Consumer Complaint: In early XXXX, Capital One closed my account and responded that I committed fraud hence the closure, later stating I committed a scam, then that I wanted my account closed, and finally that it was accidental. I was told that the funds would be sent to a state that I no longer lived in, and told Capital One but Capital One claimed it would be sent regardless. I tried to offer my second bank 's routing and account number to receive the funds electronically, but Capital One said it could not be completed once the account closed. Around the XXXX of XXXX, I finally got ahold of Capital One, because my phone number was being sent to a voicemail til then. The Capital One admin said that the funds were able to shift to my current address or second account until the day before the call. Capital One claimed it was an accidental miscommunication for not informing me of my options. I received funds through XXXX in XXXX that were sent to Capital One after the closure. Capital One said the funds were never received and XXXX provided me with a document to confirm the funds were sent to Capital One. Capital One claimed that any funds would be returned to the sender, XXXX. I later found the funds in an illegal account Capital One created I kept calling till late XXXX for my funds ( I received them in late XXXX ) and then for compensation. I was told by a Capital One member in late XXXX that an account was opened without my consent or knowledge in XXXX. I was given the password and username to this account I did not know existed. Capital One claimed it was opened accidentally. Continuous accidental mishaps led me to not afford food or housing when XXXX XXXX XXXX

Consumer Complaint: On Wednesday, XX/XX/XXXX I made an ATM check deposit of {$35000.00} into my Capital One checking account. This check was written via my attorney from an Attorney-Client Trust Account as part of an automobile accident insurance settlement. Shortly after completing the ATM deposit, I received official communication from Capital One via email stating that my check had been successfully deposited into my checking account along with a detailed schedule of availability of funds. On the XXXX, {$220.00} was to be made available ; on the XXXX, {$5300.00} was to be made available ; and, on the XXXX, the remaining {$29000.00} was to be made fully available. As of today, Friday, XX/XX/XXXX, XXXX funds have been made available and Capital One will NOT make any funds available until the XXXX, per their customer service representative. The customer service representatives stated that the delay was due to a fraudulent nature. I also received an email from Capital One stating a different reason for the delay, this time stating that there is an increased risk of the check being returned based on confidential information that indicates the check may not be paid. Meanwhile, my online banking portal also reflects incorrect, misleading, and contradictory information. As of today, XX/XX/XXXX, my online banking portal denotes my deposit was made via mobile deposit, which is incorrect as it was made via ATM deposit. My account balance reflects a total of {$5500.00} but my available balance is {$1.00}. The deposit description also notes {$29000.00} to be made available on XXXX, XX/XX/XXXX with {$5500.00} available now. Capital One Bank has done nothing short of offering misleading, incorrect, deceptive, contradictory, and false information regarding my account. They have also refused to make my funds available despite their initial communication detailing a schedule of funds availability and have failed to provide accurate account details via their online banking portal.

XXXX XXXX in the presidents office and through his representative, XXXX XXXX have engaged in dishonest and bad business practices. There is no reason for a bank as large as Capital One to BOUNCE A CASHIERS CHECK and then their representative tried to lie about it and tell me that I needed to try to deposit at another bank. That is how dishonest they are. Then XXXX the XXXX repeatedly lies about trying to get a replacement check to me only for me to find out that it was all lies and the check was never sent. This is how incompetent and malicious they are. My checking account with Capital One was closed at the end of XX/XX/XXXX. I am XXXX and had set up my XXXX check to be deposited directly into the Capital One checking account. In the account were several deposits that had been made for my social security. Since the account was closed, I have not had access to any of my money from my XXXX payments. A Capital One manager told me that my money would be mailed to me within 6 days ( there is a record of this. ) This has not happened. This has prevented me from being able to buy medically necessary medications and it prevented me from being able to pay rent resulting in ongoing financial devastation including eviction. It has prevented me from the use of my money while they have benefitted from withholding it from me ( interest. ) Capital One employees have been beyond discourteous when speaking to me, unhelpful, dishonest and downright malicious. The only way I was told that I could obtain my funds was when they mailed me a check which was to have been 6 days from the date the account was closed. As of two days before XXXX almost exactly a year later, I have been lied to multiple times by Capital One telling me that theyd mailed a check to me several times. This was not true. In the attached voice recording it confirms that they never mailed the check because they used XXXX and saw that it was an attorneys office so they did not mail it all the while lying and saying that they had previously then I was finally told oh, the reason it wasnt mailed was because we used XXXX and saw it is an attorneys office. I am a victim of domestic violence and as a safety precaution I have my mail sent there as I have a right to do under laws protecting victims of domestic violence. Capital One representative finally delivered to me a cashiers check via XXXX on XX/XX/XXXX. I deposited the check and it bounced twice and I have incurred two {$24.00} returned check fees as a result of Capital One issuing me a bad check. I still have not received the monies that Capital One is holding from multiple XXXX deposits. I have suffered extreme and repeated financial and psychological abuse from Capital One representatives from them refusing to return my funds to me, lying about checks being mailed, and gaslighting me by trying to tell me that they werent responsible for the check being returned when they knew or should have known that they were sending me a bad check. This is a FDIC regulated bank. All of these conversations have taken place over the phone and all have been recorded by Capital One. I believe that Capital One has violated State and Federal Laws by its actions towards me. Their actions have resulted in extreme undeserved harm towards me and are a violation of my rights under law. I am asking for assistance from your agency with this matter. I am also willing to participate in any legal action against Capital One for the harm that they continue to cause. When you hear the recordings of their employees they have no shame in executing the abusive practices of Capital One. They lie and they lie and they lie and it is all on record. In order to resolve this matter Capital One should overnight a check in the equal to the amount of all funds, the two {$24.00} returned check fees charged to me, interest on monies held immediately. They also owe me for the damage and mental anguish that they have caused.

Consumer Complaint: Subject- Capital One Product- Quicksilver Secured Rewards Credit Card ( security deposit used as collateral ) Agreement upon request to the product includes terms where explained how Interest Charge calculated. In the monthly Statements to the product provided Interest Charge formula which different. The difference is margin was added. In the terms written that Statements are part of the Agreement. Please see attached pictures. I requested to disclose this specific term margin by the phone, but representative didnt answer. I wrote a letter to the main office and case was created, but doesnt include this matter. Today called again to the phone number written in the reply to my letter, but no luck. Requesting to disclose term margin. Interest Charge formula = prime rate + margin. Prime rate is floating and its the same as Interest Charge, does it mean that margin is XXXX?
