Consumer Complaint: Capital Closed my account due to fraudulent activity and have continued to charge interest. I have called and questioned them and even tried to settle but they refuse to work with me on the matter. I believe it is illegal for them to charge me interest if they have closed my account and I would like to be refunded on the interest they have charged me and to settle on a payment to pay off the balance.

Consumer Complaint: In XXXX, this month, I received unsolicited emails from Capital One notifying me an account has been opened in my name with their bank. They assigned some account number. Heres info from their email : Sign in to your account Sign in Capital One XXXX XXXX XXXX XXXX Routing number XXXX On XX/XX/23 I received a email saying a debit card was on its way and asked me to activate it. They asked me to add money into this account to activate it. A physical card was mailed to me which I cut up and threw in the trash since I never requested any of this. Then I received an email saying : Account closing soon -- your new 360 Checking account is ready for you ( it's fee-free ) The email also stated ways to add money to this account : Account ending in XXXX | Routing # XXXX Action requested : Your new account is waiting. You can get started with any amount. Hi XXXX, When you bank with a Capital One 360 Checking account, your hard-earned money works even harder for you. With fee-free benefits, mobile banking and multiple funding options, getting started is simple. In the past Capital One has aggressively sent unsolicited credit card offers which I always have ignored. This is much much worse. They are deceptively trying to open bank accounts in peoples names, trying to trick them into funding them, etc. The very first email about this from them at the top of the email in the header I noticed it said they got my info from a mailing list. I have never applied for ANY account opening at Capital One. Please ask them produce proof of request with signature approvals from me? They need to Stop ever claiming an account has been opened in anyones name without their request and express consent. This is Fraud. I have the email threads to forward if you need them. Consumer Complaint: On XX/XX/XXXX, I had a Western Union money order made in the amount of {$50.00} to bring my Capitol One / Walmart credit card to a {$0.00} balance. ( Western Union Money Order Number : XXXX Western Union telephone to verify : XXXX ) Imagine my surprise when I received a statement from Capitol One listing a Late Fee of {$28.00} with {$1.00} in interest added. Since I sent payment to bring my card to a {$0.00} balance, I could not understand the addition of a Late Fee. I called Capitol One Credit Card Customer Service and spoke to a Representative about this. I was informed that the Money Order was not processed until XX/XX/XXXX ( after the XX/XX/XXXX Due date ) and thus, a Late Fee was applied plus Interest. I explained that the Money Order had been created on XX/XX/XXXX and mailed out, and that the Late Fee should be removed, but the Representative stood firm that the Late Fee would stand because my payment was not processed until XX/XX/XXXX. I eventually spoke with three Capitol One representatives, including a Supervisor, all of whom stated the fee would not be removed. I also wrote to XXXX XXXX XXXX XXXX, XXXX and XXXX, Capitol One XXXX XXXX XXXXXXXX XXXX XXXX, NY XXXX, on XX/XX/XXXX, but received no response from his office. I do not know why it took over two weeks for this Money Order to be received and credited to my account. I do not know if there was a shortage of staff at Capitol One due to the XXXX XXXX. I do not know if it sat in the Mail Room until XX/XX/XXXX. But I will not be the scapegoat for this. All I know is that I made the effort to have a Money Order made and mailed over two weeks before the due date so that the payment would be processed as cash. Clearly states that I have right to my privacy. 15 U.S.C 1681 section 608 A. Section 2, it also states a consumer reporting agency can not furnish an account without my written instructions. 15 U.S.C 1666B : A creditor may not treat a payment on a credit card account under an open- end consumer credit plan as late for any purpose. Remove these late payment and update this account immediately as you are in direct violation of several laws under The Fair Credit Reporting Act.

Consumer Complaint: I signed up for a Capital One Quick Silver Credit card, and got approved. The reason I chose this credit card was because I saw the advertised New cardmember bonus which would reward you {$200.00} if you spent {$500.00} in the first 3 months of owning this card. I signed up and turns out I didn't get the Newcard member bonus. So I called them and they explained that basically based on my credit score, I didn't receive the bonus. But nothing in the disclosures of this benefit says anything about not receiving the full benefits of the advertised {$200.00} Newcard member bonus. All it says and I fully read it, is that if you already have or have previously had a Captial one account you may not be eligible for this bonus. I never had a Capital one Credit card or account this is my first time. So they lied, made it up probably that it was cause of my credit score that I did not receive the bonus. I was unfairly denied the newcard member bonus. I should have received this benefit as it was advertised and I fell under the requirement which is being a new member. But I did not receive the bonus. I want to have the bonus that was clearly advertised as so, and also did not state that certain conditions apply in the advertisement. Just it saying new members get a {$200.00} bonus if they spend {$500.00} within the first 3 months of owning the credit card.

Consumer Complaint: Around XXXX of 2022 l applied for a Capital One Quicksilver card. A month after it was approved, sent, and used by me Capital One declared me deceased. I noticed because when l tried to make a second payment around XX/XX/2022 on my account, it said l had no account... I immediately called Capital One explaining what was happening. They had told me l was reported dead. After talking to two different agents, l was told someone would contact me verifying my information. I got a call 3 days later ... A month went by and l had to call again after receiving a bill for {$6100.00} amount owed on the card to be pay by the survivor of the deceased ( me ). I called again and was told they were going to fix the issue. I found out later they reported me deceased to all credit bureaus. I was in a bad situation because l needed to get a loan to pay for legal services and l couldn't because l had no credit report or credit score. I had fix the mess Capital One created. I was able to clear everything by early XXXX. For three months l had no credit score. Capital One closed the account on my credit report, and now after ten months of creating this mess they went back and put the amount as owed. My credit score went down over XXXX points because of this. I tried to do the right thing, but they didn't do anything and instead they falsely reported me deceased when I'm alive creating a lot of unnecessary stress, pain, and suffering.

He informed me that someone was using my personal information to commit fraudulent federal crimes and I had to liquidate the funds from my bank account prior to my social security number being frozen. The fraudulent person swindled and scammed {$6800.00} via pre-paid gift cards that I purchased under extreme mental and emotional stress. He told me that I was being followed and I provided my personal work schedule and other intimate details of my life via text. After not receiving an email with additional steps at the Social Security office, I immediately called the police on XX/XX/XXXX to file a police report. I also called Capital One 's checking and credit card departments to inform them of what happened. The agents I spoke to were able to dispute the charges listed under the disputed charges list as they were from XXXX XXXX and had posted in the system. The remaining fraud claim numbers are for charges made at XXXX which posted a day or two in Capital One 's system. I have provided a 90 page document showing the police report, gift cards with proof of purchase, and have sent rebuttals back informing that the merchant 's policy is no refund on pre-paid gift cards. The police officer I spoke to informed me to call the phone number on the back of the gift cards to see if it's possible to get the money back as a refund. When I called the gift card merchant, they informed the funds were taken the same day. Capital One 's policy states that since I made the transactions myself, they are not considered fraud or disputable and since the merchant won't refund them back the money, they have reversed all provisional credits as debits in all 4 accounts. So I have lost everything and have nothing to show for all funds stolen from me.

Consumer Complaint: On XX/XX/XXXX I received a letter from this company stating they used my information to submit an application on my behalf in XX/XX/XXXX. They stole my identity and information for use of their own benefit. They lowered my credit score by fraudulent practices for their own benefit costing me careers, education, other financial services opportunities such as getting a bank account or credit card, a car and a mortgage. They directly impacted my life in a manner that cost me and my child ( ren ) their livelihood. They also ran my social security number over eleven times in XXXX and refused to acknowledge any of their mistakes instead stating that I was crazy. They would often gaslight me and say that calls I had with them did not happen though I recorded some of them and my account from my phone company does in fact reflect the calls were made. They have caused me mental anguish, anxiety and a loss of faith in the credit system and banks.
