Consumer Complaint: XX/XX/XXXX Re : Credit Acceptance Violations of FCRA, Usuary and Truth in Lending Laws To Whom It May Concern : I am writing regarding my Auto Loan Account with Credit Acceptance Corporation. This lender has violated the Truth in Lending, Usuary Laws and has been reporting inaccurately on my account that displays on my credit report which violates FCRA Regulations. I financed a XXXX XXXX XXXX in XX/XX/XXXX. The initial balance financed was {$23000.00}. The current balance now as of XX/XX/XXXX is {$22000.00}. Next month will be a year since Ive been paying on the loan and my total balance has only been reduced by {$1200.00}. For starters, Credit Acceptance has violated XXXX Usuary Laws by charging me over 16 % in interest for this loan. My rate is at 19.99 % annum. This is predatory lending. They gave me an option to make payments bi-monthly on the XXXX of each month and the XXXX of each month based on when I got paid when I signed the contract but still continue to charge me late fees each month after the XXXX of the month. Why set up this arrangement if late fees will be incurred. Even though, I have made several full payments within 30 days, they report my account 30-60 days late because of late fees. This lender does not look out for the best interest of the customer. Furthermore, 12 CFR Part 1026 - Truth in Lending ( Regulation Z ) has been violated which states in Subpart C : ( 3 ) Subpart C relates to closed-end credit. It contains rules on disclosures, treatment of credit balances, annual percentage rate calculations, rescission requirements, and advertising. Credit Acceptance is telling me that my current pay-off is good through XX/XX/XXXX is {$22000.00} but is not fully disclosing how they came to this pay-off amount based on the payments Ive made for almost a year. This is a violation of Regulation Z pertaining to installment loans and closed-end credit. I called Credit Acceptance on XX/XX/XXXX after receiving a payment history statement. The representative assured that everything was correct and there were no violations. I noticed that my initial balance on the statement had been {$39000.00}. This is the total balance I would pay after 66 months but I am being charged the full interest and priciple combined. I am requesting that my account be reviewed and that this situation be rectified within 30-days according to FCRA regulations. Consumer Complaint: In XXXX I went into the XXXX store in XXXX Indiana with my XXXX cousin, because she was looking to purchase a vehicle. I wasnt looking to purchase anything, because my vehicle was almost paid off I only had about {$300.00} dollars left and the truck was mine paid in full. The guy that was helping my son look for a vehicle, but then she decided not to buy from them. So the car sales man talked me into getting a vehicle, and I did the application an it came back that I needed a co-signer an he asked me if I knew anyone that would help me, and I said yes which is when I asked my grandma to and she said yes. Well I got approved with my grandma being the first one on the loan and me second. Not too long after that I found out that I was XXXX which the XXXX was XXXX XXXX, and I couldnt work so I went to the XXXX store to explain my situation to them, and they told me that I had to speak with the loan company which was credit acceptance and I did to inform them that I was voluntarily returning the vehicle due to me not being able to work because of my XXXX XXXX XXXX I ended up losing my house, and moving in with my grandmother with my XXXX XXXX XXXX So in XX/XX/XXXX I received by mail that I was being sued by them for the remainder of the balance of the vehicle after they sold it in auction for over {$9000.00} dollars. I was not served a court date by the company by law enforcement for any of the court dates. The only court date that I was given was for them to garnish my wages, and I attended the hearing and the lady that came said that she wasnt a lawyer, and asking me so many questions which I answered them honestly informed her that I could not afford to have my wages garnished due to me being the sole provider for my XXXX children and I take care of my grandmother too. She said that she would talk to the company about me making monthly payments that was on XX/XX/XXXX and I have yet to hear from the company. I feel like the XXXX store and the loaner knew that I would not be able to make the payments and talked me an my grandmother into a contract illegally targeting me and my grandmother.

Consumer Complaint: When I got the vehicle the monthly payment amount wasn't discussed because if they would of said {$790.00} a month I wouldn't of got it and now I can't pay the whole monthly amount so I talked to one of their agents and we set it up for XXXX a month so I've been making the payment but they failed to tell me that since I haven't been paying the whole amount every month my credit score gas been getting hit and now that I'm so far behind if I do miss a payment they can take my truck without saying anything to me and I can't get it refinanced because they said I have to be caught up on my balance which is {$6600.00} knowing that I wouldn't be able to do that it's crazy. And my truck was only {$23000.00} at the dealership and after it was all said and done they are saying I owed {$54000.00} that's more than double of the truck and this truck isn't even worth that much brand new how can they do this to people and get away with it

Consumer Complaint: I financed a XXXX XXXX through Credit Acceptance XX/XX/XXXX for {$26000.00}. The vehicle was unfortunately totaled XX/XX/XXXX. After the insurance company made an insurance payment of {$10000.00}, Finance Charge Rebate of {$10000.00}, XXXX cancellation of {$2000.00} and a few payments made by me, Credit Acceptance made a settlement of {$800.00} in lieu the balance due of {$4300.00} XXXX. I have found out that I have been denied credit due to the balance still reporting as " outstanding '' on my credit reports. I am a business owner, and I was trying to obtain business loan financing which require a check of my personal credit. I was told on more than one occasion that this outstanding negative debt was the reason I was denied even with a 700+ credit score. I was denied a $ XXXX loan at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX $ XXXX Equipment leasing loan $ XXXXXXXX I contacted Credit Acceptance on XX/XX/XXXX and spoke to a regular customer service representative and their supervisor. I advised them of the error that was reporting and that I was being denied credit due to their error. I was told they would mail me a credit dispute form that I would have to mail back to Credit Acceptance so that they could research the issue. This process is now 2 months in. I called today and spoke to a rep who advised me that they did receive my dispute letter, and it has been resolved. I asked for the resolution info, and she said it was not available. This is where my frustration sets in with them. It is a long-drawn-out process that is costing me time and money. Not to mention the opening of my new location has been delayed because of this. I also provided them with THREE letters that they sent to me which says that I have settled the balance in full but yet they are still reporting to the credit bureaus that my balance is outstanding. I mailed those 3 letters back to them as proof that THEY know that I don't owe them anything. But still, they continue to report a balance on my credit reports. This has cost me a lot of money. I researched Credit Acceptance and what they are doing to me has happened to others and even worse. I need help with this resolution to these unfair credit reporting practices, please.

Consumer Complaint: I was involved in a car crash in XXXX where my car was totaled and the gap insurance paid off car which has left a balance on car of XXXX plus dollars. And it is still showing open with a late payment for XXXX years consecutively. I have made several attempts to pay debt but also asking the creditor to remove late payments they are refusing which is very disheartening. Because this is crushing my credit worthiness and affecting my life from moving forward. I am willing to pay amount in full but I have been trying to work with Credit Acceptance and they are making it very difficult for me. According to 15 USC 1666 B timing of payments a creditor should not treat a payment under a open ended consumer credit plan as late for any purpose. unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required.
