Issue: Struggling to pay your loan

Subissue: Lender trying to repossess or disable the vehicle

Consumer Complaint: XX/XX/2016 GM financial hired XXXX XXXX XXXX XXXX to repossessed ( Steal ) four vehicles that they did not own titles or leans or have any financial obligation to. I had a loan that I was making payments on. I made payment arrangement with a rep and was keeping my obligations with the payments and never once informed that the vehicle was in a repo status. One morning about XXXX I went out to go to work and three of thefour cars were taken without my wife permission or knowledge, The police department was notified, we were informed they were repossessed. I explained and showed XXXX XXXX Police department that 1 vehicle was paid off and the other two were current and financed with other companies. I provided letters from the financial companies showing that the vehicleswere current and under no order of repossession.. XXXX police finally took the police report. Later that evening we received a call from XXXX XXXX XXXX XXXX saying that our vehicles were taken by mistake and they want to bring them back. When asked how did they get this number they would not say. Once the auto theft unit got involved the owner of the tow company meet with us and police. XXXX the owner showed my wife and I and gave XXXX police a copy of the repossession order requested by GM financial to repossess five vehicles and offered bonuses for each car they retrieved. None of the cars taken were financed by GM Financial. three of the vehicles were in my wife name who do not have an acct with GM. Gm called and on a recorded line stated well you have them back and offered no explanation but stated what are you going to do about the XXXX. Once they learned that the police were involved we did not hear from them for a while. They have charged Off the loan and put the charge off on all three credit reports.

Consumer Complaint: GM Financial has reported me late for my lease payments on XX/XX/XXXX and XX/XX/XXXX. I called GM and spoke to a representative on XX/XX/XXXX and informed them they falsely reported me. The Rep told me I was reported late for ELECTRONIC Payments XX/XX/XXXX and XX/XX/XXXX, I told the Rep my credit report shows me late for only XXXX and XX/XX/XXXX only. I was told to fax proof of payment to GM, I faxed to the Customer Service Common department my electronic payment history of a 12 month period so I could show NO late payments were made since I incurred the lease. I also sent FULL balance bank statements showing all transactions on my account including the payment for both XXXX, XXXX, XXXX and XX/XX/XXXX. GM has not answered their phone line or responded to my fax. I have sent the fax a total of 15 times and still NO response from GM. I filed a dispute XX/XX/XXXX with all 3 credit reporting agencies and included the same 12 month payment history and full bank statements and my dispute was denied for XX/XX/XXXX payment. I need the late payments removed and GM to correct their side of me showing late for XXXX, XXXX, XXXX and XXXX. I have attached below COMPLETE bank statements reflecting my payments for every month so you can see no payments were missed.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: On XX/XX/XXXX my wife, XXXX XXXX, and I, XXXX XXXX XXXX, applied for an auto loan and were approved by GM Financial. The term of the loan is seventy-two ( 72 ) months at 0.00 % APR with a first payment due date of XX/XX/XXXX. The tradeline was first reported on XX/XX/XXXX which reflected an original loan balance of {$55000.00}, the term, a monthly payment amount, and a current and joint responsibility account status. As of today 's date, XX/XX/XXXX, my credit report indicates that GM Financial has not provided a payment history or current account status ( please see attached ). We note here in passing that we have successfully made two ( 2 ) payments each in the amount of {$770.00} on XX/XX/XXXX ( which was scheduled on XX/XX/XXXX ) and on XX/XX/XXXX ( which was scheduled that same day ) ( please see attached ). Notwithstanding our timely payments, GM Financial has failed to report our current account and payment history status to the major credit reporting bureaus since their initial tradeline report on XX/XX/XXXX. In an effort to resolve this issue, I called GM Financial 's customer service department onXX/XX/XXXX, waited for almost fifteen ( 15 ) minutes to speak with a representative, and was advised that they do not show any derogatory information reported on our account and that they typically report every thirty ( 30 ) days. The proposed resolution was that the representative would contact their credit report team and have someone call us back as soon as possible. When I requested the information that was last reported to the credit reporting agencies, the representative was unable to offer any information other than no derogatory information has been reported. When I requested to speak with the credit report team, I was advised that they do not accept customer calls and only accept internal emails from representatives of GM Financial.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: GM Financial is reporting inaccurate payment history on my credit report for account # XXXX. I have filed disputes with all three credit bureau 's. GM Financial is reporting 30 day late payments for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX and 60 day late payment for XX/XX/XXXX on the previously referenced account. The account was paid if full and closed on XX/XX/XXXX. I've made numerous phone calls to GM Financial customer service for approximately a month. They have corrected payment history with XXXX but have yet to submit a correct payment history with XXXX. They have also provided me with letters that reflect the account was satisfied in XX/XX/XXXX. This inaccurate reporting is impacting my credit score significantly. I am in the process of obtaining a mortgage and this inaccuracy is preventing me from doing so. The score simulation on XXXX 's website indicates a positive change of greater than 50 points if this inaccurate reporting was corrected by GM Financial.

Issue: Problems at the end of the loan or lease

Subissue: Unable to receive car title or other problem after the loan is paid off

Consumer Complaint: I had a lease with GM Financial for a XXXX XXXX. At the end of the lease term, I worked with my local credit union to get a loan to buy the car. I closed on my auto loan on XX/XX/XXXX. The loan amount was based on the payoff information provided by GM Financial. In XXXX, I received a call from GM Financial advising me that my lease payment was late. When I told them I had purchased the car, they said they did not have that information. I called the dealership who sent GM Financial the check and they show that the check cleared on XX/XX/XXXX. GM Financial reported a late payment to my credit bureau.I have called them multiple times and they refuse to remove the late payment report.Every time I call they act like they have no idea what I'm talking about, why I'm calling. They told me that the dealer needs to send them a copy of the cancelled check ( which they have done ). Nevertheless, GM Financial will not remove the negative report from my credit.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: My daughter and I have a auto lease with GM. We have had the lease since XX/XX/XXXX. We have made every payment via direct debit from checking out each month. My daughter was alerted in XX/XX/XXXX that we were reported as 120 days late which is not correct. I attempted to call GM onXX/XX/XXXXto straighten this out. I was told they had a system change in XXXX that caused reporting problems such as mine. I was assured someone would return my call on XX/XX/XXXX. They also told me on the phone that system said i missed 8 payments but she could see that i was current. No one called me on XX/XX/XXXX. I submitted two other online complaints and called again onXX/XX/XXXXand I was supposed to receive a follow up call but I have not received any further correspondence.

The GMF system was still down on XX/XX/XXXX and intermittently .Yesterday I first spoke with a team leader at General Motors . He ( XXXX ) said that the contract is binding because I signed it.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I established a lease with XXXX XXXX. We wanted to set up ACH debit of the monthly lease payment. After a month and a half we got a collection call. I allowed them to take a payment over the phone for a fee. They promised to send out the paperwork to establish ACH, but it never arrived. Next month, same issue. This time the rep offered to call back in a couple days to set up ACH. No call. The process went on and on. I've tried multiple times to log into their online site, but it won't accept my credentials. I've never had this problem and I'm very familiar with how to use online banking and have several online sites I use regularly without problem. I'm currently sitting on hold for 21 minutes trying to speak to someone at their lease department. I'm very frustrated at their lack of help, but eagerness to charge me a fee to accept my payment.
