of the personnel bank to my account using the credit card to cover my short of {$43.00} plus ( XX/XX/XXXX ) transaction and additional {$12.00} ( XX/XX/XXXX ) therefore they charge me the total of {$56.00} plus. Therefore, when i online and find out the charges i immediately pay on this amount and hoping on next day i call the bank to ask for the refund or waive my {$12.00} overdraft fee which is am disappointed that they can not refund this charge! This is the 2nd time they charge me for overdraft and never get the refund because they say i have no savings account at the time year XXXX and the credit card covered my short funds. Although, they said am protected by the overdraft fee if ihave a credit account from their bank. And, now they give me other reason the overdraft fee that they charge because i make a online transactions which is a fee!!!! This bank have many victims because of they terms and condition that not reveal to the consumer. This institution used our money and at the same time LEGALLY FRAUD the consumer of their small print and deceitful Terms and Condition and POLICY of the Corporate scammer bank institution. Am, sorry if i say this, am so upset this charge {$12.00} is already big money, especially i earn $ XXXX hour only just rely on the tip of the customer that i work for. Hopefully, you give your time and attention to my complaint and hoping they give as consideration being a long time customer. Thank you.

Consumer Complaint: In XX/XX/XXXX I got laid off from my job that I had been working at for 18 years, I called my Mortgage Company which is M & T bank and notified them of this and they told they would send me out a modification package. I called a company that deals with FHA housing to help that I got from M & T bank and I started the modifications packet through the hardship housing company called the Neighborhood Project Foreclosure Prevention Program , M & T bank would not let this the company come in and help they kept stating that they wasnt getting the authorization form from the company and it had been faxed to them 4 times with a confirmation saying that it was received by M & T bank. So I had continuously to keep working with them giving them every form or information they needed from. Than they sends me a denial letter stating that Im not enough months behind on my Mortgage so they cant approve my modification I applied for. I was told this over the phone as well on XX/XX/2020 with a manager in the mortgage department. This makes no sense to me that you would deny someone who has got laid off from work and only owes XXXX on there house and only have 2 plus years left to pay. Why would you deny anyone whos asking for help while there in a crises. They put it of on FHA saying it was FHA that denied the modification because I wasnt enough months behind on my Mortgage. I dont know what is the truth at this point. This is the far most worse Mortgaging Company I have ever seen and I owned a house before I became home owner of this house. I wish I can just get some type of help. I dont wan na loose my home. This company doesnt care. All they do is be very rude with you and have no compassion for homeowners. Why would you deny someone of a home modification because their not enough months behind M & T bank?

Consumer Complaint: In XX/XX/XXXX under the advisement of one of my doctors, I decided to resign from a company that I had been working for for 10 years. Despite the fact that my wife and I had never missed a mortgage payment in our lives, we proactively reached out to our current mortgage company, because we understood that the likelihood of missing a payment would drastically increase during my career change which would likely include a relocation to another state. Our mortgage company at this time was XXXX XXXX. Initially, they proved to be very understanding and resourceful. A couple of months later we miss a payment. We maintained weekly contact with XXXX 's office and they reassured us that as long as we maintained the verbally arranged repayment plan, our credit would not be affected, because the my wife and I knew that we would be attempting to purchase another house once we settled in XXXX. By XX/XX/XXXX, I had signed a contract of employment with XXXX for a startup project in XXXX XXXX XXXX, XXXX. Originally the contract was for a full relocation package ; but due to budget problems with the project, XXXX drastically reduced the relocation support which originally included a household goods move, transport of two vehicles and support to sale our current house and support to purchase a new house in XXXX. The package was reduced to a one time payment of {$10000.00} only. My wife and I took it in strive are started the process of moving across country on extremely low budget. Unfortunately for us, the company that we ending hiring to move our house hold goods, was a company that the FBI had been investigating for several years for racketeering. At this time my wife and I started making arrangements to have our house in XXXX XXXX placed on the Market. Things started off bad at XXXX and continuously got worse. Also while my wife and was in the middle of wrapping our verbally agreed to repayment plan to caught our mortgage up XXXX decided to sell our mortgage acct to M & T Bank. By XX/XX/XXXX, my wife and I decided that it was probably was in our best interest for me to seek new employment, preferable in XXXX XXXX, XXXX in order to stop our mortgage from going under. By XX/XX/XXXX, my wife and I relocated to back to XXXX XXXX, XXXX. Luckily for us this was also the time that the FBI started raiding and making arrests on their investigation XXXX XXXX XXXX. And within two days of being back in XXXX XXXX, XXXX, the federal government was able to give the location of household goods. As stated above, when XXXX sold our mortgage account to M & T Bank my wife and I wasn't quite finish with completing our catch payments that we had arranged with XXXX. By the time M & T Bank had control of the account, the first thing they did was threaten us with foreclosure. By the beginning of XX/XX/XXXX, my wife and I had recovered our mortgage to a point where the threats of foreclosures ceased from M & T Bank. During this short time back in XXXX XXXX, XXXX ; a promising career opportunity landed in my lap. The position was in XXXX, XXXX. By the end of XX/XX/XXXX, my wife and I was living in XXXX again. Contract wise, this relocation went a lot smoother. Not only did they pay for a reparable company to complete our house goods move, they also are currently providing our temporarily housing while my wife and I find one to purchase. Within the 1st week of XX/XX/XXXX, I received an email alert from the water company in XXXX XXXX, XXXX ; basically stating that they have noticed a huge increase of the water usage at my address. That evening, I had a friend check on the house for me. That's when we ultimately learned one of our water supply lines had burst on the third level of the house. The realtor was scheduled to place the house on the market the following week. Instead we ended up having take out {$200000.00} insurance claim, that ultimately took 8 months for the contractors to complete. By XX/XX/XXXX my wife and I was less than one payment behind on our mortgage. By XX/XX/XXXX we were less than 1/4th of a payment behind on our mortgage. In XX/XX/XXXX, M & T Bank finally reported our current. It was never late again and we ultimately sold the house in XX/XX/XXXX. Mortgage with with M & T Bank was paid in full. In XX/XX/XXXX, my wife and I applied for our 1st mortgage here in XXXX. Every since we successfully sold our house in XXXX XXXX, XXXX ; we had been repairing our credit, paying off more than {$40000.00} of our credit bills. By the middle of XX/XX/XXXX we were given clearance to close by our new mortgage company for XXXX XXXX, but we have to convince M & T Bank to do a " goodwill '' hardship update to the comments on my credit reports. Basically, deleting the XXXX late payment showing on my credit report. Therefore I my wife can close on our new house now ; instead of waiting until XX/XX/XXXX. M & T Bank is refusing to corporate. Basically telling my wife and I that they don't want assist us.

Consumer Complaint: FORCED PROPERTY INSURANCE - CURRENT PRESSING PROBLEM In XX/XX/XXXX M & T Bank/Mortgage retroactively Forced Placed a {$16000.00} Insurance Policy on our property for the previous year of ( XX/XX/XXXX ). Which is ( directly and indirectly ) M & T Banks fault because over recent years we are subjected to this geographical Redlining and Refinancing restriction with M & T Bank ( i.e. New York, New Jersey, Connecticut, Pennsylvania, Maryland, Delaware, Virginia, West Virginia, and Washington, D ] are the only states M & T Bank/Mortgage accept financing or refinancing of Commercial Properties. And that is after M & T bank/mortgage purchased our property from our original mortgage company ( i.e XXXX XXXX dba XXXX via XXXX XXXX ). And we were financially struggling and spending our own personal money ( thousands of dollars ) trying to repair an aged and worn roof to past an insurance inspection. Which took ( 3/4 of the year ) because we had to schedule repairs for the roof based on when we saved enough of our own money to pay for it step by step. This cost us an enormous amount of time and money we didnt have. In addition, there were other costly property upkeep repairs. ( See attached receipt copies of roofing company repair costs ). We realize that M & T Bank/Mortgage has cost us a tremendous amount of ( Financial Ruin, Financial Embarrassment, and Cost us our dignity as property owners because we had to receive phone calls from tenants reference leaking roofs and as we scrape together money to fix one or few leaks then came another to fix and pay for. Because there was not enough money available to have the property re-roofed. Presently, we have to sit and feel pressured by our insurance company ( awaiting repair verification requests on the roof ) to maintain the insurance. When our mortgage company ( M & T Bank/Mortgage ) is causing the problem and part of the problem. This it is serious, and a serious financial burden for property owners if insurance is not maintained. ( i.e. {$16000.00} of Expensive Forced Placed Insurance by M & T Bank/Mortgage when it was the banks fault ). The bank could have eliminated this costly problem off our backs a few years ago when we requested refinancing for this same type problem. Also, presently, our insurance company is requesting we pass a [ Licensed Contractors Roof Inspection ]. We have spent thousands already Fix/Patching it ) it requires a ( re-roofing of the property ) to pass this type of roof inspection. ( See attached Insurance Letter ). That ( {$16000.00} Forced Placed Insurance ) caused our mortgage payments to go up an additional {$500.00} a month. There is a lot of hard and costly work that has to be done to raise tenants rent {$500.00}. So this is very costly for a property owner. WHAT IS NEEDED TO FIX THE PROBLEM M & T Bank/Mortgage should replace the ( {$16000.00} ) Forced Insurance cost it took out of our Escrow Account because they are Directly and Indirectly to blame for our not being able to obtain Property Insurance ( expediently ) by Redlining and Geographically Restricting Refinancing of our Small Commercial Residential Property to certain GEOGRAPHICAL outline of SELECTED STATES ( i.e. New York, New Jersey, Connecticut, Pennsylvania, Maryland, Delaware, Virginia, West Virginia, and Washington, D ). Eventhough M & T Mortgage/Bank purchased our mortgage knowing we own property in [ Florida ] outside that commercial geographical financing/refinancing outline that the bank created. Note : It has been approximately ( 15 years ) that these financial institutions would not allow us refinancing. [ As a reminder, they work interchangeably as Servicers/Financial Banking Lenders ] We need M & T Mortgage to come up with some type of ( immediate assistance ) for us to re-roof this property immediately so we can maintain insurance. And keep rain from coming in the tenants apartments. Especially based on the financial position we have been placed in regarding the property by M & T Bank and XXXX XXXX. The roofing companys proposal is for approximately ( {$36000.00} ). ( See attached Roofing Proposal from the roofing company ). Since M & T Mortgage/Bank Forced Placed a ( {$16000.00} ) Insurance Policy on the property for ( XX/XX/XXXX ) the same year the propertys roof was continuously leaking and we had to continuously spend thousands of dollars to Patch Fix it, because it needed replacing. The bank should consider utilizing that ( {$16000.00} ) Insurance Policy to Replace the Propertys roof. The policy appears to have the coverage for it ( water coming in from the roof ) ( for {$16000.00} it should have ). An additional problem I was subjected to by ( M & T Mortgage Insurance Department ) between [ XX/XX/XXXX and XX/XX/XXXX ] whereby the M & T Insurance Department paid [ the property insurance company ] two ( 2 ) Yearly insurance Premium Payments instead of one out of our escrow account. After pushing ( M & T ) approximately a month to get the money back, there is approximately {$700.00} still missing.
