Issue: Struggling to pay your loan
Subissue: Lender trying to repossess or disable the vehicle
Consumer Complaint: On Friday, XX/XX/ I learned that my car was repossessed by Credit Acceptance. I called them and according to them they had not received payment since XXXX. I let them know that this is the first time I am hearing about this. I inquired if the company had tried communicating with me. We realized they had a wrong number on file. I further asked, if there were failed attempts by phone why didnt the company sent anything through the mail. The supervisor ( XXXX ) had no response to this. At this time I asked for a courtesy to release the vehicle for {$300.00}, what I was able to give at the moment. She stated that I can make the payment of {$300.00} today but the full expected amount to get the vehicle back was {$800.00} by XX/XX/XXXX or it goes into auction at which time I will be responsible for all fees including what the remaining payment was on the car. At this time I am without a vehicle and a standstill with the company as I do not have the full amount to get it back.

Issue: Getting a loan or lease
Subissue: Changes in terms mid-deal or after closing
Consumer Complaint: On XX/XX/2021, I went to a dealership looking for a vehicle and found XXXX XXXX XXXX. I was told the paystubs I provided look fake and faulty and they don't look legit. They then had me go back to my employer to have them issue me a new stubs that meets their criteria. At that time I was already in the process they told me a {$1000.00} down they will see what I can get. i had a vehicle in mind that was really nice. After verifying that my paystubs were legit and real. They told me that there finance bank " XXXX XXXX '' kicked the deal for fictitious paystubs. The deal was returned to them and they offered me in house financing through their dealership. They responded to the XXXX stating Everything I just said above. So I questioned myself over and over and just been thinking heavy about this because I paid them the down payment which was almost everything I saved up for. They told me I couldn't get the car I wanted from the start and said they have a car in the back they can pull around for me to see. It was old looking and ran down but I'm not a car expert I just needed transportation for my family and they said the car is old but very reliable and will get me from point A to B. Sales Tactics were on point I was totally tricked. The same day they told me to bring the car in the next day if I can to get maintenance on it that I asked and checked on the vehicle such as break pads, rotors, oil change, oil filters, Tires and fluids. I brought it in to their mechanic shop on their property and dropped it off. While picking the vehicle up the maintenance man ask me was I here to pick up the XXXX XXXX I said yes, he specifically told ask me did I finance this vehicle and I said yes. He said they wasn't supposed to sell me that vehicle yet because he didn't get a chance to check it out since it came from an auction it set in the back of their dealership yard. They didn't do non of the things they said they would so the car starting malfunctioning and I wasn't able to drive the car I told them about it and reached out to them multiple times and they did not want to help and I started receiving calls, emails and text from a company called XXXX XXXX but I was informed by the dealership I was setup to have in house financing. The dealer responded to the XXXX stating they never reported to my credit report and that i need to contact credit acceptance, but I thought they kicked the deal. As stated on credit report and on XXXX XXXX XXXX XXXX I never made a payment due to the vehicle not able to function after financing the vehicle. If the motor is blown then they just admitted that they sold me something that they had knowledge about from the start and their response also shows that they knowingly gave me a vehicle that has a blown motor. I just want the payments and account off of my credit report. I would like them to notify XXXX XXXX to do so. This is so wrong and its been causing a lot of troubles and emotional distress I had to deal with transporting my self to work and handling kids going to school all that was effected because of them and I am still being punished from getting a vehicle due to their actions.

Consumer Complaint: Credit Acceptance has attempted to collect this alleged debt from me since I entered into a contract with them on XX/XX/XXXX. I participated in a consumer credit transaction and not a loan Pursuant to 15 U.S CODE 1605 the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges which was never disclosed to me by Credit Acceptance. I am not terminating the contract, I am deducting my liability to pay on behalf of the obligor as I found several violations of fraud. According to the contract, I wasn't aware of my right to rescind at the time. I entered into the contract without being given full disclosure and disputed the validity of this debt when I mailed a letter of conditional acceptance on XX/XX/XXXX. In this letter, I agreed to pay the debt if within 15 days, I was sent the following from Credit Acceptance : confirmation of the debt, production of the account and a general ledger statement, a signed invoice to verify their claim against me, a copy of the contract binding both myself and Credit Acceptance ( not a photocopy ), a statement acknowledging whether they are the holder or servicer in due course, a declaration acknowledging whether they sold my note as part of a pooling and servicing agreement ( securitization ), and if securitized, the name of the REMIC to whom my loan was sold and the CUSIP number assigned to my loan after it was securitized. I have reason to believe Credit Acceptance willfully and knowingly took advantage of me and my consumer credit. In addition, I was given false and deceptive information, as I was told that a down payment was needed in order to drive off of the lot which is a violation of 15 USC 1692e. I have included the letter I sent to Credit Acceptance as well as the contract I signed with Credit AcceptanceXXXX XXXX

On XX/XX/23, Credit Acceptance ran the payment causing a NSF fee, I contacted them and was advised that a supervisor will review the call and contact me back, on XX/XX/23 Credit Acceptance ran the pay again causing another NSF fee, I contacted them and spoke with a supervisor and she stated the another supervisor reviewed the call today and she don't know why they ran the payment I advised the supervisor that the need to refund me my NSF fees and that I will be calling in on XX/XX/23 to make my payment as agreed on XX/XX/23 and now they are changing me return payment fee, because of their negligence.

Consumer Complaint: It is a crime to threaten lawsuit with no intention of doing so, therefore you can take heed that I am very serious about filing suit against your company. I have sent 3 previous letters to you, requesting that you remove inaccurate information from my file and you have failed to do so. Accordingly, I can show a judge that these accounts are inaccurate and that you violated the Fair Credit Reporting Act by ignoring my requests to investigate the items. My previous letters stated my reasons for an investigation and these reasons were not frivolous in any way. If this final request does not prompt you to conduct a proper investigation of these accounts in question, and send proof to me of said investigation, I will file a civil suit in my county for damages and you can travel to defend yourself. I take my credit very serious and your lack of professionalism and assistance disappoints me. I am well aware of my rights under the Fair Credit Reporting Act and I intend to pursue them to the maximum.
