Issue: Problems at the end of the loan or lease

Subissue: Problem when attempting to purchase vehicle at the end of the lease

Consumer Complaint: I have contacted GM Financial twice a week since XX/XX/XXXX pertaining to the return of an unpaid check from my credit union to purchase the vehicle. I unfortunately did not follow the stipulations of the loan, pre-approved checks can not be written to a lender. I need to purchase a vehicle and settle my account with GM Financial. I can not receive another check from my credit union until they have possession of the original check, a Legal Copy 21 of the check ( that can be retrieved from their bank, no photocopy ), or a statement from them confirming they will not try to resubmit the check. I have signed a letter of indemnity for the check on behalf of XXXX, but that is not sufficient to clear the matter. GM Financial is responding like my request is absurd. They are claiming to no longer have the check, the check was shredded, we never send return checks to customers, we are on a new system and the old system will have your request, no one has access to the old system, there is no phone number for the accounting dept., my request must be directed to their legal dept., legal dept. does not have a phone number ( fax only ). I was told to email and fax their resolution department. The resolution department emailed me requesting to call for further assistance. I called and was told the same thing again. I was told to fax their legal department. I am still waiting.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Hope you are well. We have had a GM loan on XXXX XXXX XXXX XXXX for 3 years. As of XX/XX/XXXX we owed approximately {$19000.00} which we paid off. The title was released after about a month. The credit report incorrectly shows loan still open and not paid off. This is interesting because if we had traded for another XXXX and financed with GM again it would have adversely affected our credit terms. This is neither fair or legal in my eyes. They seem to have a lot of undue manipulation in my credit report as well as my husbands. It shows that we owe {$40000.00} to GM and we owe {$0.00}. I expected GM to remove this as an open obligation and disputed 2 months ago. They will not respond. The truck has been paid off since XX/XX/XXXX, that is 5 months. Can you please assist? Regards, XXXX

Issue: Struggling to pay your loan

Subissue: Lender trying to repossess or disable the vehicle

Consumer Complaint: I purchased my XXXX XXXX in XX/XX/XXXX The original loan amount is XXXX with 11.90 % interest. I have been late a few times and used the deferment option. However starting in XXXX of last year I noticed payments not being applied to my account or not appearing to make a difference in the balance. I reached out to XXXX and was told that sometimes money orders sent in take longer to be applied. It is now XXXX and I have sent in 5 money orders and paid several ACH payments or debit card payments. I should not only be paid in full I should be covering some of the late fees. However instead I see no payments on my account, they now have a repo company calling me and threatening to take to me to jail and the company ( GM ) is calling my family and work disclosing personal information. They call me up to 30 times per day from XXXX XXXX ( I am on pacific time ) to XXXX XXXX at night. So in short they are violating the law by threatening me, releasing my personal information to family and work and trying to take my car when it is paid as agreed.

Issue: Problem when making payments

Subissue: Problem during payment process

Consumer Complaint: I have a loan with GM FINANCIAL. I have always made my payments on time. For some reason I realized that there was a late payment on my credit report. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX and GM FINANCIAL with no successful resolution. XXXX was the only one reporting me late. There was definitely an error on their part. I was never 30 days late XX/XX/2017.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: gm financial has failed to correctly report a paid off / paid in full as agreed auto loan account for 8 months. My credit report still shows and open unpaid load since XX/XX/2017. I have contacted GM Financial 3 times to resolve the issue. I was told GM Financial switched their credit reporting software and were fixing issues that occurred where accounts were incorrectly or not reported to the credit reporting agencies. Each time I called them I was told they put in a ticket internally to get it fixed. It is still not fixed.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Summary : My credit score has decreased by a significant amount due to GM Financial incorrectly attempted to charge me for two months after the end of a new car lease, even though I had paid-off my entire two year lease term one year in advance. Also, I have purchased this car after my lease term had ended, but had still been charged for two months of car lease payments. Once I had noticed this, I had provided a written dispute to GM Financial, insisting they fix this unnecessary issue. Very shortly after, they had closed my account, but they had never fixed the reporting to the credit bureaus to reverse the two subsequent months of reported delinquency on my account for any of the credit bureaus, and therefore I am still suffering from the negative impact they have caused me from a drop in credit score rating by more than 60 points. Their acknowledgement of quickly closing the accounts upon my dispute to them shows they understand they have made an error resulting in a financially negative impact to my credit report, though, they have chosen not to take the necessary steps to correct this error. Details : GM Financial attempted to charge me an additional two months of a lease term ( $ XXXXmonth for each of those two months ) than had ended and were not due, resulting in a significantly negative impact on my credit report/score. GM Financial attempted to charge me for the months of XXXX and XXXX of 2018 ; I should not have been charged these two months, but was nonetheless charged late for these two months. GM Financial then closed my account as a response to my filed dispute on XX/XX/2018, but they had failed to report that I had not been late, or even that these falsely manifested payments never existed. Due to this, my credit score has decreased significantly, hindering me from successful financial management going forward.

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: I was to CO-Sign for my son on an auto loan at XXXX XXXX in XXXX Tennessee. I live in another county and spoke to the salesman who i did give consent to do a credit check, but now have 7 HARD inquiries on my credit. This was not explained to me that they would use my ss in this manner and then when I got to the place to check on paperwork I declined to sign for the existing loan at 20 % and they had it in my name as primary. We went to XXXX and got a loan at 4 % and Co-signed for my son. This practice of making multiple hard inquiries even at credit unions where we did not have accounts is damaging to my credit report and an unfair practice. All of the inquiries were from XX/XX/2018. Please let me know what can be done to fix this. I am making this edit at the very end as there are 4 more companies involved that the computer system did not allow me to enter. Those are XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX AND XXXX XXXX XXXX.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I had a lease and the lease was about terminated ( ending ) XX/XX/2018. I was leasing with XXXX and my request was to to go back through the finance company I was currently with. For some reason, XXXX did not submit the application to XXXX for the new lease, they proceeded with GM. I was unaware that it was submitted to GM until receiving a call on XX/XX/2018 for my permission to make one hard pull for the lease determination as I have a fraud alert attached to my credit report. I was baffled as to why it wasn't submitted to XXXX but I did not question because I also had leases with GM for my previous XXXX. Well, after getting the vehicle, the next day I was rushed and admitted to the hospital. After finally being released, I discovered I received some notifications for hard inquiries. I viewed the notifications and I had a hard pull from XXXX and 2 hard pulls from GM. I contacted GM inquiring about the hard pulls and they referred me to XXXX. I contacted XXXX and spoke to the receptionist explaining the issue and she indicated that I needed to speak to XXXX in finance. She forwarded me and I reached his voicemail on several occasions leaving messages and no return call. I went to XXXX asking for XXXX, the receptionist indicated that he does not arrive until XXXX XXXX and she took my contact information and reassured he would call, I even asked for his email address and again, she said he will call and did not provide an email address. I explained about the several contacts to him. Needless to say, no return call.I viewed my emails and received a message about the car coming for maintenance and because I was not successful reaching any one, I replied to XXXX informing her the car is new and did not require maintenance but explain to her about my unsuccessful attempts to reach XXXX in finance ( email is attached ). Meanwhile, I called XXXX XXXX by phone and reached his voicemail, so I forwarded an email in which XXXX did call the same day and I explained the same thing. ( email attached ). XXXX tried to convince me it was 1 hard pull, but I verified with XXXX, who indicated each pull from XXXX and 2 hard pulls from GM did not go under 1 hard pull. 3 separate hard pulls. Well XXXX indicated that he would call me back in to days with the additional inquiries removed. I also received an email from XXXX, who also indicated she would contact XXXX in finance and have him to call and no call ( email attached ). For some reason, after that day, I could no longer get in touch with XXXX regardless of the contact method. My last email was saying to XXXX, it's been a long time and perhaps you were extremely busy, can you please forward me a point of contact to assist me with the matter and no response.Submitting my complaint here was my last resort because for some reason, I just could not receive any assistance with the removal of the additional hard inquiries. I was very surprise because I was under the assumption that I had a good rapport with the dealership as I left another dealership to do business with XXXX. I drive from XXXX XXXX to come to this dealership and would have done the same as I am in the process of moving further XXXX, this is such a disappointment and quite surprised about this incident.
