Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Difficulty submitting a dispute or getting information about a dispute over the phone

Consumer Complaint: I have 2 car leases with GM Financial, earlier this year I had set up automatic payments for these accounts, I accidentally made both payments at {$1100.00}, one of the payments was supposed to be {$1100.00}. I was short {$74.00} every month for 5 months. GM Financial kept that shortage on my account and in turn I have 6 30 day lates on my credit. I did not receive a phone call letting me know I would be getting these late notices reported to the credit bureaus. Year to date if I would have made all payments I would have paid {$12000.00}, I have actually paid {$13000.00}. I understand I may have been late 1-2 of those payments but again I was never notified and I have made payments ever month. I called twice to ask to have some or all of these late dings removed from my credit and they said they are not wrong and it is too bad. I asked to speak to a manager and they would not transfer me or let me speak to anyone, the gentleman XXXX XXXX because he would not give me his last name, said his manager was busy and would not talk to me. I have been a GM car owner for 10 plus years and currently have 2 accounts with them and I just do not believe I was treated fairly.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: My husband used my credit to lease a vehicle in XXXX while I was out of the country. He paid the first month 's lease when he paid down payment with other fees relating to registration and drove off the car. Since then, we never received any bills from the creditor, GM Financial, until I received an email from credit bureau ( XXXX and XXXX ) notifying me that my credit score dropped by 60 points. Surprised, I reviewed my credit report. It went down by 60 points because GM Financial reported late payments on my husband 's auto lease. I came back to the States in late XXXX. I looked through every mails that came while I was gone and there was no mail or anything from GM Financial ever. We still have not received any bills. The lease amount is only {$280.00} - I would never miss this payment at the risk of losing 60 points on my credit score. I called GM and they said they can not remove the report because they mailed them out. This is ridiculous - we just opened up the account in XXXX and this was our first time missing payment clearly due to GM 's mailing system. Again, we still have not received our XXXX bill which they claimed to send on XX/XX/2018. How am I supposed to pay the bills that I never received? I am responsible for multiple bills per months. GM Financial does not care and merely repeats that they sent out the bills. They clearly don't care about the fact that I will not be receiving those bills in the future as well. This creditor is harassing consumers and needs to be reported.

Issue: Getting a loan or lease

Subissue: Problem with additional add-on products or services purchased with the loan

Consumer Complaint: The morning of XX/XX/XXXX I took a financing offer from XXXX XXXX to XXXX XXXX. Terms were 5.69 % and specific to the XXXX XXXX XXXX I was purchasing - XXXX XXXX had researched the vehicle with VIN. Spoke with salesman. He said he would submit the offer to the finance officer and she would call me. I had put only {$200.00} down in my loan details with XXXX XXXX, however I told the salesman when he asked if I could put more down. I said if required yes, and I was open to ideas regarding better terms from the loan officer. He said she would call by early afternoon. At XXXX I had not heard from the loan officer, so I called the dealership. Salesman went to speak with loan officer and said she had found a loan that was 1 percent better than XXXX XXXX was offering. I thought that was great and said I would be in the next morning when I had a short time window to finalize the deal. When I returned the next day the loan officer showed me the paperwork and the rate was 8 %. She said that XXXX XXXX doesnt always have all the details and thus terms could change. I shouldve walked out right then - knowing I had supplied XXXX XXXX with all the details - however I had shopped for a vehicle exactly like this for about 18 months ( they seem pretty rare especially in this good condition ) and wanted to get the purchase completed. Furthermore I did not have much time that day and was heading out of town that weekend. So I figured I would complete the deal and simply refinance. The loan officer then proceeded to try to sell me a few products she had worked into the deal. I declined two of them however accepted the Tire Care that she said costs about XXXX or XXXX dollars a month. When the paperwork came out, at which time I was pressing to make a work appointment, the cost was {$990.00} plus financing over a 60 month period. I told her her math of {$7.00} or XXXX was wrong - and asked if I could cancel this after the fact. She said yes. I finished the paperwork and purchased the vehicle - although not at all happy with the terms. When I got back in town I called XXXX XXXX on XX/XX/XXXX to cancel the Tire Care. They instructed me to take a copy of the agreement to the dealer. I took a copy to the dealer on XX/XX/XXXX, spoke with the loan officer and asked if there was anything else needed from me. She said no, and that the refund would be sent to my finance company ( GM Financial ), which could take about a month to reflect on my account. At this time I also called XXXX XXXX to ask why the terms they had given me were not honored. It turned out that because of the add on products the loan officer had thrown into the deal the loan to value ratio was changed and thus higher rates were generated. This was done without my knowledge! Furthermore, four additional inquiries were registered on my credit, which had a lowering effect on my score. This is unscrupulous and should be illegal ( yes, I know I signed an permission slip for this. ) I been involved in a lot of financial dealings - this by far is the biggest scoundrel thing I have ever encountered. Ive learned my lesson though - never go to the dealer for financing. Back to the issue of getting a refund on the tire care. On XX/XX/XXXX I called XXXX XXXX to inquire about the cancellation. They said they had not received anything from the dealer so they would email me a form and take care of it. The emailed it to me, I returned it that same day. On XX/XX/XXXX I called XXXX XXXX to inquire if everything was in order and was told because I had bought this from XXXX I had to contact them for cancellation and transferred me to the XXXX Extended Service Plan department. They instructed me to send an email to them with instructions to cancel. I did that immediately. On XX/XX/XXXX I received a call from a different finance officer at XXXX XXXX asking me about the cancellation. After trying to re-sell me on the policy I declined and asked him to proceed with the cancellation. He said he would do so and I should have the amount - minus almost {$100.00} in cancellation fee and proration - credited to my account within a few weeks. That was a month ago. I called XXXX Extended Service again this week to ask the status and this time was told they dont handle this, had no record of it and I would have to visit the dealer for the refund. Ive been trying to deal with this for over three months. I feel it was an all around scam all along. I would appreciate getting a refund - preferably in full. I also think a reform on the way auto buyers are handled in cases like this is in order to save others from this abuse, which includes being switched into higher rate loans based on having products that were not asked for or discussed being added to the loan amount. Thank you.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Problem with personal statement of dispute

Consumer Complaint: I was under a vehicle lease agreement with GM financial for a XXXX XXXX Pickup Truck. All monthly payments were paid in full on time for the first 36 months, up until XX/XX/2018 when a clerical/technical error in the GM payment system stopped my payments from being withdrawn from my account. This resulted in two months of missed payments ( {$530.00} ), however GM Financial claims to have called a phone number regarding this situation that was no longer associated with me. No notification was given via alternative phone numbers or numerous email addresses associated with the account until XX/XX/2018. At that time, immediate action was done on my part to pay the outstanding balance in full. I then learned that my account was reported to the credit agencies as a delinquent account. I disputed this with GM Financial, they acknowledged that the notifications were sent to a phone number that was no longer connected to me and that no other forms of communication regarding the ceased payments through the GM Financial system. They also acknowledged that the payment was received promptly once I was properly notified, however they would not rescind the notification to the credit agencies. I was told that they ( 1 ) refused to investigate the issue within the GM Financial payment system, ( 2 ) would not revoke the delinquent notice to the credit agencies, and that no further action would be taken by GM Financial.

Issue: Struggling to pay your loan

Subissue: Loan balance remaining after the vehicle is repossessed and sold

Consumer Complaint: In XX/XX/2018 I spoke to a representative at GM financial and was told on their recorded line that I would be able to give the vehicle back and get it back after a month or two and continue the payments since I was going through a difficult time financially. When I called back asking about the letter I received after the car was returned stating the vehicle would be auctioned off I was informed that I was lied to by the previous representative and that unless I had the past due balance plus the repossession fee or the total loan amount I wouldn't be able to get my car back. Now I am stuck with a repossession on my credit. I submitted a complaint to the company about the situation but was never contacted.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: This complaint begins with an account with GM Financial that is being reported on my XXXX account with inaccurate and missing information. The car was totaled and was paid off by the liable insurance company, however GM Financial is reporting this as an account with a balance and late payments that is hurting my score. I contacted this company on XX/XX/XXXXto discuss my options in resolving this matter in that I am weeks away from closing on my mortgage and need to have this resolved for my underwriter. I spoke with a customer representative named XXXX who told me that the account showed that it was paid off in XX/XX/XXXX by the insurance company and the account should be reporting with a XXXX balance and I should dispute this with XXXX. I then got off the phone with her and contacted XXXX who then said that contacting GM directly would possibly speed the process. In hopes to escalate the situation, I contacted GM Financial again to get something in writing so that I could forward this to my lender for a rapid rescore. I then was sent to an individual named XXXX in customer service who sent me to the NON-collateral department who then told me that the account was now with a third party collection agency and that I would need to call the number XXXX, This is all the information I was given. I then got off the phone and XXXX the number to see that it opened a page with XXXX XXXX XXXX XXXX XXXX that claimed they handled complaints about the a company called XXXX XXXX XXXX XXXX who the number belonged to. I then called the number to be forwarded to a voicemail message with XXXX XXXX of XXXX XXXX and I left my name and number that GM Financial had in their files. I realized that the collection agency was not an entity of GM Financial and confirmed that the account had been sold or outsourced. I attempted to contact GM Financial for a 3rd time to try to resolve this again only to be met with another misinformed customer service representative who said they cant make any changes to the account and wanted me to verify the XXXX number to call ( the number I was given earlier ) because they have so many companies for outsourcing and the one I was given earlier was not listed in my account. I asked to be forwarded to the NON-Collateral department since our talk was leading nowhere, so she put me on hold and then came back to say that I needed to contact the third party collection agency they dont have the account. After some back and forth, she forwarded me to GM collections and not the non-collateral department where I was told that the account was with a third party collection agency, I explained to the collections assistant again what XXXX and I were discussing for 30 minutes, and was placed on hold to get me to the non-collateral department. She then put another collections rep on the phone named XXXX license # XXXX who still wasnt attempting to assist me with any effort. I am trying to resolve this issue as soon as possible in that this is the only thing keeping me from qualifying for my home loan. I have attempted tirelessly to contact GM Financial to rectify the situation as in legally they are to remove things that are inaccurate or submit correct information. The service I have received to resolve this is unsatisfactory and is in noncompliance of the Fair Credit Reporting Act. I have yet to receive any letters regarding the validity of this debt and when trying to resolve it, I was sent in circles by GM Financials representatives.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I filed an initial complaint on XX/XX/18, complaint # XXXX-XXXX with your organization, in which I disputed two payments GM financial reported as missed on my credit when payments were made. I received notice from CFPB that the company stated credit would be repaired and missing payments removed. They were removed and my credit was repaired on XX/XX/18. I considered the matter closed. Now on XX/XX/18 GM financial is now reporting XX/XX/2018 as a late payment and still reporting XX/XX/2018 as a missed payment when their response said that would be reversed.
