Consumer Complaint: I opened a XXXX XXXX checking account at M & T bank XXXX branch on XX/XX/XXXX. I'd received an advertisement from M & T a few days before that which said I could qualify for {$300.00} if I opened a XXXX XXXX account and fulfilled certain conditions. I've attached this advertisement. The condition to fulfill for earning this bonus was to set up recurring direct deposits from an employer and receive at least {$500.00} in direct deposits within 90 days of account opening. I set up direct deposits from my employer and received a direct deposit of {$1500.00} from my employer XXXX XXXX XXXX on XX/XX/XXXX. I received further direct deposit of {$2400.00} from the same employer after the 90 days, but had clearly received more than the required {$500.00} in direct deposits inside the first 90 days from account opening. The advertisement stated that the {$300.00} was to be paid out within 90 days of receiving {$500.00} in direct deposits, which should have been XX/XX/XXXX. I was never paid this money. I should mention here that there was another condition in the advertisement to be fulfilled, and that was I could not have received a bonus on an M & T personal checking account in the last twelve months counted from when I opened the account. I did receive such a bonus in XXXX on a different account, but the last bonus I received an an M & T personal checking account was on XX/XX/XXXX. XXXX while I opened this account on XX/XX/XXXX so more than twelve months had passed since the last bonus. So it's clear I was eligible for the bonus and met all conditions but was still not paid the {$300.00} on time. I also made doubly sure that the banker I opened the account with actually applied the promo code to my account. Not only did I give her the code verbally and see her put the code on the application, I actually emailed her the advertisement while she was opening the account so I may have proof that I presented the promo code while opening.

Consumer Complaint: The images I will upload to this complaint are dated, top left corner of my phone screen I have a permanent date bar, which I set to be always on for the purpose of taking screenshots of my bank account with the date in the shot. Images will show exactly the scam I'm about to explain XXXX XXXX personal checking- no pending transactions XXXX XXXX personal checking- no pending transactions, but a processed transaction pre-dated for XX/XX/XXXX. This transaction momentarily took my account negative, however I immediately transferred money from my business account to cover the negative amount. XXXX XXXX even though I added more than enough money to cover the pre-dated transaction, M & T bank still charged my an overdraft fee They do this ALL THE TIME. Transactions are listed nowhere, not even pending, then a day later they show up pre-dated for days before. The only reason to do this is to manipulate the transactions to STEAL an overdraft fee. This is 1 instance. I have ATM receipts and pictures of my account that prove this is a regular habit for M & T bank.

Consumer Complaint: Yet again M & T bank is pre-dating transactions ( specifically checks ) with the intention of removing the opportunity for account holder to add needed funds before an overdraft fee occurs. I have an entire folder of proof of this scam. I'm a bit of a night owl, I always check my accounts after XXXX, and very very often after XXXX. It's not a matter of the checks going through at a later time. They sit on these transactions, they are nowhere to be found, not even in " pending transactions ''. They lengthy agreement I signed with M & T bank promises the opportunity to deposit funds by XXXX to avoid fees. They hold these checks and do not post them to account ( pending or otherwise ) at least not on account holder end. Their staff maintains they can see them the day before. Even worse. They can see them predated, account holder can not. This is why I take screenshots and save every ATM receipt. Just today a check took my account negative. The check posted with yesterday 's date. I checked my account at XXXX, nothing pending. This morning after XXXX, check posted with yesterday 's date and negative account. Please let me know where to send the rest of my screenshots, receipts, and other docs I have confirming this scam. I attached only 4 screenshots, I have too many to add all of them here

Consumer Complaint: I applied for a COVID 19 forebearance in XX/XX/XXXX due to losing my job because of Covid 19 and today I received a Debt collection letter from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX stating that my car loan payment wasnt received for XXXX and they are reporting this information to the credit bureau agencies. I received an email shortly after my application for forbearance that my request to not pay for 3 months was accepted but they are now still reporting this lack of payment to the credit bureau. I received the delinquency letter from them dated XX/XX/XXXX and When I just called them they said they called me and I didnt answer the phone so they are not accepting my forebearance request. This bank is not following federal guidelines due to the Covid 19 crisis mandates. Please contact XXXX XXXX XXXX XXXX to ask them why they are not abiding by Federal rules.

Consumer Complaint: I discovered a fraudulent transaction on my bank account. It was completed electronically through my bank without my knowledge. The company is XXXX XXXX XXXX XXXX. When I called their toll free number ( XXXX ), a service answers that does not identify the company but placed me on an extended hold. I researched the toll free number and found this site https : XXXXXXXX XXXX At the time I looked, there were 21 reports of fraud by this company in the span of 13 days with at least three different banking institutions. It appears that they may have hacked or otherwise found a way to access accounts from M & T, XXXX, and XXXX XXXX XXXX at a minimum. The individuals who said they were able to speak to a person from the toll free number stated that that person could not identify the companies that charged the funds but that it was for random internet sites. All of the complaints had similar small amounts of funds taken without their knowledge. NOTE : Step 4 of this process required that I name the company the complaint is about. This is not possible since the company is a FRAUD and is not listed in your system. Unfortunately, I had to enter the name of my bank.

Consumer Complaint: We have attempted multiple times to contact M & T Bank mortgage servicing ( XXXX ) regarding a claim check in which their name was put on it by our Insurance Company, XXXX XXXX XXXX. In the attempts in which I have spoken to someone we have received many different responses, 1 ) we find your mortgage paid in full so you need to contact our customer service department and request a mortgage clause letter so that it releases our name fro the check 2 ) we found that your mortgage was transferred and we have no further information so we can not release our name at this time 3 ) Per representative, I can not find a mortgage with you as lender so I will need to request an investigation which an take 15 days, and someone will be in contact with you at completion of investigation. Now here 's the issue, we have not ever had a mortgage with this company and have no idea how they have ended up on a insurance claim check. I have contacted the insurance company and their response is they receive this information from a third party fax machine in their office and without investigating or asking client they just add company to the policies. It would be helpful to get to the bottom of this issue so that we could claim the check and get it reissued. Thank You for this consideration

Consumer Complaint: I contacted my loan company M and T Bank about placing a forbearance on my mortgage payments due to COVID, which are XXXX a month. They agreed to a 6 month forbearance but, when I asked that the payments be placed on the end of my loan, they said they could not do that. I mentioned that was an option under the CARES act, but they only said they could review my situation at the end of the forbearance period. When I asked if all my payments would come due at one time at the end of the forbearance, they said yes. I then mentioned that under the CARES act, that I could avoid that, but all they kept saying is that they would review the situation at the end of the six months. I am now in a forbearance plan facing an uncertain future about what I will owe at the end of six months, and the consequences of what will happen if I have to pay 6 mos of mortgage at one time. Consumer Complaint: ATTENTION M & T MORTGAGE : Eventhough XXXX XXXX XXXX , XXXX was the Originating Servicers in XXXX when this loan/mortgage was created, the company ( XXXX ) is touting that they sold you [ M & T Mortgage ] the mortgage in XXXX. ( See XXXX attached copy ). And wants to eliminate themselves from the Wrongful Acts that they carried out in ( XXXX and XXXX ) because they stated that you were sold the loan in ( XXXX ). ( See all information in this complaint ). So I am sending your company [ M & T ] the complaint ( which I thought the CFPB sent you already ). The below information explains in further detail of what was requested of ( XXXX XXXX XXXX , XXXX ) in the previous complaint that was not remotely or respectively answered. Amongst many other questions that should have been answered and Corrections that should ( should have XXXX been made. See CFPB # XXXX-XXXX. In XXXX while originating our loan application, you, XXXX XXXX XXXX , XXXX Circumvented the Florida Law reference A Borrower and A Married Borrower in the State of Florida. Which forms a [ Tenancy by the Entireties ] which treats the husband and wife as a unit. In the State of Florida, any Real Property or Personal Property held by husband and wife as ( tenants by the entireties ) belongs to neither spouse individually, but rather each spouse owns the whole property. And both signatures are required for any change in document terms ( i.e. Loan Modification Agreements ). You ( XXXX XXXX XXXX ) made my husband ( the Sole loan borrower ) on the loan application of your own volition, instead of the both of us on the application form. Which there should not have been any reason we couldnt qualify together. But even so, because we are a married unit, the Florida Law did not call for your company to dictate Spousal Rights ( in favor of my husband ) over our Real Property. ( i.e. telling me I need permission to discuss my real property with you ( XXXX ) or/and ( M & T Mortgage ) or any other entity ( i.e. CFPB ). It was Reckless, and Manipulative to further circumvent the Florida Law to create your own rules to [ exploit Rights of Power to discuss any business regarding our real property to my husband ] and simultaneously created a wall shielding the Spousal ( WIFE ) from being able to ( Call Your Servicing CompanyXXXX M & T Bank- mortgage/servicing ) to discuss any business matters in reference to our investment property. That was, and still is a Reckless, Destructive Act that could cause Severe Problems regarding property asset distribution between a Husband and Wife in this State.
