Consumer Complaint: I pulled my payoff amount from the online portal on XX/XX/XXXX and paid amount show the same day. Through the text chat I was advised it would take about 30 days to process and receive title. Called back the 2nd week in XXXX to check status and was told the payment funds had not been allocated and they would submit request. This process continued weekly until I called on XX/XX/XXXX and was told the same thing but that the account had a credit and I would receive {$320.00} back by check and they again submitted request to allocate funds and to allow 2-3 business days for completion. I called again on Monday XXXX and spent over an hour on the phone to have someone finally get into my account and finalize the account to closed and request title. This phone call I was finally told that I still owed {$350.00} and that I have been charged interest daily since the XX/XX/XXXX payment even though I have called continuously for almost 2 months and no one told me any of the above and got different answers each time. Spoke with " manager '' who had children crying the background who in a nutshell told me I was going to get charged interest and apologized for the wrong information given by " new employees ''. This situation was handled extremely poorly and I was fed incorrect information since XXXX but they are doing nothing as recourse. At conversation on XX/XX/XXXX I was told they would be able to expedite the title for me at least but as of conversation with manager on XX/XX/XXXX that is never possible.

Consumer Complaint: I had auto lease car with GM financial. I set up auto pay at the beginning of the lease and payments were automatically withdrawn from my account for 23 months. The last payment should have been withdrawn in XX/XX/XXXX. I assumed that like the previous payments they would withdraw it automatically. I usually check to make sure it was withdrawn. However, being a pharmacy manager at a community pharmacy, I was busy preparing to receive and administer the covid vaccine at my pharmacy that started on XX/XX/XXXX, I didnt check this time. On Sunday XX/XX/XXXX, I get an alert about a negative activity on my credit report, when I looked into it, it was a 30 day late payment on my leased car. I paid it up on discover and called GM financial asking why the last payment was not automatically withdrawn, I got 3 different answers : one was that I stopped auto payment in December and they received a confirmation. I told the representative that this was fraud because they can check that I havent opened the account since I set the auto pay 2 years ago. Then the second representative said that you scheduled the auto pay to end on XXXX not January 2 years ago! Then when I asked to spear to a manager, the manager stated that I had to pay the final payment manually! And that since they received the payment late, that cant do nothing about it. I asked to speak to a higher manager and was told he is busy and I can leave a voice mail and he will get back to me. Its been over 10 days now and he hasnt called. When I asked the representatives why I didnt get any alerts of the late payment or reminders, they claimed they called but I didnt receive any calls. I do receive e-mails form GM financial about services and rewards, but no e-mails about late payment or auto payment stopping. Ive had leased cars before and never had such a problem before. I disputed the late payment on my credit report but bank still wont remove it. Never had a late payment. I tried everything I could to remove it, but bank is not cooperating and representatives are were not nice about it. Tried to find excuses for the deceptive procedure they have.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

Consumer Complaint: on XX/XX/2021 I sent GM FINANCIAL a Cease and Desist, a Affidavit of Truth, Exhibits labeled with the companies violations of my federally protected consumer rights under TILA and the FDCPA, and a invoice for fair and appropriate compensation of the violations through certified mail with a green return receipt to prove the company received the documents. I also filed a complaint here through the CFPB with attachments containing everything that was sent to GM FINANCIAL supporting my claim of the violations and the section of the law referencing my consumer rights in which they violate. GM FINANCIAL responded to the CFPB with a letter that was unacceptable and unacknowledging of the fraud and violations they committed. The Affidavit of Truth filled with statements of truth which I sent to GM FINANCIAL ( and to the CFPB for documentation ) went unrebutted which by law stands as truth in commerce. On XX/XX/2021 GM FINANCIAL violated 15 USC 1692d- HARASSMENT OR ABUSE ; and 15 USC 1692c ( b ) - COMMUNICATION IN CONNECTION WITH DEBT COLLECTION ( b ) COMMUNICATION WITH THIRD PARTIES ; when they implicated a third party debt collector to the whereabouts of my location information XXXX XXXX XXXX XXXX XXXX XXXX to Harass, abuse, and embarrass me by illegally repossessing my vehicle from my location at an inconvenient time while bystanders watched my privacy be invaded. I went to the repo companies residence to get my vehicle back and was told GM FINANCIAL has to send a release. When i contacted GM FINANCIAL i was told i have to pay {$1400.00} to have my vehicle reinstated, catch up on alleged debt from past due payments, late fees, and pay the tow fee from illegally having my vehicle repossessed unwillingly and provide proof of full coverage insurance which is supposed to be included in my finance charge but was never disclosed to me. Pursuant to 15 USC 1605, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges. I am the original creditor, I entered into a consumer credit transaction with GM FINANCIAL in which a finance charge is involved, and i am aware that GM FINANCIAL used my " Credit Card '' as defined under 15 USC 1602, to create the certificate of indebtedness and it is not my obligation pursuant to 18 USC 8- Obligation or other security of the United States defined. GM FINANCIAL is criminally liable pursuant to 15 USC 1611-Criminal liability for willful and knowing violation ; for violating my rights as a Federally protected consumer under 15 U.S. Code CHAPTER 41- CONSUMER CREDIT PROTECTION. GM FINANCIAL is civilly liable pursuant to 15 USC 1640- CIVIL LIABILITY ; in my individual action for damages, for twice the amount of the finance charge in connection with the transaction.

Consumer Complaint: On XXXX XXXX I signed a " promissory note '' to get a " loan '' from GM Financial. However was not disclosed full details of the consumer credit transaction and how the transaction would be fulfilled. In addition there was no consideration given for the promissory note that was recorded on the companys books. The vehicle was also repossessed which is illegal as the the property was not the companies to have re-possessed as it was never In their possession. We had to pay almost XXXX dollars I XXXX XXXX XXXX, natural person, living man and original creditor was not given full disclosure on the consumer credit transaction. GM FINANCIAL is not the original creditor and that is false and misleading per the FDCPA. GM Financial did not disclose their initial relationship with the dealership that would bring a natural person into commerce. GM FINANCIAL did not disclose that upon the consumer providing their social security number ( credit card ) per the Truth in Lending Act and subject to 18USC 8, by the cardholder ( XXXX XXXX XXXX ) that the consumer who is the ORIGINAL CREDITOR in the consumer credit transaction, credit would be used by the dealership and the financial institutions to obtain a Loan from the federal reserve bank ( 12 USC 1431 ) in the consumers name ( identity theft ) and returned as if anything of value was provided in consideration by GM FINANCIAL. I am requesting validation of debt per 15 USC 1692g. In addition GM FINANCIAL is a debt collector per 15 USC 1692a ( 6 ). Debt Collector has thirty ( 30 ) days to properly and timely verify and validate the alleged account and debt as follows : a. Present all original account/loan level documentation from the original transacting parties containing verified signatures from all original transacting parties verified under oath and penalty of perjury to support your claim of indebtedness. Also please PROVIDE per the Generally Accepted Accounting Principles ( GAAP ) an audit trail of the aforementioned account. Lastly, There are other questions below that I would like answered point for point on a sworn affidavit. The first question is based on Federal Reserve Banking publications, by whom was the " loan '' funded I.e, who put an up ( asset ) to fund the loan and where did the funds ( I.e, cash, money, check ) come from? Second, provide full bookkeeping entries for account # XXXX created XXXX XXXX be explained in detail? And based on banking principles when the " note '' was signed and deposited to " create the funds '' an asset and liability was created to " balance the books, does that constitute as an exchange and settlement for the goods received, I.e, XXXX XXXX vehicle? Please also note That the giving a ( federal reserve ) note does not constitute payment. See Echart v Commissioners C.C.A., 42 Fd2d 158. That the use of a ( federal reserve ) 'Note ' is only a promise to pay. See Fidelity Savings v Grimes, 131 P2d 894. That Legal Tender ( federal reserve ) Notes are not good and lawful money of the United States. See Rains v State, 226 S.W. 189.

Consumer Complaint: My lease with GM ended XX/XX/XXXX. The lease contract call for the total base payments of {$10000.00} plus a lease termination charge of {$390.00}. I made payments totaling {$11000.00}. When I turned in the vehicle I took care of all items while pointing out the deficient pre-inspection report I had yet GM sent me an invoice stating I owed an additional amount of {$640.00}. I wrote to GM on XX/XX/XXXX pointing out that their inspection report was inaccurate and included all relevant proof to support my position. GM did not respond until XX/XX/XXXX stating I still owed {$420.00} for the {$390.00} termination fee plus fees and taxes while ignoring my request to have my payment overage applied to the fee, if not waived. Instead, GM falsely and fraudulently reported to the credit agencies that I " MISSED A PAYMENT '' to the detriment of my and my spouse 's credit history when in fact we did not miss any payments at all. Again on XX/XX/XXXX I wrote to GM requesting that it retract it's false and fraudulent report yet to date GM has refused to be reasonable and ignored my request.
