XXXX REF : XXXX CEASE AND DESIST TO WHOM IT MAY CONCERN : Please be advised that I am DISPUTING the above-referenced account number which belonged to XXXX. Under the fair debt collection act, once an account is being disputed all collections and phone calls must cease and desist until the account is in investigated. Also, it is NOT to be forwarded to any credit reporting agency for collections under the law. I am providing the following statement for clarity regarding this debt for your records. This bogus debt being reported to you by XXXX was for a FREE upgrade for an XXXX XXXX that was issued to me by one of the XXXX stores in my area which is no longer in business. Its my belief that the T-Mobile store was going out of business and mislead me intentionally to give me a free upgrade when I turned in my XXXX XXXX. Two months later I started to receive a bill for this new device and immediately called the XXXX customer service number. I explained to the representative what I was told at the store and they credited my account. A few months later they did the same thing again and credited my bill once again. I suggest you ask XXXX for a copy of the phone records and conversations to verify these details. I thought it would against the law to try and collect from to sources?

Consumer Complaint: I've reached out to Convergent Outsourcing Inc. about Acct # XXXX and how they were violating my rights i asked Convergent Outsourcing Inc. to provide me with an SSA-3288 to show that i gave them consent to report anything to my credit even if they process is online Convergent Outsourcing Inc. have to have consent from every customer that's SS # 's involved. I let them know that I have a right to privacy and that have to respect my privacy. 15 US Code 1681 ( a ) ( 2 ) ( Exclusions ), things that aren't supposed to be included on a consumer report. Information solely as to transaction or experiences between the consumer and the person making the report. Consumer- is an individual ( Me ). Person-Any individual partnership, corporation, trust estate , cooperative association , government, or governmental subdivision or agency, or other entity. Experiences & Transaction- Applying for a loan, credit cards, late payments, high utilization, charge off ( s ), collection accounts, Judgements, Repos, Bankruptcy. Any authorization or approval of a specific extension of credit directly or indirectly by the issuer or of a credit card or similar device. I tried to explain to this company that they were violating my rights I guess a lot of companies think there above the law and don't have to follow it. It becomes extremely difficult to exercise your rights when companies think they can do whatever they want and get away with it and we the consumer have to deal with it and that's not right because as a consumer my voice should be heard, and these types of companies need to be held accountable. 15 US Code 1681b Permissible purpose of consumer reports. ( a ) IN GENERAL, Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with written instructions of the consumer to whom it relates. You have no permissible purpose by law to contact third parties with my private or personal information. 15 US Code 1681a ( 2 ) speaks on a consumer right to privacy. I guess these companies don't follow law. This account that's being reported illegally has caused my family hardship and homelessness. This situation lines up with 15 US Code 1681 ( n ) Civil liability of willful noncompliance Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater. ( 2 ) such amount of punitive damages as the court may allow ; and ( 3 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. I've tried to fix the problem with the company and i get no where

Consumer Complaint: CONVERGENT OUTSOURCING is falsely reporting on my credit. Per my research CONVERGENT OUTSOURCING is a debt collector. Account # XXXX are falsely reporting and violating my rights and fair credit act. Under 15 U.S. Code 1681d- Disclosure of Investigative consumer Violation. I have attached the definition so you can see the violation. A person may not procure or cause to be prepared an investigative consumer report on any consumer unless ( 1 ) it is clearly and accurately disclosed to the consumer that an investigative consumer report including information as to his character, general reputation, personal characteristics, and mode of living, whichever are applicable, may be made, and such disclosure ( A ) is made in a writing mailed, or otherwise delivered, to the consumer, not later than three days after the date on which the report was first requested. 15 U.S.C 1681 section 602 A. States I have the right to privacy. I request to be provided proof of this alleged item, specifically the original contract and instrument bearing my signature with CONVERGENT OUTSOURCING. Failure to show results in item to be deleted from the report as soon as possible. Under federal law, you have 30 days for a reinvestigation. I will also be seeking {$1000.00} per violation for : 1. ) Defamation 2. ) Negligent Enablement of Identity Fraud 3. ) Violations of 15 U.S.C 1692g I further remind you that, as in Wenger v. Trans Union Corp., No. 95-6445 ( C.D.Cal. Nov. 14, 1995 ), you may be liable for your willful non-compliance. Credit reporting laws ensure that the information they gather and distribute is fair and accurate .. Every step must be take to assure the information is reporting correct.

Consumer Complaint: On XX/XX/2022 I submitted a dispute against Convergent Outsourcing Inc. On XX/XX/202XXXX Convergent Outsourcing Inc. stated that the account information disputed meets the requirements of the FCRA XXXX Convergent Outsourcing Inc, illegally reported my information to unaffiliated third parties without giving me any disclosures. Pursuant 15 USC Sec 6802 Convergent Outsourcing Inc is required by federal law to give me three disclosures, I have not received documents containing the required disclosures pursuant 15 U.S.C Sec. 6802 ( b ). Convergent Outsourcing Inc., is in violation of many other federal consumer laws. I did not give Convergent Outsourcing Inc permissible purpose under 15 U.S.C Sec. 1681b ( 2 ) to furnish this information on my credit report. Without my written consent Convergent Outsourcing Inc. is committing aggravated identity theft pursuant 15 U.S.C Sec. 1681a ( q ) ( 3 ). By furnishing this debt to my consumer report to coerce payment is a violation of 15 U.S.C Sec. 1692d ( 4 ). As a federally protected consumer, I know that my consumer report shall not include a report containing information solely as to transactions or experiences between the consumer and the person making the report pursuant to 15 U.S.C Sec. 1681a ( 2 ) ( i ). If the consumer report does not include transactions or experience, this account should not be on my consumer report. Having this negative account on my report does not make my consumer report equitable to me which is also a violation pursuant to 15 U.S.C Sec. 1681b. If Convergent Outsourcing Inc. continues to report account to my consumer report, they will be held criminally liable for aggravated identity theft pursuant to 18 U.S.C Sec 1028a, extortion and theft by deception. This is my final attempt to have this matter rectified before pursuing legal matters. If Convergent Outsourcing Inc. would like to continue committing fraud and unlawful criminal activities, this matter can be further discussed in federal court where I have no intentions on pursuing any monetary amount.

Consumer Complaint: On XX/XX/2022 I paid off my debt to Convergent outsourcing. It was for a XXXX account. During the conversation with the representative I told them I would only be paying it if the collections would be deleted off my credit report and they agreed, they said it would be deleted off within 30-60 days. As of today it is still showing up on my credit report, I have called convergent outsourcing 3 times in the past week and talked with 3 different supervisors. They have all told me it will not be deleted and they do not care that someone previously told me it would be. They said they apologize for the wrong info but they will not be sending me a deletion letter. I am trying to buy a home and this is getting in the way of it.

Consumer Complaint: Convergent outsourcing just showed up on my consumer report. The reporting states the account was open XX/XX/XXXX. My consumer file with XXXX XXXX XXXX XXXX and XXXX have been frozen locked and there's an idenity theft alert on my file as well informing all propensity creditors that they need to call me and verify my idenity before opening a credit file. THIS DID NOT HAPPEN. I DIDN'T RECEIVE A BILL NOR A LETTER LETTING MY KNOW 5 DAYS ON ADVANCE OF THE ADVERSE ACTION THAT WAS GOING TO BE TAKEN AGAINST ME. There have also been addresses showing up on my consumer report at places I've never lived or have any association with. The bill is for XXXX. Account number XXXX Not only that. They've reported 2 different days of last activity with the consumer reporting agencies. One states XX/XX/XXXX and one states XX/XX/XXXX as the last date of activity. If like this negative information suppressed from my consumer file until after the investigation. My request will be in the photos below
