Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: In XXXX my husband filed bankruptcy on a vehicle HE owned. It has been reported as XXXX on his report but shows I owe them {$3800.00}. I was never on loan. After that was discharged, magically they added the debt to my credit report as owing about {$3800.00}. They then hired a collection attorney in XXXX to sue me. In which I responded with all ORIGINAL ink signed paperwork-none showing my name. Covid hit and it got delayed. XXXX comes around they re-open the court case. I dispute again. This time actually getting a hearing and it being fully dismissed with predjudice. The company sent a letter XX/XX/XXXX, stating no $ is owed, however, for the last 5 years this has negatively impacted my credit. I have disputed it multiple times via the credit bureaus and by sending them letters. I want this FINALLY deleted from my credit in full, and the business should be fined along with the credit reporting bureaus.

Issue: Problems at the end of the loan or lease

Subissue: Problem with paying off the loan

Consumer Complaint: In XX/XX/XXXX I voluntary turned my car in due to falling behind on payments Credit acceptance sold the car leaving a balance of {$7000.00}. On XX/XX/XXXX XXXX the other party on the loan received a call from XXXX an employee at credit acceptance for a settlement of XXXX XXXX XXXX XXXX. Stating that once paid it would state paid and drop off of our credits. On XX/XX/XXXX XXXX the other party on the loan called credit acceptance to get that in writing, XXXX XXXX XXXX she stated a letter was sent out but also stated that it would not drop off my credit and report as settled. I requested a supervisor call back. Also requested the call with XXXX be reviewed. On XX/XX/XXXX XXXX called stating that credit acceptance does not drop anything off of reports. I explained to her that I do know that but they do report to an agency and pay to delete is legal for paying a settlement. She continued to tell me Im wrong and would not transfer my call to anyone. She stated that the settlement amount has not been paid so how do I even know how it will affect my credit. I asked for someone in the reporting department to call me.

Issue: Getting a loan or lease

Subissue: High-pressure sales tactics

Consumer Complaint: In XXXX of 2020, my husband and I went to XXXX XXXX in XXXX, CA to purchase a vehicle for my husband so that he could work and also have a safe vehicle to transport our brand new baby. He is self-employed as a painter and needed a truck that could fit his work needs, but also be safe for our daughter. I expressed to the owner of the dealership that I knew our credit was less than stellar, but that I had excellent income and we had willing co-signers. They had one vehicle that matched our needs. Through a long day of supposedly checking the all the creditors they commonly used, and making it seem they were working very hard to get us approved, they eventually offered us a very high interest rate loan with my father in law ( who has perfect credit and excellent income ) as the primary and myself ( excellent income, poor credit ) as the co-signer. We felt due to the pressure put on us to accept this loan that this was the absolute only way we would get a vehicle ( which we desperately needed- my husbands current truck could not hold a car seat. ) So we accepted. We found out after the fact that the ONLY loan agency she had contacted was Credit Acceptance Corporation and that this womans father was the loan officer. In hindsight, we are realizing that we were taken for a metaphorical ride, because she knew how badly we needed this vehicle. There is no reason with someone as credit worthy as my father in law being the primary on the loan that we should have the exorbitant interest that we have tacked onto this truck. We are paying a new truck payment on a 12 year old truck. We were also told that we HAD to buy gap coverage through them in order to get the loan. We expressed that our plan would be to refinance the loan to get a better interest rate in the future when our credit improved, and despite the owner of the auto dealership knowing we couldnt refinance a truck that was more than ten years old, she said oh thats a good idea. Now we are stuck with a terrible loan we cant refinance. At the end of the day, we did sign the paperwork, but we feel that we were absolutely lied to, taken advantage of and that these loan practices where the auto dealership finances with a lender who is an immediate family member can not be ethical. The amount of money we have paid in interest on this loan sickens me, and we are now in a place, despite making all the very large payments on time, that the truck is worth less than we owe on it. We are frustrated and feel this shouldnt be allowed to happen.

Issue: Managing the loan or lease

Subissue: Problem with the interest rate

Consumer Complaint: I purchased a XXXX XXXX XXXX from XXXX XXXX in XXXX of XXXX. At the time being a single mother with XXXX young sons, one of whom was very sick I needed reliable transportation to get my son back and forth to medical appointments and I couldn't get a car loan anywhere else. The car I was driving had a rusted out frame. XXXX XXXX guaranteed car loans through Credit Acceptance so I took the loan because I had no choice. I financed approximately XXXX with Credit Acceptance Corp. Over the course of the loan I paid over XXXX. By XXXX of XXXX the car was rusting out and I traded it in. However the balance of the loan had to be rolled over into my new loan with a different company. What credit acceptance showed on their website as owed from month to month vs what showed as owed on my XXXX credit report never matched. The credit report always reflected less than what credit acceptance 's customer portal showed I owed. In addition during XXXX auto lenders were not supposed to report late payments as long as you contacted your lender and made payment arrangements. I contacted Credit Acceptance when I fell behind by two payments and made payment arrangements. They continually reported my loan as late. However, I stayed with my payment arrangement and brought my loan current. When I contacted Credit Acceptance regarding this they ignored me and failed to make corrections. Having a loan with Credit Acceptance not only harmed my credit because of their unfair practices and failure to make corrections when the reported inaccurate information, but I believe it also cost me thousands of dollars in additional fees that were not disclosed in my original loan documents. I would like the corrections made to my credit report now and to be refunded the amounts that I was overcharged.
