Consumer Complaint: We bought a new car on XX/XX/18. We are co-owners. The dealership submitted numerous applications to secure the loan. We were ultimately approved for the loan by a credit union for an interest rate of 3.99 %. XXXX was one of the lenders that denied the loan. My complaint is that we did not receive our credit denial letters from XXXX until today, XX/XX/18. We received one letter for each of us. The letters are dated XX/XX/18. The Fair Credit Act states that creditors only have 30 days to send denial of credit letters. It even states on the bottom of our letters that our credit was pulled from XXXX on XX/XX/18. XXXX is obviously considerably over the time that the law allows.

Consumer Complaint: Hello, In XXXX of XXXX funds of {$590.00} were applied incorrectly to my vehicle lease account from which I notified the leasing agency for my XX/XX/XXXX statement about the error and stated that I there was an error on my account. The gentleman that I spoke with said not to worry about it, funds have been applied and that if I truly felt that the money was not mine to let them know on a later note. I stated to the representative again he the funds were not mine and a correction needed to be made so I would know what I needed to pay, and I would not make a payment because he stated not to worry about the situation and because there were already funds there I did not want to create confusion moving forward on my account. In addition, since there was already an issue I did not feel comfortable making an additional payment to what was already an overture on my account only to have a greater issue occur. I notified the leasing agency again the following month when there was still no correction made on my monthly statement for XX/XX/XXXX. IN XX/XX/XXXX I made my regular payment back on schedule since I had not heard back from the leasing agency and continued to do so until XX/XX/XXXX when my statement came in at {$900.00}. I immediately called the leasing agency to find out what the issue was and was told my the representative that I was past due for XX/XX/XXXX. I was not. I called the agency again was then informed that my account had gone into an investigation back in XX/XX/XXXX and that there was a misuse of fund applied to my account back in the fall of XXXX. I asked them why I was not notified of the investigation and was told that the leasing agency did not feel it necessary to in form me about the investigation and that if I was to not make XXXX payment they would come and repossess my vehicle. During this time from XXXX - XX/XX/XXXX I was receiving 4-6 calls a day from the collection department stating verbatim that if I did not pay them they would have my car repossessed and they would negatively impact my credit score. I simply told them that from what I have as my monthly statement s I was never behind on any of my payments and that I pay every month on time if not early. I was then told that I was never issued statements via mail, and that I only made payments via online. I do not own a computer, not did I set up a direct deposit transaction for my account so I do not see how this is even possible. When I told the representative this information, I was told that I was lying and again they were going to then repossess my vehicle for failure to make payments. I would then state that I wanted to speak to their supervisor and it was at this time the call would usually be dropped and another call would come in a few hours later. I again told them that from my records I was not behind and if they were going to continue to harass me with phone calls numerous time of the day I would contact the US General Attorney because it is illegal for collection agencies to call on client for more the once every 24 hours and can be issued up to a {$2500.00} fine for each call following within that time frame. Yet the phone calls kept coming. By XX/XX/XXXX I ended up paying for the months of XXXX and XX/XX/XXXX and was told that my account would no longer be flagged for addition contact and that everything was clear. Yet in XXXX of XXXX I was still receiving calls from the leasing agency stating that again my payments were past due and they were going to repossess my vehicle. it was at this time I requested to speak to a supervisor and I was pushed through to a voicemail box where I left my name and contact inform and what I was experiencing. It was not until XX/XX/XXXX did I get a call back form a supervisor where she stated how apologetic they were on the issue and that they were very grateful on how I was able to make the correct payment as quickly as I had in such a short amount of time. She had also apologized on their behalf for the amount of phone calls that were made to me, and how it was a clinical error on their end form the beginning despite that I had notified them almost 9 months prior to the issue, and how it was then brought to their attention 6 months later, and again how it was still becoming an issue 9 months later even when there was no issue by that point in time. I then asked the supervisor if my credit would be impacted by what has occurred in the last 10 months and she assured me that my credit score would not be negatively impacted due to the issue occurring originally on their end, and not having the original representative from the XX/XX/XXXX not follow through correctly with my report and make the correction to where my monthly statements showing no past due/ late bills. When I went in to possibly buy out my lease in XX/XX/XXXX my credit score had dropped for XXXX to XXXX due to what had occurred on my vehicle 's lease. When I called the leasing agency to fix this, I was told again by the supervisor that the error was on their end and she assured me that my credit would be reversed since my mailed out statements had shown no error from my end, and in the three years of my billing experience with them I had roughly 12 months where my payments were made in advance/ good standing ( no bad checks ). Once this was pushed through to the assistant VP/ CEO of the company I was denied the correction because they stated that the error was on my end, and since I was aware of the incorrect amount I was thus held reliable for the corrections to be made again from my end moving forward during that time and my credit score was not to be corrected. It was at this point I have reached out to the CFPB. Thank you. Enjoy the day.

Consumer Complaint: GM Financial is reflecting 30 day late payments on my account for XX/XX/2018, XX/XX/2018 and XX/XX/2018. My payment due date falls on the XX/XX/XXXX of every month and in accordance with the attached payment history, all payments were made within less than 30 days of the due date. Payments dates are as follows ( see attached doc ) : XX/XX/XXXX : XX/XX/2018 XX/XX/XXXX : XX/XX/2018 XX/XX/XXXX : XX/XX/2018 XX/XX/XXXX : XX/XX/2018 I spoke with representatives with GM Financial and they indicated they could not correct their error and that I needed to dispute with the credit bureaus. I believe this an unacceptable practice by GM Financial. As a credit, they are required to report accurate information to the three credit bureaus in accordance with the Fair Credit and Reporting Act.

Consumer Complaint: I have autopay set up on my Gm Financial Lease account in the amount of {$400.00} per month. I Have most all of my bills set up on auto draft for ease of payment. I check my bank statements on my mobile app frequently, usually every day just to make sure everything looks good, balances, no fraudulent charges, etc. It was XXXX, 2018 that I realized that I don't remember seeing my GM financial autodraft lately, so I started looking a little more into and found that it hadn't been deducted for two months ( the only emails GM ever sent was saying my bill is available to view, which I don't find the need to login since it is on autodraft ). I immediately call GM financial and asked what was going on, she said ( to the best of my recollection ) that they had switched payment systems or it went down, messed up, either way, my autodraft was turned off. So I immediately paid the balance, and asked about the late charge on the account in the amount of {$20.00}. She said that since it was a mistake on their part that she would waive the fee. I was also concerned with my credit and she reassured me that it would not be an issue and wouldn't be reported since it was due to their mistake. All is well with the world and I go on with my business. Then, this morning, XX/XX/2018, I check my bank accounts as I usually do in the morning and randomly check my FICO score as I do every few months out of curiosity to find out the my credit score had dropped about 140 points. So fearing fraud I immediately login into XXXX to find that the GM account was showing 30 days late on two consecutive months. Either way, I call Gm financial to dispute the issue, the gentleman noted our conversation and referred me to report with the CRAs. I also asked him if he could see the notes the last time I had called in to find out about the lack of payments being withdrawn. He said he could she where she removed the late payment charge as a fault on their end ( not sure what else she noted ). I then call the consumerfinance.gov number, the gentleman was helpful and referred me to this page to submit a request, walked me through what I should expect so here I am. I believe that is all the information and all I can remember at this time. I am sure I forgot something but attached you will find the GM financial statement showing where the late charge had been credited. Thank you

I did not receive a response from GM Financial until XX/XX/2018 Please note : Per the Fair Credit Reporting Act, Section 611 ( a ) ( 5 ), creditors have 30 days to investigate disputes. And if creditors could not verify the information within 30 days time period, they MUST delete and remove all of the disputed accounts from the consumers credit reports. Failure to do so can result in a {$1000.00} find per un-deleted item.

Consumer Complaint: To Whom It May Concern : First case CFPB # XXXX GM Financial Acct # XXXX On XX/XX/2018 I submitted a complaint to the Department of Agriculture regards my pay off amount disagree and discrepancies on payments and months to go, but GM financial did not response to Dept. of Agriculture or at least before I submitted the complaint to CFPB. After I submitted my complaint to Consumer Financial Protection, and received an email that GM Financial responded to the complaint and sent a letter to me which I just read it. I have not made the {$260.00} payment from XX/XX/XXXX, waiting for CFP response. Because I am not agreed with their response, I called again to CFP and spoke to an agent. Even with the deferred and overdue payments and the contract that I signed, this car is paid off. I already paid to this XXXX XXXX and if I add the {$260.00} for the month of XX/XX/XXXX the total amount will be {$18000.00} summarizing my payments with the statements I received from GMFinancial, with a margin of error. I paid this car double ( 2 cars payment in one ). Therefore, I think is not fair to continue making payments to this account. This is inhumane for me and for others who have been through the same or worse. I am going to send my last payment which was due on XX/XX/2018 according to their contract a car in the amount of {$6900.00} at an interest rate of 16.25 %, repaid in 72 months installments in the amount of {$260.00} per month, 72 months already passed and the total amount as you can see exorbitant. Hopefully you can help me to solve this situation in a fair way. Thank you so much XXXX XXXX XXXX

Consumer Complaint: First my credit report said I had a ( personal ) account not co-account for a leased auto from XXXX which was actually my wifes car which I signed on with her it stated that I owed {$1000.00} this was incorrect neither I nor my wife owed that amount she had since leased another auto and closed that account out I filed a dispute and was told one department didnt report to the other. Has since been removed. After which my score dropped on XXXX report. In XX/XX/XXXX my personal auto loan which I got in XX/XX/XXXX time was up and I hadnt paid it off yet due to hardships I filed bankruptcy and did not include the vehicle as I wanted to pay it off so I kept it as a reaffirmation of debt, at the time my loan was to be paid off ( ie the loan term had ended ) XXXX contacted me and offered to allow me to lower my payments so that I could pay auto loan off but befor I could do this I had to pay late fees on original account of {$170.00} they sent me forms to fill out and pay the late fees, which I paid because I couldnt enter the new agreement til old late fees were paid off I had to have the documents notarized which I did and sent them back, in XX/XX/XXXX I paid off balance of loan in the amount of {$280.00} suddenly the late fee turns up again I called them in dispute and was told it would be resolved, my XXXX report corrected it and showed no auto loans they were paid off but my XXXX report stated that I still owed {$170.00} it also stated that a remark had been added to my report between ( XX/XX/XXXX and XX/XX/XXXX ) that there was a reaffirmation of debt which caused my score to drop .there was inXX/XX/XXXX a reaffirmation of debt when I and my wife filed a bankruptcy but this was already on my report it seems it was added again which is unjustified since the loan has been paid off my XXXX score went from XXXX to XXXX something so when it was resolved with them it went back to XXXX which I see as unfair considering it was higher that that befor mistakes now my XXXX has fell from 570 something to XXXX because of similar problems with XXXX reports. I donot owe them anymore they agreed when I spoke with them over the phone yet it still remains on my XXXX report they said theyre sending me documents which will show everything was paid off and that it was my responsibility to send them to credit agencys to correct but I have not received them I think since they admitted they were in err they should along with XXXX do something to restore my credit to where it was befor the ( ( mistakes ) ) and then adjust it as though there wasnt any ie raise it from where it was not from where it is after mistakes I can only assume that my XXXX scores are where they are because of XXXX reporting it still remains open even though its been paid off please resolve these issues so I can continue forward as you can see in the attachments XXXX has corrected the {$170.00} and no open auto accounts yet XXXX has not due to reporting from XXXX
