However, the credit card company improperly noted that the payment was rejected due to insufficient funds. An email communication was improperly sent out in regards to this matter suggesting the payment was returned due to insufficient funds when we already spoke with a telephone representative and was advised the payment was rejected due to a name mismatch. The email communication and the account should reflect the proper reasoning for the payment being rejected. A proper email communication should be sent out with this correction.

Consumer Complaint: My identity was stolen XX/XX/XXXX. Every credit card and debit card I owned was informed. In early XX/XX/XXXX ( around XX/XX/XXXX ) I called capital one to pay a balance owed of {$300.00}. I was informed that it was paid in full. When I tried to use the credit card it was denied. I called capital one back to inquire and found out that there was a second credit line opened with capital one that I did not authorize, also {$300.00}, that credit line had already been emptied. I informed capital one that I was not the one who opened this account. I was transferred to their fraud department to make a claim. Later I was informed that the balances owed on both credit lines through capital one were attempted to be paid with my debit card that was closed when my identity was first stolen. Up to 17 times, in the month of XXXX, Capital one allowed an identity thief to continue trying to pay on credit lines that were reported as fraud with a bank account that was closed. This again was reported to capital one as fraud. I was transferred to a manager who said they would investigate. I stayed on the phone during this investigation, when it was done, the manager told me they did not see any evidence of fraud and I would be liable for all charges. I asked to speak to someone higher and was denied multiple times, being told that I was speaking to the highest level of authority at capital one. Days later I called capital one again to try settling this issue, when I was transferred to a manager, I told them my name and I was hung up on. Capital one allowed the identity thief to change my account information multiple times even after I had called and corrected it. They denied my fraud claims even after given them the police report number. I have further proof of this identity theft at this time.

I have been asked by XXXX and Capital One to show proof of cancellation. I do not have any proof because XXXX said it was a recurring automatic charge. I do not have any way of disproving this charge because I have not ever received any form of approval from XXXX. In XX/XX/XXXX I received an email saying that they were going to charge my Capital credit card. I called the telephone number, and I was talking with a very belligerent and profane man. He used the XXXX XXXX many times and somehow he was able to show a charge to personal checking account. I was adamant that this was illegal, which he answered with an XXXX XXXX. I immediately went to my local bank and they had to cancel my checking and savings accounts. I have contested this charge with Capital One and have been unable to get them to stop this charge being posted to my credit card. When I called XXXX, they were adamant that I pay the charge.I will not let XXXX to continue to charge me for something I do not want.

Consumer Complaint: The first complaint I have with Capitalone is On XX/XX/XXXX I made a payment of {$50.00}. My due date is every 1st of the month. When I check two days later I noticed they returned my payment on XX/XX/XXXX and charged me with a late fee of {$35.00} that same day. I called customer service and their reply was that I should have been paying more attention to my bank account to see if the money was taken out. I did not pay that month because I have been having a financial hardship due to a medical reason and was not able to make the monthly payment and the late fee at that moment. Later that month on XX/XX/XXXX, I received a call from a Capital One representative and I explained my financial hardship and she came up with a deal so that I only pay {$46.00} a month for three months to get my account in good standing. Also instead of paying on the first of the month I would be paying on the tenth of the month. I asked her very specifically and I asked her more than once if I had to pay my upcoming bill on XX/XX/XXXX and she answered no. When I go to make my first {$46.00} payment on XX/XX/XXXX I see I have a late fee of {$40.00} for not making a payment on XX/XX/XXXX. So I called customer service and they tell me there is nothing they can do and that the late fee was already in process when I made the deal. I still mad an online payment of {$47.00} on XX/XX/XXXX because of the fear that I would get another late fee for not paying before XX/XX/XXXX. But the deal didn't seem to happen because my due date is still on the first of the month and it keeps going up and up. The amount due is now is {$140.00} and it is not something I can pay with all the late fees. I requested a credit card agreement to see what agreement we have and I never received it. I have been having problems with them for a while now but this is the worst it's gotten. There is always an excuse for everything instead of solving the problem. For example, no one even checked on the {$46.00} agreement I made with the customer service rep I made that day. The late fees and missed payments are affecting my credit score with XXXX.

Consumer Complaint: This checking account has been open and negative for over 10 years. There hasnt been any attempts to use the account and I have contacted Capital One and informed them that this account was compromised due to fraud. My purse was stolen and all my debit and credit cards were taken. I worked with a credit repair company to file a police report and as a result my credit report was updated and accounts were either closed or corrected. The representatives I have dealt with at Capital One did not believe that I was a victim of fraud and it seems as if I was punished by Capital One by letting the account reflect to banking and creditors as negative and open. This has caused significant issues. The statute of limitations says that a debt will remain for 7 years and after such time it will not reflect to creditors on my credit or bank history. I need this account closed. I need this closure backdated so that it reflects closed as of 10 years ago and hold no bearing on my future. I think the most frustrating of this all is that I was able to obtain a secured credit card through Capital One and paid {$750.00} towards it but this account was not settled and I still look unsuitable to other creditors
