Consumer Complaint: Around XX/XX/2018 loan was delinquent since then this company has been reporting late payments every month which is illegal after 180 account should be closed payment history has multiple innacuracies i disputed the innacuracies with credit bureaus and the came to the conclusion that it was " verified '' how can I go from 120 days late to 30 days late that is innacurate reporting On a account that is in collections i contacted the company on fixing the issue and they refuse to take responsibility and update this account I am asking that this account be removed from my credit report as it is being reported illegally and failing to verify the accuracy and is negatively affecting my credit and my life I am trying this last resort before seeking legal action. Below I have attached copies of how it is being reported to the credit bureaus thank you.

Consumer Complaint: I purchased a XXXXXXXX XXXX XXXX through a used car lot called XXXX XXXX XXXX XXXX in XXXX XXXX XXXX of XXXX. The loan was serviced through Credit Acceptance. The owner of the XXXX XXXX XXXX XXXX fraudulent promised me a XXXX XXXXXXXX XXXX and the terms of that loan were already discussed when she claimed the car needed to be cleaned and repaired in which she had me driving a loaner XXXX XXXXXXXX XXXX which is the car I have now. XXXX dollars was put down as the down payment plus another XXXX to guarantee me getting the XXXX XXXX XXXX. She sold the car to someone else and left me with the XXXX. The terms of the loan are outrageous and not even close to the amount we discussed. She emails me all the time asking for more money and her business has since closed.

The vehicle I had I had asked Credit Acceptance to take back. A repossession was not necessary but they insisted. Upon settling this account I was PROMISED a " courtesy delete '' upon my settlement payment and was told the account would be removed from my credit reports in XXXX days. It was never removed as PROMISED!! Also I do not believe this Creditor is reporting correct information and historical information is missing. The creditor couldn't even verify my address when I contacted them.

Consumer Complaint: Credit Acceptance Corporation defrauded Consumer with a ( Retail Installment Contract ) thats was supposed to be a lawful finance charged which covers everything there should have not been no down payment on a finance charged. If so its illegal, In stead Credit Acceptance Corporation knowingly violated multiple consumers law Rights, Under the ( Truth in lending act. ) The law says Im the Consumer, Nowhere can you find the word ( citizen ) or ( borrower ) in the ( Truth In lending Act ) so therefore Iam the original consumer. 15 U.S. Code 1602 ( j ) The terms open end credit plan and open end consumer credit plan mean a plan under which the creditor reasonably contemplates repeated transactions, which prescribes the terms of such transactions, and which provides for a finance charge which may be computed from time to time on the outstanding unpaid balance. A credit plan or open end consumer credit plan which is an open end credit plan or open end consumer credit plan within the meaning of the preceding sentence is an open end credit plan or open end consumer credit plan even if credit information is verified from time to time. ( l ) The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. 15 U.S. Code 1605 - Determination of finance charge ( a ) Finance charge defined Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction. The finance charge shall not include fees and amounts imposed by third party closing agents ( including settlement agents, attorneys, and escrow and title companies ) if the creditor does not require the imposition of the charges or the services provided and does not retain the charges. Examples of charges which are included in the finance charge include any of the following types of charges which are applicable : ( 1 ) Interest, time price differential, and any amount payable under a point, discount, or other system or additional charges. ( 2 ) Service or carrying charge. ( 3 ) Loan fee, finders fee, or similar charge. ( 4 ) Fee for an investigation or credit report. ( 5 ) Premium or other charge for any guarantee or insurance protecting the creditor against the obligors default or other credit loss. ( 6 ) Borrower-paid mortgage broker fees, including fees paid directly to the broker or the lender ( for delivery to the broker ) whether such fees are paid in cash or financed. Residents of XXXX XXXX XXXXXXXX have additional legal protections under the XXXX XXXX XXXXXXXX Consumer Protection Law. This law requires certain debt collectors trying to collect a debt within the city to obtain a special license from the XXXX Department of Consumer and Worker Protection ( formerly known as the XXXX Department of Consumer Affairs ). Debt collectors must also comply with other regulations. For example, they can only make up to two debt collection telephone calls to a particular consumer each week. Under the federal Fair Debt Collection Practices Act, in general, a debt collector is a person or a company that regularly collects debts owed to others, usually when those debts are past-due. Consumer Complaint: In 2019, I opened a auto loan with Credit Acceptance Corp. During the signing, the dealer acted as if he was doing me a favor due to me having horrible credit. As a XXXX XXXX XXXX single mom, I knew nothing about interest rates or credit. So I blindly believed him when he mentioned I had been approved. I believed he helped me, only now to discover he fraudulently fixed me up with a huge interest rate loan with Credit Acceptance Corp, a loan I should've never been approved for. Recently, I've decided to look over my credit report and realized that the balances they have listed on my report do not match the balances Credit Acceptance Corp has on my contract. This led me to look over my contract for my vehicle completely. I was surprised and shocked to realize I have a 22.99 % interest rate. This was never explained to me and exceeds the maximum interest rate allowed in my state. I have payed thousands for an extended warranty that the dealer led me to believe was necessary, but states on the contract it is optional. The contract has me ( the buyer ) as the co-signer and my actual co-signer as the buyer. Credit Acceptance has made my life extremely difficult these past few years, due to me having to choose between paying my loan or rent. I had to go without important things just to pay them, and even gave my entire work check to this loan for years.They harass me daily with a minimum of 10 aggressive phone calls. I have already payed over {$21000.00} and they are still attempting to try to collect thousands from me. I am a victim of Predatory Lending. I have proof of everything i'm stating in this complaint.

Consumer Complaint: On XX/XX/XXXX I and an associate purchased a car from the XXXX XXXX ( aka XXXX XXXX XXXX XXXX XXXX XXXX for a sales price of {$27000.00}. With the understanding that the vehicle in question only had one recall on it. I signed using my initials. I was a little concerned about the price but since it was a gift for my fiance, I decided that I would fit the bill since she had specifically chosen this same vehicle a day earlier. The following day I noticed that several notifications on the dash kept flashing and I grew inquisitive because that car was supposed to be in top condition according to the salesman ( XXXX ). I called and asked if I could bring the car back so that the lights could be extinguished and I was given a date for that following Wednesday morning. The auto mechanic told me that the light was most likely a sensor and that it should turn off by itself after a few minutes. This never happened and then other notifications such as passenger side airbag was lighting up, the brake light as well. I took the car back again and he told me that it was a sensor and he replaced a fuse on my driver arm rest because my front side driver window had stopped working. I began to noticed that things were going wrong on a consistent basis and I took the car back about a month later for another problem and the mechanic told me that he couldnt touch the car after thirty days ( this also wasnt written in the contract ). He referred me to use the warranty that I had been given and take it to the XXXX dealership. I was going to see a client and went to park when I noticed that the car was slightly in the lane of traffic. I attempted to park it correctly and the car wouldnt start. I called a mechanic who came out to my location and informed me that most likely there was something wrong with the cable wire and that it had burned to the ground. The next day when I was able to acquire a tow truck and get it to the XXXX facility located at XXXX XXXX & XXXX XXXX in XXXX, they informed me that this was the case. I was told that they could fix this problem but that there were three recalls on this model and there was one of them that they had no idea how to fix as of yet. I kept making my payments on time and the car kept clanging and making strange noises. I then took the car to a mechanic that I knew and discovered that a pink rag had been stuck in the engine in place of a secured cap. When I questioned the dealership, they told me that this was something that I should discuss with the dealership where I bought the vehicle. The car then began cutting off in the middle of traffic. Because of my XXXX XXXX I was forced to try and maintain the vehicle the best that I could. On the advice of another dealer who is familiar with the retail value of several automobiles, I checked the XXXX XXXX XXXX value for the car and found out that it was under XXXX, yet they had it listed for & XXXX. So, when I gave them {$2100.00} up front, I figured that it would be go towards the down payment and bring the payments down. Instead they charged me a total of {$27000.00} for a car that was only worth {$9000.00}. The fact that they didnt inform me about the three recalls before I signed the contract constitutes fraud with malicious intent. This is so because a few times I have had my grandchildren in the car, and I had to preform evasive maneuvers in order to avoid accidents. I reached out to the dealership and the finance company that agreed to the loan, and told them to come their piece of junk. It was only because I mentioned that I was contacting the Attorney Generals Office of New York, that they agreed to come and pick up the car. As I looked over the contract, I saw that my down payment was written off as cost of an Optional Warranty, this a procedure that all auto resellers provide for free so why was I being charged for it, obviously because they put that money in their own pockets. Also, after having had two accidents due to the car cutting off and rolling back down on an incline, that I became frustrated to the point where I was scared for my life and those of my family members. The level of harassment by this company is unprecedented because two weeks, ago I hear a knock at my door at XXXX, and being that I am caring for an elderly parent with XXXX, I have to scrutinized every and all visitors, for her safety as well as mine. When I asked who it is?, an individual states that he has a delivery, when i opened the door there is no package and he's asking for my name. but then I ask where " is the package? '' and when he couldn't explain why he is lying in my face, I directed him to leave. He then tries to slip a paper in my hand, which I throw right back in his chest. He leaves and calls the police stating that I punched him in the face, and I am arrested, when I return from parking my wife 's car even though, I had XXXX witnesses present when this incident occurred. I later learn from my neighbor that he even had the police go to my neighbor 's apartments, trying to get them to state that i was a violent individual. Obviously, this is a direct example of retailiation by XXXX XXXX, because the process server was hired by them, and they are now finacially liable to me and all other residents of the XXXX of New York. I then discovered that in XXXX, of this year, the Attorney General of the State of New York, filed a lawsuit asking that this company be required to pay {$1.00} XXXX dollars a day, because of falsely misleading low economic families in New York State. XXXX XXXX XXXX XXXX XXXX XXXX XXXX for XXXX XXXX XXXX XXXX New York XXXX number XXXX Initial filing date XX/XX/XXXX Status Pending Litigation ) I am asking for your intervention in this matter because too many hardworking individuals are being duped by crooked dealers like these who prey on the unsuspecting victims and ruin their credit and jeopardize their lives and now they are trying to falsely incarcerated people and someone has to stand up against them. I am looking for a good attorney any help will be greatly appreciated.

Consumer Complaint: I recently sent a 2nd letter to XXXX asking them to investigate a negative Item on my credit report from Credit acceptance, in the letter as well as a wet signature from XXXX stating that they Received the letter ( I never received it ) the letter stated that XXXX XXXX was not a form of real investigation. I also reach out to credit acceptance asking them to close and delete this negative information as well from my credit report. I received a miscall from the company that led me to call them back in hopes that I would speak to someone about this matter, I ended up leaving a voicemail that I did receive a call from them to please call me back and they never did. Credit acceptance made a statement to your company that they called once and never got in touch with me, that is a lie being that I called back and left a message with XXXX XXXX XX/XX/ as well as sending her an email back on on XXXX she never responded to the email either. I am asking that I get a fair response about this matter and have it permanently removed from my credit report being that they can not provide me with the information that was stated in the letter that I sent off. I am reporting both XXXX and Credit Acceptance for not following through a proper investigation.
