Issue: Getting a loan or lease

Subissue: Credit denial

Consumer Complaint: On XX/XX/2023, I applied for an extention of credit for consumer credit transaction to purchase a vehicle from XXXX GMC in XXXX California, for personal, family, household use by the natural person. I was denied access to my own credit after submitting an application in good faith. This is discrimination. Regardless of the reason for denial, being denied my credit is in violation of the equal credit opportunity act, and XXXX finance protection act. Also I was informed that a down-payment of {$40000.00} would be a requirement. According to XXXX XXXX XXXX, finance charge is sum of all charges, and is not payable in an equal cash or any other form of currency. It is a credit transaction. They've also based they're decision on what they're opinion of credit worthiness is and not based on what XXXX defines credit worthiness as being. Again, This is discrimination. As defined by XXXX, XXXX, Federal Reserve XXXX, and Bill OF Exchange Act, the application is a security. Keeping my application where from witch I received no value in exchange is securities fraud and XXXX carry civil and or criminal liability subject to fines and imprisonment pursuant to consumer law. XXXX denied access to my extention of credit not only has left me in financial hardship, it has taken its toll on me emotionally and physically due to stress, worries, sleep deprivation and lack of apatite as a result. I am willing to take this matter to the XXXX XXXX if it can not be resolved. I am offering XXXX hrs allowing you opportunity to cure before I begin the administrative process.

Consumer Complaint: The deficiency auto sales payment to GM Financial was {$5100.00}. My payments {$2800.00} plus down payment {$500.00} plus {$3300.00} plus deficiency sale {$5100.00} total {$8400.00}. The GAP contract was refunded to GM Financial in the amount of {$1500.00}, but not reported to the credit bureaus as a deduction. Total payments {$8400.00}. GM Financial states auto deficiency balance is {$5300.00}, which is over the original balance reported to the credit bureaus and Consumer Financial Protection Bureau Auto price without Gap was {$8500.00} minus {$500.00} down payment. GM Financial is reporting an inaccurate balance due and have changed the amount of the deficiency loan as reflected in complaint ID to Consumer Financial Protection Bureau # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. GM Financial is also stating inaccurate information as to repossession date. Auto repossession occurred XX/XX/XXXX or XX/XX/2023. GM Financial reported to the credit bureau repossession occurred XX/XX/2023. The auto loan was within the thirty days late period, the auto loan was not sixty days late as, GM Financial, reported to CFPB in the above referenced complaint. I request GM Financial delete this auto account due to the fact that inaccurate balance reported and inaccurate date of auto repossession information was reported to the credit bureaus and I received no redemption letter or deficiency notice.

Issue: Getting a loan or lease

Subissue: Changes in terms mid-deal or after closing

Consumer Complaint: I am submitting this complaint against GM Financial Funding Department to report this bank/lender to Consumer Financial Protection Bureau . The reason for this complaint to report GM Financial for depriving me of my rights and my documentation for this purchase. I have attempted to resolve this matter amicably and in good faith for the last two months. However, this company has been non responsive via telephone or email. I have requested all documentation in reference to this purchase, including approval letters, welcome letter, sales contract, and reason for closed funding several times. I am the Co-Buyer for the purchase of the XXXX XXXX XXXX. I purchased this vehicle in XX/XX/XXXXXXXX at XXXX XXXX XXXX, I was approved with GM Financial as my lender for the funding of this vehicle. I signed the sales contract with buyer XXXX XXXX on XX/XX/XXXX. I was advised by the dealership that funding can take up to 30 days to process. On XX/XX/XXXX, I received a call and a voicemail from XXXX XXXX, from GM Financial Funding Department requesting stipulations from me to process the funding for this deal, since GM Financial did not receive any stipulations from the dealership. I provided the requested employer information over the phone to XXXX XXXX on XX/XX/XXXX. I also emailed XXXX XXXX on XX/XX/XXXXXXXX the rest of the stipulations that he was requesting. After I submitted the requested stipulations I did not hear from XXXX XXXX. I emailed him several times to request all documents on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. Unfortunately, XXXX XXXX XXXX was non-responsive and still has been non-responsive to all my requests via email and telephone. I have also reported this individual and my experience as to requesting all my documents to XXXX XXXX, which is the Vice President of GM Financial. I reported this matter to XXXX XXXX on XX/XX/XXXXXXXX via telephone. However, there was no resolution to this matter and I still have not received all my documents that I am entitled to by law. I am requesting for this bank/lender to be investigated as to they are depriving me and my legal rights to the documents of this purchase.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I am writing to dispute the following information that your company supplied to XXXX, XXXX, and XXXX. GM Financial has been reporting my loan/account with their company for the leasing of my XXXX XXXX XXXX as a repossession since XXXX XXXX. My account has not been in repossession status since XXXX XXXX. On the day in question, I woke up at XXXX XXXX and discovered my car was gone, within 4 hours my car balance was paid in full and I was able to obtain my car from the tow yard. At the moment the car payment was made, and the car was taken out of repossession status it should have been accurately reported to the credit bureau within 30 days. They are continuing to report inaccurately. This is a violation of my consumer credit rights. I called GM Financial in XXXX to report to them that the inaccuracies were still being reported and the customer service team provided me with incorrect information and false validation to me that the situation would be handled. After being denied credit cards, loan applications, and mortgage applications I finally did some deep diving into my credit report and to my surprise discovered this fallacy that has been going on for almost 7 months. I have enclosed the monthly billing statements from GM financial from XX/XX/XXXXXXXX to present XX/XX/XXXXXXXX for proof of my claim.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: In XXXX, I made a payment to my account. Throughout this loan, I have been charged way more than I owe, there have been several times I have called and my payment amount is different, depending who im talking to and practically nothing has come off my loan. In XXXX, I made a payment and an arrangement for a payment again in 2 weeks, and the rep put that second payment ( which was for the end of the month ) in, costing me {$300.00} in overdraft fees. He promised to take off {$450.00} off the fees/account and that has not been done. At this point, they have made thousands illegally on this loan and need ti just let it go and give me my vehicle. What they are doing is unethical, at the minimum.
