Consumer Complaint: When we moved from XXXX XXXX to an area oXXXX XXXX XXXX, OK XXXX XXXX was not yet available in that area ( this was 2017 ). We returned the box to a XXXX XXXX however, they put this on our credit report stating they didn't receive it. I have been told this is a standard practice for XXXX XXXX. This collection goes back 5 years yet is showing as a current collection and is being reported falsely. I had several conversations with XXXX regarding this in 2017, but they said I didn't return the equipment and I know I did. They don't give you a receipt when it's returned so you trust them to be honest.

I try to call them to see when it will be fixed but every time I call, no matter what number or time of day I call, they always say they cant take my call. To date I have not received any written communication from XXXX or the debt collection company. XX/XX/2022 XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX RE : XXXX XXXX XXXX XXXX XXXX # XXXX Total Balance {$110.00} Dear XXXX XXXX, Please find attached a copy of the most recent communication that I received as a result of a dispute regarding the cancellation of my service with Reliant. The communication is from a company known as Convergent Outsourcing , Inc. owned by XXXX XXXX XXXX XXXX Convergent has been retained to collect this disputed debt. I appreciate receiving the Convergent communication, as it alerted me to additional information about XXXX and XXXX relative to my dispute. Below are my notes for your review. On XX/XX/2022 I sent XXXX a personal check in the amount of {$250.00} as a result of a billing notice from XXXX. In the billing communication ( copy attached ) I now notice that a {$150.00} Early Cancellation Fee was included in what I believed to be my final XXXX electric bill. I wrote Final Payment in the note section on my check and XXXX cashed my check. I mistakenly sent XXXX {$250.00} even though my final electric bill was {$180.00}. I overpaid my electric bill by {$60.00}. I would like that amount returned to me with earned interest. Since I did not enter into a signed term-agreement with Reliant prior to Reliant initiating electric service to my residence I could not have been aware of an Early Cancellation Fee as a condition of service. I did not ever agree to a term of service with XXXX or an Early Cancellation Fee. My official understanding was that I was in a service at will status and could cancel XXXX service at any time without incurring any monetary penalties. Since XXXX solicits new customers inside of XXXX I believe it is right for me to alert XXXX management of XXXX deceptive trade practices. I have copied XXXX XXXX XXXX, the President & CEO of XXXX. I also sent him a cover letter to explain the situation with XXXX XXXX XXXX, as XXXX is being used as an accomplice in customer acquisition for XXXX XXXX XXXX. There are countless customer complaints relative to deceptive trade practices by both XXXX and XXXX. Please refer to the Texas Deceptive Trade Practices-Consumer Protection Act. XXXX deceptive trade practices and its handling of this matter resulted in a bad debt being attached to my otherwise perfect credit report. I view this as targeting and harassment. The only way I will pay the outstanding amount that XXXX says I owe is for XXXX or Convergent to send me a term-agreement that includes an Early Cancellation Fee and my signature. If I did enter into a term-agreement that included an Early Cancellation Fee then I will write XXXX XXXX to explain the misunderstanding and withdraw my complaint. If I do not receive my over-payment, this debt is not forgiven and my credit score is not restored I will seek legal guidance as to available options. Consumer Complaint: ConvergentXXXX has attempted to collect a debt owed by another individual with the name that I have ( an incredibly common name in the United States ) because that individual lived in the same apartment complex that I lived in more than 15 years after I did ( note, it was a different UNIT in that complex and again, the debt is from a period more than 15 years after I moved out of the apartment complex ). I have tried to explain this to them, but they are basing this solely upon a name. You can not call their number listed on their website or in their communications because it will tell you they are not currently available and hang up on you even during normal business hours ( I have tried numerous times ). In response to trying to explain their mistake they simply continue to say they have verified the debt. Again, this is definitely not my debt as I was not living even in the same state at the time, never had an account with the company they are referencing and simply share an incredibly common name with somebody who lived in the same apartment complex ( again different unit though ) 15 years after I did.
