Consumer Complaint: Due to extreme circumstances beyond my control, I was 32 days late on a payment. I've never been late on any previous payments and I am current with all payments now. This happened due to extraordinary circumstances out of my control. I was affected by COVID-19 and unable to access my account or internet/phone from XX/XX/XXXX - XX/XX/XXXX. I was then a victim of auto theft that lead to Identity Theft and had to change all banking /financial information. As I verified all of my financial accounts and filed police reports/investigations I noticed that GM Financial had a different last name associated on my account. They did not notify me of this incorrect Last name at any time. I was alarmed and believed this was due to the identity theft however I found out that GM was at fault for placing a wrong last name on my account. GM had a copy of my drivers license with my correct name and contract signed with my correct name. They are at fault for not verifying and correcting my contract. I called into all my financial institutions to notify them on the XXXX of XXXX. GM has been ( the only institution ) unwilling to remove a 30 day late mark to the credit bureaus. They are unwilling to understand the severity of my situation and take some accountability for an error on my statements/account. I have offered to submit police reports and other documents and they have turned down every attempt I have tried to put forth. From a business relationship, legally and Ethically that this is a violation. In summary the 30 day late payment was Due to a combination of the below events/factors : 1. COVID-19 2. Identity Theft ( Compromised financial accounts and online email, etc. ) 3. GM placing an incorrect name on my contract ( please see attached statement with incorrect Name )

Consumer Complaint: RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. GM FINANCIAL bal. {$5800.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

Consumer Complaint: I took out a lease in XX/XX/2019 on a XXXX XXXX with GM Financial. I have paid all payments on time under auto-pay. For some reason, it seems that GM Financial has a bad and malicious business practice of automatically ending auto-pay 1-mo prior to lease end. In short, I ended up missing the payment and did not realize this was an issue, until I received a notification from XXXX XXXX that a negative mark had been registered on my credit history. In this case, my plan was also to extend the lease and continue paying, which is what I have been doing ( all on time thereafter ). They will say they it's in the fine-print or they sent emails saying that my balance is coming due. Unfortunately, I received these same emails when auto-pay was active so it's think nothing of it assuming that auto-pay will take care of it. In my opinion, this is an unreasonable expectation for a customer to have to manage and has no valid rationale behind it. I have tried contacting GM Financial several times thereafter to request the mark be removed for the reasons described above and that I'm a well paying customer. Unfortunately, they said they could not help and recommended trying a dispute or making a complaint on CFPB. GM 's own customer service professionals note that this is unfair, they don't know why GM is doing this, and that this affects many customers everyday.

Consumer Complaint: I am being persecuted by GM Financial whom is attempting to collect an unlawful balance on a vehicle that was leased through them. They are reporting a balance of {$24000.00} - This entire problem began with a faulty brand new vehicle that had been problematic since day one. I leased this vehicle on XX/XX/XXXX - and the vehicle shortly began to exhibit sudden deceleration problems that was ultimately found to be related to a faulty transmission. Luckily the vehicle was brand new and was covered bumper to bumper. After many repair attempts the vehicle would work for short periods of time and then go back to the same issue, until finally it caused an accident On XX/XX/XXXX. This rendered the car inoperable and had to be towed, mind you, this was during the first Major LOCKDOWN that rendered me unable to go to the toward to retrieve the vehicle, as I had no car and ride share services were not operating at the time. Contacting GM financial resulted in them opening up a claim and since they were the lien holders they agreed to go retrieve the car from the two yard. This is were things get murky, as in the middle of covid lockdown I was informed that the car was sold, and I still don't understand who sold it or how things transpired. The car 's damage was not conducive to it being a total loss, GM Financial had stated they would go retrieve the car out of the tow yard, it was fully insured and still under manufacture warranty. I completely refute and dispute this past due balance that GM Financial is reporting as a past due balance. They completely mishandled this situation and have no right to a deficiency balance.

Consumer Complaint: In XXXX of 2019 I traded my leased vehicle in early for a new lease at XXXX XXXX of XXXX, Mo. months later it showed up on mine and my husbands credit scores that we were 2 months late on payments as we had a joint account. We spoke to the manager at XXXX XXXX and all he said was sorry they salesman you had never filed the paperwork to transfer the loan so it looks as though you were late on the payments?! He said he couldnt fix it!!!! This is the only negative thing on my credit in several years, I would like it removed as it inaccurate and I am not personally responsible for it! Also the vehicle we traded the lease in for went through GM as well so they can see the date of return on the previous lease!!!

Consumer Complaint: Pursuant to the expiration of XXXX XXXX XXXX XXXX GM Financial dated XX/XX/2020, we arranged to return the leased car prior to that date, returning it on XX/XX/2020. Due to our age and comorbidities, we requested ( as GMs normal procedure ) to have the car pre-inspected and picked up from our residence home prior to expiration of lease. No GM inspector was available and the car could not be picked up from our home, again due to Covid 19. Same advice was given by dealerships XXXX XXXX and XXXX XXXX XXXX XXXX CA. We were told to bring the car to the dealer closest to us, ( i.e., XXXX XXXX XXXX in XXXX XXXX CA ). There was no GM representative present at the dealership and the manager representative for the dealer, upon our request, had her representative staff inspect and look over the car in our presence, checked the odometer reading to ensure everything was in order ; car had XXXX miles per odometer on a 3-year allowed lease mileage of XXXX miles. The dealer reported to the manager who then issued to us Vehicle Return Receipt. Per the lease agreement a total disposal fee of {$590.00} is payable at lease end which we offered to pay but advised that GM Financial send a bill for it separately. In a phone call with GM Financial, I was told that in addition to the disposal fee of {$590.00}, we are being billed for {$48.00} sales tax on the disposal fee, not indicated on the lease agreement, and an excess wear and tear scratch on the rim of the tire valued at {$85.00} plus tax. We paid the {$590.00} total disposal fee per the lease agreement, but disputed and contested the validity of the excess wear and tear charge and disposal sales tax, requesting for the evidence supporting the charges such as inspection photos or report of inspection done in our absence. I mentioned that because of GMs representative not available, we requested for inspection done by the dealership manager or representative. However, GM financial stated that the dealership we surrendered that car to, does not represent GM Financial. The XXXX XXXX underwent premium maintenance as warranted by the lease during the lease term as required and necessary. After my payment of {$590.00}, I never received any more statement of account from GM, nor did I receive any advice on the disputed items. I discovered sometime last month that the disputed items were erroneously reported by GM Financial as delinquent, resulting in my and my husbands credit scores to drop from the XXXX for many years, to the XXXX during this unfortunate Covid 19 period. The procedure I would have expected would be a denial of my dispute and further statements of account or delinquency notice, etc., to let me know GM demands payment prior to reporting disputed balance to any credit bureau. This practically ruined our financial ratings and integrity for further financial business transactions. This is definitely an unfair consumer financing practice particularly of a large corporation as GM Financial Corporation. We are still awaiting GMs supporting evidence of the disputed items as described above.
