Consumer Complaint: On XX/XX/20 I had a checking account balance of {$220.00} in my M & T Bank account. Due to a mishap with my former employer my direct deposit was delayed in error. Several transactions began to come in from my debit card. These transactions were prescheduled and because I had no idea that my pension check would be delayed. I wasn't able to cancel the charges. My account became overdrawn for {$130.00} and I was charged an overdraft fee. I was fine with that because this was an error that the bank didn't have anything to do with, it was my fault. Several other transactions continued to come in around this same time. XXXX XXXX M & T declining them because they all were debit card transactions. They allowed every transaction to come through causing a huge overdraft on the account. I contacted them and questioned why this was done and I was told because I had some overdraft protection that allowed them to pay charges even if the money wasn't available. Well the only problem with that was that I told them a month earlier via phone to remove that feature. Because this caused a small overdraft in XXXX XXXX XXXX pension was messed up again the payroll department, put my direct deposit information into another employees profile. This caused my pension to be deposited into their account and vice versa. ) My husband and I both were on the call demanding they remove this feature. We were told then that it would be removed. They explained the ramifications of what happens when this feature is XXXX. They stated this would have any transaction would be declined if the funds weren't available. We still cancelled it. They literally allowed XXXX transactions to come through the already negative account. M & T charged XXXX NSF fees at {$38.00} per transaction. Most of the transactions were less than the NSF fee. XXXX in particular was under {$3.00}. I contacted the bank and demanded an explanation. If the account already had a deficit then why continue to allow transactions to be approved. I was given the runaround for months with no resolution. The account is now negative {$1000.00} and they are threatening to send it to collections. I have no problem paying the money for the transactions that posted, but I do not think it is reasonable for me to have me pay {$500.00} in NSF fees. I believe without a shadow of a doubt that this was done intentionally to create a windfall in the bank 's favor. They literally charged me just about as much as the transactions that posted. I also would like time to clear up the balance. I am XXXX on a fixed income. I receive XXXX and a XXXX pension from my former employer. My husband is currently out on workers compensation for a crushed hand. We do not have an extra {$500.00} to give anyone. Under these circumstances where the bank allowed this we shouldn't be held responsible for anything other than the transactions total amount. I do not want my credit ruined because of their error. In closing I am requesting that the CFPB conduct an investigation into these types of practices by this institution. It also seems very convenient that the total amount of the overdraft fees, is very close to the amount I XXXX in a bankruptcy recently from a prior account. I want to pay my debt but I need reasonable payment arrangements and the fees removed. They had the power to decline and they didn't because they wanted to benefit from the NSF fees.

Consumer Complaint: At the end of XX/XX/XXXX, I attempted to make a payment on a personal loan I had with M & T Bank, only to find out the loan had been paid off without my knowledge. I suspected it was a mistake and called to find out what happened only to be told by my loan officer, XXXX, that he couldn't tell me where the funds came from and that I should " not worry about it, since it's paid off. '' The loan was closed and an additional {$3500.00} was sent to me via check. I deposited that money into my savings account and sat on it, strongly suspecting it wasn't mine but not knowing to whom it actually belonged. I also received a letter dated XX/XX/XXXX, informing me that the loan had been paid off and closed. It turns out, a car dealership from whom I purchased a vehicle in early XXXX sent a payoff amount for my trade-in to the wrong bank. ( In order to facilitate the sale of the vehicle, the dealership actually issued a second payment to the correct bank. ) The dealership had been attempting to recover the funds mistakenly sent to M & T Bank beginning less than 48 hours after the mistake had been made. On XX/XX/XXXX, I received a phone call from M & T Bank informing me that there had been a mistake and that they had taken out ( WITHOUT my authorization or signature ) a new loan in my name back-dated to XX/XX/XXXX and were taking ( again, without needing my signature or other authorization ) the amount of {$3500.00} from my savings account to rectify the mistake. Meanwhile, the dealership had been trying to get its money back unsuccessfully until the funds were returned to them on XX/XX/XXXX. So that means that, during all this time, M & T Bank had possession of the funds. My complaint against M & T Bank is this : they have issued a new loan in my name with backdated interest to XX/XX/XXXX in the amount of {$110.00}. It can not be stressed enough - this is interest on money that was in their possession during this period of time. The dealership had not been reimbursed, and I did not have an open account from XXXX until XXXX. The remaining balance of the loan at the time the mistake was made was {$4000.00}. The loan reopened in my name was either reopened without my knowledge in XX/XX/XXXX or backdated to accrue interest from XX/XX/XXXX and was reopened in the amount of {$4100.00}. I have spoken to several members of M & T Bank, from the branch manager to the corporation 's customer service line. I have told them that the loan should have been reopened in the amount of {$4000.00}. All of them told me " tough luck '' and refuse to change the amount. It should be noted that, given the fact that my " new '' loan number is the same as my " old '' loan number, it would appear that M & T Bank has actually attempted to erase the mistake from its accounting records altogether.

Consumer Complaint: We built a new home in XXXX in XXXX XXXX, Minnesota. During the closing process we noticed that somehow the escrow got setup for us to pay the anticipated " full '' taxes for XXXX at {$4300.00}, or {$360.00} per mortgage payment. After closing we we told to make 1 payment then call to get the taxes and escrow payment adjusted. We made our XX/XX/XXXX payment. To preface the main issue, in Minnesota, per MN Statute the value used to XXXX property taxes for a certain year is based on the value of the property on XX/XX/XXXX of the previous year. So for XXXX taxes the value to base those taxes on is based on the value of the property on XX/XX/XXXX. For our property the value is based off of it being a vacant lot, proposed at {$23000.00}, with a homestead exclusion of {$9200.00} for a taxable value of {$13000.00} which makes the proposed taxes for XXXX {$210.00}. I called M & T bank in early XX/XX/XXXX to have them correct the XXXX taxes from the {$4300.00} to the {$210.00}. They opened a case up and told me that the case would take 5-10 business days to resolve. When I called back @ XX/XX/XXXX they said the case had been closed and the taxes they had at {$4300.00} were correct. I explained the situation again and asked the to open a new case as that was not correct. They opened a new case and I sent them a document I received from XXXX County with my proposed XXXX taxes listed at {$210.00}. On XX/XX/XXXX I called again to find out the resolution. Once again I was told by XXXX that they had the correct amount and that the case had been closed without changing my payment. At this point I was getting extremely frustrated and asked to speak with a supervisor. I went through the same process of explaining the situation and opened another case. She told me that they can't speak directly to the " research " department handling the case. She once again told me that it would be 5-10 days. I called on XX/XX/XXXX again and once again was told that everything was correct in their system. I once again opened a case and also uploaded to them a letter from the XXXX County assessor, XXXX XXXX, who I had talked to about this XXXX tax issue. Once again I called on XX/XX/XXXX and spoke to a XXXX who informed me of the same closed case. I asked to speak with a supervisor and was told none were available but would call me back in 24-48 hours. I again opened a case and subsequently never did receive a phone call from a supervisor. XX/XX/XXXX, I called and spoke to a supervisor XXXX who informed me of the same closed case scenario. She though went one step further and actually called XXXX XXXX in a conference call with me. XXXX confirmed the proposed XXXX tax amount, based off of the undeveloped lot as of XX/XX/XXXX. She opened another case .... That is where we are at today, XX/XX/XXXX

Consumer Complaint: I use M & T bank. I get scammed recently by somebody and this person told me to send them money. The scam was about a job. They send me a check for about XXXX $ and they ask me to send this money for the supplier for some supplies. They ask me to send it through XXXX money transfer. They ask me to send XXXX XXXX They then send me another check for about XXXX XXXX When I realized I get scammed after 24 hours from money transfer, I went to the bank and told them the story and I asked them to stop this money transfer, they told me they can't. At the same time, they accept the checks firstly online, and after that they told me it is fraud.

Consumer Complaint: I open up a RV Loan with M & T Bank in XX/XX/XXXX. Recently The RV was flipped and considered totaled after hurricane Zeta on XX/XX/XXXX. Most {$31000.00} was paid in XXXX which still left a balance of around {$4100.00}, the balance as of today is {$3100.00}. I am currently as always making payments on time and have never had a 30 day late. I have very good credit and do not want to do anything to change that especially during these hard time. I had a collection call from someone with a dog barking in the background so I was a little weary. She told me my account has been closed and needed to be paid by with in 20 days or it will be sent to collections. I have all intentions of paying it. I am still dealing with the GAP and RV Dealership to rectify this situation. In the mean time I planned on making all my payments in full if not more every month until this balance is paid in full. She told me it needed to be paid in full this month.

Consumer Complaint: There are 3 people on the loan ( XXXX, XXXX, and XXXX XXXX. My sister XXXX XXXX XXXX started to make payments for us in XX/XX/XXXX due to financial difficulties. We applied for the forbearance program back in XX/XX/XXXX due to COVID. XXXX lived in a different state and when she came home and noticed that the payments were not being applied as requested, we requested the forbearance program again about XX/XX/XXXX. We received confirmation that forbearance program began XX/XX/XXXX. We paid {$13000.00} during fiscal year XXXX and the amount due including principal and interest for the fiscal year is {$14000.00} - note that XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX was not due, due to the forbearance which amounts to {$3700.00}. We filed a complaint previously w/the CFPB previously and M & T noted that XXXX is not an authorized 3rd party when she is a loan holder and CFPB closed the case. We called M & T mortgage and they said the person reviewing the file had to go to a second screen. It is very frustrating. To give credit, after the complaint was filed M & T did apply some of the payments towards the principal but now have a {$74000.00} payment unpaid for XXXX. I'm not sure how this was done but now our credit score is negatively impacted even though the forbearance program is not supposed to have any negative impact on your credit. I have been on the call w/M & T mortgage for literally XXXX to discuss this just today alone which ended up either in a disconnect or a hang up. CFPB was not that much helpful when I called after my frustration that I am in fact on the loan and their response that I am not an authorized 3rd party is XXXX - excuse my language.

Consumer Complaint: Between the dates of XX/XX/XXXX-XX/XX/XXXX someone used my business debit card to purchase $ XXXX {$7000.00} worth of high cost items. 38 charges for random products such as shoes, batteries, child face shields, dog boots and more. My account was taken down to only {$900.00} left in the account. I only realize what was going on when I started receiving these packages. Not once did the bank call me or freeze the account. They just watched someone continue to run charge after charge all day long mainly on XX/XX/21. Charges were not small items. Charges were XXXX, XXXX and more. I want this incompetence looked into. I am just a small middle class mom of 2 trying to run my own candle business. Im appalled at the lack of action of M & T bank. It took me months to grow the amount in that account by working 16 hours a day for the pay several months, just to have someone drain it in 48 hrs. I have contacted the police and filed a police report and I have also contacted the FBI. Whoever did this is having all of these packages ( 38 of them ) delivered to my home. It has been advised to watch my home as we are not sure if someone is watching my house to collect these packages if they can. I cant even begin to explain the emotional stress this has caused let alone the bank is only giving me back at this time 13 of the 38 charges. I am looking into further legal action against this bank as well.
