Consumer Complaint: At the end of the lease I was charged for two instances of excess wear, one for {$75.00} and one for {$85.00}. Both of these should have been covered under the lease insurance that I had through GM Financial that covered four instances of {$1000.00}. I have contacted GM Financial four times explaining this, they tell me they are going to open a claim, I call back later and they act like I have never called them before. Originally it was showing on my credit as a late payment. I disputed it through XXXX and it was shown as a charge off. I disputed that and now it's saying three months of charge off and the rest is a late payment.

Consumer Complaint: I made a {$2200.00} payment on XX/XX/2022, which I asked to be applied to the principal only. According to the XX/XX/2022 statement, the ending balance was {$18000.00} ( {$1900.00} principal + {$210.00} interest ). The entire payment was not applied to the principal, however, there was no payment due as of XX/XX/2022. I went to the website, and on or about XX/XX/2022, it stated that I owed {$700.00} and it was 4 days late and that I owed a total of over {$1400.00}, that was going to have to be paid by XX/XX/2022. I immediately sent a payment of {$800.00} to XXXX, and according to my bank, it has not been received as of XX/XX/2022 ( not believable because it has been over a week since it has been sent by the bank in the form of a check ). I also made a {$700.00} payment on or about XX/XX/2022, and it has arrived and has been subtracted from the so-called total based on their calculations stating that I owe over {$20000.00}. I am confused. I am trying to pay my bills, however, it seems that XXXX is not giving me credit for payments made and they are charging me fees and interests, which is not making sense. I am a poor widow of a veteran who can barely make ends meet, however, XXXX it overcharging me based on my payment history.

Consumer Complaint: The GM FINANCIAL account is currently reporting on my credit report that does not belong to me and it is a mistaken identity case and a fraudulent account. I filed an official identity theft report with FTC and I included that fraudulent account in order to dispute and remove it from my credit report. Except for XXXX credit bureau this fraudulent account has been removed from my credit report. I am not the responsible party for this account because I never applied for it nor did I gain benefits from the services provided by that company. Thereof with the submitted documents, XXXX must delete fraudulent account reporting by GM Financial from my credit report.

Consumer Complaint: On XX/XX/2022, I reached out to the loss recovery department of GM Financial in regard to negative information being reported to the credit reporting agencies. GM Financial has been reporting my account as charged off from XXXX XXXX XX/XX/2022. The GM Financial representative from the loss recovery department stated that according to their policy there is a difference between a write off and a charge off, however according to 7 CFR 1956.54 A charge off is defined as the writing off of a debt and termination of collection activity without release of personal liability. I wanted clarity on if their policy definition supersedes the federal laws definition and I was transferred to many representatives who couldn't assist me at all. GM Financial is furnishing my nonpublic personal information to third parties ( Credit reporting agencies ) without my consent ( 15 USC 1681s2 ). The reporting of this negative information is ruining my financial reputation, and this is unlawful activity that is causing me substantial harm. The representative stated that per their policy they are required to report the information and that is a violation of 18 US Code 892 which is them stating that they knew I was going into an extortion and extension of credit.

Consumer Complaint: I called GM financial XX/XX/XXXX spoke to XXXX about a misapplied payment. I always make my payment for the month its due for and then make a 2nd payment afterwards. This allows me to see my principal to decrease faster. GM financial however CONSTANTLY misapplies the payment towards prepaid interest and the next payment due. EVERY MONTH I've had to call GM since ( XX/XX/XXXX ) i got the car loan to ask that they correct the misapplied payment. EVERY MONTH i ask for a payment history to reflect how the payment was applied to my outstanding UPB ( unpaid principal balance ) as a mortgage underwriter for a big bank i know the benefit to paying more each month. Paying your loan down faster decreases the amount of interest you pay over the long haul. I believe GM financial is directly causing me and others harm by misapplying the payment. Furthermore by the time they fix the misapplication they've still caused harm by not applying it on the day they receive it towards the interest. SO in this most recent example. On XX/XX/XXXX i paid the XX/XX/XXXX payment that was due XX/XX/XXXX. Then on XX/XX/XXXX i paid an extra {$50.00}. GM Financial applied that extra {$50.00} on XX/XX/XXXX towards the XX/XX/XXXX payment that was NOT YET DUE. So i called XXXX and was told it take 1-2 biz days for them to correct the misapplied payment. I was also promised a payment history to show me how the payment was applied. But if the payment was corrected on XXXX or XXXX i still paid extra interest from XXXX and depending on when it was corrected thus still charging more interest on the UPB then i should have. This is where they are committing financial harm to their customers. Its like your penalized for paying more and/or its like we ( GM Customers ) are not allowed to make an extra payment each month. Like your DISENCOURAGED on paying your car payment down more each month. I want a payment history every month. I would like to see the GM financial website UPDATED so customers like myself can see where our funds are going, see how the UPB decrease each month. Every other financial provider has this technology available. My last car loans with XXXX XXXX and XXXX XXXX ( 10 + years ago ) already had this technology in place. Each time i make a payment i should be able to see what goes to the balance of the loan ( UPB ) and the interest each and every month. As a GM Customer i should be able to accurately track where my funds are applied. No different then a personal loan, mortgage loan or even a car loan. Please update your website to allow a more customer friendly experience, This will create trust with me and others. It will allow me to also free up my time and your customer service agent like XXXX from taking long unnecessary calls that could be easily AVOIDED. I spend at least 30 mins each time having to call GM after i make my principal payment ( Again after the payment is due for the respective month ) This is now the 4th CFPB complaint I've filed. Each time i get a canned letter saying You took out a loan, you owe us 75 payments at X amount. You signed this contract on x date. Blah, blah, blah. Here 's a payoff statement thru x date. you're free to leave we don't care we got you strangled by 8.1 % interest rate. UMMM YA i know it GM Financial. I'm not an XXXX. I just want to pay off my loan sooner. PLEASE FIX YOUR PAYMENT PORTAL. PLEASE STOP MISAPPLYING MY PRINCIPAL PAYMENTS. I want to see the fruit of my labor come to for wishing. i want to strengthen my equity position with my car so i can refinance AWAY from you and/or trade this car in and finance thru another bank

Due to the Corona Virus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX XXXX breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I am doing.
