Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I first began receiving text messages of a " XXXX XXXX '' in XXXX XXXX I contacted the Creditor who is supposedly owed the debt on or around XX/XX/2023 regarding the balance ; the agent advised my account is in good standing and I have no outstanding balance. Moreover, to be certain, I encouraged the Agent to validate with her supervisor to confirm, which she did and subsequently advised me to ignore these notices as SPAM. I received a written notification from a debt collector in XXXX, which I disputed online and in writing ( on XX/XX/XXXX ), however I've since received a subsequent notice from a debt collector

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon, and I didn't sign an agreement on. A legal contract is signed by two parties, and I did not participate in any of it. More so they didn't follow the proper 5 step validation procedure which make these unfair practices. The balance on my credit report is not the same balance I have with the original creditor. Furthermore, I was never sent correspondence notifying me that this account was sold to IC SYSTEM INC which is another violation. I received nothing in the mail leading up to this collection being reported. This account was added in XX/XX/2023. I am requesting a copy of the correspondence mailed to me during that time informing me that I had a debt with your company. If you can not provide this, then that is another violation. According to the FDCPA Im entitled to XXXX dollars per violation. I demand this company to delete this account from all XXXX credit reporting agencies and compensate me for the violations or I will have no choice but to forward this to my litigation attorney.

Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: In accordance with the Fair Credit Reporing Act, I C System has violated my rights. 15 U.S.C 1681 section 602 A states I have the right to privacy. 15 U.S.C 1681 section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions. With regard to I C System who is the collection agency responsible for an original debt owed to XXXX. First and foremost, I C System furnished my credit report to the credit bureaus for the purpose of investigating a dispute without my written instuctions which has violated both section 602 A and Section 604 A Section 2. Furthermore, the dates reported on my credit report are incorrect. The date the account is listed to have been opened is fraudulently reported. I have disputed this information with IC System in an attempt to rectify the incorrect dates appropriately, however, I C system continues to knowingly report false information on my credit report. Some versions of my credit report depict different account information than other version of my credit report reporting on this same account, a clear and obvious depiction that I C System is reporting incorrect information as I C System, themselves, can not even keep the information straight.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: I am submitting a formal complaint against I.C. System, Inc., a debt collection agency, and XXXX, the credit reporting agency. The issue stems from a modem/router combo that I returned on time to AT & T U-Verse in early XXXX. Unfortunately, I was not credited for the return, leading to a charge of {$450.00} for the equipment. This debt was subsequently sold, and a collections agency named XXXX pursued me through the credit reporting agency XXXX. I disputed the collection with XXXX, and they conducted a thorough investigation, ultimately ruling in my favor by declaring the collection invalid. However, my struggle did not end there. I.C. System, Inc., yet another debt collection agency, opened a collections account with XXXX on XX/XX/XXXX. Frustratingly, I have made XXXX attempts to dispute this collection with XXXX, both through online channels and over the phone, but their responses were not helpful at all. The first time I raised the dispute, XXXX got back to me within a few days, only to offer an unsatisfactory resolution. The second attempt was even worse, with a response received in less than XXXX hours that did not address the issue adequately. The third time around, the outcome remained unchanged, leaving me extremely dissatisfied. I strongly believe that my rights under various XXXX Codes have been violated in this situation. For instance, as per 15 USC 1681s2 ( A ) ( 1 ) A, no person or agency should provide inaccurate information to a consumer reporting agency, which seems to have happened with I.C. System, Inc. 's actions. Additionally, 15 USC 1681c ( a ) ( 5 ) explicitly states that consumer reporting agencies like XXXX should not include any adverse item of information in a consumer report without proper authorization, which I did not XXXX. I.C. System, Inc. and XXXX have been uncooperative, making it incredibly challenging for me to resolve this matter, despite the previous ruling by XXXX in my favor. I am now filing a complaint with the Consumer Financial Protection Bureau to address these grievances and seek a fair resolution. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX is not maintaining reasonable procedures. Also, 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. Please investigate this matter and take the necessary actions to ensure that my rights are protected and that the inaccurately reported collection is removed from my credit report promptly.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: I am writing this formal complaint to express my serious concerns about the unprofessional and illegal actions of IC System Inc. ; reference : ( XXXX ) who have persistently engaged in actions that are in clear violation of the Fair Debt Collection Practices Act ( FDCPA ). In particular, the agency has violated the following sections of the FDCPA : 1. Section 806 ( 5 ) : This section prohibits a debt collector from causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. However, the collection agency has been calling me multiple times per day, including before XXXX XXXX and after XXXX XXXX, which is clearly aimed to harass and intimidate. 2. Section 807 ( 10 ) : This section prohibits a debt collector from using false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer. Despite this, the agency has threatened me with actions they can not legally take, such as wage garnishment and imprisonment, which is an egregious breach of this statute. 3. Section 809 ( a ) : Under this section, within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall send the consumer a written notice containing various details about the debt. I have yet to receive any such written communication from the debt collection agency, demonstrating a disregard for my rights under the FDCPA. 4. Section 805 ( b ) : This section specifies that a debt collector may not communicate with any person other than the consumer in connection with the collection of any debt. However, the agency has repeatedly contacted my family members, friends, and employer, causing me personal embarrassment and potential professional harm. The actions of the debt collector have caused significant emotional stress and damage to my personal and professional relationships. The collect reminder does not even include a full list of might rights under federal, state, or local laws. I would like the CFPB to take strong action against the debt collector and to ensure that the company complies with the FDCPA and does not attempt any further action to collect this illegal debt.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: Initially, I received notification on my consumer report under XXXX XXXX about XXXX, I wrote to them request a detailed debt validation request via certified mail dated XX/XX/23. I received a generic debt collection letter from I XXXX Systems Collections as a follow-up. I wrote again to I C System on XX/XX/23 and XX/XX/23 via certified mail and repeatedly received the same generic attempt to collect a debt, disregarding my request for specific documents for verification. That alone is a violation under FCRA. I wrote directly to the credit bureaus to request an investigation and it is simply being auto verified by just simply being on my credit report. I will provide copies of letters sent asking for a cease & desist until a proper investigation & render of documentation has been provided for this alleged debt. This reporting has damaged my credit report & caused a lot of losses for my family & I, by its presence on my profile. Please supply requested documents on the letter dated XX/XX/23 to validate this debt. Additionally, while this account is being investigated, I request a cease and desist of this reporting. Should this information not be available, I request immediate deletion from my credit report.
