Issue: Problem with a company's investigation into an existing issue

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I have a car loan through GM Financial and I had been paying my car note on time every since XXXX around XXXX I was in a hardship up until XXXX when I missed a payment and they have contacted me. During the conversation, I told them that I notice that they haven't been reporting my on time payments to credit bureau. She said yes we haven't because we been having a problem with our system and we just got a new one it will start reporting now. I said so there's nothing you can't do about it but instead they continued to call me on a daily basis and also have put a late payment on my credit. During the time I was paying on time they wasn't reporting. Also last year I had a back injury and haven't been back to work as of today. They gave me a defarament and didn't take off the late fees in which I was told that the late fees isn't included in that when I spoke with them in XXXX, but I was told that I would have to pay partial of my carnote in XXXX and it would push everything toward the end of my balance but it didn't. I feel like my rights was violated due to not reporting to the credit bureau until I missed a payment was unlawfully.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I received a copy of my Credit Report from all 3 credit bureaus and noticed an erroneous charge reporting from GM Financial in which they said I owed. I've since reached out to them on XX/XX/2018, regarding VERIFICATION of this debt and amount in which they said I owed per the FDCPA guidelines. I have also asked the credit bureaus to do an investigation on the matter as well via disputes sent. The only responses I get from them is that the they do not know what it is i'm disputing when my letter clearly outlines what I need from them. The item has since come back VERIFIED and I've received no PROOF and/or documentation from either side regarding this charge despite reaching out multiple times to GM Financial and their reporting on my credit report is highly impacting my creditworthiness. I do not believe this debt belongs to me and until I can be provided proper documentation via a signed signature, e-signature, or proof of indebtedness I would like this to be completely REMOVED from all 3 credit bureaus immediately or my next step will be legal action.

Issue: Problems at the end of the loan or lease

Subissue: Termination fees or other problem when ending the lease early

Consumer Complaint: I was sent a letter from XXXX XXXX XXXXXXXX detailing the sale of the leased car I had turned in early. The letter stated there is a refund amount of {$100.00} DUE TO ME, and will be mailed to me within 30 days of the date. ( XX/XX/XXXX ) of the letter. I have made numerous calls ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) involving hours of my time to the only number listed to call and I have been passed off from one customer service person to another and given excuse after excuse after excuse. My last phone communication ( XX/XX/XXXX ) I was told that the payment would be processed/ " expedited '' but that never happened either. I have received one scripted email ( XX/XX/XXXX ) from a so called " Customer Experience Specialist '' that I replied to with my frustrations and I have never gotten a reply with a resolution to my specific situation. I know {$100.00} is not much, and it isn't even about the money anymore. At this point I want XXXX XXXX XXXXXXXX to be held accountable for not processing refunds that they owe to me and who knows how many hundreds of other people. How many thousands of dollars do they have hiding in their books somewhere that they are assuming ( hoping ) people aren't going to bother to go to the lengths that I am to get what is owed to me?

Issue: Problems at the end of the loan or lease

Subissue: Unable to receive car title or other problem after the loan is paid off

Consumer Complaint: I paid off lease # XXXX for purchase in the Name of XXXX XXXX on XX/XX/XXXX. The Lease is through GM Financial. The Lease was for a XX/XX/XXXXXX/XX/XXXX serial # XXXX. This was a lease in my mother 's name. As she entered a XXXX XXXX and we rearranged her finances, I decided to pay off her lease and purchase the car for my own use. Since the payoff I have repeatedly attempted to obtain a title. To date I have faxed the odometer statement and titling instructions a total of 4 times and to 2 different # 's supplied to me by GM Financial Representatives. I call weekly and every week there is a new excuse. First they don't have a fax, then they have the faxed odometer statement, but not the titling instructions. Both documents have been included in all of the faxes sent, and I verbally communicated and faxed ( 4th fax of the same docs. ) titling instructions on XX/XX/XXXX. It is now XX/XX/XXXX and I am on hold again after insisting that I speak to a supervisor and faxing the same documents to her direct fax line. This is my 5th Fax transmission all from a business fax line that sends as many as 100 faxes/day. She has purportedly called the Titling department to and passed the documents to them. However she has informed me there will be a 3-5 day delay for " processing '' : I feel at this point, that this is a pattern of behavior with the objective of holding the title after receipt of the payoff in order to make the asset side of their balance sheet reflect a more positive number. When one works the numbers conservatively, if GM Financial is successful in holding titles for 25,000 units at an average payoff amount of $ XXXX for 30 days it is a $ XXXX addition to the asset side of the balance sheet. This is called working the " Float '' and GM Financial appears to have it down to a science. The length of the title transfer process of GM Financial needs to be looked into by the the CFPB and punitive actions should be taken.

Issue: Problems at the end of the loan or lease

Subissue: Problem with paying off the loan

Consumer Complaint: My XXXX XXXX XXXX was financed through XXXX. It was totaled on XX/XX/XXXX. My insurance paid the claim on XX/XX/XXXX. Due to a denial in GAP insurance, there was a balance remaining after pay off. I was in contact with XXXX on several occasions to get the matter resolved. XXXX agreed to update my credit file if I paid 1/2 the remaining balance which I did on XX/XX/XXXX with a stipulation to remove the charge-off and remove the late payments ( see attached ). I wrote the terms on the back of the check which they accepted and cashed. The account is still showing late payments and as a charge-off on my credit reports.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: XX/XX/15 Car Accident. Had Issues With Insurance Company. Contacted XXXX Filed A Complaint Insurance Took A Few Months Although Claim Was Paid. The Original Amount Wasn't Paid Due To GM FINANCIAL Repossession Of The Vehicle. However, I Kept In Contact With GM FINANCIAL Regarding The Situation. I WAS NOT NOTIFIED BY GM FINANCIAL THAT THEY HAD TAKEN POSSESSION OF THE VEHICLE. I Have Supporting Documents That The Claim Was Paid & The Only Reason GM FINANCIAL Did Not Receive The Original Amount Is Due To The Information That They Reported To The Insurance Company. Therefore, Claim Should Have Been Paid In Full Through Insurance & GAP. With That Being Said, GM FINANCIAL Brought On A Debt Which I DO NOT OWE. If The Insurance Company Rectified The Situation So Should GM FINANCIAL.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I have an auto loan with GM financial and in the earlier part of the year, I realized that they were not reporting my account history to the credit bureaus so I contacted them and they told me they were updating their system and they turned their reporting off. So I wasn't pleased with that information so I reported them to the XXXX XXXX XXXX. Once that was done, I checked my credit report and saw that GM financial reported to XXXX XXXX but not XXXX, and I reported this to XXXX XXXX XXXX in XX/XX/2018. I then disputed this with XXXX in XX/XX/2018, and received my dispute results on XX/XX/XXXX, so I checked and the history reported is still incorrect, it is showing my last payment received was in XX/XX/2018, which is incorrect, my last payment was XX/XX/2018. I want the correct information reported to all 3 credit bureaus, as a consumer, I expect this to be done accurately and timely.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: On XXXX-18 my lease with GM Financial was closed as a result of GM doing a buy back on my car because of mechanical issues. The account was paid off by GM when the car was returned. I have all documentation showing that the lease was paid off. I am still receiving statements from GM showing I have a {$0.00} payment and 0 payments left on my account. I called GM approximately 1 month ago and they confirmed the account should be closed and I do not owe anything. However, GM reported that I am delinquent by 3 months on payments for an account that no longer exist. I filled a dispute with GM and have not recieved a response. I also contacted XXXX who would not reveres the delinquent payment status even though I had all documentation showing the account was paid off in XX/XX/XXXX. I have never missed a payment on any type of credit. I have all documentation if needed.

Issue: Managing the loan or lease

Subissue: Billing problem

Consumer Complaint: I had an auto payment plan set up for my lease payment though GM financial. They reported I never paid my lease payment for XX/XX/2018. I have since confirmed on XX/XX/18 that XXXX dollars was withdrawn from my checking account for the lease payment. I open a complaint with GM in regards to the matter and they said they would dispute the late payment. The late payment still reflects on my credit.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: In XX/XX/2018 My leased vehicle was totaled in a auto accident. My auto insurance company paid off their portion of the balance which left XXXX to be paid by GAP which is part of GM Financial who the lease was financed. I was told that all would be handled from the point of reporting to the insurance company and there was nothing further I would need to do. They would contact me once GAP was paid. In XX/XX/2018 I received a credit alert that I had a " missed/Delinquent '' payment on my credit bureau reports. Upon looking into the reports it showed that GM Financial was reporting me 60+ days past due on the lease. I immediately contacted GM Financial and was assured that they would get this corrected as they had many customers affected by a recent change of finance companies with their GAP department. I was told that an accurate report would be sent to the credit bureaus and it would take up to 45 days for the update. Long story short, I am still fighting with them to correct my Credit Bureau report. My credit score as a result has dropped from a XXXX to XXXX and I can not obtain any further credit. In fact, I have many current creditors closing my accounts, reducing my credit limits and increasing my interest rates as a result. This has been a unresolved issue since XX/XX/2018 and it is now the end of XXXX. GM Financial should be held responsible for my suffering and it is unjust that I, a good customer who has worked very hard to maintain a high credit rating to now be going through such turmoil with my credit. GM does not seem to be in any rush to follow through on their promises or obligations to their customers.
