Issue: Problem when making payments

Subissue: Problem during payment process

Consumer Complaint: I have a loan with GM FINANCIAL. I have always made my payments on time. For some reason I realized that there was a late payment on my credit report. As you can see, I have always had a stellar payment record with this company. I tried contacting both XXXX, XXXX, XXXX and GM FINANCIAL with no successful resolution. XXXX, XXXX and XXXX were reporting me late. There was definitely an error on their part. I was never 30 days late XXXX - XXXX, XX/XX/2018.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: GM Financial Settled " Settled less than full balance '' their account that was opened in XX/XX/XXXX that is currently closed. They updated my credit reports showing different statuses on all 3 credit bureaus. The information they have on each report is different. On XXXX PAYMENT STATUS states : " legally paid for less than the full balance '' with a STATUS UPDATED date of XX/XX/XXXX with an original balance of {$17000.00}. This shows positive on my report as it states PAID. On XXXX, there is nothing showing in PAYMENT STATUS, thus showing the account as derogatory. The date under STATUS UPDATED and BALANCE UPDATED is the wrong date ( XX/XX/XXXX ). On XXXX, under PAYMENT STATUS it shows " Bad debt/placed for collection & skip '' as opposed to settled/paid for less than full balance ''. Thus showing it as derogatory. Under the section YOUR STATEMENT, they filled in " settlement accepted on this account paid charge off ''. That is not my statement as I have not made any statements. They also put this under their comments. It would have been helpful if they put this under payment status instead. Since the account has been settled, could they please show that in the Payment status section as " SETTLED AS PAYMENT IN FULL FOR LESS ''. Either consistency or deletion is helpful. Thank you kindly.

Issue: Problems at the end of the loan or lease

Subissue: Problem with paying off the loan

Consumer Complaint: Bought a car, was ripped off in payment as it was increased after loan was signed. I paid on time then could not keep up with payments. I tried to refinance for a smaller payment, they refused so I told them I voluntarily surrender the car. I made sure it was clean and had gas. It was in great condition, they picked it up like I was a criminal, I handed them the keys. They auctioned it or sold it. And tried to get me to pay {$12000.00}. They then charged it off as a bad debt write off for taxes. Reported me being late XX/XX/XXXX, what it was charged off in XXXX, still reporting late payments and a balance due of {$12000.00}. FCRA says if it is charged off the balance is XXXX as they can no longer collect. It has been written off their taxes. I have disputed all three credit bureaus and GM still has not corrected. I have also called them directly and they are still reporting incorrectly. Do not use under any circumstances. You will be XXXX in the end.

Issue: Struggling to pay your loan

Subissue: Denied request to lower payments

Consumer Complaint: My name is XXXX XXXX and I am the " recent '' legal guardian of my " legally incapacitated '' brother as of XX/XX/XXXX. My brother has had 2 XXXX within the past 6 months. One on XX/XX/XXXX and another on XX/XX/XXXX. He is only XXXX years old. Since his second XXXX, he has been unable to XXXX or XXXX XXXX XXXX XXXX XXXX XXXX XXXX. My sister and I decided to get guardianship on him in XX/XX/XXXX. All the while we've been trying to get him well through XXXX XXXX and Private Care. He had a XXXX XXXX XXXX that we thought was paid for because we were unraveling his financial situation. He is a private guy. Well, in XX/XX/XXXX ... we received notification ( by luck ) that his vehicle was 118 days past due with GM Financial from a letter that was brought over to us from one of his friends. Needless to say, we immediately contacted GM Financial. When I say " we '' I mean my sister and I. We share Guardianship responsibilities for him. My sister contacted them and advised them of his situation, " hence his delinquent status ''. Prior to his " 2 '' XXXX. His pay history was fine. After my sister spoke with the collection representative. She called me and told me that we needed {$390.00} " immediately ''. I asked her if she had explained to them what's been going on with him. She said yes and that it didn't matter. They needed a payment NOW " or else ''. I didn't and couldn't believe that they would act in such a manner. So I called and spoke with the representative. At this point, there was a " clear '' break-down of communication and miscommunication. I advised the rep that we had just received this notice regarding the vehicle and that coming up with {$390.00} today or by the end of the week would be difficult considering the spontaneous request. However, I would be able to pay {$200.00} on XX/XX/XXXX and then the rest by the end of the month. The just of the conversation was that the account needed to be caught up by " 1 '' payment to prevent a repo and/or charge off. I asked several times, " so as long as the {$390.00} is paid by XX/XX/XXXX, the account would be fine? '' The representative said " yes '' every time. Because that was my understanding, I focused on making a payment by the end of the month instead of just the {$200.00}. So I called and left a voice message on the representatives phone that I would be making a full payment on XX/XX/XXXX. I left two voice messages on XX/XX/XXXX. One at XXXX XXXX and another at XXXX XXXX attempting to advise them of my intent to pay {$390.00} in full on XX/XX/XXXX. Today, XX/XX/XXXX ... the vehicle was repossessed. We immediately contacted GM and I asked, " what was going on? '' The reply turned into an entirely different discussion from my phone call. The reply was, " I told you that if you didn't pay the {$200.00}, that I couldn't prevent them from taking the vehicle. '', " We scheduled the {$200.00} for the XX/XX/XXXX and when it wasn't made there's nothing we could do to prevent the repo. '' Because my line of questioning was focused on making sure a payment was made by XX/XX/XXXX in the amount of {$390.00}. That was where my focus was. Had the representative been clear in saying, " I'm not going to stop the repossession '' OR " They can come pick it up any day if you don't pay the {$200.00} NOW. '' Then I would have Robbed, Peter to Pay Paul ... ( so to speak ) -- -But because I emphasized and she agreed that was more important was to make sure that a payment was made by the end of the month. That's what our intentions were and that's what we planned to do. I asked had she received my " two '' voice messages. She said " NO '' ... she stated that she called me. However I do not have any call logs or incoming calls on my phone that shows that she called me to further discuss anything beyond the voice message that I left advising of the " full payment '' date of XX/XX/XXXX. What's troubling is that I understand their position. The account was behind and subject to repossession. I get it. I'm not defending that position. But having some empathy for a legally incapacitated person ... whose family is trying to correct his situation in a short notice should've had some consideration. He needs his car to go to and from his Dr. 's appointments. He is still XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Remember, all of this transpired within " 1 '' week of us receiving the notice of the delinquent status. We came up with the money to pay it up and he was finally approved for XXXX. Which would've eliminated this problem from continuing. All of this was explained to the representative during all of the conversations. My sister advised her several times as well about his condition. I made first contact on XX/XX/XXXX. The vehicle was taken on XXXX day- XX/XX/XXXX. How unfortunate.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: On XX/XX/XXXX the co-debtor on an auto loan through GM Financial filed Chapter XXXX Bankruptcy. This plan was confirmed on or around XX/XX/XXXX. The car loan through GM Financial was included in the wage earner 's plan and paid regularly by the Trustee. In XX/XX/XXXX the court issued an order that the car was to be surrendered under the plan and the balance of the loan after proceeds from the sale of the vehicle would be considered unsecured debt paid at 100 % through the plan. I am listed as a co debtor on this account and am protected under the automatic stay. Fast forward to today, nearly 3 months later, and the car is still here. GM Financial has knowingly and fraudulantly reported the full balance of the loan on my credit report, marked the account as 180 days derogatory as of XX/XX/XXXX, which is not accurate considering the Trustee paid them in XX/XX/XXXX. They also changed to notation on the account to reflect open and delinquent as opposed to included in chapter XXXX wage earners plan. They are violating my co debtor rights under the automatic stay and hindering my ability as a consumer to get financing for a car as their malicious and deliberate false reporting dropped my score nearly 80 points and tainted my account history.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: GM Financial is refusing to take off incorrect information from my Credit Report.. back in XX/XX/2017 I went to court for a Car Loan that I was being sued for. I had no idea that I was listed as a co buyer for this Loan until I was served with court papers. I went to court and explained to the judge that the information was not mine and I didn't know of this until I was served the signature didn't belong to me. I never agreed to be a co buyer for any Vehicle. The Judge dismissed the case against me without prejudice.. I submitted disputes with all Three Credit agencies yet XXXX has refused to remove it from my report, stating that GM Financial said that the information is correct and therefore can not remove it.. I can't understand why this is possible because XXXX and XXXX has already removed the information from my Credit Report.

Issue: Improper use of your report

Subissue: Credit inquiries on your report that you don't recognize

Consumer Complaint: This was a lease that I entered into with GMfinancial. The agreement opened on XX/XX/XXXX and ended XX/XX/XXXX. It was a 36 month lease term that ended early. I choose to end the lease as my wife was over miles 2 months early. GM and I worked out the payments need to complete the agreement, which I paid in full. The total of {$2700.00} was paid for early termination and mileage. I opted to ground the car at the dealership that I purchased a new GM car from. Throughout the life of the lease, I had an excellent payment history. GMFInancial is appearing on the derogatory section of my report. This should not be derogatory and be removed. This has hurt my credit score and resulted in high costs to buy another vehicle. I have been unfairly affected as a consumer by this error and should be compensated.
