Consumer Complaint: Capital One allowed XXXX XXXX lines to over charge my account even after I immediately notified them of the circumstance. XXXX keeps sending them a list of trumped up charges due to a faulty sail and sign card. This is not a small amount, it was to the tune of over XXXX in one day/night. I told XXXX immediately that these were not my charges. The charges shown are not correct. The only evidence is video surveillance and Capital One will not ask for and XXXX will not provide. I have told Capital One this is fraud on my account. They even allowed them to go over my credit limit by XXXX.

Consumer Complaint: I contacted Capital One and informed the company that my identity had been stolen and someone not by my authority, consent or knowledge made unauthorized transactions to my account as a direct result of my identity being stolen. For my protection of further damages I voluntarily requested the closure of my accounts that were compromised. Today I learned that theres another card baring the transactions of my closed account. I immediately informed representatives that my account with my card number is closed and I do not know where the new account and card number comes from and I do not have the card on file in my possession. I did not apply for a new account/card. I additionally requested a copy of banking statements. I spoke with a representative by the name of XXXX. XXXX took note of the transactions identified by me that were not made or authorized by me. XXXX transferred me to XXXX who was to give me access to temporary credit to my account because my account was closed. XXXX had me explain the conversation with XXXX. Without hesitation I provided XXXX which I was also told was the fraud department all the information I provided to XXXX including informing both representatives of my previous report of identity theft to Capital One including my police report and FTC report upon request. XXXX then advises that he is not the fraud department and transferred me to XXXX. XXXX had me explain to her everything again. I did so. XXXX asked what was I requesting. I informed XXXX of my request to utilize my temporary credit that was placed onto my account per XXXX. XXXX claimed she could not give me access to my funds which I informed her of prior process which this was the report of identity theft. I recently lost a child and today I am well enough to report additional thefts. XXXX transferred me to banking who stated she should not have transferred me there. The phone disconnected while I was on hold. I immediately received an email from Capital One saying my account was investigated and I am responsible for the charges I identified as unauthorized. Although identifying the unauthorized charges and offering law enforcement reports of the theft Capital One did not properly investigate my report.

Consumer Complaint: I had my purse stolen with all my personal info, that i beleave was used to open up some of these accts and also placed a large amount of hard inquires on my report. I have been trying to get this address for a couple years now i have contacted all 3 credit companies and the other party, I have spent XXXX of dollars in certified mail send letters to both parties to be back at square one and nothing is being down. I also reported a car being stolen and having my personal thinks inside durning a move. I been suffer from idenity issuses since i was younger with a friend of the family was using my name ate a younger child age. Im now at a stand still stuck with all this stuff on my report and still no answers on how to fix them.

Consumer Complaint: I was provided a refund by XXXX XXXX XXXX to My Capital one account on XX/XX/2023 for the amount of {$850.00}. This amount was provided to me and I didnt spend it. I called XXXX because I previously told them to refund me the {$850.00} on my XXXX Visa card and they did not. The corrected their mistake taking the {$850.00} from my capital one card and refunded it to me via XXXX Visa card. However when the transaction was reversed Capital one added the {$850.00} to my balance and they refuse to correct the issue I explained to them that my balance on my card was never {$850.00} and that they were supposed to put the refund back to my spending amount not money for me to owe them! Im sick of fighting with them and just want my account corrected!

Consumer Complaint: I set up auto pay for a Capital One XXXX card, and discovered that not only did they not deduct the money from my checking account, but they reported it as a " charge off '' to all 3 credit bureaus. I've verified with my bank that Capital One has failed to debit my account going back several months despite having used the same account information. I have offered to pay in full if I received a written letter stating that the " charge off '' was in error and that I paid as agreed. I have decided not to do business with Capital One due to their unethical business practices concerning my auto loan. As soon as I am provided with such a letter agreeing to " paid as agreed-never late. Account closed by customer '' in exchange for full payment, I will pay it. Otherwise, it will do no good to pay anything if it continues to be reported as a delinquency.

Consumer Complaint: On XX/XX/XXXX, I wrote Capital One. XX/XX/XXXX Dear Capital One, On XX/XX/XXXX, I received correspondence regarding my credit card accounts ending with # XXXX ( Platinum ) and # XXXX ( Quicksilver ) informing me both accounts are closed due to account activity not in alignment with the credit card agreement. And I do not know why. I paid my credit card balance for # XXXX for statement due XX/XX/XXXX in full on XX/XX/XXXX in the amount of {$1200.00}. When I received my XX/XX/XXXX statement, I realized my account had not been credited timely, so I reported a billing error on XX/XX/XXXX. On XX/XX/XXXX, when I accessed the app on my phone to schedule my payment for the account ending with # XXXX due XX/XX/XXXX, I noticed both accounts had been restricted. At that time, I had not received any notices on the website, the app, via email nor via mail. I was not until XX/XX/XXXX, that I received two very vague letters stating my accounts have been closed. The letters did not include any details on what to do if I had any questions or concerns. Simply two letters stating both accounts were closed and advising me to destroy the cards and that I will still be responsible for the balances. The letter is unsigned and included the verbiage for Equal Credit Opportunity Act So here is what the law says about my actions ( Obligor ) and Capital Ones ( Creditor ) actions. I paid my statement on time and in full on XX/XX/XXXX. 18 U.S. Code 8. I expected my account to be credited timely. 15 U.S Code 1666 ( b ) ( 4 ). When it was not, I reported a billing error dispute timely. 15 U.S Code 1666. I expected a complete and thorough investigation 12 CFR 1026.13 and my account credited accordingly or a written explanation or clarification 15 USC 1666 ( ii ). The response I received was an adverse action ( restricted/closure ) of both my credit card accounts. In doing so you violated a number of laws including 12 CFR 1026.13 ( d ) ( 3 ) Acceleration of debt and restriction of account prohibited. A creditor shall not accelerate any part of the consumer 's indebtedness or restrict or close a consumer 's account solely because the consumer has exercised in good faith rights provided by this section. A creditor may be subject to the forfeiture penalty under 15 U.S.C. 1666 ( e ) for failure to comply with any of the requirements of this section. Adverse action against a consumer is AGAINST THE LAW according to the Equal Credit Opportunity Act which is codified in 15 U.S. Code 1691c and is pursuant to civil liability under U.S. Code 1692k. You are subject to criminally liability for violating 15 U.S. Code 1691 as I have proof that I was discriminated against by Capital One Platinum Credit Card and Capital One Quicksilver Credit Card due the actions taken. Ultimately, I expect my accounts to be reinstated in good standing and my account credited accordingly. I have enclosed all documents supporting my statements made in this letter. I have also sent this to your Chief Financial Officer, XXXX XXXX, addressed to his office located in XXXX VA. I am extremely disappointed in how this has been handled. I thoroughly enjoyed the contractual arrangement we had. I hope this is resolved swiftly and my accounts placed in the proper standing. If they are not, I will have to seek legal counsel for remedy. On XX/XX/XXXX, I received a response from Capital One 's Customer Advocacy Office confirming my account ending in # XXXX was closed on XX/XX/XXXX. There was no mention of the account ending with # XXXX, which suffered the same fate. The response indicated my payment for the account ending # XXXX, was not accepted as it was not considered to be legal tender. The response stated my accounts would not be re-opened and if there were other claims not specifically addressed, it did not mean they agreed to such claims. I would like both accounts re-opened and placed in good standing.
