Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I received a letter in the mail from a company called IC Systems, asking me if I would like to accept an offer settlement for a debt I do not owe or know anything about. This debt can not possibly be mine as it states the original creditor is XXXX. I currently have an account with XXXX and have been a loyal customer for XXXX years. How can I have a collection account and have my service on at the same time? I have already submitted an ID theft/ Fraud report because someone has been attempting to obtain credit in my name. Under the XXXX XXXX Collections Practices XXXX a debt collector is to provide proof and validation that this debt even exists. You did not do that. Because it doesnt. I am demanding you provide a copy of the original contract signed by me and prove that is my real signature, a full accounting ledger of this debt, and proof that I even owe this debt. You will not be able to do that. 15 USC 1692b and c states that a debt collector must cease all communications and collection efforts once notice is received. This is your notice. 15 USC 1692g states a 30 day notice must be given to a consumer to dispute the validity of a debt. I never received a notice. You placed this on my credit report to be malicious and as a scare tactic. You are attempting to put me under duress and force me to pay this debt. I have filed a Fraud report with the Federal Trade Commission, if IC Systems had followed the law and taken the proper precautions before reporting this to the major credit bureaus, you would know that. Under 15 USC 1681 all fraudulent accounts reported by a consumer that furnishes a fraud report, are to be removed within four days. XXXX, XXXX and XXXX have been put on notice already. Because this so called company failed to complete their due diligence you are in violation of these rights protected by federal law. XXXX CFR XXXX gives the consumer the right to opt out under the Fair Credit Reporting Act, before any creditor places an item on their credit report. Each company is to give a 30 day notice to the consumer and offer this chance. IC Systems has also failed to do this. The Privacy Act of 1974 clearly states that written notice and consent must be given to all consumers before any private and personal information is to be shared from one agency to another agency. Once again IC Systems has failed to do this. Under 18 USC 8, all debt is alleged debt. WE as consumer do not owe any debt and all debt are the obligations of US govt. IC Systems has shown Willful Non-Compliance and disregard to all federal laws. I am demanding that you remove all erroneous, fraudulent, fake tradelines from all credit bureaus within 4 days of receiving this notice and pay a penalty for this violation. XXXX and XXXX were quick to add this tradeline to my report without doing any research, yet take their time or ignore my Fraud reports sent to them. I will be pursuing legal action against these entities.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Problem with personal statement of dispute

Consumer Complaint: I have reached out this Debt Collecting Company by the name of IC Systems. I mentioned that I do not acknowledge this debt that they are making efforts collecting on. I have spoken to Two separate representatives and also Two supervisors that were on duty at that time. I requested a Validation of debt. They mentioned they have no validation of the debt they are collecting on and asked me to provide proof to them that the debt isn't mine that they are making attempts to collect on behalf of a creditor. However they are in violation of Utah Code Law. That clearly states that need to provide validation of debt in order to make attempts to collect debt. This collection company is inaccurately reporting information to credit bureaus that is affecting me negatively and has costed me lot of money. Along with that it has hurt my ability to obtain new accounts such as mortgage and has affected my credit rating. I now demand that this information be removed if ic systems are not able to provide validation of debt immediately so my credit report is accurately being reported to the credit bureaus.

Subissue: Attempted to collect wrong amount

Consumer Complaint: I am disputing a {$580.00} charge from XXXX who have been sending me a bill for a XXXX account I NEVER activated. I received a bill from the company every month for three months until it was sent to debt collections. Every month I received the bill I would call XXXX, the technician would confirm that I never activated the lines and that they would take care of closing the account and that no money was owed, only to receive another bill with a late charge the following month. Here is the complete story : I was interested in switching phone companies back in XXXX from XXXX to XXXX. I received " cards/chips '' from XXXX that were to be put into our cell phones when we were ready to activate then, I was clearly instructed not to cancel my current XXXX account until we activated the " cards/chips '' into the phones, but they did not send all the cards for the XXXX lines and when they told us to go to a XXXX store I said that wouldn't work because my elderly parents were out of state and I wouldn't be able to get them to a store, so I said forget it, I don't want to switch to XXXX, in which they said XXXX okay, we will keep this account open just in case you change your mind but you won't be charged anything ''. Sure enough, I received a bill the following month for {$300.00} for all the lines. When I called XXXX, they said " hmm, that's strange because we usually cancel with the other phone providers when you switch to us but since we can confirm you never activated these lines we will take care of this charge and close this balance ''. One month later, another bill with a late charge. I call again to both request to close whatever account is open and causing this problem and to see why the balance was not settled. Their response " hmm, let me put you on hold '' I wait on hold, the technician then says " yes I confirmed with our staff you did not activate these lines and I see notes here that there was an issue we were supposed to reach out to you but the technician didn't but I will take care of this and you will see a credit for {$250.00} because that's the max I can credit a month but don't worry the following month the rest of the balance will be paid I assure you ''. By XXXX, I get XXXX ( military ) only to come back a month later to a letter from a debt collector and XXXX will no longer take my calls. The debt collectors are now just essentially demanding {$580.00}. I called the debt collectors initially, they said they will only take a statement in the mail disputing the charge because I am from the state of XXXX, then they will reach out to XXXX and we should hear back within XXXX days. So I sent them a statement last week and called them today to confirm if they received my letter in the mail. The debt collectors responded with " yes and XXXX proved you owe the charge so how would you like to pay today? ". I challenged this, I said you told me last week it would take XXXX days how have they already received my letter in the mail from last week and responded? '' She then said " Oh you sent the letter last week? In that case we haven't received your letter yet but I am confused because XXXX already proved you owe the amount '' I then said " Is it just a bill? '' She said " Yes '' and I said " how does that prove anything they send me that bill every month? ". She told me to just wait and call back next week and she would speak to the XXXX. At this point I was now not trusting the debt collectors, and saw on the letter from the debt collectors that I could review the statement on their website. When I went to the website It would not let me view anything and said that they received my dispute, verified the charge and have sent it to the XXXX credit bureau. I was beyond furious obviously. I called the debt collectors back, spoke to someone else, who claimed there was a double dispute on the file and to call back next week. I am literally praying that all the phone recordings from XXXX and the debt collectors are available somehow. I don't understand how I owe XXXX money for an account they repeatedly verified every month that I called them that I did not owe. Thank you in advance for your time and support.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: Upon researching how to file this complaint, I discovered that IC System, the company this complaint is regarding, has violated Regulation F of the FDCPA. IC System did not include an itemized list of charges. IC System did not include a returnable form allowing the consumer to check a box for " This is not my debt '', " This amount is wrong '', or " Other ''. Regulation F requires this to be included in the validation letter, and IC System is in direct violation. IC System has unexplained charges on their debt validation letter. I'm unsure of how to upload a copy of this letter to the CFPB. It lists {$430.00} as " Previous Balance '', which is not a validation of the debt, and has no explanation of where this balance came from. IC System did not send me required correspondence within XXXX days of initial contact, which is required by the FDCPA. IC System has falsely reported negative information on my credit reports after being disputed, and they have refused to discuss a remedy for this false reporting. IC System has caused me measurable harm, and is liable under the FDCPA for up to {$1000.00} in civil penalties. This is an attempt to resolve the matter and have myself made whole. If IC System refuses to resolve the matter with the CFPB intervention, I will be filing a lawsuit.

Subissue: Attempted to collect wrong amount

Consumer Complaint: I've repeatedly contacted IC Systems ( ICS ) XXXX XXXX XXXX XXXX XXXX XXXX XXXX, MN XXXX to ask that they remove an account previously with XXXX XXXX for Cable and internet services in the amount {$130.00}. The company has been report this account as in a collection status since XX/XX/2020. The account in fact was over-paid closed. XXXX actually issues a {$250.00} credit for the overpayment. I reached out to IC Systems several times starting in XX/XX/2020 to ask that they contact XXXX XXXX to confirm the status of the account and I was told that they would not contact XXXX XXXX to confirm the account. I also provided a copy of my receipt of the final payment made in XX/XX/2020 along with a letter asking that IC Systems delete to account. At the time I was just retiring from the military and trying to complete the purchase of a home. Due to the erroneous debt my credit score dropped over XXXX points over the course of 6mos and forthmore impacting my ability to secure a mortgage. I'm currently consulting an attorney to possibly file a lawsuit for damage as result of IC System 's erroneous reporting of this account. I'm also considering pursuing a class action suit again the company for it's practice. Please help.. Respectfully,
