Consumer Complaint: Per the Federal Credit Reporting Act as a federally protected consumer, per 15 USC 6802 I XXXX ; XXXX am now OPTING OUT of ANY AND ALL Authorization I, the consumer may have given to CAPITAL ONE FINANCIAL CORPORATION written, unwritten, verbal or non verbal to report my nonpublic personal information. CAPITAL ONE FINANCIAL CORPORATION is in violation of the Privacy Act of 1974 as well as 12 CFR 1022.24 Reasonable opportunity to opt out because I was never notified by CAPITAL ONE FINANCIAL CORPORATION that my nonpublic personal information was going to be shared to non affiliated third parties such as XXXX XXXX XXXX XXXX XXXX et al and I was NEVER GIVEN THE CHANCE TO OPT OUT. Also, 15 USC 6508 states that I have the option to opt out of any account reported to my credit report and I am supposed to receive an opt out notice every thirty ( 30 ) days which CAPITAL ONE FINANCIAL CORPORATION never sent to me. I am hereby exercising my rights under 16 CFR 313.7 Form of opt out notice to consumers. Also, CAPITAL ONE FINANCIAL CORPORATION violated the terms and conditions within their banking agreement, because CAPITAL ONE FINANCIAL CORPORATION states that they do not provide consumer information to third-parties which they violated by reporting my nonpublic personal information to the credit reporting agencies listed above. According to 15 USC 6802 B ) I am supposed to receive THREE different disclosures before my nonpublic personal information is shared but I never received notice. I am hereby invoking all rights under to OPT OUT and to Privacy protected by 15 USC 6802 B, 12 CFR 1022.24, 15 USC 6508, 16 CFR 313.7, the Privacy Act of 1974 et al. Please see 15 USC 6802 B ) OPT OUT below. A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Finally, CAPITAL ONE FINANCIAL CORPORATION is in clear violation of 15 USC 45 - Unfair methods of competition for their failure to update the records after receiving tender of the full balance of the debt in accordance with the Electronic Funds Transfer Act as well as their acts of securities fraud and Tax evasion which I intend to report as a whistleblower via form IRS form 3949A. To conclude, the above listed credit reporting agencies are in violation of 15 usc 1681 sec 604a section 2, because it states that a Consumer reporting agency can not furnish an account w/o my written instruction. I did NOT give consent nor written instruction to XXXX XXXX XXXX XXXX XXXX to report the CAPITAL ONE FINANCIAL CORPORATION account and supporting nonpublic personal information such as the transaction history and balance. Also, The credit reporting agencies are in violation of 15 usc 1681 sec 604a section 2, because it states that a Consumer reporting agency can not furnish an account w/o my written instruction. I did NOT give consent nor written instruction to XXXX XXXX XXXX XXXX XXXX to report my nonpublic personal information.

Consumer Complaint: 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of XXXX compliance. Provide me with the XXXX compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211 : Application For Award For Original Information Overview with the Internal Revenue Service against ALL entities involved.

Consumer Complaint: My name is XXXX XXXX XXXX. I am an XXXX XXXX XXXX woman who was duped on the phone by a group of criminals who claimed they were from my bank on XX/XX/2023. They told me that someone had stolen my identity and they would help me to close down all of my accounts. However, after I got off the phone with them, my daughter told me that it was probably a fraudulent call. We immediately froze my bank accounts and called each of my credit card companies. We also filed a police report. When I called Capital One on the night of XX/XX/2023 to report what had happened, they told me there had already been a charge of {$13000.00} and asked if I made that charge. I told them I did not and they removed it from the account. However, after their initial investigation, they put the charge back on my account. Capital One then requested a copy of the police report. I provided them a copy and now they are telling me that their case is closed and that they will not be reversing the charge. They said that because I had " authorized '' the charge, it was not fraud. I told them that I obviously did not " authorize '' the charge because the people on the phone never asked me to authorize a charge and they were lying about who they were. I don't understand why Capital One will not reverse this charge when my bank and all my other credit cards immediately reversed the charges that the criminals made. The charge remains on my account and has now added interest and late fees. I have tried numerous times to contact Capital One and to ask what other information I can provide for them to reverse the charge. They told me the case is closed and they will not reopen it and that I remain responsible for the charge. The last XXXX digits of the case # is XXXX.

Consumer Complaint: I have applied for Capital one Savor one credit through XXXX XXXX. The advertised rate was 19.99 % - 29.99 % with a {$200.00} bonus if I spend {$500.00} in the first 3 months. I hit continue and I was approved for 30.74 % and I spent {$600.00}. I come to find out that there is no bonus to redeem. I called customer service and they had two different stories to tell me. The first representative said that my credit is " good '' and not " excellent ''. Although, my score is XXXX and I never defaulted on a loan, declared bankruptcy or had a late payment. The second person I spoke to was a manager, he claimed that I have applied for the " good credit score '' card instead of the " excellent credit score '' thought their website when I have clearly applied through XXXX XXXX and not their website. Another agent told me to send a letter to genral correspondence. I did that and they wrote back telling me to call customer service. On XX/XX/2023 They opened a case for the issue. However, the case was closed on XX/XX/XXXX with basically 2 different answers. The 1st one was " there was no errors on our end ''. The 2nd was " you weren't approved for the 0 % apr and welcome bonus '' Capital one is false advertising on XXXX XXXX to bait new consumers into getting their card. Due to having 2 credit inquiries this year I won't be able to get another card or at least a decent one according to XXXX XXXX.

Consumer Complaint: I applied for a business credit card based on a pre approval offer and a fraud alert which was placed on my credit by myself triggered a freeze to all my personal cards that have been open for over a year and been in use. My account was verified and still the freeze was not removed, instead they requested for me to send bank statements which was sent and now they are requesting business account statements which has nothing to do with my personal accountshowever they refuse to unfreeze my account even though I gave them all the information they requested. I then asked for them to send me more information in writing as to the reason for all the inconvenience being caused by them and they told me that they do not know what to send in writing as they have a right to do whatever they want with my account whenever they want to.
