This account isnt mine and their agents kept trying to have me pay when i called to fix the issue. I kept telling him its not my account so theres nothing for me to pay. This company came out of nowhere on my credit report as a collection.

Consumer Complaint: I have been actively trying to fix my credit for quite a few months now. It has been brought up on all 3 of my credit reports ( XXXX XXXX and XXXX ). I have sent letters to the credit bureaus about the incorrect information in which they responded that my dispute was denied. I have filed a police report with my local Police Department as it is identity theft and I am now currently contacting each creditor to have the false information corrected on my credit reports, I was given the advice to file a complaint and will be sending a copy of complaint to each creditor as well.

Consumer Complaint: I am filing a complaint of non-compliance requesting validation, made pursuant to the Fair Debt Collection Practices and the Fair Credit Reporting Act, along with the corresponding local state laws. Please note that I am requesting VALIDATION ; that is competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay these companies : 1 ) XXXX XXXX ( XXXX XXXX XXXX ) SEE ATTACHMENT 2 ) XXXX XXXX XXXX ( XXXX XXXX XXXX ) SEE ATTACHMENT 3 ) JEFFERSON CAPTIAL SYSTEM ( XXXX XXXX ) SEE ATTACHMENT This month the FTC, and Federal Law Enforcement Partners have announce Nationwide Crackdown on Abusive Debt Collection Companies. This is formal complaint that you have failed to provide me with copies of any viable evidence, bearing my signature to my dispute letter deposited by certified registered mail with USPS. ( have attached certified letters that were sent ). I have maintain careful records and for your benefit, and as a gesture of goodwill final attempt to have you clear up this matter. You have 15 days to cure. How are you guys reporting or verifying these accounts to the CRAs when it lacked underlying documentation. In 2000, the FTC held that the FCRA barred a debt buyer from " verifying a tradeline disputed by a consumer when it didn't posses the original documents. FTC allegations was that upon receiving a CDV form from a CRA that the debt buyer ( s ) and furnisher ( s ) they can not use the PCM for verification does not constitute an " investigation '' for purpose of section 1681s-2 ( b13 ), when a consumer disputes the accuracy of information reported by debt buyer ( s ) or furnisher ( s ), they should either verify the information with the original documents bearing a signature within the time period set forth in the FCRA or take all necessary steps to deleted the information from the files of all consumer reporting agencies to which the information was reported within 5 business days after receiving the consumer dispute, notify all consumer reporting agencies to which the information has been provided that the information is to be deleted from the file of the consumer who has disputed the account. Consent Decree Order, Section II. As per FTC opinion letter from Attorney General XXXX XXXX XXXX, you should be aware that a print out of a bill or itemized document does not constitute verification. I am again formally requesting a copy of VERIFIABLE PROOF ( of original Consumer Contract with my Signature on it ) you have on file ( Section 609 ( a ) of the accounts listed on my original letter. If not you must remove the accounts listed above. These accounts have hurt my ability to obtain credit.

Consumer Complaint: XXXX ( and most likely other credit reporting agencies ) are reporting a debt shown by JEFFERSON CAPITAL SYSTEM, a collection agency, for a XXXX account opened in 2019. I disputed the account online with XXXX, days later they sent a status and said the account was VERIFIED AS ACCURATE. I contacted XXXX, and they say they have no obligation to ask for any proof of the account, if a creditor provides my name, address and social security number they will report it as a debt. After they asked me for paperwork to prove it wasn't my account ( I asked them, how am I supposed to prove a negative? Shouldn't the obligation be for them to ask Jefferson Capital for proof?? ). I also contacted Jefferson Capital, and after asking for all of my information, new address, etc., they simply went into debt collection mode and asked about me paying off the account. I stated that this was not my account, I've never had an account with XXXX, and asked them to please send me whatever documentation they had relating to the account being established ( my signature, where was phone sent, etc. ). They said they couldn't do that and hung up on me. How do I get this cleared up??? This is a ridiculous system where companies can submit faulty information and then aren't required to provide documented proof of the account when challenged.

Consumer Complaint: I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. Consumer Complaint: I pulled my XXXX XXXX and I seen there were some accounts that were not mines and need it removed. According to the provisions of the Fair Credit Reporting Act 611 ( a ) [ 15 USC 1681 I ( a ) ], these disputed items must be investigated or deleted from my credit report record within 30 days. During the investigation. The items I am disputing must be removed from my credit report as the mere reporting of these items prior to debt validation constitutes collection activity. I am also requesting my name and correct address and telephone number updated every move any other name and addresses and telephone numbers that do not belong to me I have reported my information the OPT in OPT out. Consumer Complaint: ON XX/XX/2020, Jefferson Capital added a derogatory credit report per XXXX. Upon, further research, this account was transferred/sold and am I no longer responsible for the account. Debtors creditor did not verify this collection. Also, there was NO written form of communication, contract, or signature for this accused debt at all. A bill without a signature does not validate the debt and anybody can send a bill and say that it belongs to me. According to the FCRA, Jefferson Capital has violated my rights as a consumer, and I am requesting legal action to remove this account immediately.

They claimed to serve judgement to me through my wife and thwy lied. I was XXXX from XXXX. To XX/XX/XXXX. They said they served me on XX/XX/XXXX. This is intentional fraud. My wife was not home and never talkes to any man at the home. She will testify in court. My full name is XXXX XXXX. My birthday is XXXXand the website you can confirm this at is XXXX in florida. This is a easy win for a lawyer. This company already has a classaction suit. Please provide lawyer who will prosecute. There is no other adult in my home they couls have talked to.
