Consumer Complaint: During Covid-19 me and my husband experienced reduced hours and job loss which made it hard to pay our car loan from credit acceptance. We explained our situation with credit acceptance and are currently on a reduced payment plan that we have made on time payments on but credit acceptance has reported XXXX late payments on our credit reports which are dramatically affecting it. From the dates of XX/XX/2020 to present. This is predatory and violates fair credit reporting. My credit shouldnt negatively be impacted during Covid 19.

I spoke with the agent and she was a smartty and rude and could not give me the information I ask for and that was documentation that they claimed to have sent me. Now seems every other month they update to my credit report that I voluntary gave them my car and I did not give them my car. I tried to get my car and they pulled it from the wrecker office. The reporting of this account is in violation of 15 USC 1681a, The Fair Credit Reporting Act [ 15 USC 1681 ( a ) ( 2 ) ( B ) ] : ( 2 ) Exclusions.Except as provided in paragraph ( 3 ), the term consumer report does not include ( B ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device ; So let me explain. Under the Truth in Lending Act 15 USC 1602 ( g ), credit card is defined as the following : The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. This makes my social security card, drivers license/ID, and license plate credit cards that are/were used for the extension of credit. I have recently come across information from the Federal trade Commission ( FTC ) more specifically the GrammLeachBliley Act 15 USC 6802 obligations with respect to disclosures of personal information ( a ) Notice requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) Opt out ( 1 ) In general a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Consumer Complaint: The financial company supposed to have repoed the vehicle. I gave them the information where the car is located. It was located at the XXXX dealership in XXXX XXXX georgia for repairs. They attempted to repo the car 4 times at the dealership but the dealership said they had to pay a small fee to come on the property to repossess the car. So I think the financial company didn't pay so they didn't repo the car and I never got the car back because it was suppose to be removed there so I dnt know what happened to the car after that but they have the car on my credit report as a open account as if I still have the car. It's been 2 years now and it's still on my report as a open account. I financed the car in 2016. The car is a XXXX XXXX. It's not my fault the didn't repo the car. I gave the the address where it was located and the dealership said they attempted to 4 times but didn't want to pay the lot fee first.

Consumer Complaint: This company credit acceptance and its predatory lending and finance hidden charges have destroyed me financially and otherwise this company is reporting 35 or more late payments of 90 days on all my reports destroying any possibility of getting another car loan or any other sort of credit products due to the erroneous and I wish I was a lawyer to say illegal tactics brought forth upon me and my family. I have asked this company to delete and update the reporting on my account to reflect accurate information they literally just laugh at me and right away my credit reports get dinged with late payments added instead of deleting them.in all my years I've never seen a company purposely and maliciously add on 30 or more late payments on one 's report its something that I will never forget because it's already a struggle and having this company do the types of things they're doing and the credit reporting agencies actually allowing such mess is another reason why I'm making this report.my balance is as to this company 's calculations XXXX dollars on a vehicle that when I bought it I put XXXX down payment and had a total price of XXXX which this company upped the car price and then added the down payment which if I show you the paperwork is kinda suspect.i bought the vehicle in XX/XX/XXXX and I stopped paying for the vehicle in XXXX of XXXX i did not make another payment until the vehicle was repossessed and i paid XXXX dollars or so to take back then I never paid until I called credit acceptance to come pick up the vehicle as a voluntary surrender they picked up in XX/XX/XXXX when this account was supposed to be closed they finally closed the account in XXXX XXXX.there should be no reporting on this account at all especially a reporting of a balance that's not accurate and not what was the agreed upon price of vehicle and my down payment was disguised as something other in the final paperwork which I have copys of.theyre charging some kind of daily compound interest that no one going thru financial health hardship can overcome.i had a XXXX XXXX on XX/XX/XXXX my birthday XXXX XXXX XXXX on XX/XX/XXXX 1 year before and now almost 2 years later I'm still dealing with this financial nightmare. They say I owe them XXXX dollars however are willing to settle for XXXX dollars. Does that even make sense? They're charging me interest and late payments on a vehicle I haven't had since XX/XX/XXXX please all I'm asking I'll pay you guys XXXX what your asking because that's about what I owe I'll pay please delete this payment history and account off my report after payment that's my resolution I'm going to borrow XXXX XXXX from family to hopefully put this nightmare behind me.
