Issue: Managing the loan or lease
Subissue: Loan sold or transferred to another company
Consumer Complaint: Team, I originally obtained a 4 year lease with GM Financial in XX/XX/XXXX for a XXXX Escalade for payment of approx. {$1600.00} a month. ( This in itself was deemed extortionate and further more I was sold a 3 year maintenance contract which is an additional issue just brought to my attention ). In XXXX I began a search for an alternative vehicle at a more competitive price and eventually found one which i purchased and now meant I would need a lease assumption with GM. I advertised on XXXX and obtained the criteria from GM to move forward in XX/XX/XXXX. I found a qualified buyer in XXXX and followed to procedures during which time GM kept defaulting my account into a past due status which meant i was unable to move forward and I lost the qualified buyer. The same happened in XXXX when i again provided a qualified buyer signed all the paperwork and GM alleged XXXX lost the documents and so therefore the transaction was unable to be completed. Fast forward i am now within the last 12 months of the lease and no longer able to meet the criteria and am stuck with the lease payment through the fault of GM. GM deliberately stalled the process and despite speaking to all 3 departments they continued to give me the run around and also contacted XXXXXXXX to have my advert removed. Its clear GM did not act in an honest and timely manner in addition to at one point harassing me in an attempt to reposes the vehicle despite it being always in state of good payment, in my possession and insured. The Customer Service Department, Lease Assumption Department, Total Loss Department and the Collections Department all have documented detailed call records to support my conversations but yet they all seemed not to be in contact with one another which to me seems like negligence on GM 's part or a blatant attempt to confuse and deceive me as a customer into remaining stuck with the Lease agreement. I would like this investigated please and for GM to be responsible for taking back the vehicle with no negative report on my credit as it was their errors that led to my lease assumption not going through. I even purchased another identical vehicle and everything was timed perfectly for the transfer until GM caused the process to breakdown and I am now stuck with 2 car payments till XX/XX/XXXX. I constantly had to chase them to try to complete however they are quick to harass me despite asking to be removed from their call lists when i changed payment dates. Thanks for your consideration Regards XXXX

Consumer Complaint: This account is being reported inaccurately and incorrectly on my credit report. I see multiple 30 & 60-days late marks which is a clear violation of my right under the FCRA. The company has never responded to any of my attempts to obtain any proof or documentation that will prove this account is being reported accurately.

Consumer Complaint: his started when GM Financial sent my account to a collection Agency called XXXX XXXX XXXX. I will start by telling you the situation. I was in a career ending accident with this very car ( XXXX XXXX ). From that point on I had to apply for XXXX in PA. Unfortunately it takes 2 years before you get a hearing in front of an administrative judge. So I was unable to pay my payments. Now the original loan was taken out in XXXX of XXXX. The problem started when XXXX XXXX got involved. We were talking about making a settlement on the account that's when the games started. I explained my situation and told them that I was Permanently and Totally XXXX. I said I would be willing to give you my total monthly income of {$1100.00} to settle this debt, because I only make {$1100.00} a month from XXXX. The total bill was {$9700.00} when I defaulted back in XXXX. The woman said that she would send in the request to GM financial, with the reason why to see if they would accept, because of my condition. She told me it would take about 2 weeks to get an answer, and that she would get back to me. So two days pass and I get another call, This is XXXX XXXX etc. I am calling about a debt that you owe. I said I have already discussed this with one of you reps and put an offer in, she said she sent it off to GM Financial for review and to see if they would accept the offer and she would get back to me in two weeks. He said sorry it never happened. Then he says if you give my {$6000.00} I will send the offer in. I said I don't have that kind of money, I am XXXX and only make {$1100.00} a month, but I can do what I offered the woman. He said he won't do it. Then we hung up. These calls have gone on for 3 months now. They went as low as {$1100.00} and as high as {$6000.00} and everyday it's a new figure. One day it was {$2000.00} last week. It is just game after game. I told them the only offer and money I have is {$1100.00} and I will give it to you in good faith to show you I am not running from My obligations and good Faith. But again, it just depends on who calls me for that day. One day they say they will send in the offer and it never gets done

Consumer Complaint: We received notice of a return of lease charge of {$420.00} in late XXXX after returning our XXXX XXXX. We held the lease from XX/XX/XXXX for 24 months and never missed a payment. The first bill was received sometime in late XXXX and I contacted GM Financial to inquire about why there was tax on the return charge, as the dealership we leased from, XXXX XXXX XXXX at XXXX XXXX XXXX XXXX, XXXX XXXX, claimed there should not have been tax. I contacted them 3 times, by phone and over online message, over the following months to find out about the tax with no call back or explanation from GM Financial, and my most recent call on XX/XX/XXXX, a rep stated in their account that there was a discussion and the system shows no follow up was given to us regarding the question. On XX/XX/XXXX, wife Wife, a cosigner, received a derogatory mark notice on my XXXX which stated there was a charge off for the balance of {$420.00}. Our only record of notice was that first letter received in late XXXX, and no further contact from GM financial regarding the question on the {$30.00} tax added to the fee. I reached out on XX/XX/XXXX to GM financial and requested information on why there was a derogatory mark and why no one had contacted me prior. The first representative claimed she did not see any information on my account. I was then transferred to an " escalations '' team member, who claimed they did see a balance due and a previous request, but no follow up from their department. I was then transferred to a supervisor who informed that they did not see a derogatory mark, and believed we should have been contacted regarding the issue. When asked for records of my contact with them and any contact they have made with me, I was told I was require an attorney to subpoena to obtain that info. My intent was always to pay the fee, but to receive an answer on why there was sales tax on this fee. No one called back, no further communication was sent, and no additional letters demanding payment were sent.

Issue: Problems at the end of the loan or lease
Subissue: Excess mileage, damage, or wear fees, or other problem after the lease is finished
Consumer Complaint: I leased my XXXX XXXX in XXXX, was due to turn it in by XX/XX/XXXX. As most people know, we are dealing with a pandemic then and now. So on XX/XX/XXXX. XXXX, I turned in my lease due to mileage almost being over. I planned on going back to purchase or lease another vehicle before the end of the month. However, the car dealerships closed within a day or 2 of turning in the lease. The car dealerships didn't reopen and still are barely open to this day, until a few months later. Leaving me without a vehicle. Then as soon as the dealerships open in XXXX, I got slammed with the disposition fee ( which is a very sneaky way for the companies to make more money and is not fully explained at signing ). I did know this was one of their great ways they do business, but assumed due to not being able to buy a car, it would be waived. So I get to pay another {$410.00} for a vehicle I don't even own. I had no excess wear and tear or mileage. I have spoke with them several times and they will not help me. This is completely unfair business practices and I had no control over buying a vehicle within their time frame. They are willing to " help '' others during the pandemic but screwing over many others at the same time. I lost my job and can not afford to pay it right now either.
