Issue: Getting a loan or lease
Subissue: Changes in terms mid-deal or after closing
Consumer Complaint: On XX/XX/XXXX, I purchased a vehicle from XXXX XXXX XXXX, located at XXXX XXXX XXXX , XXXX XXXX, MI XXXX. I provided pay statements from my full-time employer, in which my income was more than sufficient enough to cover the purchase of the vehicle and the monthly payments. I also provide pay statements from my part time employer, as supplemental income. The contract for the vehicle was signed and dated on XX/XX/XXXX. I was told that the finance company was XXXX located in XXXX XXXX, TX XXXX. I purchased insurance and indicated that XXXX was the Leinholder. I received copies of the contract, the keys for the vehicle and a new license plate for the new vehicle as the new owner of the vehicle with 11 miles on the odometer and with financing in place with XXXX. The contract had no " cooling off period '' and clearly indicates that the sale is final. After closing on the vehicle loan, an individual from the dealer, named XXXX XXXX, began bogus attempts to change the terms of the vehicle loan, make changes to the contract/loan and/or altogether cancel the contract/loan, through the use of phone calls to my phone and full time employer business line with threats, intimidation, high pressure tactics and scare tactics and threats of making police reports regarding the purchase of the vehicle, all in an attempt to have documents to be texted to his personal cell phone. On or around XX/XX/XXXX, I received a call from an individual ( XXXX XXXX, stating he is a manager at the company ) requesting that I text him on his personal cell phone, a cancelled check from my part time job. I requested that he provide to me, in writing, exactly what documents that he is requesting, however he refused. I informed him that I had already, provided my most recent pay statements showing the amount earned on a weekly basis from my part-time employer. Both myself and employer then requested a fax number to fax any documents being requested, to be faxed directly to the company, however, he refused to provide the fax number and continued to request that any documents are submitted to his cell phone only. He became threatening and intimidating, and began using high pressure tactics to gain this information, however continued refusing to provide anything in writing. My part time employer personally contacted this individual, however he refused to identify himself over the phone. Both myself and my part time employer tried to reach GM Financial several times and called GM Financial at XXXX, which indicates its the funding department, however continued to only reach voicemail, therefore voicemail messages were left for a return call. The voicemail indicated to press 0 ( zero ) for another funding agent, however, when pressed, the call pauses then hangs up. Therefore, Via email to the XXXX sale rep 's email, Mr. XXXX XXXX, which was provided to be used to send proof of insurance to, I provided a copy of my XXXX for tax year XXXX from my part time employer, supporting the supplemental income. Although Mr. XXXX XXXX, received the XXXX information, he intentionally began to confuse the situation and began requesting other documents without any clarity as to the exact documents he is requesting and he then began calling my full-time job, disturbing my work. My part time employer contacted Mr. XXXX XXXX for clarification of what documents, however he refused to state exactly what documents he is requesting. He was asked several times to clarify the documents that he is requesting, however he continued to refuse. He became even more threatening and intimidating and began to threaten to call the police and file a false police report if we will not provide him with documents, none of which he would clearly state or indicate what documents nor the purpose of the documents. On XXXX, both my part time employer and I have emailed over to the dealer verification of my part time employer 's business establishment information including the business bank's/credit union 's voided business check and business entity document supporting establishment of accounts, a copy of the MI Dept of Treasury Tax Id Number with supporting business address and mailing address, and another copy of my XXXX tax year XXXX. I have acknowledged that tax deductions are less at points and more at other points on my XXXX, it is done so, with my permission. The information provided is more than sufficient enough to support the small amount of income earned part time and to verify the established business. Requesting relief : That the contract/loan remains as it is, as of XX/XX/XXXX. That the dealer and finance company only contact me in writing. That I receive the monthly statement timely as the 1st payment is due XX/XX/XXXX. That XXXX XXXX cease among all other things the unprofessional acts and actions, cease all harassing and illegal tactics, cease all business misconduct, cease all calls, cease all threatening and intimidating calls, end all high pressure tactics and scarce tactics which include the threats of making false police reports, in his blatant attempts to coerce and gain unwarranted information. And all other relief under the law.

Consumer Complaint: I had a lease with GM financial which I extended for 6 months. I was able to lease a new car in XXXX, 2018 so I returned the car on the existing lease in XX/XX/2018. However the dealer, XXXX XXXX XXXX in XXXX, MA did not process the transaction to close the original lease so GM contacted me regarding the status of the lease. I informed GM on XX/XX/18 that I returned the car to the dealer and had entered into a new lease which GM does have that information. However, GM has not reached out to the dealer to complete the transaction to close the lease. Rather GM continues to harass me with telephone calls and letters. I have tried on several attempts to resolve this with GM but can not resolve the problem.

Consumer Complaint: I have been given incorrect information numerous time about my auto loan with GM Financial. I was collected upon when a payment was not due yet. I was told the due date was changed from XX/XX/XXXX to XX/XX/XXXX. I continued to call to verify with their automated system, live agents, and their corporate complaint line and even social media complaint line. I was current on my loan as of XX/XX/XXXX. The due date was changed and verified to be due on XX/XX/XXXX. I am now getting emails from them stating my account is past due when it should not be. I have not been sent any paperwork I requested for a due date change in writing. My statements do not accurately reflect the pay history as they state a payment was returned when I show it is posted. These are the outgoing calls I have made include the following in regard to the complaint. XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX call made at XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX XX/XX/XXXX XXXX, XXXX, XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXXXXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX I advised XXXX the social media complaint agent to call my cell phone today with no answer. I also called for a manager call back again and I am getting no service from this company. My complaint and my loan are not being serviced. I have been given conflicting and wrong information on nearly every call I placed. There is no consistency. I feel like I was lied to and strong armed into making a payment that wasn't due yet and when it was collected, I was told my due date would be changed based on being current and is not.

Consumer Complaint: I have a loan with GM FINANCIAL. I have always made my payments on time. For some reason I realized that there was a late payment on my credit report. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX, XXXX and GM FINANCIAL with no successful resolution. XXXX and XXXX were reporting me late. There was definitely an error on their part. I was never 30 days late XX/XX/2018.

Consumer Complaint: Previous attempts ( complaints ) to remedy the situation have not been addressed. Simply sending me the terms of my lease agreement does not answer the question as to why I was reported late XX/XX/XXXX and XX/XX/XXXX due to well known errors and deficiencies and the GM financial website. The GM financial website Displayed a XXXX balance owed in XX/XX/XXXX. Based on this information no payment was made. The XX/XX/XXXX payment was made a few days late which caused a 30 day late assessment. This again occurred for XX/XX/XXXX causing a cascade effect. The fact that GM financial uses this website to except payments should imply implicitly that the information displayed on the website is correct. It was not. The website has been updated and corrected which now shows the correct payment amount. This in itself, clearly implies that GM financial was well aware of the problem. I would like the XX/XX/XXXX and XX/XX/XXXX late payment reports made to the credit bureaus reversed. I am guessing there are thousands of other customers who experienced the same problem which has other implications.
