Consumer Complaint: This is my spouse and I third attempt to have M & T Bank cooperate with us. The two prior complaint numbers are : XXXX and XXXX Both complaints have been closed with no satisfactory resolution. Quick summation of the 1st two complaints : We requested M & T Bank to complete a simple " hardship/goodwill '' update to the payment history of mortgage account they have listed on our credit report. Basically we requested to have the late payment for XXXX of 2019 removed from our credit report. Doing so will allow my veteran spouse and I to close on our next home sooner in stead of later. In M & T Bank 's official response to the 1st two complaints they simply stated that reviewed their records and that the information is correctly reflected on our credits reports. Since M & T Bank neglected to address and respond directly to what we actually requested, we feel that it is necessary to try again. We will like for M & T Bank to directly state why they refuse to grant us our request ( is there a law or act preventing them from granting our request ). Prior to them supplying their official response to this 3rd complaint ; we are asking them to consider the following : - Please consider all of the information reported in the 1st two complaints. It was in those complaints we described with great detail the hardship we reference in all three complaints. - In their official response to complaint # XXXX, they openly admitted and apologized for delaying the release of some of the $ 200,000+ escrow funds that our insurance company gave them to complete the repairs to our home. This admitted to " mistake '' delayed us in placing our house on the market to be sold by at least three months. - Per M & T Bank 's official response to complaint # XXXX, they purchased this VA mortgage from XXXX while we were in the middle of catch up payment plan with XXXX. According to M & T Bank, the day they took control of our account, we were already 60 days behind on our mortgage. But the other part that failed to mention was that it took my spouse and I more than a month to reach the correct person at M & T Bank to properly discuss our situation and establish a new payment plan that would allow us to save our mortgage from going into foreclosure. I guess one can assume that M & T Bank purchase our mortgage expecting to eventually turn a profit. Surely they must of been under the impression that this mortgage was going to default into foreclosure. We believe that this is a correct assumption since they acquired the account while it was in default ; plus it took them several months to grant us online access to our new account with them ; thus preventing us from having readily available access to pay our mortgage during our hardship. They mentioned that if their customers ' accounts are not current, they lock their online access to the account. That makes absolutely no sense, unless your goal and purpose is to cause your customer to default bad enough for foreclosure. So please answer this question directly too, what is the purpose of locking your customers online account access if their account is not current. We are struggling to understand this company policy. Personally, we believe that it is a terrible policy ; maybe someone can shed some light on to this for us. Because, not only is it your company 's policy to inconveniently lock online access to your customers ' accounts, your company also has the audacity to charge extra fees to make payments over the phone with your reps. -Finally consider the fact that my spouse is a veteran of two services, that this a VA mortgage we are discussing and that your are preventing/delaying us from securing and new VA mortgage, and the fact that had M & T Bank not made it next to impossible pay our mortgage once you'll acquired it- we possibly could of caught our mortgage up well before XX/XX/2019. By the time we managed to talk to correct person at M & T Bank ( especially with no online access to our account ) my spouse and I ended up having to pay >150 % of monthly mortgage payment for several months.

Consumer Complaint: My family and I are going through a difficult and stressful situation made even more stressful by my new mortgage holder, M & T Bank. Just before XXXX last year we discovered that our dishwasher was leaking for quite some time. It was to the extent that our kitchen and adjacent bathroom floor were damaged, and mold had started to grow. The workman who discovered the leak advised us to contact our insurance company. The insurance company sent in teams to block off the kitchen area, remove the counters, flooring, and to conduct mold abatement. When this was completed and the tests came back negative, the insurance company recommended a contractor, XXXX XXXX XXXX, to reconstruct the kitchen and bathroom. We signed a proposal with them and they were scheduled to start after the XXXX holidays. On the day the contractor started work, I paid {$2500.00} towards the half of the {$31000.00} we agreed to pay them at the start. The remainder will be paid when the work is completed. Around that time we received a check from the insurance company for {$24000.00} made out to myself, my wife XXXX, and M & T Bank. XXXX took the check to the M & T branch in XXXX XXXX to get it endorsed. They refused and instead gave her a number to call. They also advised her to get a home equity loan. XXXX called the number and was given an address and information to mail the check along with several documents. She complied, endorsed the check, and posted it with the documents. This was over five weeks ago. During this time, we received at least five calls from the bank requesting all manner of seemingly unrelated additional documents : some documents we already sent to them, some documents we don't possess, and some documents that are completely unknown to us. We sent the check to be endorsed and returned so that we can pay the contractors for their work. Instead, M & T Bank cashed the check and is now holding on to the funds. As a result, work has stopped on the repairs and my family and I are without the use of a kitchen and a bathroom, 162 days and counting. We are unable to even accommodate our son with XXXX at home because of this situation. Given the current state of affairs and the restrictions brought about by the coronavirus outbreak, there is no telling when our hardship will be resolved. All this difficulty my family is facing could have been avoided if the bank had done the right thing in the first place. To make matters worse, the insurance company refuses to compensate us for the continued inconvenience, even though it is a coverage included in our policy. We would greatly appreciate any help or advice you can provide.

Consumer Complaint: After speaking with an attorney who identified himself as XXXX XXXX of XXXX XXXX about an inheritance document ( that was later found to be forged along with death certificates and notarized court documents ) ..I then realized that he stole the identity and letterhead of the actual XXXX XXXX as I called the correct office of the real attorney who I thought I was dealing with. The real XXXX XXXX told me it was not him and I was involved in a scam. Along with the stolen identity of the attorney was another party who pretended to be a bank audit department head ( XXXX XXXX of XXXX XXXX in the XXXX ) using the exact same letterhead and phone exchange as the real XXXX XXXX in the XXXX. Before I realized all this they had me wire funds ( {$7700.00} on XX/XX/20 and {$31000.00} on XX/XX/20 ) to their so called domestic trust account at M and T Bank at XXXX XXXX XXXX in XXXX MD. The name on this account was XXXX XXXX XXXX and account # XXXX. Upon realizing this fraud I went to my bank ( XXXX XXXX ) and had them order a reverse and stop transfer of fund request and told M & T to investigate these transactions due to fraud but my bank or myself has yet to hear from them. I reported this to the FBI as well as local authorities

Consumer Complaint: M & T Bank, XXXX. Contacted on XX/XX/20 at this number after contacting refinance dedicated number XXXX with automated response " MESSAGE CENTER FULL '' and disconnected. Initially after 45 min hold XXXX responded that he was only relay to Loan officer and hung up. Repeated tries, I was able to get XXXX of another Bank Department who attempted to onnect me with loan officer and failed. She arranged for 24 hr call back by a loan officer. Well, 24 hrs have passed nd no call. I bleive that M & T Bank is a debt collector and there is more incentives to get customers into debt than provide normal services. Thank You

Consumer Complaint: In XX/XX/2020, M & T Bank was complicit in fraudulent transactions based on forged unauthorized withdrawals from my checking account. Two of my checks were stolen from the U.S. Postal Service mail. The amounts and the payee were changed and and the authorizing signature was forged. The checks were submitted to M & T Bank for withdrawal of funds and M & T Bank released the funds from my account. The signature endorsement on the back of two checks, that was routinely required before M & T Bank processed these transactions, is MISSING. The financial institution involved in this transaction is not visible. M & T Bank representatives can not tell me how these transactions occurred and they can not tell me the name of the other financial institution invovled in these transactions. The M & T Bank Affidavit of Forgery Alteration Unauthorized Check Form was submitted to M & T Bank along with a police report on XX/XX/2020. Two forged M & T Bank checks, totaling {$10000.00} were involved in the transactions. M & T Bank has not restored the funds to my checking account.

The issues which you avoided went right to my fundamental right to be free from inaccurate reporting as well as fraud and identity theft. One can only assume that the avoidance of those issues is an indication that you have more to hide. Your company failed to provide a responsive answer which would satisfy my right to information requested. I wish to make public notice of the following : 1. I filed a complaint with the cfpb. The complaint challenged the legal sufficiency of your actions. c. Your companys response appears intended to misrepresent and mislead me into believing that your company is in possession of sufficient substantively admissible facts to establish your right to report or collect on an alleged debt without having produced said facts. d. Your company has failed to provide me with substantively admissible facts sufficient to show that you have or had my express written authorization to use my personal identifying information in connection with the collection of the alleged debt in question. e. Your company has failed to provide me with verification of the alleged debt in question or contract in the form of a credit application. f. Your company has failed to provide me with substantively admissible facts which would show that I have agreed to any terms and conditions relative to an agreement with your company. g. Without a witness to swear to proof of service/proof of mailing of any billing statements, I am forced to deny the existence of any such account stated. h.
